Dear Mr. Golden:
In response to your letter of September 17, 1990, regarding
the above matter, enclosed herein please find three fully executed
applications to abandon and vacate with respect to portions of
Old Boynton Road. The applications have been signed by all
adjacent property owners.
I realize that when you wrote to me a few months ago, your
schedule of hearings covered only 1990. Please provide a schedule
for the coming months with a suggested hearing date so I may plan
accordingly. It is the intent of the Petitioners, if approval
of abandonment is received from the City of Boynton Beach, to
apply to Palm Beach County pursuant to County Ordinance 86-18,
for vacation and abandonment by Palm Beach County and acquisition
of the right-of-way by the adjoining owners.

Gentlemen:
Please be advised that this office represents the owner
of a small triangular portion of property adjoining Old
Boynton Road. I have met with and received approval from
both FLORIDA POWER AND LIGHT and DOCTOR and MRS. JACOBS, the
other owners adjoining the subject right-of-way, to seek an
abandonment pursuant to Palm Beach Ordinance No. 86-18.
A portion of the Ordinance requires that if the right-
of-way sought to be abandoned lies within a municipality, it
will be necessary that the municipality first abandon its
interest in this site by appropriate Resolution and a certi-
fied copy of the Resolution be attached to the Petition.
It is my understanding that a representative of the
owner, MR. PAUL D. HIMMELRICH, has met with your office and
discussed this matter. It is also my understanding that, in
accordance with Paragraph 7 a. of your Master Land Plan, it
is anticipated that the subject right-of-way area should be
abandoned. Attached hereto please find a copy of Paragraph 7
a., together with a copy of a survey sketch prepared, which
provides a legal description of the area sought to be aban-
doned.
