DESCRIPTION: This is a request from Land Design South, agent for
Boynton Commons Corporation to appeal Chapter 7.5, Article II -
Landscape Code, Section 5.E. to omit a 2 1/2 foot wide landscape
strip between the vehicle use area and the abutting property line
at the southwest corner of the site. The site is located at the
southwest corner of Old Boynton Road and Congress Avenue. The
request is submitted in connection with a rezoning and master plan
approval for the subject property.
RECOMMENDATION: The Planning and Development Board, with a 7-0
vote, recommended approval subject to all staff comments (Planning
and Zoning Department Memorandum No. 95-568).

SUBJECT: Boynton Commons - LAAP 95-006 (landscape appeal to omit
abutting property landscape strip and landscape material)
NATURE OF REQUEST
Land Design South, agent for Boynton Commons Corporation, is
requesting to appeal Chapter 7.5, Article II - Landscape Code,
Section 5. E. The section of the landscape code that the applicant
is seeking relief from pertains to the perimeter landscape strip
that is required between a vehicle use area and an abutting
property line. The subject site is located at the southwest
corner of Old Boynton Road and Congress Avenue (see Exhibit "A" -
location map and Exhibit liB" - request for appeal prepared by the
applicant's agent).
BACKGROUND
The request is submitted in connection with a rezoning and master
plan approval for the subject property. The rezoning request is to
change the current zoning classification of C-3 (community
Commercial) to PCD (Planned Commercial Development). Exhibit "C" -
proposed master plan, delineates the area of the subject landscape
appeal.
ANALYSIS
The following text is taken from section 5. E. of the landscape
code:
E. Perimeter landscaping relating to abutting
properties. On the site of a building or structure
or open lot use providing an off-street parking
area or other vehicular use area, such area shall
be provided with a landscaped barrier, preferably a
hedge not less than four (4) feet nor greater than
six (6) feet in height to form a continuous screen
between the off-street parking area or other
vehicular use area and such abutting property.
Such landscape barrier shall be located between the
common lot line and the off-street parking area or
other vehicular use area in a planting strip of not
less than two and one-half (2 1/2) feet in width.
The provisions of this subsection shall not be
applicable in the following situations:
1. When a property line abuts a dedicated alley.
2. Where a proposed parking area or other
vehicular use area abuts an existing hedge
said existing hedge may be used to satisfy th~
landscape requirements of this subsection
provided that said existing hedge meets all
applicable standards of this article.
As depicted on Exhibit "B", the request is to omit approximately
270 lineal feet of hedges planted 18 inches tall, spaced 2.0 feet

on center and installed in a 2.5 foot wide landscape strip. The
code code states the purpose of the landscape strip and hedge is to
form a continuous visual barrier to screen the view of the vehicle
use area from the abutting property. A secondary purpose for
perimeter landscape strips is to provide pervious area for
drainage.
The application is proposing to maintain an existing access aisle
that straddles the southwest property line of the project. The
applicant states that he does not want to relocate the access aisle
north so that it is entirely on his property because it currently
aligns with a median opening within Winchester Boulevard. In
addition, if moved north, when the parcel to the south is
developed, a new driveway off of Winchester Boulevard will be
needed to serve the south parcel. This new driveway most likely
will not be permitted another median opening wi thin Winchester
Boulevard, limiting the accessibility and marketability of the
parcel.
RECOMMENDATION
The Planning and Zoning Department recommends that the Planning and
Development Board recommend to the City Commission approval of the
landscape appeal to Section 5. E. of Article II - Landscape Code,
provided that the approval of the appeal does not grant the
property owner to the south an exemption to installing the required
landscape material in a minimum 2.5 foot wide landscape strip. The
basis for this recommendation is that, wherever possible, the city
should encourage cross access to alleviate the need for additional
curb cuts on heavily traveled roads.

Dear Ms. Heyden:
This letter is to serve as a formal request for appeal from the requirements of the Boynton Beach Land Development
Regulations, Article II, Section 5. E. This code requirement is for a not less than 2.5' landscape strip containing a
minimum 4' to a maximum 6' hedge separating vehicular use areas from abutting properties. As you are aware, the
Boynton Commons PCD has an existing ingress/egress easement located on the south west side of the property. This
easement allows joint use ofthe existing median opening on Winchester Parkway for the Boynton Commons PCD,
as well as the two (2) acre parcel located directly south of this easement.
I spoke with Mike Haag last week, and he indicated that the issue regarding the 10' PCD Greenbelt being shifted to
the north of the ingress/egress easement was resolved following a meeting with the applicant and the City Attorney.
He also stated that due to the fact that we have a vehicular use area, being the existing ingress/egress easement next
to the abutting property line, we would have to request a waiver for the perimeter landscaping that would be required.
The ingress/egress easement in question, is a recorded easement. It was created to allow access for the southern
parcel across what is now known as Boynton Commons PCD. The pavement exists in this easement and runs back
into the Boynton Commons site. This pavement is to remain a part of the proposed submittal, and as such, would not
allow for any landscape area directly adjacent to the property line in this 269' strip. We do, however, have the 10'
PCD Greenbelt directly to the north of this easement that gives sufficient screening from the remainder of the facility
to this adjacent commercially zoned property.
As I have pointed out, the requirement for this 2.5' landscape strip to be placed adjacent to the lot line on this project
is unnecessary. Due to the existing ingress/egress easement that is utilized by the abutting property, and the existing
pavement within this easement, it is not possible to install this landscape area. Also, with the 10' PCD Greenbelt to
the north of this easement, an effective buffer is already being provided from the overall center.
With these thoughts in mind, I would respectfully request that your office recommend this waiver request for
approval by the City Commission concurrently with the Boynton Commons PCD rezoning and master plan approval.
