AN ORDINANCE OF THE CITY COMMI SSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
ANNEXING A CERTAIN UNINCORPORATED TRACT
OF LAND THAT IS CONTIGUOUS TO THE CITY
LIMITS WITHIN PALM BEACH COUNTY AND THAT
WILL, UPON ITS ANNEXATION, CONSTITUTE A
REASONABLY COMPACT ADDITION TO THE CITY
TERRITORY, PURSUANT TO A PETITION OF THE
OWNER OF SAID TRACT OF LAND, REQUESTING
ANNEXATION PURSUANT TO ARTICLE I,
SECTION 7 ( 32) OF THE CHARTER OF THE
CITY OF BOYNTON BEACH, FLORIDA, AND
SECTION 171.044, FLORIDA STATUTES;
PROVIDING THE PROPER LAND USE
DESIGNATION AND PROPER ZONING OF THE
PROPERTY SHALL BE REFLECTED IN SEPARATE
ORDINANCES TO BE PASSED SIMULTANEOUSLY
HEREWITH; REPEALING ALL ORDINANCES AND
PARTS OF ORDINANCES IN CONFLICT
HEREWITH; PROVIDING A SAVINGS CLAUSE;
PROVIDING FOR ADVERTISING; PROVIDING AN
EFFECTIVE DATE; PROVIDING AUTHORITY TO
CODIFY; PROVIDING THAT THIS ORDINANCE
SHALL BE FILED WITH THE CLERK OF THE
CIRCUIT COURT OF PALM BEACH COUNTY,
FLORIDA, UPON ADOPTION; AND FOR OTHER
PURPOSES.
WHEREAS, Michael D. Gordon and Enrico Rossi, agents for
Intracoastal Development, Inc. (Lawrence Lake), owners of
the following tract of land as hereinafter described, have
filed a Petition for Annexation to the City of Boynton
Beach, Florida, directed to the City of Boynton Beach,
Florida, directed to the City Commission pursuant to Article
I, Section 7 (32) of the Charter of the City and Section
171.044, Florida Statutes; and
WHEREAS, said tract of land lying and being within Palm
Beach County is contiguous to the existing City limits of
the City of Boynton Beach, Florida and will, upon its
annexation, constitute a reasonably compact addition to the
City territory; and

WHEREAS, the proposed use of said land and Land Use
Designation have been determined to be consistent with the
future land uses of the City of Boynton Beach.

Section 1:
Pursuant to Article I, Section 7(32) of
the Charter of the City of Boynton Beach, Florida and
Section 171.044, Florida Statutes, the following described
unincorporated and contiguous tract of land situated and
lying and being in the County of Palm Beach, Florida, to
wit:
The East 313.50 feet of the North
one-half (N 1/2) of the Northwest one-
quarter (N\4 1/4) of the Northwest
one-quarter (NW 1/4) of the Southwest
one-quarter (SW 1/4) of Section 18,
Township 45 South, Range 43 East
and
The North one-half (N 1/2) of the South
one-half (S 1/2) of the Northwest
one-quarter (NW 1/4) of the Northwest
one-quarter (NW 1/4) of the Southwest
one-quarter (SW 1/4) and the North 495
feet of the Northeast one-quarter (NE
1/4) of the Northwest one-quarter (NW
1/4) of the Southwest one-quarter (SW
1/4) and the North 495 feet of the West
132 feet of the Northwest one-quarter
(NW 1/4) of the Northeast one-quarter
(NE 1/4) of the Southwest one-quarter
(SW 1/4) in Section 18, Township 45
South, Range 43 East.
Together with that portion of the Lake
Worth Drainage District Canal L-21 Right
of way abutting the north property line
of the above described subject property
including the L-2l canal right of way
located between the subject property and
Lawrence Road and tha t portion of
Lawrence Road right of way abutting the
west property line of the subject
property.
All of the above being located in Palm
Beach County, Florida and subject to any
and all easements/dedications of record.
Containing 13.5391 acres of land, more
or less
is hereby annexed to the City of Boynton Beach, Florida, and
such land so annexed shall be and become part of the City
with the same force and effect as though the same had been
originally incorporated in the territorial boundaries
thereof.
Section 2:
That Section 6 and 6 (a) of the Charter
of the City of Boynton Beach, Florida, is hereby amended to
reflect the annexation of
said tract of land more
particularly described in Section 1 of this Ordinance.
section 3:
That by Ordinance adopted simultaneously
herewith, the proper zoning designation and Land Use
category is being determined.
Section 4:
All ordinances or parts of ordinances in
conflict herewith are hereby repealed.

Section 5:
Should any section or provision of this
Ordinance or any portion thereof be declared by a court of
competent jurisdiction to be invalid, such decision shall
not affect the remainder of this Ordinance.
Section 6:
This Ordinance shall not be passed until
the same has been advertised for four (4) consecutive weeks
in a newspaper of general circulation in the City of Boynton
Beach, Florida, as required by the City Charter and Section
171.044, Florida Statutes.
Section 7:
This Ordinance shall become effective
immediately upon its final passage.
Section 8:
Specific authority is hereby given to
codify this Ordinance.
Section 9:
This Ordinance, after adoption, shall be
filed with the Clerk of the Circuit Court of Palm Beach
County, Florida.

AMENDING ORDINANCE NO. 80-19 OF SAID
CITY BY ZONING A CERTAIN PARCEL OF LAND
WITHIN THE CITY OF BOYNTON BEACH,
FLORIDA FROM AR
(AGRICULTURAL/RESIDENTIAL) PALM BEACH
COUNTY TO PUD (PLANNED UNIT DEVELOPMENT)
CITY OF BOYNTON BEACH, WITH A LAND USE
INTENSITY OF 4.0 ( PUD LUI = 4), SAID
PARCEL BEING MORE PARTICULARLY DESCRIBED
HEREIN; AMENDING THE REVI SED ZONING MAP
ACCORDINGLY; PROVIDING THAT ALL
DEVELOPMENT OF SAID PROPERTY SHALL
PROCEED IN STRICT COMPLIANCE WITH THE
DEVELOPMENT PLANS AS SUBMITTED AND

for Intracoastal Development, Inc., (Lawrence Lake), has
heretofore filed a Petition with the City of Boynton Beach,
Florida, pursuant to Section 9 of Appendix A - Zoning of the
Code of Ordinances, City of Boynton Beach, Florida, for the
purpose of rezoning a certain parcel of land consisting of
approximately 15.5391 acres (t) located within the municipal
limits of said City, said property being more particularly
described hereinafter, from AR (Agricultural/Residential) to
pun with a Land Use Intensity of 4 (PUD LUI 4); and
WHEREAS, the City Commission deems it advisable to
amend the aforesaid Revised Zoning Map as hereinafter set
forth.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA:

DESIGNATION IS BEING CHANGED FROM
MEDIUM-MEDIUM HIGH RESIDENTIAL (PALM
BEACH COUNTY) TO CITY OF BOYNTON BEACH
LOW DENSITY RESIDENTIAL; PROVIDING A
SAVINGS CLAUSE; PROVIDING REPEALING

WHEREAS, the City conunission of the City of Boynton
Beach, Florida has adopted a Comprehensive Land Use Plan and
as part of said Plan a Land Use Element by Ordinance No.
79-24 in accordance with the Local Government Comprehensive
Planning Act; and
WHEREAS, a certain parcel of land more particularly
described hereinafter is being annexed in accordance with
the application by Michael D. Gordon and Enrico Rossi,
agents for Intracoastal Development, Inc. (Lawrence Lake),
into the City by Ordinance being adopted simultaneously
herewith; and
WHEREAS, the procedure for amendment of a Land Use
Element of a Comprehensive Plan as set forth in Chapter 163,
Florida Statutes, has been followed; and

Conunission deems it in the best interest of the inhabitants
of said City to amend the aforesaid Land Use Element of the
Comprehensive Plan as adopted by the City herein.

LAND USE AMENDMENT APPLICATIONS
Accompanying this memorandum you will find newspaper
advertisements for the four land use amendment requests submitted
to the Planning Department on the october 1, 1987 deadline.
There are separate ads for the Via Lago request and the th}-ee
contiguous requests located on the east side of Lawrence Road.
With respect to the Lawrence Road applications, two of the three
requests have previously been forwarded to your office (Citrus
Glen Phase II and Lawrence Lake). The school Board appliciltion
has not yet been forwarded, as there are several outstanding items
which must be submitted before the request can be transmitted.
The procedure for advertising these requests is outlined in the
October 11, 1987 memorandum from the Planning Director to the
City Manager, a copy of which should be in your possession. The
relevant schedule within this memorandum is entitled "Schedule of
Public Hearings and Advertisements for Requests and Change~; in
the Comprehensive Plan Future Land Use Element and Rezoning."
In addition to the above, please note that the three Lawrellce
Road applications are also Annexation applications and should be
advertised for four consecutive weeks, consistent with Chapter
171.044, Florida Statutes.
The attached advertisements are to be used for both the
notification to the surrounding property owners and for the
newspaper advertisements. The newspaper advertisements arc
placed.in the "Local News" section of the Palm Beach Post.

the purpose of this contract at One River Road, Schenectady, New York 12345,
(hereinafter called .Sellerll) and ALAN MILLER, an individual having his
principal office and place of business at 70 South Congress Avenue, Suite 20l,
Delray Beach, Florida (hereinafter called .Buyerll);

1. PREMISES: Subject to the terms, provisions and conditions of this
Agreement, Seller hereby covenants and agrees to sell to Buyer~ and Buyer
hereby covenants and agrees to buy from Seller, on the terms hereinafter
specified, the following described real estate, together with all buildings
and other improvements, if any, located thereon, situate, lying and being in
the County of Palm Beach and State of Florida to wit:

7. ADJUSTMENTS; TRANSFER TAXES: Water and sewer charges, rents and
fees, if any, shall be apportioned as of the Closi~g Date. Buyer shall pay
Seller for any fuel oil on the Premises on the Closing Date, at the going
rate. The expense and cost of all federal, state and local documentary stamp,
conveyance, sales and other taxes, and the cost of an ALTA Form B, 1970
.Owners Title Insurance Policy" shall be paid by Seller. Buyer shall pay the
Deed recording fees and any other charges, if any, related to Buyer's
financing, including, but not limited ~o, loan policy premium and mortgage
tax. Seller and Buyer shall equally share any closing and escrow fees of the
title insurance company.
8. REAL ESTATE TAXES: All -real estate taxes are to be apportioned as of
the Closing Date on the basis of the fiscal year for which assessed or on
whatever other basis customarily used in connection with transfer of real
property in the locality of the Premises subject to this Agreement. If the
closing of title shall occur before the tax rate (or rates) is (are) fixed,
the apportionment of taxes shall be upon the basis of the tax rate (rates) for
the next preceding year applied ~o the latest assessed valuation. Buyer shall
pay all taxes which shall become due on and after the Closing Date.
9. DAMAGE OR DESTRUCTION: The risk of Toss or damage by fire or ot~er
casualty to any buildings on the Premises until the Closing Date is assumed by
the Seller. In the event that such loss or damage does occur prior to the
Closing Date, the Seller may extend the Closing Date for a period of up to ten
(10) days to enable it to repair or replace such loss or damage. In the event
the Seller does not repair or replace such loss or damage prior to the Closing
Date, as same may have been extended as aforesaid, the Buyer shall have the
option:

a) of terminating this Agreement, in which event Seller
shall promptly refund to Buyer all sums paid by Buyer
to Seller pursuant to this Agreement and both parties
shall be relieved and released from any further
obligation or liability hereunder; or
b) of completing the purchase in accordance with the terms
of this Agreement, in which event all insurance monies
recovered on ~ccount of such loss or damage, less the
amount of any monies actually expended by the Seller on
said repairs, shall be payable to Buyer, or if such
monies are not then available, all claims therefor
shall be assigned to Buyer.
Failure of Buyer to exercise one of the aforementioned options by written
notice to Seller within ten (10) days following the Closing Date (as same may
have been extended as aforesaid), shall be conclusively deemed to be an
exercise of its option to complete the purchase as set forth in subparagraph
.
(b) hereof.
10. CONDEMNATION: If, prior to the Closing Date, all or any substantial
part of the Premises shall be condemned by governmental or other lawful
authority, Buyer shall have no liability for any such condemnation and shall
have the option:
a) of terminating this Agreement in which event Seller
shall promptly refund to Buyer all sums paid by Buyer
to Seller pursuant to this Agreement and both parties
shall be relieved and released from any further
Obligation or liability hereunder; or
b) of completing the purchase in accordance with the terms
of this Agreement, in which event all of the condemna-
tion proceeds shall be payable to Buyer, or if such
proceeds are not then available, Seller shall assign
all claims therefor to Buyer.
Failure of Buyer to exercise one of the aforementioned options by written
notice to Seller within ten (10) days following the Closing Date shall be
conclusively deemed to be an exercise of its option to complete the purchase
as set forth in subparagraph (b) hereof.
11. BROKER: Buyer represents and warrants that Cushman and Wakefield of
Florida, Inc. (nBroker") was the sole broker it dealt with on this property
and the one who .brought about this sale, and Seller therefore agrees to pay to
said Broker such fee or commission as may be set forth in a separate written
agreement between Seller and Broker, if, as and when title passes to Buyer.
If any person other than the Broker shall assert a claim to a fee, commission
or other compensation on account of alleged dealings with or for Buyer as a
broker or finder in connection with this Agreement, tnen Buyer (a) shall
indemnify and hold harmless Seller against and from any such claim and all
costs, expenses, and liabilities incurred in connection with such claim or any
action or proceeding brought thereon (including but without limitation,
counsel and witness fees in defending against such claim), and (b) shall
satisfy promptly any settlement or judgment arising from any such claim or any
action or proceeding brought thereon. The provisions of this Paragraph shall
survive the closing of title.
12. "AS IS" CONDITION: Buyer represents that it has inspected the
Premises and every part thereof, is fully acquainted with and satisfied with
the condition thereof, and shall accept same in an lias is. condition as of the

date of this Agreement. Seller makes no representation nor.warranty concerning
the condition of the Premises or its fitness for any particular purpose.
Seller further specifically disclaims any implied warranties or condition or
fitness for use. As may be required by law, the parties agree that this
disclaimer is conspicuous. Seller agrees to convey the Premises on the
Closing Date in the same physical condition as they now are, ordinary wear and
tear excepted and subject to the provisions of Paragraphs 9 and 10 hereof.
13. GOVERNMENTAL APPROVALS: Should Seller be required to obtain
subdivision or some such other governmental approval in order to convey out

title to the Premises, the Closing Date shall be extended to the extent
necessary to obtain same; however if the Closing Date need be extended for
more than thirty (30) days as a result thereof, either party may terminate
this Agreement, whereupon Seller1s sole obligation shall be to refund all sums
paid on account of the Purchase Price, and upon the refunding of such payments
this Agreement shall be deemed cancelled and all rights and obligations of the
parties,hereto under this Agreement shall cease.
14. BUYER'S DEFAULT: Should the Buyer aefault in the performance of any
of the terms of this Agreement. then Seller may, at its option. retain all
monies paid on account of this Agreement as liquidated damages. whereupon this
Agreement shall thereupon become null and void and neither party shall have

any further rights against the other. Notwithstanding the foregoing, however,
Buyer shall deliver to Seller copies of all studies, research and findings
with respect to the Premises in the event that Buyer fails to close as herein
provided.
15. NOTICES: All notices, demands and requests which mayor are required
to be given by either party to the other shall be in writing and shall be sent
by United States certified mail, postage prepaid, return receipt requested,

the United-States as either party may from time to time designate in a
written notice to the other party. Notices, demands and requests

l6. ENVIRONMENTAL: Notwithstanding any other provision to the
contrary in this Agreement contained, it is expressly understood and

from the Purchase Price at closing as provided for herein. Seller

18. MISCELLANEOUS: This Agreement and the terms, covenants and
conditions herein contained, contains the entire agreement between Buyer and
Seller, and same shall inure to the benefit of and be binding upon the parties

representatives, successors, and assigns. Notwithstanding the foregoing,
however, Buyer shall not assign this Agreement or any interest herein without
the express written approval of Seller which approval shall not be unreason-

to a master plan approval for Lawrence Lake P,U.D.:
1. Landscaping for all common areas must be reviewed and approved
at the Community Appearance Board. These plans are required
to be submitted along with the preliminary plat documents for
