The replat for Boynton Commons PCD is being prepared for the September 16, 1997 City
Commission meeting. The Engineering Division has indicated that the construction plans
associated with the replat do not match the configuration of the project as depicted on the
approved master plan. It is my understanding that a previous agreement was made with the
developer that would allow the replat without modifying the master plan. Is this correct?
Please respond before 10:00 a.m. September 5, 1997 in order for us to place the replat on the
agenda for the September 16th meeting. A written or verbal response to John Yeend or me will
be acceptable.

Please be advised of the following comments regarding the review of the fourth
submittal of the above-referenced request:
1. Considering that the configuration of the site depicted on the submitted paving
and drainage plans does not match the approved master plan, modify the paving
& drainage drawings to show compliance with the previous development orders
and the city code of ordinances including but not limited to the following:
a. Chronologically number the parking spaces depicted on the plan.
b. Show parking space computations indicating the number of regular
and handicapped parking spaces required for no more than
213,650 square feet of gross leasable floor area using the ratio of
one (1) space for each two hundred (200) square feet of gross
leasable floor area.
c. Show parking space computations indicating the number of regular
and handicapped parking spaces provided on the site.
d. Show on the plans no less than the required number of regular and
handicapped parking spaces.
e. Delineate with a labeled symbol the location of the nine (9) required
loading zones. Also dimension the loading zones consistent with
the size regulations identified in the zoning code including the
required block wall screening.
f. Add to the plan computations to verify that the area of the
landscape islands located within the parking area meets the interior
parking area landscape requirements specified in the landscape
code.
g. Add to the plans horizontal control dimensions that show the
parking lot is designed consistent with the dimensions identified on
the city standard drawings (B-90012 and B-90013) and parking lot
regulations. Also, show the location and specifications for the
traffic control signs and pavement markings.
h. Modify the plans to show the location of the curbing required to
protect the landscaping in compliance with the code.
i. Indicate on the plan with a labeled symbol the location of the site
lighting and pedestrian light poles/fixtures in compliance with the
code regulations.
j. Delineate on the plan with a labeled symbol the location of the
parking spaces that use a portion of the landscaped area as part of
the parking space. Also provide a dimensioned detail drawing for
this type of parking space.

2. Submit for review the required landscape plans for the project. Show, label and
dimension on the landscape plan the location of the easements of record as
show on the recorded plat. Where applicable, the plant list and landscape plan
shall delineate with symbols and notes the landscaping material provided for the
following landscape elements of the site:
a. landscape material required by the landscape code;
b. landscape material approved for the greenbelt;
c. landscape material required by a development order;
d. landscape material required for lake areas;
e. landscape material required for rights-of-way;
f. landscape material required for the tree preservation ordinance and
g. additional landscape material provided by the applicant
3. To remain consistent with the square footage of the project that was approved
with the master plan and site plan reduce the square footage of Major #5 (Bed,
Bath & Beyond) from 41,332 to 41,011. The total gross leasable floor area
shall not exceed 213,650 square feet.
4. Modify the declaration and covenants to include the following:
a. Remove the site plan shown as Exhibit "B" and replace with the site plan
approved by the city commission on October 15, 1996.
b. Omit from the document all reference regarding the landscape area
identified in Exhibit "E". This off-site easement shall not relief the
applicant from providing the required 1 0 foot wide greenbelt on the subject
property.
c. Add to the declaration and covenants language that includes reference to
the off-site drainage agreement. This reference is required if the off-site
drainage is allowed per the city code.
5. The drainage plans indicate an increase in the size and location of storm water
retention area(s) from the master plan. Amend the master plan to show the off-
site drainage. This off-site drainage shall be landscaped with littoral zone
plantings and additional landscaping (towards greenbelt requirement) as per the
landscape sketch received by Joe Lelonek. Drainage easement agreement and
plans shall be modified to .note that off-site drainage is temporary and may be
required by the city to be removed when the property is developed and that no
grandfathering of the off-site retention will be granted when the property is
developed.
6. Through discussion with the applicant and agent it is understood that the permit
plans may not resemble the approved plat drawings, master plan or site plan, if
this is the case the process the applicant will follow to make the changes will be
evaluated consistent with the City Code Chapter 4 - Site Plan Review, Section 9.
7. To complete the plat submittal transmit a copy of the Health Department and City
Utility Department approved water and sewer plans.

It is our understanding that the developer will be allowed to meet our criteria for
tree species within utilities easements, thereby addressing item 1 of our previous
memo. Given that understanding, please be advised that all conditions of our
memo no. 97-023 have been met, with the exception of item 2 regarding the
Department of Health permits. In discussing this matter with Dutch Holland of
the Health Department on Wednesday March 26, my staff was informed that
newly revised plans had been submitted to his office the previous day, and he did
not expect issuance of the permit before Monday, March 31. We have not yet
received the revised plans, but expect to with our copy of the permit. Although
the revisions are reported to be minor in scope, at this time we do not have either
the permits or revised plans in our possession.
We will advise your office when said plans and permits are received, so that the
project can proceed.

Please be advised of the following comments regarding the second review of the
above-referenced request:
1. Extend the 10 foot wide peripheral greenbelt area to all sides of the subject plat
with the exception of the 269.64' portion of the south property line that touches
Winchester Park Boulevard. [Land Development Regulations, Chapter 2 - Zoning,
Section 6. F. 7. f,]
2. To avoid a conflict with the location of the approved peripheral greenbelt
landscape material encroaching into easements, it is recommended that either all
utility easements be moved outside of the peripheral greenbelt area (buffer
easement) or the peripheral greenbelt area (buffer easement) be moved outside of
the utility easements, more specifically north and east property lines, or provide
written verification from all utility users that the peripheral greenbelt landscaping
approved for the project can be installed. [Plat note found on the front page of the
plat]
3. To properly determine the required setbacks in compliance with the master plan
indicate with a symbol and note, on the plat, that the Congress Avenue frontage of
the PCD is the front of the property, [Land Development Regulations, Chapter 2 -

7. To be consistent with the references on the plat for extinguishing the ingress/egress
easements submit a completed abandonment application to the Planning and
Zoning Department. It is recommended that the if the proposed property does not
want the easements that they be omitted with plat request.
8. The site plan as shown on Exhibit liB" with the declaration and covenants for the
project does match the approved site plan. Correct the exhibit accordingly.
Considering that the subject property is under one ownership it is recommended
that the proposed declaration and covenants be omitted from the request.
9. To remain consistent with the square footage of the project that was approved with
the master plan and site plan reduce the square footage of Major #5 (Bed, Bath &
Beyond) from 41,332 to 41,011.

1 . Modify the master plan to reflect compliance with the conditions of approval for the
most recent rezoning (file number REZN 96-001). The conditions of approval were
documented by the City Attorney's office and are dated August 20, 1996. The
rectified master plan shall receive unconditional sign-off by the Technical Review
Committee (TRC) prior to plat approval.

2. Extend the 10 foot wide peripheral greenbelt area to all sides of the subject plat
with the exception of the 269.64' portion of the south property line that touches
Winchester Park Boulevard. [Land Development Regulations, Chapter 2 - Zoning,

To avoid a conflict with the location of the approved peripheral greenbelt
landscape material encroaching into easements, move all utility easements outside
of the peripheral greenbelt area, more specifically north property line, or provide
written verification from all utility users that the peripheral greenbelt landscaping

To properly determine the required setbacks in compliance with the master plan
indicate with a symbol and note, on the plat, that the Congress Avenue frontage of
the PCD is the front of the property. [Land Development Regulations, Chapter 2 -
Zoning, Section 6. F, 7. e.]
6. Considering that the configuration of the site depicted on the submitted paving and
drainage plans does not match the approved master plan, modify the paving &
drainage drawings to include the following data to ensure the plan is in compliance
with the city code of ordinances.

Chronologically number the parking spaces depicted on the plan.
Show parking space computations indicating the number of regular
and handicapped parking spaces required for the area specified on
the plan using the ratio of one (1) space for each two hundred (200)
square feet of gross leasable floor area.
Show parking space computations indicating the number of regular
and handicapped parking spaces provided on the site.
Show on the plans no less than the required number of regular and
handicapped parking spaces.
Delineate with a labeled symbol the location of the nine (9) required

Restrictions and Protective Covenants

As per your request (referenced in your Memorandum dated February 18, 1997),
please ensure that the form of the above-referenced document includes language that
indicates that the contents of the document and any modification or amendment to the
document will not override laws or regulations of the City of Boynton Beach Code of
Ordinances or conditions of any Development Order issued by the City. The following
issues were observed in reviewing the document:
a. The document references several exhibits as back-up to the contents of
the document. These exhibits are pertinent to the acceptance of the
document and shall be submitted.
b. The document does not reference the off-site drainage area that is
located on the south side of Old Boynton Road west of Winchester
Boulevard. The drainage area is integral to the function of the project.
The document shall reference the drainage area and describe that the
P .O.A. is the entity responsible for the perpetual maintenance of the area.
The location, ownership and size of the drainage area shall be shown
and described in an exhibit.
With reference to the letter to you from Alan Pellingra, dated February 13, 1997, to
James Cherof, only item number 1 relates to the Planning and Zoning Department.
Item number 1 regarding unified control document (not unified title documents as
identified in the letter) was a comment generated by the Planning and Zoning
Department because the applicant did not provide the document in 1995 at the time the
applicant was requesting the original rezoning of the property from Community
Commercial (C-3) to Planned Commercial Development (PCD), as required by the
zoning code section 6. F. 3 (pages 2-53 and 2-54 of Chapter 2 - Zoning of the Land
Development Regulations). However, if the above-referenced document meets the
code section, then item 1 identified in the letter from Mr. Pellingra and our staff
comment number 44 identified in Development Order issued by your office on August
20, 1996, regarding the master plan associated with the recent rezoning (Ordinance
No. 96-64) will be complied with and omitted from our comments.

Boynton Commons - Final Plat Review
The applicant has not adequately addressed any of our review comments from the previous
submittal. We therefore repeat those comments for their convenience.
1) Palm trees will be the only tree species allowed within utilities easements, especially the
existing easement along Congress Avenue. Canopy trees may be planted outside of the
easement so that roots and branches will not impact those utilities within the easement in the
foreseeable future.(Sec. 7.5-18.1)
2) Dept. of Health permits will be required for the water and sewer systems servmg this
project.(Sec. 26-12)
3) Fire t10w calculations will be required demonstrating the City Code requirement of 1500
g.p.m, (LDR chap, 6, Art. J Sec. 16), or the requirement imposed by insurance underwriters,
whichever is greater. (Sec. 26-16(a))
4) Water meter sizes are smaller than normally installed for the service line size specified.
Please provide engineering calculations, or an explanation of why the service lines are over-
sized.(Sec. 26-16(c))
5) Capacity reservation fee will be due for this project upon my request for signature on the
Health Dept. application forms. This fee will be determined based upon final meter size, (Sec.
26-34(E))
6) Water meters and services shall be included within utilities easements. Off-site utilities
shall also be shown in an easement on the engineering drawings, the easement to be dedicated
via separate instrument to the City.(Sec. 26-33(a))
7) This office will not require surety for installation of the water and sewer utilities, on
condition that the systems be fully completed, and given to the City before the first permanent
meter is set. Note that setting of a permanent water meter is a prerequisite to obtaining the
certificate of occupancy.
We recommend the project not proceed at this time. As you know, Health Department
permits are required prior to the finalization of a Plat. This item alone is sufficient cause to
delay Plat approval. In addition, this office has not yet approved the engineering plans for the
water and sewer systems serving this project.

Re: Boynton Commons PCD - Preliminary Plat Review
Gentlemen:
We have forwarded the documents recently submitted to this office to the various City
Departments expected to review the eventual final plat. Their comments were as follows:
General Comment - All comments and recommendations previously made including, but
not limited to, two Development Orders issued on August 20, 1996 and two Development
Orders issued October 15, 1996 must be complied with.
F ire Department
1. The fire flow requirement is either 1500 g.p.m. or the Insurance Underwriters
requirement which ever is higher.
Police Department
1. I have reviewed the proposed plans. I have concerns regarding the ingress/egress
on Old Boynton Road. Even though it now accommodates a 100' throat, there are
still serious traffic flow concerns. There is a lot of traffic "cross-over" (large
trucks to enter loading zone, sanitation trucks to block drive when making pick-
up, and cars making wide turns from the north side of Walgreens to exit the
property, and cars exiting this area during any of the aforementioned events.)
This is not an ideal design and I do NOT recommend approval of these plans.
Planning and Zoning Department
1. Modify the master plan to reflect compliance with the conditions of approval for
the most recent rezoning (file number REZN 96-001). The conditions of approval
were documented by the City Attorney's office and are dated August 20, 1996.
The rectified master plan shall received unconditional sign-off by the TRC prior to
plat approval.
2. On the cover sheet change the word "buffer" to "peripheral greenbelt easement".
Also change the text on the plat drawings from "buffer easement" to peripheral
greenbelt easement".

3. Extend the 10 foot wide peripheral greenbelt area to all sides of the subject plat
(last page of the plat drawings) with the exception of the 269.64' portion of the
south property line that touches Winchester Park Boulevard.
4. To avoid a conflict with landscape material encroaching into easements, move all
utility easements outside of the peripheral greenbelt area or verify that the
peripheral greenbelt landscaping approved for the project can be installed.
5. It is recommended that surveyor's notes be added to the cover page of the plat
drawings. The notes shall include text regarding restrictions with respect to
structures and landscaping being located within easements. A note shall include
text specifying that the proj ects building and site regulations shall be consistent
with the City of Boynton Beach Code of Ordinances.
6. Place a statement on the cover page of the plat indicating that the plat boundary is
consistent with the legal description identified in Ordinance 95-42. Correct the
documents accordingly.
7. Amend the infrastructure (paving & drainage and water & sewer) drawings to
show the approved configuration of the driveway located on Old Boynton Road.
Utilities Department
1. Palm trees will be the only tree species allowed within utility easements, especially
the existing easement along Congress A venue. Canopy trees may be planted
outside of the easement so that roots and branches will not impact those utilities
within the easement in the foreseeable future. (Sec.7.5-I8.1)
2. Dept. of HRS permits will be required for the water and sewer systems serving this
project.
3. Fire flow calculations will be required demonstrating the City Code requirement of
1500 g.p.m. (LDR Chap.6. Art.IV. Sec.I6), or the requirement imposed by
insurance underwriters, whichever is greater.
4. Water meter sizes are smaller than normally installed for the service line size
specified. Please provide engineering calculations, or an explanation of why the
service lines are over-sized.
5. Capacity reservation fee will be due for this project upon my request for signature
on the HRS application forms. This fee will be determined based upon final meter
size. (Sec.26-34(E)
6. Water meters and services shall be included within utility easements. Off-site
utilities shall also be shown in an easement on the engineering drawing, the
easement to be dedicated via separate instrument to the City.
7. This office will not require surety for installation of the water and sewer utilities,
on condition that the systems be fully completed. and given to the City before the
first permanent meter is set. Note that setting of a permanent water meter is a
prerequisite to obtaining the certificate of occupancy.

1. To provide for safe interior circulation of vehicle traffic exiting Walgreen's
property, a stop sign should be installed. Chap.23, Art.l, Sec. 1 and Art.II,B of the
LDR.
2. Landscaping at entrance driveway should be provided such that reasonable sight of
oncoming vehicles is maintained from the Walgreen's point of egress. Chap.23,
Art.I1,I and Chap.7.5, Art.lIl, Sec.8A4 of the LDR.
3. Sufficient lighting should be provided in this immediate area to facilitate traffic
safety under evening conditions. Chap.23, Art.I1, A of the LDR.
Engineering Division
I . Revise documents to reflect all comments.
2. Provide proof of unity of title, including off site retention area
3. Specify on dedication sheet the number of acres in the parcel.
4. Correct "key maps" to reflect 3 sheets of plat instead of 4.
5. On sheets 2 & 3 specify the types of easements shown.
6. Final plat shall reflect recorded book & page of each abandonment.
7. Add the words "P.C.D." to the title.
8. Provide a dedication on the plat identifying the entity responsible for the
continuing operation and maintenance of areas, functions and facilities of the
P.C.D. Chap.2, Sec.6F3b, pg.2-54
9. Planned Commercial Developments are subject to development consistent with
Chapters 5 & 6 of the LDR. Chap.2, Sec.6FI2a, pg.2-58
10. No building permits shall be issued unless and until platting procedures and the
requirements outlined in Chap. 5 of the LDR are completed in every respect.

11. Provide a statement that all utilities are available and will be provided by

ARTICLE XI
LANDSCAPE EASEMENT
11.1 Landscape Easement. The Partnership hereby grants to the
Responsible Party, its successors and assigns, a perpetual non-
exclusive easement appurtenant to and for the benefit of the
Property over, across, under and through the Easement Property for
purposes of planting, installing, maintaining, replacing and
renewing, at the Responsible Party's expense, a landscape buffer
for use by the Property (the "Landscape Buffer") .
11.2 Installation and Planting of Landscape Buffer. The
Responsible Party shall, at its sole cost and expense, cause to be
planted and installed all plants, shrubs and other materials
comprising the Landscape Buffer. The Responsible Party shall be
responsible for repairing any damage done to the Partnership
Property in connection with planting and installing the Landscape
Buffer. The Landscape Buffer will be installed and planted
strictly in accordance with the requirements of applicable laws,
rules, codes, ordinances and other requirements of governmental
entities.
11.3 Conditions to Commencing Installation. Prior to the
planting and installation of the Landscape Buffer, the Responsible
Party shall deliver to the Partnership (i) certificates of
insurance and copies of applicable policies providing comprehensive
general liability coverage in an amount of not less than One
Million Dollars ($1,000,000.00) and with a deductible of not less
than Ten Thousand Dollars ($10,000.00) naming the Partnership, as
an additional insured, which certificates and policies shall
include provisions and provide coverage reasonably acceptable to
the Partnership; (ii) a copy of the Contract for the installation
of the Landscape Buffer, which will only be for the installation of
the Landscape Buffer on the Easement Property and for no other
facilities or improvements including the Shopping Center to be
constructed by the Responsible Party on the Property; (iii) a copy
of the Notice of Commencement recorded in the Public Records of
Palm Beach County, Florida, but only after having first obtained
from the Partnership the prior approval of the proposed Notice of
Commencement, which Notice of Commencement shall describe the
property to be improved as the easement rights of the Responsible
Party in the Easement Property and shall describe the improvements
to be made as the Landscape Buffer, and evidence that the recorded
Notice of Commencement has been posted on the Easement Property in
accordance with applicable law; (iv) a written statement from any
person or entity, contractor, subcontractor, laborer or material
supplier who has performed work or rendered services or provide
labor or materials, in conjunction with the installation of the
Landscape Buffer acknowledging that such person or entity shall
look solely to the Responsible Party and its easement interest in
the Easement Property for payment in conjunction with such work and
