SUBJECT: CITRUS GLEN PHASE II/ADDITION ELEMENTARY SCHOOL "P"/LAWRENCE LAKE
Dear Mr. Annunziato:
As requested, the Palm Beach County Traffic Division staff has reviewed the
plans and traffic impact analyses for the above mentioned developments. The
following comments are provided for your consideration:
1. If Citrus Glen Phase II and Lawrence Lake were being reviewed under
the County's new Traffic Performance Standards (County Ordinance 87-18),
the 4-lane widening of Hypoluxo Road between Congress Avenue and 1-95
would be required to be under construction before ~ building permits
could be pulled. Also, the amount of background traffic growth to be
considered during the "5-7 year buildout" of these projects would be
far greater in most cases under the new Ordinance.
2. The County anticipates adopting in the near future a 110' cross-section
to replace the old 108' cross-section included in its Thoroughfare
Right-Of-Way Protection Map. The plat for Citrus ',Glen should, there-
fore, show a 110' right-af-way corridor for Miner Road.
3. There appears to be an under-assignment of peak hour trips to the
southern access to Citrus Glen Phase II from Lawrence Road. Given the
50%/50% distribution of trips to north/south Lawrence Road, and the
locations of the two Lawrence Road accesses with respect to the 106
units in Citrus Glen Phase II, it is likely that sufficient traffic
would use the south access in the peak hours to warrant separate
westbound 1 eft and ri ght turn egress 1 anes onto Lawrence Road wi thout
school traffic included. It is also possible that sufficient southbound
left turn traffic on Lawrence Road would exist during the PM peak hour
at the southern access to Citrus Gl en Phase II to warrant a separate
turn lane.

Thi.s proposed development site calls for implementation of one (1)
man-made lake. According to current development guidelines of the
City, such physical elements must be designed with littoral zones.
By definition, a littoral zone (or rim) is, "the edge of a water
body where the water is shallow enough to permit light penetration
to its bottom, typically occupied by rooted plants." (Environmen-
~ Quality by Design: South Florida; Veri, Jenna, and Bergamas-
chi; University of Miami Press; c. 1975.) In a broader sense of
the definition, a littoral zone serves as a transitional ecosystem
between wetland areas and upland areas with a specific range of
vegetation. Lawrence Lake, therefore, requires a littoral zone
with introduced indigenous vegetation and a management plan for
that same littoral zone.
I. Littoral Maintenance Program
A. During the development process the Developer will main-
tain vegetative (tree, shrub, ground cover, and water-
borne plant) material installed within the littoral
zone according to the guidelines established below.
Upon completion of construction of the littoral zone,
the Developer may, at his discretion, assign responsi-
bility of maintaining the vegetation within the littoral
zone to an association of homeowners if and when such an
association exists. When a Home Owners Association is
given responsibility to maintain all vegetation within
the littoral zone then that same Association shall main-
tain the vegetation in accordance with the maintenance
ance plan outlined below. This Littoral Zone Management
Plan for Lawrence Lake shall be binding and shall be
made a part of the Home Owners Association Documents and
shall also be referenced upon recorded plat documents.
B. It is not reasonable to expect the littoral zone vegeta-
tion will be maintained and nurtured precisely and as
delicately as naturally occurring littoral zones are
within nature. However, some form of maintenance must
be implemented in order to promote the man-induced zone
and to insure some semblence of success/survivability.

Therefore, the following maintenance plan is minimal in
scope, application, and execution and pertains to the
littoral zone only.
1. Plant identification;
2. Propagation;
3. Exotic control;
4. Irrigation;
5. Fertilization;
6. Pruning;
7. Protection;
8. Replacement;
9. Education.
C. Plant identification: Considering the geographical loca-
tion of Lawrence Lake and the City of Boynton Beach, and
the geological and soil characteristics, a man-made
littoral zone should be considered to occupy a combina-
tion of two zones (from low to higher elevation):
marsh/mangrove zone and forest zone. Because mangrove
characteristics are more dominant in this area than are
marshes, the mangrove ecosystem should be emphasized in
conjunction with the forest zone.
The marsh/mangrove zone vegetation typically includes:

D. Propagation: After the specified vegetation has been
installed and sufficient time has elapsed to allow
proper root establishment and growth, plant propagation
by nature's own natural means (natural seed germination)
should be encouraged. Additional plant species of only
indigenous nature, installed by knowledgeable persons
directed by the Home Owners Association, should be
allowed.

Propagation by artificial means (grafting, layering,
etc.) should be avoided to minimize further human impact
after initial installation. This restriction promotes
natural selectivity and generation.
E. Exotic control: It will be natural to have an influx, at
first, of undesirable vegetative types such as weeds
(many sub-species), noxious water-borne plants such as
water hyacinth (Eichhornia crassipes), and invasive
trees such as Australian pine (Casuarina spp.), Brazil-
ian pepper (Schinus terebinthifolius), and the punk tree
(Melaleuca spp.). Careful identification of any plant
material should be conducted by knowledgeable persons
under the direction of the Home Owner Association prior
to any form of applied exotic control.
Control of exotic species (any plant type not normally
found within that particular ecosystem/plant associa-
tion) is conducted by chemical eradication or manual
eradication. It is recommended that manual methods only
be incorporated in removing and controlling exotic
species. Chemical eradication of exotic species must
llQt be allowed either on a spot or point application nor
on an overall, systemic application due to the proximity
of the littoral zone to the water body and, ultimately,
to the drinking water supply.
Under extreme conditions such as algae blooms, hyacinth
infestation, etc., chemical control application may be
considered. The Home Owners Association, while continu-
int to exercise full responsibility and assuming all
liability, may, at such time and condition, override the
chemical restriction and engage in such a chemically
applied program providing such activity is conducted by
knowledgeable, licensed, and experienced professionals
under the direction of the Home Owners Association.
Manual control of exotic species is encouraged. Such
methods literally call for removal of material by hand
from the littoral zones and total removal from Lawrence
Lake.

F. Irrigation: Trees and shrubs, when initially installed
within the littoral zone, may require irrigation espec-
ially during drought conditions. In such a case, refer
to the irrigation procedure set forth within the
Lawrence Lake Tree Management Plan (page 4, VI. C.
Irrigation). Otherwise, the vegetation is not in need
of irrigation due to its very nature.
G. Fertilization: Fertilizers applied in any manner to
vegetation invariably find their way into bodies of
water because of runoff. Due to the close proximity
of the vegetation within the littoral zones to the pro-
posed lakes, fertilization of all plant material within
the littoral zones will not be allowed.
H. Pruning: Pruning of any vegetation within the littoral
zones will not be permitted because only a natural habit
is desired.
I. Protection: Physical protection of littoral zone vegeta-
tion is necessary if living, established, and abundant
zones are to be expected. Protection in this sense
means avoiding traumatic and physical abuse to the plant
material. Physical barriers are unsightly and will not
be erected so an educated public, policing themselves,
should prove to be the solution. The maintenance ease-
ment surrounding the lake, as required by code, will
provide vehicular access to the lake as well as to the
vegetation. This access will possibly lead to vegeta-
tive impact and abuse so care must be exercised and
damaged plants addressed accordingly.
J. Replacement: Whenever originally installed plant mater-
ial is damaged for whatever reason and the death of the
material seems imminent, the Home Owners Association
shall replace the dead or dying material with identical
and healthy species, and at a size originally specified
in the Landscape Plan.

K. Education: The best program available to ensure a living
and abundant littoral zone calls for an educated public.
The Home Owners Association is encouraged to make avail-
able to individual residents a list of the plants which
comprise the littoral zone, the respective characteris-
tics of the trees/plants, the location of the material
(perhaps a basic landscape plan), and a bibliography
(attached below).
All above written data defined as information, specifications,
standards, performance standards, programs, plans, instructions,
and the like shall be abided by until such time in the future that
up-dated research, bulletins, information, specifications, stan-
dards, and the like, as promulgated by any City, County, or state
of Florida official, and, together with common sense, mandates a
change or changes, for whatever reason(s), in the aforementioned
writt.en data.
This Littoral Zone Management Plan for Lawrence Lake shall become
an official binding document within the Home Owners Association
Documents.

proposing to annex an 11.521 acre tract of land located at the
southeast corner of Lawrence Road and the Lake Worth Drainage
District L-21 canal. In addition, you will find legal
descriptions for two rights-of-way impacted by this annexation
which should be incorporated (a portion of Lawrence Road and the
L.W.D.D. L-2l canal adjacent to this property).
Please place this item on the Commission Agenda for the November

In conformance with your Traffic Ordinance and subsequent
discussions with Jim Golden, Murray-Dudeck & Associates, P.A.,
(MDDM), have undertain certain Traffic Analysis on the subject
development, Based on this analysis, a Traffic Impact Analysis
is not required because there are less than 250 trips during the
peak hour or less than 3,000 trips per day. However, MDDM did
incorporate the Lawrence Lake Traffic in the Citrus Glenn's Phase
II Traffic Impact Analysis.

In examining the ingress and egress trips during the Peak
Hours at the intersection at Lawrence Road and the development
access, there is no need for turn lanes, The reason being is that
there are substantially less turning volumes than the normal
requirements for turn lanes, Palm Beach County criteria
establishes the need for a left turn lane when there are 30 left
turn movements during the peak hour and the need for a right turn
lane is recommended when 50 vehicles per hour are making a right
turn movement. Since our traffic would be well below that level,
it is recommended that no turn lanes are required.

II. MATERIALS TO BE SUBMITTED WITH APPLICATION.
g. (Page 4) - The property is unsuitable for develop-
ment under the existing zoning because said property
is presently zoned AR (Agricultural) by Palm Beach
County. The property is more suitable for develop-
ment under the proposed zoning since it will be
developed in accordance with the land use densities
established by the City of Boynton Beach, In
addition, the property will be serviced with
utilities provided by the City of Boynton Beach.
h. (Page 4) - The property can be developed under the
existing AR (Palm Beach County) zoning at a
density of 1 unit per 5 acres.
h(l) (Page 4) - It is not economically feasible to
develop the property under the existing zoning.
The proposed zoning or development shall provide
jor a density not to exceed 4.82 dwelling units
per acre with the following type of dwelling units.

h(2) (Page 4) - The uses that would be allowed in the

The following words, when used in this Declaration, shall

1. ASSOCIATION shall mean and refer to LAWRENCE LAKE
HOMEOWNERS' ASSOCIATION, its successors and as~igns.
2. OWNER shall mean and refer to the record owner, whether

5. LOT shall mean and refer to any plat of land or any
portion thereof upon which a dwelling unit has or may hereafter
be constructed, which lot or portion thereof is shown upon
any recorded subdivision may of the PROPERTY with the exception

Upon the conveyance of the COMMON AREA submitted or

the COMl-10N ~REA, the ASSOCIATION shall be considered owner'
for the purposes of this Declaration and have the responsibility
of owner aS,those responsibilities pertain to the common areas

ARTICLE II.

PROPERTY RIGHTS IN COMMON AREAS

1. On or before the earlier of the dates set forth in
ARTICLE III, Paragraph (a) and (b), DECLARANT shall convey to

-the ASSOCIATION the COMMON AREAS described in Schedule B attached
to and made a part of this DECLARATION and the' DECLARANT hereby
covenants that the majority control of the ASSOCIATION shall
be in the OWNERS of lots other than the DECLARANT or Developer
o,f the properties on the' earlier of such ,dates. The DECLARANT
hereby covenants and agrees that neither the DECLARANT nor the
ASSOCIATION will conveyor transfer (or enter into a contract
for the same) the COMMON AREAS prior to the date control of

2. OWKERSI EASEMENTS OF ENJOYMENT. Every owner ofa lot
or a portion thereof on which a dwelling unit is or may hereafter
be constructed shall have a right and easement of enjoyment in

and to the COMMON AREA which shall qe appurtenant to and shall

pass with title to every lot o~ portion thereof as herein
contemplated, subject to the following provisions:

(a) 'The right of the ASSOCIATION to charge reasonable ad-
mission and other fees for the use of any recreational facilities,
including the entire'COMMON AREA, by any OWNER for any period
during which any assessment against his lot or portion thereof
remains unpaid, and for a period not to exceed sixty (60) days
for any infraction 'of its published rules and regulations;
(b) The ,right of the ASSOCIATION to dedicate or transfer
all or any part 'of the COMMON AREA to any pUblicllagency,
authority or utility for such purposes and subject to such
conditions as may be agreed to by the members. No such
dedication or transfer shall be effective unless an instrument
agreeing '~b such dedication or transfer signed by two-thirds(2/3rds)
of the members entitled to vote has been recorded.
3. ' bELEGATION OF USE. Any OWNER may share, in accordance
with the By-Laws of the ASSOCIATION, his right of enjoyment to
the COMMON AREA and facilities with the members of his family,
his tenants, or contract purchasers who reside on the PROPERTY.

ARTICLE III.
MEMBERSHIP AND VOTING RIGHTS
1. Every owner of a lot or portion thereof ~hich is subject
to assessment shall be a member of the ASSOCATION. Membership
shall be appurtenant to and may not be separated from ownership
of any such lot or portion thereof.
2. The ASSOCIATION shall have two classes of voting membership:
CLASS A. Class A members shall be all oWfiers, with the
exception of the DECLARANT, and shall be entitled to one(l)
vote for each lot or portion thereof owned. When more than
one person hol& an interest in any lot or portion thereof,
all such persons shall be members, but the vote for such lot
or portion th~reof shall be exercised as they determine,
but in no event shall more than one (1) vote be cast with

respect to any lot or portion thereof.
CLASS B. Class B member(s) shall be the DECLARANT and/or its

assigns, ,and shall be entitled to four' (4) votes for each lot
or portion thereof owned. The Class B membership shall cease
and be converted to Clas~ A membership on th~ happening of
either of the following events, whichever occurs earlier:
(a) When the total votes outstanding,in the Class A

ARTICLE IV.
~
COVENANT FOR MAINTENANCE ASSESSMENTS
, .
l. .CREATION OF THE LIEN AND PERSONAL OBLIGATION OF
ASSESSMENTS. The DECLARANT, for each lot or portion thereof
owned within the PROPERTY, hereby covenants, with each OWNER
of any lot or portion thereof by acceptance of a deed therefor,
whether or not it shall be so expressed in such deed, is deemed
,
to covenant and agree to pay to the ASSOCIATION:
(1) Annual Assessment or charges, and (2) Special Assessments for
capital improvements; such charges and/or assessments shall be
established 'and collected as hereinafter provided. The Annual
and Special Assessments, together with interest, costs and
reasonable attorney's fees, 'shall be a charge on the land and
shall be a ,continuing lien upon the PROPERTY against which each
such assessment is made. Each such assessment, together with
interest, costs and reasonable attorney's fees shall also be the
personal obligation of the person(s) who was the owner of such

property at the time when the assessment fel~ du~. The

personal.obligations for delinquent assessments shall not pass
to the OWNER1s successor in title unless expressly assumed by
such successor.

2. PURPOSE OF ASSESSMENTS. The assessments levied by the
ASSOCIATION shall be used exclusively to promote-the recreation,
health, safety and welfare of the residents in the PROPERTY and
for the improvement, preservation and maintenance of the
COMMON AREA.
3. MAXIMUM ANNUAL ASSESSMENT. Until December 31, of the
year during which the conveyance of the first lot or portion
thereof is made to an OWNER, the maximum shall be $1,200.00
per portion of any lot, payable $300.00 quarter-annually.

addition to the annual assessments authorized above, the
ASSOCIATION may levy, in any assessment year, a special assessment
applicable to that year only for the purpose of defraying,
in whole or in part, the cost of any construction, reconstruction,
repair or'replacement of a capital improvement in or upon the
COMMON AREA, including fixtures and personal property related
, thereto provided that any such assessment shall have the assent
of two-th~rds (2/3rds) of the votes of each class of members
who are v~ting in person or by proxy at a meeting duly called
for these purposes.
5. CLASS B.MEMBERS EXEMPT FROM ASSESSMENTS. The Class B
members shall be, and are hereby exempted from the above pro-
visions with respect to the providing of money.~or annual or
special assessments~ provided that the Class B members shall
bear their proportionate share of and do or cause to be done
any of the work, maintenance, construction or providing of those
services and/or improvements for which such assessments are
intended~

6. NOTE AND QUORUM FOR ANY ACTIONS AUTHORIZED UNDER
PARAGRAPHS 3 and 4 ABOVE. Written note of any meeting called for
" the purpose of taking any action authorized under Paragraphs 3

or 4 above shall be sent to all members no~l;less than ten (10)
days nor more than twenty (20) days in advance of the meeting.
At the first date,of any such meeting called, the presence of
members or of proxies entitled cast sixty (60%) percent of all

7., UNIFORM RATE OF ASSESSMENT. Both annual and speoial

divided in or substantially in the same manner as the one-half

8. DA~E OF COMMENCEMENT OF ANNUAL ASSESSMENTS: DUE OATES.

9. EFFECT OF NON-PAYMENT OF ASSESSMENTS: REMEDIES
OF THE ASSOCIATION. Any assessment not p~id within, thirty (30)
days after the due 'date shall bear interest from the due date
at the rate of nine (9%)percent per annum. The ASSOCIATION
may bring an action at law agains~ the OWNER personally obligated
to pay tpe same, or foreclose a lien against the property.
No OWNER may waive or otherwise escape liability for the assess-
ments provided for herein by non-use of the COMMON AREA or
abandonment of his lot or portion thereof~

10. SUBORDINATION OF THE LIEN TO MORTGAGES. The lien
of the assessments provided for herein shall be subordinate
to the lien of any first mortgage granted to or issued in favor
of a reg'ularly constituted and government supervised lending
institution. Sale or transfer of any lot or portion thereof
shall not affect the assessment lien. However, the sale

or transfer of any lot pursuant to mortgage foreclosure
or any proceeding in lieu thereof, shall extinguish the
I ,
lien of such assessments as to payments which become due
prior to such sale or transfer. No sale or transfer shall
relieve such lot or po~tion thereof from liability for any
assessment ,thereafter becoming due or from the lien thereof.
11. RIGHT OF CITY OF BOYNTON BEACH TO MAINTAIN UPON
DEFAULT ,pY ASSOCIATION. In the event the ASSOCIATION fails
properly to maintain the COMMON AREAS or any portion thereof
'in a r~a~onable manner, the City of Boynton Beach (C~ty) shall
have the right~' but not the obligation, to undertake such
maintenance, repair or replacement as may be r~asonably necessary.

The judgment of the City as to whether or not/the standard
of maintenance called for in this paragraph is being met shall
be final. 1 The right of the City shall not bec~me effective,
however, unless written notice shall first be given to the
ASSOCIATION of the details of the intended maiptenance, repairs
or replacements to'be undertaken by the City, and thirty (30)
days shall elapse after the giving of such notice. If during
such thirty (30) day notice the ASSOCIATION shall commence and

diligently pursue the completion of such ~aintenance, repair
or replacement, then the City1s rights shall not become effective.
In the event the City shall expend any money in maintaining,
repairing or replacing any part of the COMMON AREA pursuant to the

right given to the City herein, then the Ciity shall have the
right to assess all the OWNERS for such expenditures in the same

manner as the ASSOCIATION would have had'iexcept that the City
shall not be subject to any limit established herein. Any such
assessm~nt levied by the city shall be subject to collection, by
the City by any of the remedies given ~o the ASSOCIATION for
collection of assessments, and such assessments shall be a lien on

all the land affected by this Declaration p~oportionately allocated
to each OWNER.

ARTICLE V.

ARCHITECTURAL CONTROL
No building., fence, wall Qr other structures shall be
commenced, erected or maintained upon the PROPERTY, nor upon
any lo~ or portion thereof, nor shall any exterior addition
to or change or alteration:therein be made unless and until
the plans and specifications sho~ing the nature, kind, shape,
heigh~, material, propo~ed color scheme, a~~ location of
the same'sha~l have been submitted to and approved in writing
as to harmony of external design and location in relation
to surro~nding structures and topography by the Board of
Directors of ,the ASSOCIATION, or by an architectural review
committee composed of three (3) or more representatives' appointed

by the Board. In the event said Board ot its designed committee
fail .to approve or disapprove such design location and colors
withitt'thirty (30) days after said plans and specifications
have been submitted to it, approval will not be required

and this ARTICLE will be deemed to have been fully complied
with. Such control shall not be applicable to any construc-
tion by DECLARANT, its successors or assigns whether according
to its own discretion or pursant to any approval granted by
the municipal ~fficials ,'or boards of the City of Boynton Beach.
All adjoining units. shall be maintained in the same' color,
and the owners thereof shall, from time to time, agree upon
the color; in the event that the said owners shall be unable
to agree, then they shall notify the ASSOCIATION, which
shall select the ,color, which shall be applied by the owners.

ARTICLE VI.
SPECIAL EASEMENT AND MAINTENANCE PROVISIONS

Each owner shall have the right and privilege: to keep
and maintain in perpetuity any part or portion, segment or
section of his dwelling unit 'on, in or over the property and/or
dwelling unit of the other; to repair, rebuild, maintain,

service and otherwise take care of his1dwelling unit; to go
upon those parts of the ,adjoining property or dwelling as may
be necessary in order reasonably to accomplish the same.
The condition of any of the above is th~t any person, whether
doing said work personally or through the services of others

shall: do and perform such work during I ':usual and normal
working hours, and in such'a manner, where possible, as not
unduly to disturb the domestic peace and tranq~ilityof his
adjoining owner; in going upon the premises or dwelling' of
his adjoining owner, the other shall be liable and responsible
to him Ifor any damage of any manner done to the property or
dwelling of his neighbor. Such adjoining owners shall so treat
of and with their dwellings that t~eir neighbors shall ~easonable

Wherever the eaves, overhangs or other portions of

dwellings are so constructed as to encroach upon or over the
dividing line separating any lot or portion thereof from
any other portion, the owner in question shall have the
right and privilege to maintain such situation, repair
and maintain the dwelling, etc., all as contemplated by
and in accordance ~ith the standards and conditions of
this Artlcle.
All of the above standards of care and maintenance
shall apply with equal force and effect to privacy walls
which m~ybe constructed on'or straddling the ~de of division
lines o~ any lot or lots constituting any portion of the
property.
Anything' otherwise contained in or set forth in this
Declaration to the contrary notwithstanding, the provisions
of this Article shall attach to, be and ~un ~ith the lands
and premises subject hereto in perpetuity.
ARTICLE VII.
GENERAL PROVISIONS

· l. USE RESTRICTIONS. The lots or portion thereof
herein described may be used for residenr~al dwelling units
and for no other purposes; no commercial, indust~ial or
other ~on-residential buildings may be erected on the lots or
portions thereof and no businesses may be conducted on

2.' MAINTENANCE OF LOTS. All areas of lots or
poktions thereof not covered by buildings, structures or
paved parking facilities shaYl be maintained as landscaped
areas, and shall 'be maintained to the pavement edge or any
abutting streets and to the property lines of the various
lots or portions thereof. The said landscape areas shall
be main~ained by the OWNER in good and substantial condi-
tion, and so as properly to maintain and promote the property
values of all lots and portions thereof and properties within
the entire subdivision which is the subject matter of
this Declaration. In the event that any OWNER shall' fail
or refuse to maintain such areas as above provided the
DECLARANT and/or the ASSOCIATION shall have the right to
enter upon such areas and t~ install ,thereon such landscape
material as may be necessary to comply with the

maintenance of such standards and/or to maintain thesameJ
any such entry made by the DECLARANT or the ASSOCIATION
shall not be deemed a trespass. Should said right to
install and/or maintain the said landscape areas be exercised
the cost thereof shall be borne by the OWNER and payment
ther.eof shall be due and payable to the DECLARANT and/or
the ASSOCIATION withi~ thirty (30) d~~S from a written
request to the OWNER to pay same. Should the OWNER fail
to make such payment within the said thirty (30) day period,
then'the D~CLARANT and/or ASSOCIATION shall have a lien for
the cbst thereof, enforceable as otherwise provided herein.
3. All areas within the public right~'of way not

maintained by the City of Boynton Beach shall be maintained
by the ASSOCIATION, and the adjoining owners shall have no
obligation for maintenance thereof. The ASSOCIATION shall
alsormaintain the property within the lOI ~lanting and utility
easements along the perimeter of the property.
3(a). THE OWNERS shall be responsible for and shall

maintain as provided fot in the Declaration" all of the property
ownep by them and whic~jmay be within 'the p~tio'walls which
may'be constructed on the property during the construction
phase of the development. All portions of the property
located outside of the patio walls shall be attended to and
maintained by the ASSOCIATION and the OWNERS shall have neither
the obligation nor the right to maintain the same. The costs

4. ACCESSORY OR TEMPORARY BUILDINGS. No tents and
no accessory or temporary buildings or structures shall be
permitted upon a lot or ~ portion of a lot unless approved
in writing by DECLARANT'and/or the ASSOCIATION. A
tempprary construction facility may be permitted during
construction and its size, appearance and temporary.
location must be approved by DECLARANT and/or the
ASSOCIATION in writing. Any signs to be used in
conjunction with this temp~rary cons~ruction facility must
also be approved by DECLARANT and/or the ASSOCIATION, '

5. NUISANCES. There shall not be erected, maintained,
operated, carried on, permitted or conducted upon any
lot or portion of any lot any thing or activity which shall
be or become noxious or offensive or an annoyance or a
nuisance to the OWNER or OWNERS of o~her lots or
portions thereof. i I,
6. ANTENNAE. No outside antenna~ ' poles, masts,
electronic devices or towers shall be permitted unless

approved in writing by DECLARANT and/or the ASSOCIATION.
7. GARBAGE CONTAINERS, OIL AND GAS TANKS, AIR
CONDITIONERS. All garbage and trash containers, oil tanks
and bottled gas tanks must be underground or placed in
walled-in area so that they shall not be visible from any
street or adjacent lot or portion thereofr All air-

conditioning units and equipment shall 'be shielded and
hidden so that they shall not be visible from any street
or adjacent property. Landscaping adequate to screen
air-conditioning units and equipment and the garbage and
trash containers, oil tanks, if any, shall be installed and

party wall shall be burdened with an easement, of support

4. If a party wall is destroyed or damaged by fire or

entitled. to one (l) vote for each lot or portion thereof owned.
When more, than one person holds an interest in any such lot
or portion thereof, all such persons shall 'be members, but the
