b. Site development plans. All plans for lots or
parcels proposed to be developed within planned
commercial developments are subject to and shall
be developed consistent with the requirements of
-Chapter 4, Site Plan Review, Land Development
Regulations.
c. Permits. No building permits shall be issued
unless and until platting procedures and the
requirements outlined in Chapter 5 of the Land
Development Regulations are completed in every
respect.
13. Changes in plans.

Modifications to approved plans which result in
an increase of ten (10) per cent or more in
measurable impacts such as traffic created, water
used or sewage or storm water generated or some
other comparable measure shall be processed as
for a new application for zoning to PCD.
MOdifications to approved plans which result in
an increase of less than ten (10) per cent in
measurable impacts as determined by including any
changes in traffic generated, water consumed or
sewage to be collected will require review and
recommendation by the planning and development
board and final approval by the City Commission.
The City Commission decision to approve, approve
with modifications or deny, shall be predicated
upon a finding of consistency with the
comprehensive plan and a finding that any such
increase will not result in a negative impact on
infrastructure delivery systems or the
surrounding area in general. It is the intent of
this section that all additional impacts be
mitigated. Modifications which result in an
increase of less than ten (10) percent in
measurable impacts shall not extend the
expiration date of the eighteen month approval of
a PCD classification.
Section 7. Planned iDdustrial development district.
A. INTENT AND PURPOSE. A planned industrial development
district (PID) is established. The purpose of this
district is to provide a zoning classification for light
industrial development that will better satisfy current
demands for light industrial zoned lands by encouraging
development which will reflect changes in the technology
of land development and relate the development of land to
the specific site and to conserve natural amenities.
Regulations for the PID are intended to accomplish a more

Pursuant to our recent telephone conversation regarding converting the master plan modification
request into a rezoning request, I would request that the item remain as was submitted in light of the
recent negotiations with the City Utilities staff. We expect that the information that was provided
outlining the loading areas on the proposed plan, and the absence of those areas on the original
submittal will in turn reduce the change in water usage, by the calculation rate, to under the 10%
required. In the event that the determination is made by the Utilities Department that the increase
is still over the 10% threshold, we realize that we will then have to transfer this request to a rezoning
application.

ordinances of the C:lty of Boynton Beach require its consent in
which event the Master Plan shall not be amended without having
first obtained the consent of the city of Boynton Beach.
7.3 Covsnants 'Rl1nn;l,.na.with the Land. The terms, conditions,
covenants, rights and obligations coctained within this Declaration
shall run with the Shopping Center and all parts thereof and inure
to and be for the benefit of the Responsible Party, its successors,
a~~igns, employees, agents, inv:lt..B. guests and tenants and its
tenact'S successors, assigns, employees, agents. invitees, guests
and subtenants fo~ an initial term commencing with the date this
Declaration is recorded in the Public Records of palm Beach County.

AS you are probably aware, the Winchester property lying south
of the Mall and fronting on Congress (approximately 23 acres) is
currently under Contract to Boynton Commons Corporation and that
entity is in the procesB of attempting to obtain requisite
government approvals for its proposed shopping center de~.lopment.
The Developer, through its principal, DOD Stiller, has been
working diligently in attempting to co~ly with the requir~ents
and comments of the City Planning Department, and other staff
departments, so as to meet the September 1 filing deadline which
W'ould permit the project to appear 011 Planning Board and city
Commission Agendas in Octoberl 1995.
The Planning Department' s staff is seeking to impose a
requirement upon the Developer which I believe to be based upon, at
best, an overly technical reading of the Land Development
Regulations and, more importantly, one which is not only
unreasonable, but whioh, if complied with, could result in the
Developer being ill violation of its Purcbase Ag:reement for the
property.

in connection with a rezoning from C-3 to Planned Commercial
Development (PCD).

The southwest corner of Old Boynton Road and
Congress Avenue
LANDSCAPE APPEAL - Request for a landscape
code appeal to omit a 2Y2 foot wide landscape strip
between the vehicle use area and the abutting
property line at the southwest corner of the site.
Mr. Lelanic exptained that this parcel is in a commercial area with the Mall to the north. There are four
access points to this parcel. Three of the access points are full turning movements and the fourth
(southern-most access on Congress Avenue) is right-in/right-out. The application has been re'V'iewed
by the TRC and the applicant has responded to the comments. The 10' required PCD landscape buffer
will be provided around the property. There were requests by staff that the landscaping be upgraded, _
and the applicant has no problem with that request.
A landscape appeal has been filed for the southwest corner of the property. At that location, there is
an existing ingress/egress easement which services the property adjacent to Boynton Commons parcel.
This ingress/egress easement provides access fram Windlester Park Boulevard through a median cut.
Without this, access to the southern property will be denied. The applicant proposes to move the
required 1 O'PCO buffer to the north of the easement. This site plan has been developed into a
configuration which allows internal circulation, provides outparcels along Congress Avenue, and an
efficient flow th'JOugh the site.
lambri Heyderit" Planning & Zoning Director, made the presentation. There will be two main
buildings and three outparcels. Some of the buildings indicate drive-throughs. When the master plan
is submitted, if a drive-through is indicated, a conditional use approval is not required at site plan
approval. The Comprehensive Plan includes this property and the property to the west as Planning
Area 7.f. The Plan indicates that this property shou1d be rezoned to PCD when developed. The
maximum height of the structures will be 45' including the clock tower.
There are three '5tIndards used for evaluating the appropriateness of PCD zoning. They are:
1. Relation to major transportation facilities;
2. utility extensions, storm water mitigation and roadway improvements; and
3. physIcal character of the site.

OCTOBER 17, 1995
Palm Beach County has reviewed the traffic study, and this project meets their Ordinance. The
Engineering Department has received the storm water master plan, and indicated that it must be
certified by an engineer that it meets Code. Standard #3 has been accepted by the Engineering
Department.
Staff recommends approval of this project subject to staff comments. The Planning and Development
Board also recommended approval of this project subject to all staff comments.
MAYOR TAYLOR ANNOUNCED THE PUBLIC HEARING. THERE WAS NO ONE PRESENT WHO
WISHED TO SPEAK ON THIS PROJECT.
In response to Commissioner Jaskiewicz' question regarding the location of this parcel, Mr. Lelanic
confirmed that there is an existing bank building currently on the site which will be removed.
Commissioner Jaskiewicz feels this project will be a tremendous asset and aesthetic improvement to
the area.
Vice Mayor Bradley inquired as to the look of the north elevations. Mr. Lelanic advised that
architectural elevations are still in the finalization stages. The applicant has proposed extensive
landscaping to the rear ofthe buildings. There will be a hedge and trees which will hide the view of
the rear of the buildings. Ms. Heyden advised that site plans will be required at a later date and full
elevations will be submitted at that time. .
In response to Mayor Pro Tern Matson's question about possible anchor tenants, Mr. Lelanic stated that
possible tenants include Barnes & Noble, Linen & Things, ete.
Motion
Mayor Pro Tem Matson moved to approve the zoning and master plan change from C-3 to PCD for
Boynton Commons, southwest corner of Old Boynton Road and Congress Avenue, so that a 186,130
square foot retail complex can be built on 23.03 acres of land subject to staff comments.

At the podium, N\ayor Pro Tem Matson reminded everyone that the City implemented the Lottie Pierce
Citizenship Award last year as part of City Government Week. Lottie Pierce was a member of the
African-American community who volunteered her services to the City and other organizations.
Honoring an exemplary citizen is a way of keeping her memory alive. Last year, Joy Currier was the
recipient of this award.
This year's recipient is a member of the "Friends of the library" and the City's Library Board. She is
a volunteer at Galaxy Elementary School, a member of the Advisory Council on African-American
Affairs, and the North Boynton Beach Task Force. She has participated in the Wrice anti-drug marches
and is a member of the Northwest Neighborhood Association, St. John's Missionary Baptist Church,
the Florida Retired Educators' Association, Palm Beach Classroom Teachers' Association, Alpha Kappa
Alpha Sorority, etc. This recipient has been exemplary in her service to the community. Mayor Pro
Tem Matson proudly presented the 1994/95 Lottie Pierce Citizenship Award to Dorothy Walker.

The proposed land use plan for the above reference contains 213,650 square
feet of building area. The current approved land use plan contains 186,130
square feet of building area. The net new daily trips for the proposed plan is
6,782 while the net new daily trips for the approved plan is 6,684. Thus, the
net increase is 98 daily trips and represents a 1.5 percent increase in trips. The
peak hour trips associated with the proposed plan are actually less than those of
the approved plan since the drive-in bank is being eliminated.

The attached memorandum number 96-190 determination, by the City's
Utility Department, regarding water used and sewer generated for
the proposed modification to the Boynton Commons project results in
an impact greater than 10%. Therefore, the application process for
the proposed changes will require a rezoning submittal rather than
a master plan modification.
Please submit a check for $500.00 to cover the balance of the
$1,000.00 rezoning application fee. The rezoning application
process will result in the project being presented as a public
hearing to the Planning and Development Board on July 9, 1996 and,
if approved, the first ordinance reading by the City Commission on
July 16, 1996 and second ordinance reading on August 6, 1996.

Dear Ms. Heyden:
The Palm Beach County Traffic Division has reviewed the revised
traffic impact study for the project entitled Bovnton Commons,
pursuant to the Traffic Performance Standards in Article 15 of
the Palm Beach County Land Development Code. The proposed
project will consist of 213,650 square feet of general retail.
The build-out of the project has been extended to 1998. The
proposed project will generate 6,782 net daily trips.
The study shows the need to phase the project to one roadway
improvement. An improvement to the intersection of Lawrence
Road and Gateway Boulevard is required before more than 40 of
the project traffic is allowed. This required intersection
improvement is included in the improvement of Gateway Boulevard
that is scheduled for construction in FY 96/97.
The Traffic Division has determined that the project meets the
requirements of the Traffic Performance Standards of Palm Beach
County. This approval does not constitute approval of access to
any County roadway. If you have any questions regarding this

Please find enclosed, a complete application for a minor amendment to a Planned Commercial
District. Pursuant to our previous discussion. this request is to increase the square footage for the
development from 186,130 sq.ft. to 213.650 sq.ft. This increase is necessary to allow for more
display area within the individual users on the site. Please note, as you look at the plan. that the
number of big box users and the outparcels has not changed from the previous submittal.
The one major revision to the site plan from the previous approval. is the addition of an access point
onto Old Boynton Rd. There had been a similar entrance proposed under a previous submittal. but
it was removed due to the access point not lining up with the property to the north. The proposed
access point will be right in. right out only. and as a result will not need to be lined up with the
adjacent property. The remainder of the plan has only been changed slightly to renect the new
building sizes.

Kimley-Hom and Associates, Inc. was retained to prepare a traffic impact analysis
for the project. This document presents the methodology used and the findings of
these analyses.
The traffic impact analysis was conducted in accordance with the 1990 Traffic
Performance Code of Palm Beach County. The analysis used current data available
from Palm Beach County. The buildout year for the proposed development is 1998.

Inventory
The data used in this analysis were obtained from Palm Beach County. They
included:
· 1995 24-hour traffic volumes
· 1994/1995 intersection turning movement counts
· Roadway geometries
· Approved development traffic
· Historic count data
The location of the site is shown in Figure 1.
Planning Data
Information on the site was provided on a copy of the proposed site plan prepared
by Land Design South. Access to the development will be provided through two
access driveways on Congress Avenue and two on Winchester Park Boulevard. The
two driveways on Winchester Park Boulevard and the north driveway on Congress
Avenue will provide full access. The southern driveway on Congress Avenue will
provide right-in/right-out access.

PROJECT TRAFFIC
Traffic Generation
The daily traffic generation for the development was based on trip generation rates
published by Palm Beach County. Peak hour characteristics were based on
information published in the Institute of Transportation Engineers' Trip Generation
Report (5th Edition). Table 1 presents the proposed potential trip generation for the
project site. Pass-by rates published by Palm Beach County were used in the
analysis.
Traffic Distribution
From a review of the existing and approved development in Palm Beach County
and considering the arterial network with its travel time characteristics, the external
traffic distribution was calculated. These were summarized by general directions
and are depicted below:

Traffic Assignment
The distributed external trips for the project in 1998 were assigned to the roadways
within the radius of influence, both in terms of daily external trips and A.M. and
P.M. peak hour volumes.
Based on the net impact of the project, it was determined that the maximum radius
of development influence for Test 1 of the traffic performance standards is three (3)
miles. The maximum radius of development influence for Test 2 is three (3) miles.

BACKGROUND TRAFFIC
Background traffic is comprised of two components:
· Traffic from the unbuilt portions of approved major developments
. Historical growth
A review of major developments in the area indicated that no major projects would
contribute greater than ten percent (10%) of the level of service standard on any
link significantly impacted by the project during its buildout time frame.
According to the requirements of the 1990 Traffic Performance Code of Palm
Beach County, existing traffic volumes were grown by factors determined by a
review of growth data published by Palm Beach County.
The total background traffic was determined for each link within the radius of
influence.

ASSURED CONSTRUCTION
The existing laneage for each link analyzed was identified. A review of the Five-
Year Plans of Palm Beach County and FOOT, as well as those improvements
committed by the developers of projects in the area was made to identify pertinent
roadway improvements.
The Lawrence Road improvement south of Hypoluxo Road to Gateway Boulevard
is scheduled to be widened to five lanes by Palm Beach County in FY 97/98.
Gateway Boulevard is to be widened to six lanes between Military Trail and
Congress Avenue by Palm Beach County FY 96/97.

LINK EVALUATION
A link performance standard evaluation was undertaken for each link considering
its total traffic volume and the roadway laneage to be in place in 1998. Project
traffic and total traffic for 1998 are shown in Tables 2 and 3 for daily and average
peak hour conditions. Figure 2 depicts the roadway links that are significantly
impacted on a daily basis by project traffic. As can be seen, aJl except two of the
roadway links upon which the project has significant impact meet the daily level of
service standard through 1998. Table 3 shows that the same two links fail to meet
the average peak hour link standard for 1998.
Alternate Test 1
The two links that failed to meet the daily and average peak hour standards were
then analyzed for peak hour peak season conditions in order to determine if they
would meet the Alternate Test 1. Table 4 shows the peak hour directional link
volumes for these links. As can be seen from Table 4, these links meet the peak
hour link level of service standard.

In addition to the link level of service analysis, intersection critical volume analyses
were also conducted and .are included in the Appendix. All existing intersection
volume data was provided by Palm Beach county. The counts were adjusted to

in the Appendix show the development of total 1998 intersection traffic. The
intersections associated with these links were then analyzed for adequate capacity
during the A.M. and P.M. peak hours.
The critical volume analysis worksheets show that all but one intersection operate
under the standard capacity of 1,400 vehicles considering the existing lane
geometry. The intersection at Lawrence Road and Gateway Boulevard operates
under the standard capacity of 1,400 vehicles with Gateway Boulevard
improvements which are to be in place by 1998.
The links that fail the daily link test therefore meet Alternate Test 1.
Test 2
The Model Test 2 indicates a radius of influence of three miles from the site. No
links listed in Modified Table 5 of the Performance Standard Code are within the
project's radius of influence.

TURN LANE REQUIREMENTS
Driveway Classification
According to the Palm Beach County "Guide Parking Lot and Street Access Design
Criteria and Standards", it is necessary to classify project entrances as minor,
intermediate, or major according to the following criteria:
1. Minor - Provides for a maximum average daily traffic of 500.
2. Intermediate - Provides service for a maximum average daily traffic
from 501 to 2,000.
3. Major - Provides service for a maximum average daily traffic greater
than 2000.
Using these criteria, the northern two driveways on Winchester Park Boulevard and
the north driveway on Congress Avenue would be classified as major. The northern
driveway on Old Boynton Road would be classified as intermediate.

Figure 3 presents the proposed project AM and PM peak hour total volumes
assigned to the project's access driveways. Consideration of these volumes with
respect to the Palm Beach County access design standards results in the
determination that left-turn and right-turn ingress lanes will be required at the two
driveways on Winchester Park Boulevard and the north driveway on Congress
Avenue.

Water and Sewer Usage
We offer the following comments on this project:
Chapter 26 of the City's Code includes provisions for determining the capacity needs
.of a project, with unit values assigned for various uses. For restaurants, the value
assigned, per seat in the restaurant is 44 gallons per day (gpd) for water, and 35 gpd
for sewer. The expected demand for a 200 seat restaurant would therefore be 8800
gpd of water, or 28.21 equivalent dwelling units. The resubmittal reflects no change
in restaurant seating.
The' Code also assigns a value of 0.125 gpd per square foot of retail space, for
water. The increase in retail square footage shown in the resubmittal would
therefore amount to (30020 x 0.125 =) 3752.5 gpd, or 12.03 equivalent dwelling
units. Given that the. original project was approved for 99.78 equivalent dwelling
units, this increase amounts to 12.06% of the total original demand.

The proposed land use plan for the above reference contains 213,650 square
feet of building area. The current approved land use plan contains 186.130
square feet of building area. The net new daily trips for the proposed plan is
6.782 while the net new daily trips for the approved plan is 6,684. Thus, the
net increase is 98 daily trips and represents a 1.5 percent increase in trips. The
peak. hour trips associated with the proposed plan are actually less than those of
the approved plan since the drive-in bank. is being eliminated.

Planning Data
Information on the site was provided on a copy of the proposed site plan prepared
by Land Design South. Access to the development will be provided through one
access driveway on Old Boynton Road, one driveway on Congress Avenue and two
on Winchester Park Boulevard. The two driveways on Winchester Park Boulevard
and the driveway on Congress Avenue will provide full access, The northern
driveway on Old Boynton Road will provide right-inlright-out access.

Dear Mike,
Please find enclosed, a complete application for a minor amendment to a Planned Commercial
District. Pursuant to our previous discussion, this request is to increase the square footage for the
development from 186,130 sq.ft. to 213,650 sq.ft. This increase is necessary to allow for more
display area within the individual users on the site. Please note, as you look at the plan, that the
number of big box users and the outparcels has not changed from the previous submittal.
The one major revision to the site plan from the previous approval, is the addition of an access point
onto Old Boynton Rd. There had been a similar entrance proposed under a previous submittal, but
it was removed due to the access point not lining up with the property to the north. The proposed
access point will be right in, right out only, and as a result will not need to be lined up with the
adjacent property. The remainder of the plan has only been changed slightly to reflect the new
building sizes.

Dear Skip,
Weare currently proposing to expand the currently approved square footage of the Boynton Commons
P.C.D. through the submittal of a minor amendment to the approved master plan. The current approval is for
186,130 total square feet containing a 7,500 sf restaurant, 5,000 sf bank, 15,930 sf pharmacy, and 11,200 sf
of inline retail. We are proposing to expand the square footage by 27,520 sfto a total of 213,650 sf including
a 5,000 sf restaurant, 8,000 sf retail outparcel, 15,930 sf pharmacy, and 18,750 sfofinline retail.
Pursuant to Chapter 2, Section 6F, of the peD section of the code, for an amendment to be considered a
minor deviation, it must have an increase below ten percent of measurable services, such as traffic, water,
and sewer usage. The proposed increase in square footage for this shopping center is to increase the size of
the individual users, not to create more users. The proposed development will still consist of six major "box"
tenants, local retail, and three outparcels, one containing a 200 seat restaurant. Because the increase is in the
size of the display area of the individual users ofthe site, we do not anticipate a major increase of water and
sewer uses for this development beyond the ten percent allowable minor amendment
