Heyden, AICP Planning and Zoning Director FROM: Jerzy Lewicki -\ L-- Acting Senior Plann~ DATE: August 8,1997 SUBJECT: Boynton Beach Mobile Village - CDPA 97-003 (canvas dumpster enclosure) NATURE OF REQUEST Bob Brown, partner of Spillane Brown Development Co., owner of the Boynton Beach Mobile Village, located between N.E. 4th Street, and the FEC Railroad right-of-way and approximately 800 feet south of Gateway Boulevard (see Exhibit "A" - Location Map), is requesting approval of a Community Design Plan appeal to allow a canvas dumpster enclosure. The proposed enclosure is shown on the site plan and construction sketch in Exhibit "B". BACKGROUND Currently, the on-site dumpster does not contain enclosures. There is an existing concrete pad, west of the pump house. The unenclosed dumpster is "grandfathered in", as the Boynton Beach Mobile Village was constructed prior to enactment of Chapter 9 - Community Design Plan of the City of Boynton Beach Land Development Regulations. The property owner wishes to construct screening of the dumpster, but not of the type required by code (see Exhibit "C" - Letter of Request). / Page 2 Memorandum No. 97-411 Boynton Beach Mobile Village ADAP 97-003 ANALYSIS Chapter 9 - Community Design Plan, Section 10.C.3 states the following: "All dumpsters and recycling receptacles shall be screened from public view with a six (6) foot high, concrete block stuccoed wall. Such enclosure openings shall have gates. " The proposed canvas dumpster enclosure does not meet the above with respect to: . permanent masonry material (proposed canvas instead of required stuccoed concrete block) . height of the enclosure (proposed 9 feet instead of required 6 feet). The canvas material is not considered a permanent building material. It has a tendency to deteriorate quickly and fade when exposed to sunlight and cannot withstand strong wind. Severe weather conditions associated with frequent hurricane or tropical storm occurrences in Florida, in conjunction with the limited durability of canvas may cause the proposed enclosure to be a hazard to adjacent properties. RECOMMENDATIONS Based on the above issues that suggest that canvas is not a viable alternative to masonry, staff recommends denial of this request. THE PROPERTY WAS IN NEED OF A MAJOR FACE LIFf, AND SINCE JANUARY OF TIllS YEAR MUCH EFFORT AND MONEY HAS BEEN PUT BACK INTO THE PROPERTY TO UP-GRADE THE APPEARANCE AND ENHANCE THE DRIVE BY LOOK, AS SOME OF THE OTHER PROPERTY OWNERS IN THE AREA HAVE DONE. A NEW SIGNAGE PROGRAM AND FRONT FENCING IS PLANNED FOR TIllS SUMMER THE RESIDENTS OF THE VILLAGE ARE QUITE HAPPy WITH WHAT IS BEING DONE, ESPECIALLY SINCE THE OWNERS ARE PERFORMING THE LANDSCAPING DUTIES. WE WANTED THE PARK TO "ALL" LOOK NICE AT THE SAME TIME. INTERNALLY, THE TRASH DUMPSTER AREA WAS ADJACENT TO THE CLUB HOUSE, CENTRALLY LOCATED, BUT QUITE VISABLE FROM ANY DIRECTION. WE FILED AN APPLICATION , VOLUNTARILY, WITH THE CITY TO PLACE AN ENCLOSURE AROUND THE TWO(2) DUMPSTERS, MAINTAINING THE DUMPSTER SITE(pAD) THAT PRESENlL Y EXISTS. TO BElTER F AClLIT ATE OUR MORE ELDERLY RESIDENTS, NEW "SIDE LOAD" DUMPSTERS WERE BROUGHT IN, AND WE INVESTED IN HAVING STEEL ROLLERS WELDED TO THE BOTIOMS TO ENABLE US TO PUSH THE DUMPSTERS OUT OF THE ENCLOSURE FOR "LESS DESTRUCTIVE" PICK-UPS. THE PLAN CALLS FOR A STURDY STEEL FRAME, A LACED, GREEN HEAVY AWNING MATERIAL ON THREE SIDES, AND TWO GATES TO CLOSE OFF, VISUALLY, THE FORTH SIDE. NOW TO THE APPEAL; WE WISH TO APPEAL THE CODE COMPLIANCE, CEMENT BLOCK ENCLOSURE, THAT HAS NOW BEEN APPLIED TO OUR PERMIT APPROVAL. THE ENCLOSURE OF THE DUMPSTER IS STRICTLY VOLUNTARY, AN ENHANCEMENT OF AN OTHERWISE, UNSITEL Y AREA IN THE CENTER OF OUR COMMUNITY.
