first party, to the city of Boynton Beach, a political
subdivision of the state of Florida, second party:
(Wherever used herein, the terms, "first party" and
"second party" shall include singular and plural,
heirs, legal representatives and assigns of individuals
and the successors and assigns of corporations,
wherever the context so admits or requires.)
WITNESSETH
WHEREAS, the first party is the owner of property situate in Palm
Beach County, Florida, and described as follows:
Situated in Section 21, Township 45 South, Range 43
East, city of Boynton Beach, Palm Beach County,
Florida, and part of Block 1 of LAKE ADDITION TO
BOYNTON FLORIDA, as recorded in Plat Book 11, Page 71
of the Public Records of Palm Beach County, Florida,
being more specifically described as follows:
\BEING that portion of a 20' alley, abandoned by the
Icity of Boynton Beach Resolution R#93-79, west of said
Block 1, bounded on the north by the westerly
projection of the north line of the south 10 feet of
Lot 4 of said Block 1, and bounded on the south by the
westerly projection of the south line of the north 45
feet of Lot 6 of said Block 1;
CONTAINING 0.048 acres, more or less.
and,
WHEREAS, the second party desires an easement for water and sewer
utilities and/or other appropriate purposes incidental thereto,
on over and across said property,
and,
WHEREAS, the first party is willing to grant such an easement,
NOW, THEREFORE, for and in consideration of the mutual covenants
each to the other running and one dollar and other good and
valuable considerations, the first party does hereby grant unto
the party of the second part, its successors and assigns, full
and free right and authority to construct, maintain, repair,
install and rebuild facilities for above stated purposes and does
hereby grant a perpetual easement on, over and across the above
described property for said purposes.
IN WITNESS WHEREOF, the first party has caused these presents to
be duly executed in its name and its corporate seal to be hereto
affixed, attested by its proper officers thereunto duly
authorized, the day and year first above written.

Please be advised that Southern Bell has no obj ection to
the requested abandonment at st. Marks Catholic Church.
The abandonment at 925 N. Federal Highway can be made under
the following conditions~
1. Existing telephone facilities will remain in place
until such time that Southern Bell relocates to an
easement provided in condition 2.
2. Provide a 10' wide easement that is the westerly 10' of
the 20' alley to be abandoned.

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Planning and Development Board of
the CITY OF BOYNTON BEACH, FLORIDA, will conduct a PUBLIC HEARING
on Tuesday, May 11, 1993 at 7:00 p.m. to consider an application
submitted by Ronald J. Moore, agent for Raymond J. Moore, owner,
to ABANDON that portion of a 20 foot wide alley located between
the FEC Railroad and 925 N. Federal Highway (Meineke Discount
Muffler), more particularly described as follows:
A 20 FOOT ALLEY 105 FEET IN LENGTH ADJACENT TO THE WEST
PROPERTY LINE OF SOUTH TEN FEET OF LOT 4 AND ALL OF LOT
5 AND THE NORTH FORTY FIVE FEET OF LOT 6, BLOCK 1 OF
THE LAKE ADDITION BOOK 11, PAGE 71 OF THE PUBLIC
RECORDS OF PALM BEACH COUNTY, FLORIDA.
ALSO
A PUBLIC HEARING will be held by the City Commission of the City
of Boynton Beach on the above request on Tuesday, May 18, 1993 at
7:00 p.m. or as soon thereafter as the agenda permits.
All interested parties are notified to appear at said hearings in
person or by attorney and be heard. Any person who decides to
appeal any decision of the Planning and Development Board or City
commission with respect to any matter considered at these
meetings will need a record of the proceedings and for such
purpose may need to ensure that a verbatim record of the
proceedings is made, which record includes the testimony and
evidence upon which the appeal is to be based.
