of Occupancy, I would like to ensure that you do not have any outstanding or pending conditions
concerning this site that must be rectified (excluding issues that are covered entirely with a city approved
surety).
If any outstanding conditions are related to permits issued by the Building Division, please provide this
division a memorandum containing a description of the unresolved conditions. If the unresolved conditions
are not permit related, please notify the owner or the owner's agent to ensure that the matters are rectified.
Please respond to me, within ten (10) days in order that we may proceed in a timely manner to issue the
Certificate of Occupancy. No response is necessary if your department is satisfied with the current state of

We recommend approval of the above referenced project subject to the following comments:
Building Division (Michael Haag 561-375-6352)
1. All wall signs shall be below the roof line. Signs erected upon or above a roof or parapet wall of a
building are considered a "roof sign". The sign code states roof signs are prohibited. [Chapter 21 -
Sign Code, Article II, Section 3.H. and Chapter 1 - General Provisions, Article II. Definitions, Roof
Sign] To clarify whether the proposed sign age is allowed, show and label on all elevation view
drawings the location of the roof line. Where applicable, relocate the signage below the roof line or
omit the signage from the plans. No variances may be granted to signs expressly prohibited by the
sign code. [Chapter 21 - Sign Code, Article II, Section 1.]
2. One or more flat wall sign(s) which advertise the premise are allowed per the sign code. The
maximum area for this signage is one and one half square feet of sign area per each one foot of
linear building or tenant bay frontage. [Chapter 21 - Sign Code, Article IV, Section 7. and 3.C.]
Therefore, to ensure the proposed wall signage complies with the sign code regulations, place a
note on each sheet depicting an elevation view of the buildings indicating that the maximum wall
signage for an "in-line tenant" and/or an "out-parcel tenant" is one and one half square feet of sign
area for each one linear foot of building or tenant bay store frontage. Also add the following
definitions below this note:
Definitions:
"In-Line" Tenant - Tenant that occupies a space that has store frontage in a multi-tenant building.
"Out-Parcel" Tenant - Tenant that occupies space in a stand along building.
Building or Tenant Bay Store Frontage - Facade ofthe building or tenant space where the main
entrance is located.
3. To ensure that the proposed site project identification signs comply with the sign code, place a note
on each elevation view drawing of the proposed free standing site signs indicating the following:
a) Maximum height allowed is 20 feet.
b) Maximum sign area allowed is 160 square feet.
c) Minimum set back from all property lines is 10 feet including, where applicable, compliance
with line of sight regulation.
4. Amend the site plan to show with dimensions the location of the site signs in compliance with the
sign code setback regulations. [Chapter 21 - Sign Code, Article III, Section 5.] It appears as
though the proposed sign along Congress Avenue does not meet the required setback regulations.
5. The submitted survey does not correspond with the recently submitted plat or submitted site plan
with respect to type, size and location of easement and property lines. Signs that are located within
an easement shall be relocated outside of the easement. When signs are located within an easement
the applicant shall provide completed City of Boynton Beach easement release forms at time of

6. The sign code regulations [Chapter 21 - Sign Code, Article IV, Section 7.] specify that signage
within a planned commercial district follow the regulations that are established in the Shopping
Center section of the sign code. However, the planned district sign regulation also allows for
flexibility with respect to number of signs. With respect to the number of site signs, it is
recommended that the applicant's justification regarding adding one site project identification sign
be accepted and the site contain three free standing site signs. However, each sign shall comply
with the code regulations regarding height, area and location. The justification submitted by the
applicant made reference to the project having street frontage and access points on three primary
roads (Congress Avenue, Old Boynton Road and Winchester Park Boulevard).
7. To ensure the purpose and intent of the planned district sign regulations are maintained with
respect to encouraging continuity while allowing for flexibility regarding type, color, style and
design of signage it is recommended that the applicant follow the signage regulations specified in
the Community Design Plan, Chapter 9, Section 10.1. ofthe City's Land Development Regulations.
8. The applicant is proposing that the length of all signs for tenants that lease 2,000 square feet or less
of floor area occupy only 80% of the length of the tenant frontage. This requirement is more
restrictive than the sign code regulations. Therefore, it is recommended that the tenant requesting
approval of a sign permit secure from the property owner a written sign-off that is placed on both
sets of permit plans. The sign-off will acknowledge that the length of the tenant sign complies
with the 80% rule. Note: Sign-off from the property owner will not justify deviation from the
approved sign program. This authorization may be delegated to another party via a signed affidavit
by the owner Boynton Beach Development Associates.
9. To ensure the approved sign program is implemented in an efficient manner it is recommended that
the applicant complete and properly execute the sign program form available from the Planning and
Zoning Division.
10. To be consistent with the requirements of a sign program add to the submittal a chart or list that
includes computations that identify the type and number of signs or sign structures proposed for
each tenant and the site. Also add to the chart the area and dimensions of each proposed sign.
[Chapter 21 - Sign Code, Article IV, Section 7.B.1. & 2.]
Note: Wind load calculations, structural design details and electrical specifications are not needed
for the sign program. However a note shall be provided within the sign program indicating that
compliance with the applicable provisions ofthe Sign, Building and National Electrical codes shall
be provided at time of permit review.
11. To ensure the signage for all tenants complies with the approved colors, submit a material sample
of all approved sign colors prior to or in conjunction with the first request for a sign permit. The
material sample shall include the color name, color code and manufacturer. Color samples are also
required for the material used on the sign face and sign structure of the free standing site signs.
[Chapter 9 - Community Design Plan, Section 5.]
12. The submitted plans do not identify the width ofthe tenant spaces, length of the building frontage
or dimensions identifying the size of proposed wall signs. Therefore there is no way to determine
whether the proposed signage complies with the sign code regarding sign area. The submitted
drawings are acceptable for display purposes only. However the plans submitted for wall sign
permits shall provide, but will not be limited to, showing and identifying the following:
a) Show and identify roofline.
b) Dimension width of tenant space frontage (in-line tenant).

c) Dimension length of building frontage (outparcel building).
d) Dimension height and length of proposed signage.
e) Identify total sign arca of each sign, including non word depiction signage. (Note: sign area
shall not exceed sign code requirements)
t) Identify type of sign consistent with the approved sign program.
g) Identify type of letter style consistent with the approved sign program.
h) Provide color specifications consistcnt with the approved sign program.
i) Provide dctail drawings and design criteria in compliance with the Building & Electrical Code.
j) Where applicable, the plans have signature of property owner allowing proposed signage.
k) Where applicable. shown and identify type of illumination.
13. Place a note within the sign program indicating that the signature of property owner on permit
plans is not authorization to change the criteria of the approved sign program.
14. Place a note below the drawing depicting window signage indicating that window signage shall not
exceed 20% of the glazed window area. [Chapter 21 - Sign Code, Article II, Section 2.C.]
15. Place a note below the drawing depicting rear door signage indicating that rear door signage shall
not exceed three (3) square fect. [Chapter 21 - Sign Code, Article IV, Section 3.F.]
] 6. To ensure that there is a smooth transition from sign program approval to reviewing permits plans
for signs, it is recommended that the applicant amend the sign program to comply with the
conditions of approval prior to the first permanent sign permit being issued for a tenant within the
project.

We recommend approval of the above referenced project subject to the following comments.

I. The applicant did not provide sufficient information on the submitted sign program plans to
determine whether the location of the proposed tenant wall signs are in compliance with
Article [I. Section 3.H. of the sign code with respect to the roofline. Therefore, to ensure at
time of permit review that the location of the proposed wall signs are in compliance with the
code. place the following note on all sign program drawings that depict the location of the
wall signs: "No sign shall be erected upon or above a roof or parapet wall ofa building".
2. The applicant did not provide sufficient information on the submitted sign program plans to
determine whether the size of the proposed tenant wall signs including non-word depiction
signage are in compliance with Article IV, Section 3.e. of the sign code and Section 10.1.4.
of the community design plan. To ensure at time of permit review that the size of the
proposed wall signs are in compliance with the code, remove from the sign program
drawings the allowable and proposed wall sign area and replace it with the following note:
"The total wall sign area for each tenant including out-parcel buildings shall not cxceed 1.5
times the length of the building frontage (note building frontage is the main entrance side of
the building or bay) and the maximum area of non-word depiction signage shall not exceed
20% of the erected sign area".
3. The applicant did not provide sufficient information on the submitted sign program plans to
determine whether the colors depicted on the proposed tcnant wall signs are in compliance
with Section 10.1.3. of the community design plan. To ensure at time of permit review that
the colors of the proposed tenant wall signs arc in compliancc with thc approved colors, add
to shcet I of 19 (Exhibit A) the color specifications for all approved colors. Also add the
following tcxt to the title of the sheet: "and approved colors for all wall signs excluding non-
word depiction signage".
4. Considering sheet I of 19 includes eleetrical details add this following note to the sheet: "All
electrical work shall comply with National Electric Codc".
5. The applicant did not provide sufficient information with the submitted sign program plans to
determine whether the letter styles depicted for the proposed tenant wall signs are in
compliance with Section 10.1.8. of the community design plan. To ensure at time of permit
revicw that the letter styles are in compliance with the code, add the following note to sheet 2
of 19 (Exhibit B): "Tenants may use their own letter style for wall signs following submitting
at the time of permit review, written verification that the copy is nationally registered".

6. [n order to erect a sign within an easement. properly executed and recorded City forms arc
required at time of permit review. It appears that the Congress Avenue and Winchester Park
Boulevard free standing pylon signs are located within an easement. Add the following note
to sheet 8 of 19 (Exhibit I) and sheet 10 of 19 (Exhibit K): "Signs proposed to be erected
within an casement will require at time of permit review, properly completed. executed and
recorded City easement release forms".
7. The sign program drawings ofthe pylon signs illustrated on sheets 8 of 19. 9 of 19 and 10 of
19 do t!m indicate whether the signs will be illuminated. If the signs are illuminated. identify
on each sheet the type of illumination and indicate with a note: "all electric work shall
comply with the National Electrical Code'..
8. To ensure that there is a smooth transition from sign program approval to reviewing permit
plans for signs, it is recommended that the applicant amend the sign program to comply with
the conditions of approval identified in the project Development Order, prior to the first
permanent sign permit being issued for a tenant or a pylon sign located within the project.

The following is a list of comments regarding the second review of the above-referenced project, that
identify deficiencies from the City's Land Development Regulations (L.D.R.). These comments are
required to be corrected and shown in compliance on the plans and/or documents submitted for permits.
1. Provide landscape information regarding landscaping of the free-standing signs
consistent with the approved site plan (LDR, Chapter 21, Article III, Section 3). Note
that the City of Boynton Beach Comprehensive Plan Policy 4.4.6 states that native
vegetation species shall satisfy at least 50% of all required landscaping.
2. Helvetica Medium has been selected as the lettering style selected for Boynton
Commons PCD. All nationally registered tenants intending to use their own lettering
style shell provide a copy of national registration (LDR, Chapter 9, Section 10.1.8).
3. Limit the number of sign colors to two in addition to black and white (LDR, Chapter
9, Section 10.1.3).
4. On Exhibit "A" - Typical Letter Fabrication provide a note that the sign style selected
as the sign style selected for Boynton Commons PCD is channel and shall be used
for wall signage on all buildings of the PCD (LDR, Chapter 9, Section 10.1.2).

Attached is the amended site plan submittal for the above referenced project for your final
review and recommendation. Please review this amended site plan submittal to determine if
the plans have been adjusted to satisfy the comments previously made by your department.
If your comments have been satisfied or if your comments can be met at time of
building permit, please advise this office in writing. If your comments have not been
met, please indicate this in writing to my office.
Finally, include in your memorandum a recommendation as to whether the project should be
forwarded to the Planning and Development Board for consideration. Please return your
memorandum and the amended plans (Building and Engineering Divisions shall keep
their plans) to Planning and Zoning by 5:00 P.M. on Wednesday, October 10, 1997.
