On November 16, 1998, we sent you a memo (copy attached) regarding a cash bond of $1 0,654.23 for the
completion of the landscaping and irrigation at an off-site drainage area that serves the Boynton Commons
Shopping Center. The owner of the off-site land is now Wal*Mart. The responsibility for the installation of the
landscaping and irrigation is now part of the required improvements for the Wal*Mart project. The Planning &
Zoning Division has approved the improvements and the permit has been issued to Wal*Mart to install the
landscaping and irrigation. The release of this bond was approved by the City Commission on July 5, 2000.
Therefore, please return the bond to Boynton Beach Development Associates, L.P. Attached is a Direct
Payment Requisition.

On :'oiovember 16, 1998, the Building Division sent to the Finance Department a cash bond for SID, 654.23, which was for
the completion of landscaping and irrigation that was part of the off-site improvements associated with the Boynton
Commons Shopping Center project. The owner of the off-site land is now Wal*:Ylart. The responsibility for the installation
of the landscaping and irrigation is now part of the required improvements for the Wal*Mart project. The Planning &
Zoning Division has approved the improvements and the permit has been issued to Wal*Mart to install the landscaping and

Please place the attached $10,654.23 check (#0716), from the Boynton Beach Development
Associates, L. P., in the appropriate account for monies that have been accepted for a landscape
bond. The bond money is being given to the City in lieu of the applicant installing required
landscaping and irrigation at an off-site drainage area that serves the Boynton Commons
Shopping Center. The shopping center is located at 333 North Congress Avenue. The off-site
drainage area is located approximately 538 feet west of Winchester Park Boulevard and 260 feet
south of Old Boynton Road. The landscaping that is required to be installed within and around
the drainage area is depicted on sheet L-6 of landscape plans for landscape permit number
97-4259. The backup information for the amount of money that is being remitted to the City is
located in the permit file.
After the applicant requests and receives an approved landscape inspection and after the bond
release is approved by the City Commission, the money will be returned to the Boynton Beach
Development Associates, L. P. If the inspection is not approved by May 10, 1999, the City will
use the bond money to hire contractors to install the required landscaping and irrigation.

Dear Mr. Musselman:
This letter is a verification of the currently approved development orders for the Boynton Commons
Planned Commercial Development (PCD). The site currently has a Master Plan approval for
213,650 square feet of retail shopping center. This approval was granted August 1996, with
comments, as outlined in the Development Order signed by the City Attorney on August 20, 1996.
The site plan for the project was approved in October 1996, by the City Commission, following the
outline and square footage established by the Master Plan for the project. This site plan was
approved with comments as outlined in the Development Order signed by the City Attorney on
October 15, 1996.
Currently, the developer has submitted to the City for plat approval. These plans are proceeding
through the normal review process through the Engineering Division. Among other things, these
plans are being reviewed for consistency with the currently approved site and master plans.
With the site plan approval, the developer has the ability to submit for building permits for the
project. These building permits, however, cannot be issued until the plat has been signed and
recorded in the public records. In addition, the applicant has discussed with staff further changes
to the approved site plan including a right turn out driveway onto Old Boynton Road (recently
resolved) and revisions to certain tenant locations and their building footprint. These revisions can
be made as a future minor site plan modification as part of the building permit review process if they
fall within the attached criteria set forth in the code which defines what constitutes a minor versus
a major site plan change.

Several weeks ago, we had a conversation regarding the Boynton Commons PCD. Our office later
received a letter from you which included the status of the approvals on the project. The developer
of the project is in the process of closing on the property; but the lender, who will be financing the
project, has requested that we provide them with as much information on the property as possible.
Among the information needed is the status of the Master Plan and Site Plan approvals, and the
ability ofthe developer to submit for building permits for the tenants on the project.
When we last spoke, you were willing to provide us with a letter that could be given to the lender,
providing that we forward a draft to your office of what the letter needed to contain. Attached, is
the information that the lender is requesting. This narrative gives a brief overview of the status of
the approvals, and what is to be completed.
I respectfully request that you review the attached draft, and if acceptable, provide this letter for the
purpose of the lender's closing. I understand that your time is limited, but I would appreciate it if
you could complete this letter as soon as possible. I will be calling your office to arrange a time
schedule for this letter to be picked up, rather than having it go through the mail system.

approved as part of this Ordinance.

plans are proceeding through the normal review process through the Engineering Department, with
our department reviewing the documents for consistency with the currently approved site and
master plans.
With the site plan approval, the developer has the ability to submit for building permits on the
project. These building permits, however, can not be issued until the plat has been signed and
recorded in the public records.
At the time the project was approved before the City Commission, an agreement was made this
office to allow two minor changes to the site plan. One was the addition of the right out access with
the required 100' entry throat onto Old Boynton Rd. This was reviewed by the TRC immediately
following the City Commission approval. The second change was regarding a limited change to the
building footprints to move Old Navy to the north set of buildings, to shift PetsMart to the east
where Old Navy was, apd to revise the remaining in-line box users located west of the PetsMart
store. This change ~ t~ be completed at the time of building permit by submitting revised site
plans with the permit packages.

Enclosed herein is a copy of the letter I received from attorney, Alan Pellingra regarding the
Declaration of Easements, Restrictions and Protective Covenants for the Boynton Commons
Shopping Center. Also enclosed is a black line version indicating recent changes and a clean
copy, both provided to me by Mr. Pellingra.
The last time I was involved with this project was to approve the draft declaration as to legal form
on or about October 31, 1996. Accordingly, I am unaware of what progress has been made since
then. Please review the letter and the black line version of the Declaration. I have reviewed the
changes and accept them as to legal form, but I wanted to make sure you each did not have any
comments as to the revised Declaration before commenting to Mr. Pellingra. Further, please
address the four (4) items listed on page 2 of the Pellingra letter. I have indicated to Mr.
Pellingra's office that these matters must be forwarded through your respective departments.

Please be advised of the following comments regarding the review of the fourth
submittal of the above-referenced request:
1. Considering that the configuration of the site depicted on the submitted paving
and drainage plans does not match the approved master plan, modify the paving
& drainage drawings to show compliance with the previous development orders
and the city code of ordinances including but not limited to the following:
a. Chronologically number the parking spaces depicted on the plan.
b. Show parking space computations indicating the number of regular
and handicapped parking spaces required for no more than
213,650 square feet of gross leasable floor area using the ratio of
one (1) space for each two hundred (200) square feet of gross
leasable floor area.
c. Show parking space computations indicating the number of regular
and handicapped parking spaces provided on the site.
d. Show on the plans no less than the required number of regular and
handicapped parking spaces.
e. Delineate with a labeled symbol the location of the nine (9) required
loading zones. Also dimension the loading zones consistent with
the size regulations identified in the zoning code including the
required block wall screening.
f. Add to the plan computations to verify that the area of the
landscape islands located within the parking area meets the interior
parking area landscape requirements specified in the landscape
code.
g. Add to the plans horizontal control dimensions that show the
parking lot is designed consistent with the dimensions identified on
the city standard drawings (B-90012 and 8-90013) and parking lot
regulations. Also, show the location and specifications for the
traffic control signs and pavement markings.
h. Modify the plans to show the location of the curbing required to
protect the landscaping in compliance with the code.
i. Indicate on the plan with a labeled symbol the location of the site
lighting and pedestrian light poles/fixtures in compliance with the
code regulations.
j. Delineate on the plan with a labeled symbol the location of the
parking spaces that use a portion of the landscaped area as part of
the parking space. Also provide a dimensioned detail drawing for
