Masters, Inc_, has filed plans to build buildings three and four in our condominium. There are a number of items that we feel you should be aware of: 1. The Association currently has liens filed against the proposed units in building three and four and is in the process of foreclosure on the same units_ 2_ The Association is also presuing the possibility that the Developer failed to turn over the "submerged land" during the turnover ordered by the 1988 consent order_ 3. The pool next to building seven is a private pool that the Developer built_ The pool does encroch on the common ground but is not a common pool_ 4_ The Association would like to insure that the home owners have continued access to the dock and beach facility_ 5_ The Association wants to insure any changes to the original buildings and/or plot are reviewed with the Homeowners Association and are architecturally compatiable_ The Association would like to propose a meeting with the Developer to discuss the future of the Via Lago development_ The home owners would like to participate with the Developer to develop a joint plan to complete the condominium as one condominium_ We believe that we can both make concessions that will result in a condominium that everyone would be proud to live in or say that they were the Developer_ (Zi;\Sg[h WiLLiam T_ Edwards President RECEIVED cc:file R. As you are aware, I have had several meetings and/or telephone conversations with you, Mr. Abdullah, Mr. Cook, and the previous land owner concerning the status of the required im- provements within Via Lago, Plat No.1. As a basis to move forward, I have been led to understand that any future development of this property (i.e., Plat 2 or Plat 3, etc.) will be designed with a self contained drainage system that will not utilize Plat No.1 drainage facilities in any way. This means the lake will not be used for drainage retention purposes by the subsequent Plats at via Lago. It is important to under- stand that if future Plats are designed utilizing any of the Plat No. 1 system, the entire Plat No. 1 system will have to be . brought up to the present code requirements. The construction cost for the Plat No. 1 drainage system, as designed in 1979, has been estimated at between $40,000 and $50,000. The Plat No. 1 drainage system, as indicated on the o'Brien, sutter & o'Brien record drawings (February 1990), does not appear to be constructed in the locations shown on the 1979 Malek & Associates design drawings. In addition, several pipes shown on the record drawings as 15 inch diameter were to be 18 inch diameter according to the Malek design drawings. One Harvard Circle. Legan Shepherd Legan Aldrian LTD November 7, 1991 - Page Two with respect to the completion of Plat No. 1 and obtaining a permit to construct the final building in Plat NO.1, the devel- oper has the following options with respect to the drainage system: option No. 1 - Make necessary modifications in the field to bring the system into conformance with the design draw- ings and provide certifications to the city in accordance with Appendix C, Article XI, section 3 and section 4 of the Code of Ordinances. An extension of the time period to provide the re- quired improvements would be necessary from the city commission to accomplish this option. with proper surety provided, the Engineering Department could sign off prior to actual reconstruction of the system. option No. 2 - Developer's engineer of record could prepare and submit documentation to the Engineering Department certifying that installed improvements will, although not in conformance with design plans, meet the requirements of an adequate drainage system. An adequate drainage system, according to Boynton Beach Codes must provide 100 year flood protection to all buildings and must provide dry pretreatment of stormwater flows and meet drainage design criteria for flows noted in Appendix c. - , , I 1 1 , GEE & JENSON n Mr. Joseph R. Legan Shepherd Legan Aldrian LTD November 7, 1991 - Page Three Pursuing this option (i.e., not relocating pipes into Platted easements) would require the develop- er to provide metes and bounds dedications of drainage easements for those portions of the system outside of Platted easements. Also, a variance would have to be applied for by the developer and granted by the city commission for acceptance of a drainage system which does not conform with the approved construction drawings. Because the system is privately maintained, the city would require the posting of surety for the guarantee period, a complete cleanout and inspec- tion of the system, and the concurrence of the Plat No.1 Homeowner's Association to process this variance to the Code. option No. 3 - Some combination of option No. 1 and option No. 2 above. Whichever route is pursued by the developer, some existing fences and walls within Plat No. 1 encroach on Platted drainage ease- ments and may be located over existing storm drainage pipes. Full acknowledgement of this condition by the developer and Homeowner's Association, as well as indemnification to the city for any costs associated with future relocation or rebuilding of these fences and/or walls must be provided if the walls are not relocated.
