DESCRIPTION: Land Design South, agent for Bill and Elsie Winchester, property owner, is requesting a variance to the City of Boynton Beach Land Development Regulations, Chapter 23 - Parking Lots, Article II, Paragraph H - Driveways, Subsection 5, Clearance at major driveways, to reduce the required distance of the interior access aisle to the driveway on Old Boynton Road from 100 feet to 65 feet. The PCD zoned property, to be known as Boynton Commons, is located t the southwest corner of Congress Avenue and Old Boynton Road. RECOMMENDATION: At the October 8, 1996 Planning and Development Board meeting, and the October 15, 1996 City Commission meeting, this hearing was postponed at the request of the applicant to redesign the driveway off of Old Boynton Road. Since those meetings, the applicant has submitted two different driveway designs. The second driveway design goes before the Technical Review Committee on November 19, 1996. If this second design is acceptable to staff, the variance will be withdrawn by the applicant. However, until that happens this already advertised public hearing needs to be continued to the December 3, 1996 City Commission meeting, and announced as such. Haag Current Planning Coordinator DATE: October 2, 1996 SUBJECT: Boynton Commons PCD - PKLV 96-005 Parking Lot Variance (length of major driveway access aisle) NATURE OF REQUEST Chapter 23 - Parking Lots, Article I, Paragraph 3.B.3.d. of the City of Boynton Beach Land Development Regulations, requires that when a variance to the parking lot regulations is requested, the Technical Review Committee (TRC) must forward to the City Commission a recommendation that is to be made part of the public record. This change in parking lot variance procedure requiring Commission action only became effective with the 1995 adoption of unified land development regulations. Although, Planning and Development Board action is not required, in cases where review by the Board will not lengthen the approval process (such as this request), the Commission is desirous of receiving the Board's recommendation. Land Design South, agent for Boynton Commons Corporation, contract purchaser of the land to be developed as Boynton Commons, is requesting a variance to the City of Boynton Beach Land Development Regulations, Chapter 23 - Parking Lots, Article II, Paragraph H - Driveways, Subsection 5. H. 5. "Clearance at major driveways. The minimum distance from the street right-of-way line at any major ingress or egress driveway to any parking stall or to any interior access aisle having direct access to such driveway shall be one hundred (100) feet." Boynton Commons is located at the southwest corner of Congress Avenue and Old Boynton Road (see Exhibit "A" - location map and Exhibit "B" - proposed site plan). BACKGROUND This request is being processed in connection with an application for site plan approval for the Boynton Commons, Planned Commercial District (PCD), retail center. The variance request is to allow the clearance distance to the closest interior access aisle at the major driveway located on Old Boynton Road to be 65 feet, rather than the code required 100 feet. Therefore, the length of the driveway access aisle between the south side of the Old Boynton right-of-way line and the adjacent interior access aisle having direct access to the driveway aisle will be reduced 35 feet from the required 100 foot distance. The subject driveway is a one-way, right turn in only driveway, rather than a right turn in and right turn out only driveway that was associated with an August 20, 1996 parking lot variance for this same area of the site and section of the code (file number PKL V 96-003). This variance voids the previous variance which was processed concurrently with an application for a I Page 2 Memorandum No. 96-501 Boynton Commons PCD PKLV 96-005 substantial modification to the Boynton Commons PCD master plan (rezoning), file number REZN 96-001 also approved on August 20, 1996. Other modifications to the master plan depicted on the proposed site plan include a reconfiguration of the northwest building. This reconfiguration of the building required a change to the layout of the vehicle use area located on the north side of the building, causing the omission of an access aisle connection which allowed vehicles to circle the building (see attached Exhibit "C" - approved master plan; approval conditions not yet reflected on this plan). ANALYSIS A copy of the parking lot variance application submitted by the applicant has been provided in Exhibit "D". It includes the applicant's statement of justification. On Tuesday, September 24,1996, the Technical Review Committee (TRC) reviewed the plans and documents submitted (see Exhibit "B" - proposed site plan delineating the proposed major access aisle driveway). The committee raised the following safety issues regarding traffic flow where the in-only driveway aisle intersects the interior access aisle: 1. At the northwest corner of the north parking area located on the north side of the Walgreens building east bound traffic needs to be precluded from entering the parking area by reducing the width of the access aisle opening to 15 feet wide, shaping it with a south bound radius similar to the drive-thru exit and placing "Do Not Enter" signs facing traffic traveling east and southeast from the Old Boynton Road driveway. 2. Change the traffic flow along the north side of the Walgreens building from two-way to two lanes south bound. 3. Reposition the dumpster located on the west side of the Walgreens tenant space to allow the approach from the north rather than from the south side. 4. Move the dumpster enclosure to the south, as far as possible, to allow a longer stacking area behind the sanitation vehicle servicing the dumpster from the north. RECOMMENDATION The TRC recommends approval of the variance request as depicted on Exhibit "B", subject to the recommendations above. The attached Exhibit "E" enumerates all conditions of approval recommended by staff and other comments related to the driveway variance.
