Please see the attached letter received by the property owners adjacent to the proposed ARC at Boynton
Beach project (scheduled for Planning and Development Board review of the site plan on August 12,
1997). This property was formerly known as Alhambra Square South of the 1990 Milnor settlement
agreement. The property owners are requesting changes to the screening requirements set forth in the
settlement agreement. In the C-l zoning district (the zoning of the subject property), the code allows a
wall to be replaced with a dense vegetative buffer of at least two feet in height at time of planting.
Therefore, if you are going to forward to the Commission on August 5, I 997 (or any other time) a
proposal to change the Milnor agreement for Alhambra Square North (now know as Walgreen's), it
might be advisable to combine the requested changes for Alhambra Square South.

Dear Ms. Heyden:
At our regularly scheduled board meeting on July 21, 1997, Mr. Bradley Miller of Charles Putnam
& Associates met with our board and presented the proposed assisted living project at the southeast
comer of Congress Avenue and SW 23rd Avenue. The purpose of the meeting was to familiarize our
board with the project and to discuss the landscaped buffer along the south property line. It was
agreed upon by the board that in lieu of a wall which was a stipulation in the agreement, that a
combination berm and landscaping approach is more desirable to buffer the Golfview Harbour Estates
community. The type of buffer and landscaping discussed was as follows:
an undulating berm approximately 3 to 4 feet in height;
a hedge installed at 2 feet on center at a height of 2 feet to be maintained at a minimum of 3
feet;
canopy trees (such as live oak, mahogany, etc.) to be installed at a minimum of 1 for every
30 linear feet at varying heights of8 to 14 feet. (In no event to be less than 30 trees)
We understand that the landscape buffer is a condition of a stipulation of agreement for the subject
property. This letter serves as our approval of the landscape buffer pursuant to the above minimum
criteria.

It came to my attention that there was some question regarding the interpretation of units
as it relates to this agreement. On page 2, under Article II Section A(2) the term units is
used synonymously with the term beds. Therefore, this agreement should be interpreted
to mean a maximum of 248 beds are allowed. How those beds are to be distributed
among a 1, 2, or 3 bedroom design is left up to the developer (i.e. 248 one bedroom, 124
two bedrooms or 82 three bedrooms or some combination of the above). Please place this
in the file for future inquires. Thank you.

Staff has reviewed the above referenced project and offer the following comments:
1. Palm Beach Health Department permits will be required, (Sec. 26-12).
2. Proposed connection to existing sanitary sewer main will not allow for minimum
slope as required by HRS/DEP. Utilities requests a meeting with the design
engineer to discuss alternative connection points for proposed water and
sanitary sewer mains.
3. Fire Hydrants shall be within 200' of all points on every commercial building.
Fire flow calculations will be required demonstrating the City Code requirements
of 1500 g.p.m., (LDR chap. 6, Art. IV, Sec. 16).
4. Plan shall specify meter size and location, (Sec. 26.16(c).
5. A Capacity Reservation Fee will be required within thirty (30) days of City
Commission approval, or upon request for my signature on the HRS/DEP
permit applications. The fee amount will be determined based upon meter
size or expected demand, (Sec. 26-34[ED.
6. Only palm trees will be permitted in utility easements, (Sec. 7.5-18.1). Trees
shown in R.O.W. will conflict with a city water main. Please relocate or change
type of tree, (Chapter 22, Art. I, Sec. 7(N).
It is our recommendation that the plan proceed through the review process.

We have reviewed the subject project and have the following comments:
Building Division
I. The code requires that signage be provided for review at time of site plan review, therefore add to the site
plan the location of all site signage i.e., project identification and/or directional signage and where applicable,
add wall sign age to the building elevations. Also provide dimensioned elevation drawings of all signs. The
location and size of all signage shall comply with the applicable sign code regulations. [Chapter 9-Community
Design Plan, Section 10.1.1. and Chapter 21-Sign Code, Article III, Section 5 and Article IV, Section 1.]
Engineering Division
1. Show clearly on survey the date of the recertification. Chapter 4, Section 7 A
2. Provide an Engineer's written certification that the drainage will conform with all rules, regulations and codes,
including but not limited to, Chapter 6, Art.lV, Section 5 of the City's Land Development Regulations.
Chapter 4, Section 7F2
3. Show the required sidewalk along SW 23rd Avenue thru the project including the driveways. Also show the
required traffic control markings and signage and the location of the handicap stalls (recommend at least one
at each building). Chapter 4, Section 7B2
4. Make the site pIan the same scale as the landscape plan or vice versa to satisfy Chapter 4, Section 7Cl.
5. Show proposed locations of parking lot lighting. Chapter 4, Section 7B4
6. All plans submitted for specific permits shall meet the City's code requirements at time of application. These
permits include, but are not limited to the following; site lighting, paving, drainage, curbing, landscaping,
irrigation and traffic control devices. Permits required from agencies such as the FDOT, PBC, SFWMD and
any other permitting agency shall be included with your permit request. Chap. 1, Art.l, Sec.6, par.A, pg.I-3.
Recommendation:
1. Provide a fifteen foot, one way egress road entirely within your site, subject to the City's LDR to
accommodate the Fire and Public Works Departments requirements.
Recommend that plan go forward to Planning & Development Board with one review. Changes can be reviewed
upon permit request.

Staff has reviewed the above referenced project and offer the following comments:
1) Dept. of Health permits will be required for the water and sewer systems serving this
project. (Sec. 26-12)
2) Fire flow calculations will be required demonstrating the City Code requirement of
1500 g.p.m. (LDR chap. 6, Art. Sec. 16), or the requirement imposed by insurance
underwriters, whichever is greater. (Sec. 26-16(a))
3) Water meter sizes are smaller than normally installed for the use specified. Please
provide engineering calculations.
4) A capacity reservation fee will be due for this project upon my request for signature on
the Health Dept. application forms or within 30 days of site plan approval. This fee will be
determined based upon final meter size.(Sec. 26-34(E))
5) Water and sewer lines to be owned and operated by the City shall be included within
utility easements. Please show all proposed easements on the engineering drawings, using a
minimum width of 12 feet. The easements shall be dedicated via separate instrument to the
City. (Sec. 26-33(a))
8) Appropriate backflow pre venters will be required on the domestic water service to the
building, and the fire sprinkler line if there is one.(Sec. 26-207)
9) City water may not be used for irrigation where other sources are readily available.

We recommend approval of the above referenced project subject to the following comments.
Building Division
1. On the Site Plan place a note indicating that the required handicapped accessible path leading
to the entrance of each building from the abutting public right-of-way and the handicapped
parking spaces will be designed and constructed in compliance with the regulations specified
in the Florida Accessibility Code for Building Construction, Section 4.1.2. m (1) thru (4).
Where applicable, specify with notes on the plan the location of the required curb cut ramps.
Also, dimension the width of the accessible path.
2. Where applicable, provide the following information on the Paving and Drainage Plan:
a) Show the location of the handicapped accessible curb cut ramps.
b) Provide a detail drawing of the curb cut ramp(s).
c) Specify the finish grade elevations and/or slope ofthe accessible paths required to each
building from the public right-of-way and the handicapped parking spaces.
d) Identify the finish floor elevation of each building.
Note: All drawings, dimensions, surface finishes, elevations and slopes shall comply
with the regulations specified in the Florida Accessibility Code for Building
Construction, Section 4.1.2.m (1) thru (4).
3. At time of site plan review building and site signage is required to be submitted and reviewed
for compliance with the applicable code regulations. Because the applicant did not provide
the requested detail drawings of the site or building sign age including showing, identifying
and dimensioning the location, size, color, type, style, height or form of illumination, the site
sign shown on the plans at the main entrance to the project shall be removed from the plans.
To clarify the status of the signage for the project place a note on the site plan and each
elevation view drawing of the buildings indicating that the site and building signage will be
approved under a separate site plan review submittal specifically for signage. [Chapter 21 -
Sign Code, Article III, Section 5 and Article IV, Section 1 and Chapter 9 - Community
Design Plan, Section 10.1]
4. Permit plans for the proposed project shall comply with the applicable Building, Energy and
Handicapped Codes. [Chapter 20 - Building, Housing and Construction Regulations[

Building Division
1. On thc Site Plan placc a notc indicating that the required handicapped accessiblc path leading
to the entrancc of each building from the abutting public right-of-way and the handicapped
parking spaccs will be designed and constructed in compliance with the regulations specified
in the Florida Acccssibility Code for Building Construction, Section 4.1.2. ill (1) thru (4).
Whcre applicablc, specify with notes on the plan the location of the required curb cut ramps.
Also, dimension the width of the accessible path.
2. Where applicable, provide the following information on the Paving and Drainage Plan:
a) Show the location of the handicappcd acccssible curb cut ramps.
b) Providc a detail drawing of the curb cut ramp(s).
c) Specify the finish grade elcvations and/or slopc of the accessible paths required to each
building from thc public right-of-way and thc handicapped parking spaces.
d) Idcntify the finish floor elevation of each building.
Notc: All drawings, dimcnsions, surface finishcs, elevations and slopcs shall comply
with the regulations specified in the Florida Accessibility Code for Building
Construction, Section 4.1.2. ill (1) thru (4).

rcviewcd for compliance with the applicable code regulations. Because the applicant did not

dimcnsioning the location, color of sign structurc or form of illumination, it is rccommcnded
that thc sign be approved administrativcly subjcct to the location of the sign complying with
the sctback rcgulations ofthc Sign Codc, color of the structure being compatible to the color
of thc sign and a notc being placed below thc sign drawing indicating thc sign is not
illuminatcd. To clarify the status of the building signage for thc project, place a note on cach
elevation vicw drawing of the buildings indicating that no building signagc will be installed

Engineering Division
1. All plans submitted for specific permits shall meet the City's code requirements at time of
application. These permits include, but are not limited to, the following; site lighting, paving,
drainage, curbing, landscaping, irrigation and traffic control devices. Permits required from
agencies such as the FDOT, PBC, SFWMD, L WDD and any other permitting agency shall be
included with your permit request.
2. Locate stop signs next to stop bars at both egress driveways. [MUTCD]
3. The site lighting shall conform to Chapter 23, Article II.A. at time of permitting to include,
but not limited to, a minimum averagc of one foot candle.
4. Show handicap acccssible route from handicap parking spaces to sidewalk to the west of
parking lot. [Florida Accessibility Code]
5. Provide a clarification of conncction between Retention Area # 1 and #2 with Retention Area
#3 and #4. [Chapter 6, Article IV, Section 5.B]
6. Provide engineer's written certification that the drainage will conform with all rules,
regulations and codes including, but not limited to, Chapter 6, Article IV, Section 5 of the
City's Land Development Regulations. [Chapter 4, Section 7.F.2.]
Recommendation:
Recommend that a second handicap pedestrian sidewalk extend from proposed 5' concrete
sidcwalk on Golf Road to onsite sidewalk, on east side of entrance. [Florida Accessibility Code]

considered more of an 1o~il/commercial use. State
governs the distinction between ACLFs and nursing homes and
requires different building standards, nursing care requirements
and medical provisions for each type of facility. In addition,
nursing homes require a certificate of need, whereas ACLFs do not.
There is concern that the facility could be converted from an ACLF
to a nursing home and would then not be a permitted use at this
location within the R-3 district. Awareness of the conversion
could be difficult, since from the exterior, no changes would
likely be noticed. This is because at the site plan level,
building plans are not required which would indicate whether the
building is to be built to the higher nursing home standards.
Construction now to these higher standards would enable future
conversion to be easily made with interior improvements. At time
of City permitting of these improvements, it might not be apparent
that these changes are being made to satisfy state nursing home
requirements. However, there are currently three ACLFs in the
City in R-3 districts and they could potentially convert to nursing
homes as well.
