We've traded some phone calls regarding the subject project. The Bu~ding
Depaiment suggested that we coordinate a bu!lding color matter with you.
After the project architects saw a larger semple of the color approved for the
buildings. they te~ it was too bold. They have used a more subtle tone of the same
color on other projects here in south Aorldaand they find it to be much more
aestheticany pleasing. They would like to do the same for this project. In fact some
of the buildings are already painted with the desired cofor.
If you would like, I con helle the architect send you color sample5 for your file.
Please let me know as soen as possible if we need to provide you with any
additional information. Unless we hear othervvise in the next few days, we will
proceed using the new color tone.

Wall Requirements along South Property Line
Dear Tambri:
This letter is to confirm our brief discussions last evening. Based on the City Attorney's interpretation
of the Stipulation Agreement, I understand the following:
1 . The above referenced project will be required to construct a 6 foot high solid wall
along the south property line. This wall will replace the berm and landscaping as
shown on the Landscape Plan of our Site Plan application and agreed to upon
request of the Goltview Harbour Home Owners Association.
2. The Grand Park ALF project to the east has already committed to constructing a
wall along their south property line.
3. The wall can be shown on a revised Site Plan submitted with the building permit
plans.
4. To reverse the City Attorney's interpretation, the Stipulation Agreement would need
to be revised by going back to the court.
Building permit plans are being finalized and will be submitted shortly. By copy of this letter, I will
advise my client and project consultants to proceed according to the above understanding.
Please call me if I have misunderstood how we should be proceeding.

Dear Ms. Heyden:
The Palm Beach County Traffic Division has reviewed the trip
generation information for the project entitled ARC at Boynton Beach,
pursuant to the Traffic Performance Standards in Article 15 of the Palm
Beach County Land Development Code. The project is identified in
your transmittal letter as being on the southwe orner of Congress
Avenue and S.W. 23rd Avenue (Golf Road). The oposed project
consists of 91 ACLF units. The project is reported by C les Putman
& Associates to be exempt from concurrency requirements. ~.....-~
I have reviewed the list of Previous Approval determinations from th~ fu...,...e
City. There is a project identified as Alhambra Square South that is JoeA-
located in a Traffic Analysis Zone 494 (TAl). This would correspond to S\;;:
the southeast corner of Congress Avenue and Golf Road. It wa~\
approved for 248 ACLF units. There does not appear to be any vacan ~
land on the sduthwest corner of Congress Avenue and Golf Road. I <
assume that ARC at Boynton Beach is the same site as Alhambra
Square South, and this is the basis of Charles Putman's statement
regarding concurre(lcy exemption. Please confirm that ARC at Boynton
Beach is the Alhambra Square South site and that the development -~~;4

Dear Ms. Heyden:
At our regularly scheduled board meeting on July 21"\ 1997. Mr. Bradley Miller of Charles
Putnam & Associates met with our board and represent the proposed assisted living
project at the southeast corner of Congress Avenue and SW 23rd Avenue. The purpose of
the meeting was to familiarize our board with the project and to discuss the landscaped
buffer along the south property line. It was agreed upon by the board that in lieu of a wall
which was a stipulation in the agreement, that a combination berm and landscaping
approach is more desirable to buffer the Golfview Harbour Eatates community.
The type of buffer and landscaping discussed was as follows:
An undulating berm approximately 3 to 4 feet in height.
A hedge installed at 2 feet on center at a height of 2 feet to be maintained at a
minimum of 3 feet.
Canopy trees (such as live oak, mahogany, etc.) to be installed at a minimum of one
for every 30 linear feet at varying heights of 8 to 14 feet. (In no event to be less than
30 trees)
We understand that the landscape buffer is a condition of a stipulation agreement with the
City of Boynton Beach for the subject property. This letter serves as our approval for both
the Site Plan and the landscape buffer pursuant to the above minimum criteria and shall
replace our previous letter of July 23rd, 1997.

Dear Ms. Heyden:
The Palm Beach County Traffic Division has reviewed the trip
generation information for the project entitled ARC at Boynton Beach,
pursuant to the Traffic Performance Standards in Article 15 of the Palm
Beach County Land Development Code. The project is identified in
your transmittal letter as being on the southwest corner of Congress
Avenue and S.W. 23rd Avenue (Golf Road). The proposed project
consists of 91 ACLF units. The project is reported by Charles Putman
& Associates to be exempt from concurrency requirements.
I have reviewed the list of Previous Approval determinations from the
City. There is a project identified as Alhambra Square South that is
located in a Traffic Analysis Zone 494 (TAZ). This would correspond to
the southeast corner of Congress Avenue and Golf Road. It was
approved for 248 ACLF units. There does not appear to be any vacant
land on the southwest corner of Congress Avenue and Golf Road. I
assume that ARC at Boynton Beach is the same site as Alhambra
Square South, and this is the basis of Charles Putman's statement
regarding concurrency exemption. Please confirm that ARC at Boynton
Beach is the Alhambra Square South site and that the development
order is still valid. If it is, we also need to know if the 91 ACLF units will
use the entire site, or if there may be additional units at a later time.
This information is needed for our concurrency management system.

Please be advised,that at a meeting in early June 1997, at
Boynton Lei~ureville, we met with the Arvida Development
Corpo~ation concerning the lot on Woolbright Road and the
B-26 Canal.
At that time, the plans for the development were presented to
the Community, and to all the people who abut the project.
We were very well satisfied with the two medical office
buildings that they proposed to put in there, and the fact
they are going to be two stories hiqh. I understand that
there may be something in the previous agreement with the
City, and Mr. Jangoli, fro~ Lawrenceville, New Jersey about
one story height limit only. Again, I wish to reiterate,
that the Board of Directors, and the people abuttinq the
project, have no problem with the buildings being ~wo stories
high.

Dear Ms. Heyden:
At our regularly scheduled board meeting on July 21, 1997, Mr. Bradley Miller of Charles Putnam
& Associates met with our board and presented the proposed assisted living project at the southeast
corner of Congress Avenue and SW 23rd Avenue. The purpose of the meeting was to familiarize our
board with the project and to discuss the landscaped buffer along the south property line. It was
agreed upon by the board that in lieu of a wall which was a stipulation in the agreement, that a
combination berm and landscaping approach is more desirable to buffer the Golfview Harbour Estates
community. The type of buffer and landscaping discussed was as follows:
an undulating berm approximately 3 to 4 feet in height;
a hedge installed at 2 feet on center at a height of 2 feet to be maintained at a minimum of 3
feet;
canopy trees (such as live oak, mahogany, etc.) to be installed at a minimum of 1 for every
30 linear feet at varying heights of8 to 14 feet. (In no event to be less than 30 trees)
We understand that the landscape buffer is a condition of a stipulation of agreement for the subject
property. This letter serves as our approval of the landscape buffer pursuant to the above minimum
criteria.

The subject project proposes the development of a ninety-one (91) unit (93 bed) Adult
Congregate (assisted) Living Facility (ACLF). Based upon Palm Beach County traffic
generation rates, this type of use generates 2.145 trips per day per unit. Therefore, the proposed
project is anticipated to generate approximately 196 trips per day.
91 units x 2.145 trips/day/unit = 196 trips/day
In addition, this project is exempt from concurrency requirements as indicated in the
attached June 23, 1995 letter from Michael Rumpf, Senior Planner of the City of Boynton
Beach.

This meeting was held to introduce the proposed ARC Assisted Living facility in Boynton Beach to the Planning
and Zoning staff within the city, as well as to determine the review process required for this facility.
· After briefly introducing the proposed projects conceptual site plan, Mr. Haag informed us that this project
would require a 2 step review process with approximately 20 days between 1st submittal and receipt of
formal comments from staff (preliminary comments would likely be available beforehand). From receipt of
comments, the design team would have approximately 8-10 days to respond to comments and resubmit.
Based on the cities current review schedule, site plan would be required to be submitted by May 29th in
order to be approved by the city commission by August 19th ( the soonest we could feasibly get approval
for this project).
. The city is currently revising its schedule for site plan review based on some changes that the city manager
is making. Because of this, Mr. Haag can only commit to the end date of the above outlined process.
Since the new process has not been fully developed, Mr. Haag suggested that if we submitted our plan by
May 15th, we could still expect final approval by August 19th, and suggested that if we want to meet that
end date, we should submit our plan for review by May 15th (see attached site plan review application for
specific requirements).
. Mr. Haag suggested that even though assisted living is listed as a conditional use in the R-3 zone, it may not
require conditional use application. This is due to a 1991 stipulation and settlement agreement between
the City and property owner, which allows this site to be developed as a 248 unit ACLF. Mr. Haag will
check with Tambri Heyden, department head of Planning and Zoning to confirm whether this will be
required.
. Access to property should be easier to achieve from SW 23rd Avenue. The city of Boynton Beach
requires a curb cut be a minimum of 180' from the intersection of Congress and SW 23rd Avenues. A
curb cut on Congress would be difficult given that Congress is a D.O.T. regulated road, which would
require a distance of greater than the 335' frontage from the intersection to any proposed curb cut.

· Mr. Haag suggested that the design team might want to try to meet with members of the technical review
committee within the various city departments to get some preliminary feedback prior to the 1 st site plan
submittal. Specifically, utilities and fire issues should try to be addressed as early as possible. Bradley and
Matt will try to address ASAP.
· The City of Boynton Beach will allow the site plan review process and the plan review process to run
simultaneously. However, until the site plan is approved, the building plans review will only be considered
a preliminary review. Upon site plan approval, care must be taken to make sure this process is converted
to a final review process. Based on concurrent schedules, a building permit could be pulled approximately
2-3 weeks after site plan approval.
· Building setbacks in the R3 district will be:
Front & Rear - 40'
Sides - 20'
Since the property is on a corner, the design team should select one street as the front and
label the site plan accordingly.

Dear Tambri:
Attached herein are twelve sets of a site plan application package and the $750 application
fee for a proposed assisted living facility at the southeast comer of Congress Avenue and SW 23RD
Street (Golf Road). In 1989 this property was subject to a settlement and stipulation agreement
between the property owner and the City of Boynton Beach of which a copy is attached for your
reference. The agreement allows for the development of 248 ACLF units on a 9.32 acre parcel
of land. The subject application proposes the development of 91 assisted living units on
approximately half of the property or 4.622 acres. The project has been designed to be consistent
with the stipulated conditions within the agreement.
