The following comments are provided for your consideration: 1. If Citrus Glen Phase II and Lawrence Lake were being reviewed under the County's new Traffic Performance Standards (County Ordinance 87-18), the 4-lane widening of Hypoluxo Road between Congress Avenue and 1-95 would be required to be under construction before ~ building permits could be pulled. Also, the amount of background traffic growth to be considered during the "5-7 year buildout" of these projects would be far greater in most cases under the new Ordinance. 2. The County anticipates adopting in the near future a 110' cross-section to replace the old 108' cross-section included in its Thoroughfare Right-Of-Way Protection Map. The plat for Citrus ',Glen should, there- fore, show a 110' right-af-way corridor for Miner Road. 3. There appears to be an under-assignment of peak hour trips to the southern access to Citrus Glen Phase II from Lawrence Road. Given the 50%/50% distribution of trips to north/south Lawrence Road, and the locations of the two Lawrence Road accesses with respect to the 106 units in Citrus Glen Phase II, it is likely that sufficient traffic would use the south access in the peak hours to warrant separate westbound 1 eft and ri ght turn egress 1 anes onto Lawrence Road wi thout school traffic included. It is also possible that sufficient southbound left turn traffic on Lawrence Road would exist during the PM peak hour at the southern access to Citrus Gl en Phase II to warrant a separate turn lane. .. According to current development guidelines of the City, such physical elements must be designed with littoral zones. By definition, a littoral zone (or rim) is, "the edge of a water body where the water is shallow enough to permit light penetration to its bottom, typically occupied by rooted plants." (Environmen- ~ Quality by Design: South Florida; Veri, Jenna, and Bergamas- chi; University of Miami Press; c. 1975.) In a broader sense of the definition, a littoral zone serves as a transitional ecosystem between wetland areas and upland areas with a specific range of vegetation. Lawrence Lake, therefore, requires a littoral zone with introduced indigenous vegetation and a management plan for that same littoral zone. I. Littoral Maintenance Program A. During the development process the Developer will main- tain vegetative (tree, shrub, ground cover, and water- borne plant) material installed within the littoral zone according to the guidelines established below. Upon completion of construction of the littoral zone, the Developer may, at his discretion, assign responsi- bility of maintaining the vegetation within the littoral zone to an association of homeowners if and when such an association exists. When a Home Owners Association is given responsibility to maintain all vegetation within the littoral zone then that same Association shall main- tain the vegetation in accordance with the maintenance ance plan outlined below. This Littoral Zone Management Plan for Lawrence Lake shall be binding and shall be made a part of the Home Owners Association Documents and shall also be referenced upon recorded plat documents. B. It is not reasonable to expect the littoral zone vegeta- tion will be maintained and nurtured precisely and as delicately as naturally occurring littoral zones are within nature. However, some form of maintenance must be implemented in order to promote the man-induced zone and to insure some semblence of success/survivability. Plant identification: Considering the geographical loca- tion of Lawrence Lake and the City of Boynton Beach, and the geological and soil characteristics, a man-made littoral zone should be considered to occupy a combina- tion of two zones (from low to higher elevation): marsh/mangrove zone and forest zone. Because mangrove characteristics are more dominant in this area than are marshes, the mangrove ecosystem should be emphasized in conjunction with the forest zone. The marsh/mangrove zone vegetation typically includes: (* Denotes species specified within the conceptual land- scape master plan.) This restriction promotes natural selectivity and generation. E. Exotic control: It will be natural to have an influx, at first, of undesirable vegetative types such as weeds (many sub-species), noxious water-borne plants such as water hyacinth (Eichhornia crassipes), and invasive trees such as Australian pine (Casuarina spp.), Brazil- ian pepper (Schinus terebinthifolius), and the punk tree (Melaleuca spp.). Careful identification of any plant material should be conducted by knowledgeable persons under the direction of the Home Owner Association prior to any form of applied exotic control. Control of exotic species (any plant type not normally found within that particular ecosystem/plant associa- tion) is conducted by chemical eradication or manual eradication. It is recommended that manual methods only be incorporated in removing and controlling exotic species. Chemical eradication of exotic species must llQt be allowed either on a spot or point application nor on an overall, systemic application due to the proximity of the littoral zone to the water body and, ultimately, to the drinking water supply. Under extreme conditions such as algae blooms, hyacinth infestation, etc., chemical control application may be considered. The Home Owners Association, while continu- int to exercise full responsibility and assuming all liability, may, at such time and condition, override the chemical restriction and engage in such a chemically applied program providing such activity is conducted by knowledgeable, licensed, and experienced professionals under the direction of the Home Owners Association. Manual control of exotic species is encouraged. Such methods literally call for removal of material by hand from the littoral zones and total removal from Lawrence Lake. Irrigation: Trees and shrubs, when initially installed within the littoral zone, may require irrigation espec- ially during drought conditions. In such a case, refer to the irrigation procedure set forth within the Lawrence Lake Tree Management Plan (page 4, VI. C. Irrigation). Otherwise, the vegetation is not in need of irrigation due to its very nature. G. Fertilization: Fertilizers applied in any manner to vegetation invariably find their way into bodies of water because of runoff. Due to the close proximity of the vegetation within the littoral zones to the pro- posed lakes, fertilization of all plant material within the littoral zones will not be allowed. H. Pruning: Pruning of any vegetation within the littoral zones will not be permitted because only a natural habit is desired. I. Protection: Physical protection of littoral zone vegeta- tion is necessary if living, established, and abundant zones are to be expected. Protection in this sense means avoiding traumatic and physical abuse to the plant material. Physical barriers are unsightly and will not be erected so an educated public, policing themselves, should prove to be the solution. The maintenance ease- ment surrounding the lake, as required by code, will provide vehicular access to the lake as well as to the vegetation. This access will possibly lead to vegeta- tive impact and abuse so care must be exercised and damaged plants addressed accordingly. J. Replacement: Whenever originally installed plant mater- ial is damaged for whatever reason and the death of the material seems imminent, the Home Owners Association shall replace the dead or dying material with identical and healthy species, and at a size originally specified in the Landscape Plan. Membership shall be appurtenant to and may not be separated from ownership of any such lot or portion thereof. 2. The ASSOCIATION shall have two classes of voting membership: CLASS A. Class A members shall be all oWfiers, with the exception of the DECLARANT, and shall be entitled to one(l) vote for each lot or portion thereof owned. When more than one person hol& an interest in any lot or portion thereof, all such persons shall be members, but the vote for such lot or portion th~reof shall be exercised as they determine, but in no event shall more than one (1) vote be cast with I , ' respect to any lot or portion thereof. The DECLARANT, for each lot or portion thereof owned within the PROPERTY, hereby covenants, with each OWNER of any lot or portion thereof by acceptance of a deed therefor, whether or not it shall be so expressed in such deed, is deemed , to covenant and agree to pay to the ASSOCIATION: (1) Annual Assessment or charges, and (2) Special Assessments for capital improvements; such charges and/or assessments shall be established 'and collected as hereinafter provided. MAXIMUM ANNUAL ASSESSMENT. Until December 31, of the year during which the conveyance of the first lot or portion thereof is made to an OWNER, the maximum shall be $1,200.00 per portion of any lot, payable $300.00 quarter-annually. The ASSOCIATION may bring an action at law agains~ the OWNER personally obligated to pay tpe same, or foreclose a lien against the property. No OWNER may waive or otherwise escape liability for the assess- ments provided for herein by non-use of the COMMON AREA or abandonment of his lot or portion thereof~ . 10. SUBORDINATION OF THE LIEN TO MORTGAGES. The lien of the assessments provided for herein shall be subordinate to the lien of any first mortgage granted to or issued in favor of a reg'ularly constituted and government supervised lending institution. Sale or transfer of any lot or portion thereof shall not affect the assessment lien. However, the sale I or transfer of any lot pursuant to mortgage foreclosure or any proceeding in lieu thereof, shall extinguish the I , lien of such assessments as to payments which become due prior to such sale or transfer. No sale or transfer shall relieve such lot or po~tion thereof from liability for any assessment ,thereafter becoming due or from the lien thereof. 11. RIGHT OF CITY OF BOYNTON BEACH TO MAINTAIN UPON DEFAULT ,pY ASSOCIATION. In the event the ASSOCIATION fails properly to maintain the COMMON AREAS or any portion thereof 'in a r~a~onable manner, the City of Boynton Beach (C~ty) shall have the right~' but not the obligation, to undertake such maintenance, repair or replacement as may be r~asonably necessary. " The judgment of the City as to whether or not/the standard of maintenance called for in this paragraph is being met shall be final. 1 The right of the City shall not bec~me effective, however, unless written notice shall first be given to the ASSOCIATION of the details of the intended maiptenance, repairs or replacements to'be undertaken by the City, and thirty (30) days shall elapse after the giving of such notice. If during such thirty (30) day notice the ASSOCIATION shall commence and t ' diligently pursue the completion of such ~aintenance, repair or replacement, then the City1s rights shall not become effective. In the event the City shall expend any money in maintaining, repairing or replacing any part of the COMMON AREA pursuant to the I right given to the City herein, then the Ciity shall have the right to assess all the OWNERS for such expenditures in the same , , I' manner as the ASSOCIATION would have had'iexcept that the City shall not be subject to any limit established herein. In the event said Board ot its designed committee fail .to approve or disapprove such design location and colors withitt'thirty (30) days after said plans and specifications have been submitted to it, approval will not be required j 'It. and this ARTICLE will be deemed to have been fully complied with. Such control shall not be applicable to any construc- tion by DECLARANT, its successors or assigns whether according to its own discretion or pursant to any approval granted by the municipal ~fficials ,'or boards of the City of Boynton Beach. All adjoining units. shall be maintained in the same' color, and the owners thereof shall, from time to time, agree upon the color; in the event that the said owners shall be unable to agree, then they shall notify the ASSOCIATION, which shall select the ,color, which shall be applied by the owners. /i ARTICLE VI. SPECIAL EASEMENT AND MAINTENANCE PROVISIONS '. Each owner shall have the right and privilege: to keep and maintain in perpetuity any part or portion, segment or section of his dwelling unit 'on, in or over the property and/or dwelling unit of the other; to repair, rebuild, maintain, I ' ' service and otherwise take care of his1dwelling unit; to go upon those parts of the ,adjoining property or dwelling as may be necessary in order reasonably to accomplish the same. In the event that any OWNER shall' fail or refuse to maintain such areas as above provided the DECLARANT and/or the ASSOCIATION shall have the right to enter upon such areas and t~ install ,thereon such landscape material as may be necessary to comply with the I maintenance of such standards and/or to maintain thesameJ any such entry made by the DECLARANT or the ASSOCIATION shall not be deemed a trespass.
