Meineke Discount Muffler at 925 N. Federal Highway
Alley Abandonment - File No. 73'7
Section 22 -40 (a) (3) of the Code of OrdinancE~s requires that when an
application for street or easement abandonment is submitted, the
reports and recommendations from the city engineer, planning and
zoning director, utilities director and the public utilities
companies must be forwarded to the Planning and Development Board
and city Commission for consideration in the proceedings of the
public hearings. To that end, this memorandum is forwarded,
consistent with Sections 22-40(a)(3), (b) and (c).
Ronald J. Moore, agent for Raymond J. Moore who is the property
owner of Meineke Discount Muffler at 925 N. Federal Highway, is
requesting abandonment of a 20 foot wide alley 105 feet in length
located between the F. E. C. Railroad right-of-way and the west
property line of the parcel at 925 N. Federal Highway. Mr. Moore's
reason for submitting this request relates to a fence he wishes to
erect for security purposes. Abandonment requests for that portion
of the subject alley running adjacent to the property to the north
(1009 N. Federal Highway, submitted in 1991 by Horace Williams in
connection with a conditional use approval for a used car lot -
Williams' Auto Sales which was denied) and running adjacent to the
property to the south (915 N. Federal Highway, submitted in 1990 by
Ted Morakis, owner of M and M Appliance, formerly Overland
Construction Company) have been approved by the City Commission in
the recent past. Also, these previous requests are similar to the
subject request in that erection of fences to combine the alley
with the adjacent lot for security purposes was also an issue.
The comments from staff and the utility companies, with respect to
this request, that have been received to date are attached.
Concerns were raised by the utilities department, the engineering
department and Southern Bell due to existing water and sewer lines
and telephone facilities within the alley. These concerns can be
addressed by rededicating the 20 foot wide alley as a 20 foot wide
utili ty easement. As indicated in the attached Engineering
Department Memorandum No. 93-117, a response from Florida Power and
Light has not yet been received. If Florida Power and Light's
response is not received by May 11, 1993, staff recommends that
action taken on this abandonment request, for which the required
public hearings have been advertised to be held at the May 11th
Planning and Development Board meeting and the May 18, 1993 City
Commission meeting, be deferred and the public hearing continued to
the June meeting. If Florida Power and Light's response is
received prior to the May 11, 1993 meeting, it is recommend that
this request be approved, subject to a 20 foot wide utility
easement being dedicated to replace the alley. Such action would
be in keeping with a project being conducted by the engineering
department to assemble and prepare legal descriptions for alleys
and streets no longer needed as rights-of-way, located in the
vicinity of Federal Highway, for the purpose of abandonment.

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Planning and Development Board of
the CITY OF BOYNTON BEACH, FLORIDA, will conduct a PUBLIC HEARING
on Tuesday, May 11, 1993 at 7:00 p.m. to consider an application
submitted by Ronald J. Moore, agent for Raymond J. Moore, owner,
to ABANDON that portion of a 20 foot wide alley located between
the FEC Railroad and 925 N. Federal Highway (Meineke Discount
Muffler), more particularly described as follows:
A 20 FOOT ALLEY 105 FEET IN LENGTH ADJACENT TO THE WEST
PROPERTY LINE OF SOUTH TEN FEET OF LOT 4 AND ALL OF LOT
5 AND THE NORTH FORTY FIVE FEET OF LOT 6, BLOCK 1 OF
THE LAKE ADDITION BOOK 11, PAGE 71 OF THE PUBLIC
RECORDS OF PALM BEACH COUNTY, FLORIDA.
ALSO
A PUBLIC HEARING will be held by the City Commission of the City
of Boynton Beach on the above request on Tuesday, May 18, 1993 at
7:00 p.m. or as soon thereafter as the agenda permits.
All interested parties are notified to appear at said hearings in
person or by attorney and be heard. Any person who decides to
appeal any decision of the Planning and Development Board or City
Commission with respect to any matter considered at these
meetings will need a record of the proceedings and for such
purpose may need to ensure that a verbatim record of the
proceedings is mad~, which record includes the testimony and
evidence upon which the appeal is to be based.
