applications are processed through Planning and Zoning.

included with your permit request.

56. There is an existing buffer wall located on the Christian Villas
property south of the proposed development. If the existing
buffer wall meets, or can be upgraded to meet, the proposed /
buffer design guidelines with respect to the height, exterior finish
and the required setback, the proposed buffer wall on the Auto
Care Center of America property can be omitted, subject to
providing an appropriate upgrade and perpetual maintenance
agreement between Christian Villas and Auto Care Center of
America prior to a certificate of occupancy being issued for the
first building on the PCD property,
57. Exterior utility boxes, meters, transformers, etc. shall be screened V
from public view by a buffer wall or continuous vegetative buffer
as required by the Landscape Code (Land Development
Regulations, Chapter 9, Section 10,C).
58. Although required by the code, signage information was not vi
submitted as a part of the site plan application. Another formal
submittal containing signage will have to be made and presented
to the Planning and Development Board and City Commission for
approval.
59. In order to eliminate potential vehicular conflicts between vehicles V
backing-up from service bays of the tire store and oil change
building onto a main driveway of the complex, it is recommended
that the configuration of the detail shop and tire store will be
reversed. Move the tire store to the north and install mirrors to
allow access to bays from the secondary driveway.
60. Increase the width of the sidewalk in front of all buildings to a V
minimum of 7 feet and provide a two foot wide planting area as
required by Planning and Development Board at the time of
rezoning appr.val.

61. In order to enhance uniformity of the complex, it is recommended vi
that all three buildings be connected by an arcade placed over
the sidewalk located in front of the structures. (see attached

20, Extend the landscape island on the south side of the north
ingress aisle from Congress Avenue to be in line with the
westerly extension of a line along the curbed landscaping along
the north side of the retail store; to align eastbound traffic with
the lane through the two buildings,
21. For better circulation remove the landscaped island at the
northwest corner of the detail shop to provide two way traffic.
22, Extend the landscape island at the northwest corner of the oil
change building so that it is in line with the west extension of the V
landscape island at the northeast side. Align eastbound traffic in

BUILDING DIVISION
Comments:
23. The applicant did not submit a completed sign program proposal
for review and approval with the subject site plan review request.
A sign program would include detail plan and elevation view
drawings of the proposed tenant and project identification
signage including, but not limited to showing and identifying V
sign age height, color(s), style, type, area, form of illumination
and location. Note: Structural drawings, wind load calculations
and electrical data are not required to be submitted with a sign
progral'T\i however, a note shall indicate that such issues will be
in comp1ance with the applicable code regulations. Therefore to
avoid confusion regarding the status of the sign age identified
and illustrated on the submitted plans remove the project
identification sign from all plan view drawings of the site and
remove the tenant building signage depicted on the elevation
view drawings of the buildings. To further clarify the status of
the signage for the proposed project place a note on the site
plan and each sheet depicting elevation view drawings of the
buildings indicating that a subsequent site plan review is
required for a sign program. [Chapter 21 - Sign Code, Article IV,
Section 7]. Note: All signage shall comply with the applicable
regulations specified in the Sign Code and Community Design
Plan, [Land Development Regulations; Chapter 21 - Sign Code,
Articles I through IV and Chapter 9 - Community Design Plan,
Section 10.1]

24. The site plan and other plan view drawings of the site do not
indicate the location of the handicap accessible path that is
required to connect all three proposed buildings. Amend the
plans to show and identify the accessible path including
specifying the width, slope and type of material for all handicap
accessible paths, All specifications shall comply with the
regulations of the Accessibility Code. [Florida Accessibility Code
for Building Construction, Section 4.1.2 III (1) through (4)].
Where applicable, specify with notes and symbols the location of
the curb cut ramps and built up ramps that are required to make
the site meet the Accessibility Code.
25. On the paving and drainage plan place a note indicating that the
required handicap accessible path leading to the handicap
accessible entrance of each tenant space from the abutting
public right-of-way and the handicap accessible path leading to
the building entrance from the handicap parking spaces will be
designed and constructed in compliance with the regulations
specified in the Florida Accessibility Code for Building
Construction, Section 4.1.2.111 (1) through (4). Where applicable,
specify with notes and symbols the width of the path and the
location of the curb cut ramps and build up ramps that are
required to make the site meet the Accessibility Code. Also
indicate the finish floor elevation of each building and specify the
finish surface elevation and/or the slope of each accessible path
leading to the accessible entrance to each tenant space.
26, As indicated on the paving and drainage plan provide detail
architectural drawings of the following:
a) Handicap accessible walkways leading to the accessible
entrance to each tenant space from the abutting right-of-way
and each handicap parking space.
b) Pro~e detail drawings of the built up ramps and curb cut
ramps.
Note: All drawings, dimensions, surface finishes, elevations and
slopes shall comply with the regulations specified in the Florida
Accessibility Code for Building Construction, Section 4.1.2111 (1)
through (4).
27. The Palm Beach County tax map depicts the project contains two
(2) parcels of land. Therefore, to meet the Zoning Code
regulations regarding setbacks, the two parcelS shall be
combined by either platting the project or submitting a
completed. executed and recorded City of Boynton Beach Unity
of Title form.
28. It is the applicant's responsibility to design and construct the
project in compliance with the applicable Building, Energy and
Accessibility Code. Permits are required to make improvements

Comments:
29. Indicate on the landscape plan which trees will be preserved,
transplanted, or removed and replaced. These trees are
considered to be required in addition to the trees required by the ~
Landscape Code. (Environmental Regulation, 7.5, Sec.4, p.2,
Sec.12, p.3), There are 3 Cabbage Palms and 12 Slash Pine
trees on the site.
30. The applicant shall submit landscape and irrigation plans for that ~
portion of the Congress Avenue grass median which abuts the
site, (Comprehensive Plan, Policy 2.4.5, p.42.) The city has a
landscape design policy and an existing landscape design for
the median which can be made available to the applicant.
PLANNING AND ZONING

31, Adoption of the ordinance for PUO rezoning approval is V
necessary prior to building permit issuance.
32, Submit a legal document that constitutes evidence that the entire V
site is under unified control as required for PCO rezoning

The north, east and west buffer shall be the same as the south
buffer, but without the wall. At minimum, 50 percent of the
landscape material in each of the above buffers shall be Florida

54. Any raif top equipment shall be screened from view at a
distance of 600 feet. If such equipment is planned, indicate its
location and the height of the equipment above the top of the
parapet wall or mansard roof. Provide elevations of the structure
showing the roof top equipment and the required screening (all
reduced to a small scale) and draw in on these elevations the
lines-of-sight connecting the highest point of the equipment with
eye level from a distance of 600 hundred feet from the building
(LOR, Chapter 9, Section 11.E). If necessary, provide
architectural details of screening structures.

RECOMMENDATION: Please place the attached ordinance pertaining to the request below on the September 2, 1997 City
Commission meeting under Legal, Ordinances, 2nd Reading for approval. Second reading of the attached ordinance was
postponed at the August 5th City Commission meeting due to a condition of the rezoning approval regarding connecting the

AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, REGARDING
THE REZONING OF AUTO CARE CENTERS OF
AMERICA (HEISE PCD - APPLICATION No. 97-001);
AMENDING ORDINANCE 91-70 OF SAID CITY BY
REZONING A CERTAIN TRACT OF LAND MORE
PARTICULARLY DESCRIBED HEREIN, FROM C-3
(COMMUNITY COMMERCIAL DISTRICT) TO PCD
(PLANNED COMMERCIAL DEVELOPMENT DISTRICT);
AMENDING THE REVISED ZONING MAP
ACCORDINGLY; PROVIDING FOR CONFLICTS,
SEVERABIL TY AND AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton Beach, Florida has
adopted Ordinance 091-70, in which a Revised Zoning Map was adopted for said
City; and
WHEREAS, Anna Cotrell of Anna S. Cotrell & Associates, Inc., agent for
Autocare Centers of America, contract purchaser, has heretofore filed a Petition,
pursuant to Part III of the Land Development Regulations, Chapter 2, Zoning of the
City of Boynton Beach, Florida, for the purpose of rezoning a certain tract of land,
said land being more particularly described hereinafter from C-3 (Community
Commercial District) to PCD (Planned Commercial Development District); and
WHEREAS, the City Commission deems it to be in the best interests of the
inhabitants of said City to amend the aforesaid Revised Zoning Map as hereinafter
set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1: The following described land, located in the City of Boynton
Beach, Florida, as set forth in Exhibit "A" attached hereto and made a part hereof,
be and the same is hereby rezoned from C-3 (Community Commercial District) to
PCD (Planned Commercial Development), A location map (Exhibit "B"), a reduced
version of the corresponding Master Plan (Exhibit "C"), and the Conditions of
Approval (Exhibit "0") are attached hereto and made a part of this Ordinance by
reference.
Section 2: That the aforesaid Revised Zoning Map of the City shall be
amended accordingly.
Section 3: All Ordinances or parts of Ordinances in conflict herewith are
hereby repealed.
Section 4: Should any section or provision of this ordinance or any portion
thereof be declared by a court of competent jurisdiction to be invalid, such decision
shall not affect the remainder of this ordinance.
Section 5: This ordinance shall become effective upon adoption.

56. There is an existing buffer wall located on the Christian Villas
property south of the proposed development. If the existing
buffer wall meets, or can be upgraded to meet, the proposed
buffer design guidelines with respect to the height, exterior finish
and the required setback, the proposed buffer wall on the Auto
Care Center of America property can be omitted, subject to
providing an appropriate upgrade and perpetual maintenance
agreement between Christian Villas and Auto Care Center of
America prior to a certificate of occupancy being issued for the
first building on the PCD property.
57. Exterior utility boxes, meters, transformers, etc. shall be screened
from public view by a buffer wall or continuous vegetative buffer
as required by the Landscape Code (Land Development
Regulations, Chapter 9, Section 10.C).
58. Although required by the code, signage information was not
submitted as a part of the site plan application. Another formal
submittal containing signage will have to be made and presented
to the Planning and Development Board and City Commission for
approval.
59. In order to eliminate potential vehicular conflicts between vehicles
backing-up from service bays of the tire store and oil change
building onto a main driveway of the complex, it is recommended
that the configuration of the detail shop and tire store will be
reversed. Move the tire store to the north and install mirrors to
allow access to bays from the secondary driveway.
60. Increase the width of the sidewalk in front of all buildings to a
minimum of 7 feet and provide a two foot wide planting area as
required by Planning and Development Board at the time of
rezoning approval.
61. In order to enhance uniformity of the complex, it is recommended
that all three buildings be connected by an arcade placed over
the sidewalk located in front of the structures. (see attached
sketch of proposed building connections)

The site is currently undeveloped and contains a deteriorated
asphalt slab in the northern portion of the site. There is also native
vegetation on the site - three Cabbage Palms and 12 Slash Pines.
The developer is proposing construction of:
. 8,085 square foot building designated for retail use, and
. 10,446 square foot automotive repair center consisting of:
a) 1,612 square foot, three bay oil change building,
b) 1,819 square foot, two bay detail shop, and
c) 7,143 square foot, ten bay tire sales and installation (see
Exhibit "B" proposed site plan)
According to the traffic impact analysis submitted, the
number of trips projected through each driveway will not
exceed the threshold which would qualify any of them as a
"major access drive" (major access drives must have an
access aisle at least 100 feet long). The Palm Beach
County Traffic Engineering Division has reviewed the traffic
analysis and finds this project consistent with the Palm
Beach County Traffic Performance Standards ordinance.
Insufficient drainage information has been submitted for the
Engineering Division to certify compliance with the City's
drainage levels of service at the time of site plan approval,
as required. The Engineering Division is recommending that
this be postponed to time of permit review.
On-site traffic circulation consists of a multi-looped driveway
system connected to three separate ingress/egress access
driveways with widths varying between 16 and 27 feet. Two of the

driveways are on Congress Avenue, and the third driveway is on
Woolbright Road. Also, there is an internal connection provided
between the McDonald's/Amoco service station and the subject
site.
Parking Facility:
There are 97 on-site parking spaces to be provided including six (6)
handicap accessible spaces as required by ADA. This exceeds the
minimum standard of 94 parking spaces as required by the Land
Development Regulations, Chapter 2 - Zoning for this use.
Landscaping:
The landscaping of the site will fully meet the code requirements
when staff comments are incorporated.

Community Design
Plan: There are three buildings proposed on the site which will be located
along Congress Avenue. The retail use will be within a stand-alone
building which is to be separated from the automotive uses by an
access driveway. The automotive service complex consists of two
attached buildings. The site configuration is proposed to be as
follows: the buildings are to be located along Congress Avenue,
parking is to be located along the perimeter, and the drainage
retention area is to be located along the eastern property line of the
site. As was discussed with the review of the PCD master
planlrezoning, due to the small size of the subject property and the
closeness and smallness of the McDonald's/Amoco outparcel which
was subdivided from the subject property, it is important that the
buildings on the two properties and within the two properties "read"
as one integrated project. Therefore, staff is recommending equal
building setbacks, connection of all PCD buildings and
incorporation of the McDonald's/Amoco materials and color into the
PCD. This is consistent with the Community Design Plan which
requires that "buildings or structures located on separate parcels
and buildings or structures which are part of a present or future
multi-building complex, shall achieve visual unity of character and
design concepts through the relationship of building style, use,
texture, color, materials, form, scale, proportion and location", The
adjacent McDonalds-Amoco service station set the tone for the

corner of this highly traveled and visible intersection. Specifically,
staff recommends the following building design changes:
· Spanish "S" tiles (terracotta blend), comparable to those
used on McDonald's/Amoco, be added to the building.
· that a stucco wall finish painted a combination of beige,
antique white or another close-matching color combination
similar to McDonald's/Amoco be used.
. that trim or accent colors be changed to match the blue used
on McDonald's/Amoco.
. that awnings be covered with Spanish "S" tiles,
. that the building height not exceed 30 feet (the
McDonalds/Amoco gas station is approximately 21 feet).
. that the trim, arches, pillars and scoring proposed on the
west elevations be extended to all other elevations.
. That all three buildings be connected by an arcade having a
vertical clearance allowing emergency vehicle passage. The
arcade shall be placed over the sidewalk located in front of
all buildings.
Signage:
Signage. although required, has not been submitted as a part of
this application. Therefore, a future major site plan modification will
have to be made and presented to the Planning and Development
Board (and Commission) for consideration and approval.
RECOMMENDATION:
The Planning and Zoning Department recommends approval of this site plan request,
subject to the comments included in Exhibit "C" - Conditions of Approval. The TRC
recommends that the deficiencies identified in this exhibit be corrected on the set of
plans submitted for building permit.
Note: Most of the design changes above in the conditions of approval and the north,
east and west buffer changes in the conditions of approval were presented by staff with
the June 1997 rezoning report. They are being carried over to this review because
although the Planning and Development Board with a 4-3 vote recommended they be
deleted with the rezoning and recommended that the building and buffer designs be
determined with the site plan review, the Commission has not yet approved the
rezoning at the request of the applicant. The applicant requested this irregular
procedure so that the Commission could review the site plan and rezoning conditions at
the same time and possible allow some flexibility.
