Erection of Basketball Facility within the Public Rights-of-Way
of SW Congress Blvd.
Dear Mr. Orns:
The Engineering Department is in receipt of the above referenced
letter of inquiry and after consulting with the City Manager, we
have determined that the City will not authorize your request.
The Engineering Department, in conjunction with the City Manager's
Office, feel ,that the condoning or permitting of such an activity
within a public rights-of-way would result in the City's severe
exposure to risk liabilities associated with pedestrians/vehicular
accidents, sports injuries, etc., therefore we must deny your request
to erect a basketball hoop at the dead-end of SW Congress Blvd.
Of special interest to your association may be the fact that there
currently exists excellent basketball facilities within proximity to
your neighborhood. Caloosa Park and Forest Hill Park are two such
facilities which may be accessed as follows:
Caloosa Park
Caloosa Park is situated along the east side of Congress Avenue, south
of SW 30th Avenue opposite the WXEL Television Station.
Forest Hill Park
Forest Hill Park is situated just south of SW 23rd Avenue, immediately
east of the I-95 overpass.

Engineering Department, for review.
I would suggest you contact him directly regarding your request.
However, we have determined that a site plan or master plan
modification is not needed if the request is acceptable to the
City Engineer,

We have received the attached request from the Lakes of Tara
Homeowners Association regarding a basketball hoop on S.W. Congress
Boulevard.
Since this is a City right-of-way, I would ask that you review this
request and contact Mr. Orns directly regarding whether or not this
project can be undertaken by the Homeowners Association.

Dear Christopher;
Please excuse the delay in sending this request to you for your expertise and approval regarding
the erection of a basketball hoop on the property adjacent to ours that lies on the most westerly
dead end of S,W. Congress Blvd. As we previously discussed by phone, if a basketball hoop is
allowed to be erected on the site mentioned above, it would be totally paid for by Tara Lakes
Homeowners Association and the property adjacent to the hoop would be cleaned and kept in an
orderly fashion by the children of Tara Lakes using the facility and would be supervised by their
parents or adults as designated by our board of directors.
