RECOMMENDATION: Please place the request below on the August 19, 1997 City Commission meeting agenda under
Consent. The Planning and Development Board, with a 7-0 vote, denied the request of a Community Design Plan appeal to
allow a canvas dumpster enclosure. For further details pertaining to this request, see attached Planning and Zoning
Memorandum No. 97-411. Also, the applicant is requesting postponement of the Commission's ratification of the Planning
and Development Board's action so that he can make a presentation before the Commission (see attached letter). Therefore,
if the Commission determines that the postponement is warranted, this item should be pulled off the consent agenda to be
discussed under "Development Plans" at the September 2, 1997 City Commission meeting.

Comments:
1. If the appeal is granted, it is recommended that the sides of the dumpster
shall be protected by additional structures (such as a heavy duty steel frame,
concrete or steel bollards, etc.) and appropriately landscaped. A letter from
the property owner releasing the city from any liability of damage (to either
the canvas, or structural framing) caused by city sanitation vehicles is
required prior to issuance of a building permit.
