1. The applicant must indicate on the landscape plan which trees will be preserved,
transplanted, or removed and replaced. These trees are in addition to the trees required by the
Landscape Code.(Environmental Regulation,7.5,Sec. 4,p.2,Sec.12,p.3). There are 3
Cabbage Palms and 12 Slash Pine trees on the site.
2. The applicant must submit landscape and irrigation plans for that portion of the Congress
Avenue grass median which abuts the site.(Comprehensive Plan, Policy 2.4.5,p.42.) The
City has a landscape design policy and an existing landscape design for the median which
can be made available to the applicant.
The project should continue in the normal review process.

Staff has reviewed the above referenced project and offer the following comments:
1. Palm Beach Health Department permits will be required, (Sec. 26-12).
2. Plan shall specify meter size, (Sec. 26-16(c)).
3. Unobstructed access to utility facilities must be provided, proposed buffer wall
may not allow clear access, (26-33(a)).
4. Palm trees will be the only tree species allowed within utility easements,
(Sec. 7.5-18.1).
5. Backflow preventors are required for certain uses, (Sec. 26-207).
6. A Capacity Reservation Fee will be required within thirty (30) days of City
Commission approval, or upon request for my signature on the HRS/DEP
permit applications. The fee amount will be determined based upon meter
size or expected demand, (Sec. 26-34[E]).
It is our recommendation that the plan proceed through the review process.

We have review subject plans and offer the following comments:
Building Division
1. Considering the applicant did not submit for sign program approval as is required with
site plan approval remove the proposed site and building signage from the plans. A
subsequent site plan approval is required for the project signage. [Chapter 21 - Sign
Code, Article IV, Section 7.]
2, Permit plans for the proposed project shall comply with the applicable Building, Energy
and Handicapped codes. [Chapter 20 - Building, Housing and Construction
Regulations]
Engineering Division
1. Provide an Engineer's certification in writing that drainage will conform with all rules,
regulations, codes, etc., including but not limited to, Chapter 6, Article IV, Section 5 of
the LDR. (Drainage & stormwater treatment) [Chapter 4 - Site Plan Review, Section
7.F.]
2. Obtain Pahn Beach County approval to outfall into the Congress Avenue storm sewer
system.
3. Show proposed locations of site lighting. [Chapter 4 - Site Plan Review, Section
7.B.4.]
4. Locate the stop bars and signs 4' behind sidewalk at both Congress Avenue driveways
per MUTCD and City Standard Drawing B-9l 004.
5. The parking lot traffic plan shall provide internal traffic and information signs where
appropriate for proper, efficient and safe movement of traffic thru the site. [Chapter
23, Article II.B.]
6. All plans submitted for specific permits shall meet the City's code requirements at time
of application. These permits include, but are not limited to the following; site lighting,
paving, drainage, curbing, landscaping, irrigation and traffic control devices. Permits
required from agencies such as the FDOT, PBC, SFWMD and any other permitting
agency shall be included with your permit request. [Chapter 2, Article I, Section 6.]

Recommendations:
1. Relocate the 6 parking spaces opposite the detail and oil change shops westward some
16' so that the ingress/egress opening is aligned with the opening to the south. This
accomplishes safer traffic control and provides additional landscaping.
2. Regarding the curbed island on the north side of the north egress lane onto Congress
Avenue; extend the island southeasterly with a smaller comer radius to establish a
stopping point for southbound vehicles and to deny crossover conflicts from Congress
Avenue ingress traffic.
3. Remove the two striped pedestrian crosswalks over the parking lot area. Pedestrians
may infer that they have the right of way.

The City of Boynton Beach has completed its first review of the documents submitted for the above-
referenced project. Attached are comments made by the reviewing departments during their initial
review of your project.
In order to complete the review process, the site plan and documents must be amended to comply
with these comments within 90 days of the date of this letter. (If amended plans are not submitted
in 90 days, a new application fee will be required.) When there are comments made by the reviewers
that you feel are not applicable to the approval ofthe project or will be addressed separately and you
have not amended the plans to comply with the comment(s), you must prepare written explanation
for each comment stating why the comment is not applicable and return the explanation with the
amended plans and documents.
After amending the plans and documents, please submit twelve (12) complete sets (including
surveys) of the plans to the Planning and Zoning Department, When the amended plans and

The following list and information is provided as a checklist to ensure that the submittal of amended plans and
documents is substantially complete for review. Turning in this list and the appropriate plans and documents will
enable the submittal to be efficiently checked prior to being accepted by the Planning and Zoning Department.

1. Submit an amended Site Plan Review/Conditional Use application form that reflects the changes that were
made as a result of amending the plans and documents to comply with the Code of Ordinances and the
Technical Review Committee comments. A copy of the original form with a distinguishable symbol
identifying the change(s) may be submitted or a completed new form with the changes identified. If there
are no changes required to be documented on the application form, a letter from the applicant stating same
must be turned in with the amended submittal.
2. Submit twelve (12) assembled and complete sets of plans and documents, including surveys that show
compliance with the Code of Ordinances and comments made by the Technical Review Committee. Two
(2) of the sets shall have the appropriate legible raised seal and signature of the designer responsible for the
drawing(s). Plans and documents shall be assembled in twelve (12) individual complete packages with the
title of the project on all pages and/or sheets and each page or sheet numerically numbered such as the
following example: 1 of3, 2 of3, 3 of3.
3. Submit color photographs of the buildings on the site that are to remain in their existing condition and
photos of existing buildings that are located on the sites that abut the perimeter of the subject property. The
minimum size is 4" by 6". Each photograph shall be labeled to identify the location of the existing structures
with respect to the location of the proposed project. If the abutting property is vacant photographs are not
required.
4. Submit colored elevation view drawings - a colored duplicate copy of all drawings of the elevation views
of each side of all buildings and signage associated with the project. The colors shown and described on
the colored elevation views shall match the colors identified on the elevation drawings submitted for site
plan review, All exterior surfaces of the structure(s) shall be colored and the color name, associated color
code and manufacturer identified, The type of exterior surface material shall also be identified on the
drawing. The colored elevation drawings shall have compass direction or title of the side of the building
identified. The title block of the original drawing shall be shown. The maximum size is 24" by 36". Do
not submit on board of any kind.
5. Submit color samples as an example of the proposed colors, Each sample shall have attached a label that
identifies the color by name, color code and manufacturer. The colors should be referenced from an
established color chart.
6. Submit 8 1/2" x 11" transparencies of the site plan, landscape plan and project signs to be used on an
overhead projector at board meetings.

I have reviewed the above plans and have the following comments/recommendations:
1. The FAST FOOD parcel shows some serious traffic flow concerns. The plans do not show the details of the
drive-thru (ie. order board location, drive-up window location,etc.) I foresee a congested area where the drive-thru
connects with east parking area ofthe Tire Store & Installation. As vehicles stack up for the drive-thru, traffic will
also be trying to exit the property through the same driveway. See attached sheet for blow-up of area of concern.
2. The "parking detail" for the Handicapped parking spaces are not to current guidelines and need to be amended.
3. All ingress/egress areas need to have a D.O.T. approved Stop Sign and pavement painted Stop bar.
4. The North Elevation (page 5 of 6) plans do not reflect the finallook(bay doors).
5. The North Elevation & South Elevation (page 6 of6) are not consistent with the plans on pagel of6 of the

Staff has reviewed the above referenced project and offer the following comments:
1. A Capacity Reservation Fee will be required within thirty (30) days of City
Commission approval, or upon request for my signature on the HRS/DEP
permit applications. The fee amount will be determined based upon meter
size or expected demand, (Sec. 26-34[ED.
2. Plan shall show location of all utility easements, existing or proposed,
(Sec. 26.33(a)).
3. Palm Beach Health Department permits will be required for water and sanitary
sewer mains, (Sec. 26-12).
4. Palm trees will be the only tree species allowed within utilities easements,
(Sec. 7.5-18.1).
5. Fire hydrants shall be within 200' of all points on every commercial building,
(Chapter 6, Art. IV Sec. 16).
6. City water will not be supplied for irrigation. Please remove your note on plan
sheet 2 of 2 (Preliminary Landscape Plan) and show source and location of
proposed water source, (City Compo Plan, Policy 3C.3.4).
7. The Utilities Department requests a meeting with the Project Engineer to
discuss alternate connection points to the existing water and sanitary sewer
systems.
It is our recommendation that the plan proceed through the review process.

6. Show intended separations of buildings noting 2 hr., 4 hr. and 6 hr. walls -

The following is a list of comments regarding the first (1st) review of the above-
referenced project. It should be noted that the comments include recommendations I
believe will enhance the aesthetics and function of the project.
The comments that identify deficiencies from the City's Land Development Regulations
(L.D.R.) or previous conditions of approvals are required to be corrected and shown in
compliance on the plans and/or documents submitted for second (2nd) review in order
for the project to continue through the site plan review process.
The applicant shall understand that all documents and plans submitted for site plan review
are subject to additional comments. I recommend that the applicant/agent contact me
regarding questions related to the comments. If the applicant is not intending to correct
code deficiencies and they request that the project remain on the review schedule
identified they should contact me regarding the procedures, application forms, fees and
submittal deadline dates for seeking relief from the code requirement or previous condition
of approval.
1. To determine what setbacks apply to each property line of the subject property,
add a symbol and note to the site plan (sheet 1 of 2) indicating whether Congress
Avenue or Woolbright Road is the front of the property. Show and label with a
distinguishable symbol the setback dimensions around the perimeter of the
subject site. All setback dimensions shall be shown in compliance with the
applicable zoning district regulations. Provide horizontal control dimensions that
identify the distance each building is from all property lines including distances
between buildings. The location of all buildings shall comply with the applicable
building and site regulations for the subject zoning district. On sheet 1 of 2, 1 of 6,
3 of 6 and 6 of 6 show and label a symbol that represents the location and width
of the building overhang and/or width of covered walkways/canopies on all
buildings. [Chapter 2 - Zoning, Section 6. C. 3 and Section 6. F.7. e. of the Land
Development Regulations]
2. On the site plan and landscape plan show and label a distinguishable that
represents the required peripheral greenbelt. Specify the width dimension of the
greenbelt along each side of the project. The greenbelt dimensions shall comply
with the Planned Commercial Development (PC D) regulations. [Chapter 2 -
Zoning, Section 6. C. 1. cc. of the Land Development Regulations]
3. Add the word "Typical" to the Parking Detail drawing found on sheet 1 of 2. Also
dimension the length of the regular parking spaces shown at the bottom portion of
the detail drawing. All dimensions shall be in compliance with city standard
drawing B-90012. If the drawing does not represent the configuration of all

parking spaces on the site, indicate the location of the different type(s) with a
labeled symbol and provide a typical parking detail drawing for each type. All plan
view and detail drawings shall comply with city standards.
4. Modify the parking space computations found on sheet 1 of 2 to show the required
parking for the entire project as 1 parking space per each 200 square feet of gross
leasable floor area. [Chapter 2 - Zoning, Section 11. H. 16. d. (2) of the Land
Development Regulations]
5. Add to all plan view drawings the buffer wall required along the south property line
of the project. Also provide a detail drawing of the wall. The design and
construction drawings of the required wall shall be consistent with the regulations
specified in Section 4. L. of Chapter 2 - Zoning of the Land Development
Regulations.
6. On sheet 2 of 2 add the following landscape notes:
a) Indicate that the quality of the landscape material is Florida NO.1 or better
as specified in the "Grades and Standards for Nursery Plants" Part I 1963
and Part II, State of Florida, Department of Agriculture, Tallahassee. [Land
Development Regulations, Chapter 7.5, Article II - Landscape Code,
Section 5. C. 1.]
b) indicate that the landscape material will be installed in a sound workmanlike
manner. [Land Development Regulations, Chapter 7.5, Article II -
Landscape Code, Section 5. A]
c) Add to the landscape plan a note that identifies the source of the water that
is required for the automatic water supply system. [Land Development
Regulations, Chapter 7.5, Article II - Landscape Code, Section 5. B.]
7. Omit the word "Preliminary" from the title of sheet 2 of 2.
8. Amend the plant list to include separate labeled categories that represent the
following landscaping; I
a) peripheral greenbelt landscaping;
b) landscaping required by the landscape code;
c) lake area planting;
d) additional landscaping provided by the applicant and
e) where applicable landscaping required to comply with the final
determination of the site plan approval request.
9. Add to the landscape plan and plant list a distinguishable symbol that identifies
the location of the plant material for each category.
10. Add to the landscape plan, notes and symbols that represent the location and
type of lawn grass. Specify on the plan the method used to install the lawn grass.
[Chapter 7.5, Article II - Landscape Code, Section 5. C. 6. of the Land
Development Regulations]
11. On sheet 2 of 6, 4 of 6 and 6 of 6 show with notes and symbols the type of
exterior finish material used for each building component including specifying the
color of the material. The color or colors shall be identified by name, color code
and manufacturer. All exterior building components shall be identified such as;
walls, glass, storefront frames, door frames, overhead doors, downspouts, each
member of the building cornice, architectural bands, columns, arches, etc.

12. Add to the submittal a detailed sign program. The sign program shall depict the
proposed site and wall signage. The signage shall be shown in compliance with
the regulations specified in the sign code and community design plan. [Chapter 9 -
Community Design Plan, Section 10. I. and Chapter 21 - Sign Code, Article IV,
Section 7. of the Land Development Regulations]
13. To determine whether the project is required to comply with the parking lot
regulations regarding major driveway improvements submit a traffic analysis that
breaks down the total number of trips generated at each driveway. Where
applicable, modify the driveways to comply with the parking lot regulations.
[Chapter 23, Article II, Section H. 5. of the Land Development Regulations]
14. To eliminate the congestion regarding patrons exiting the north side of the site
onto Woolbright Road through the drive-through lane of the proposed restaurant,
it is recommended that the north driveway be modified to include a separate
egress. To better serve the site it is recommended that the new egress be
added as a by-pass lane to the east or side of the fast food drive through building.
15. To conceal the view of the overhead garage doors shown on the north, west and
east sides of the auto repair building, it is recommended that the peripheral
greenbelt required along the north, south, east and west sides of the property
include, in addition to the required vehicle use area landscaping, the following
landscaping:
a) within the 10 foot wide greenbelt required along the north, east and west
property lines install a 20" tall berm with a 4: 1 slope;
b) along the Congress Avenue and Woolbright Road frontage of the project
install 12 foot tall native evergreen trees spaced 40 foot on center. (The
proposed trees shall be centered between the 40 foot on center trees
required to comply with the landscape code vehicle use area screening,
therefore, creating a 20 on center tree line along the west and north
frontage of the property);
c) within the green belt located along the abutting property to the north and
east install 12 foot tall native evergreen trees spaced 20 foot on center;
d) within the green belt located along the west, east and north sided of the
property install a group of (3 to 4) 6 foot tall Wax Myrtle shrubs (full to base)
or equal mid-level native evergreen shrubs spaced evenly around the
proposed 40 foot and 20 foot on center 12 foot tall greenbelt trees and the
required 40 foot on center vehicle use area screening trees;
e) within the 25 foot wide greenbelt required along the south property line
install a 36" tall berm with a 4: 1 slope;
f) within the greenbelt located along the south property line install 12 foot tall
native evergreen trees spaced 20 foot on center;
g) within the south greenbelt install a group of (3 to 4) 6 foot tall Wax Myrtle
shrubs (full to base) or equal mid level native evergreen shrubs spaced
evenly around the proposed 20 foot on center 12 foot tall greenbelt trees.
16. The survey shows a 35 foot wide ingress/egress, utility easement along the south
property line. This easement encroaches the required 25 foot wide perpheral
greenbelt. Either relocate the existing easement outside of the greenbelt area or
omit the easement. The required greenbelt and the associated landscaping shall
take precedence over the existing ingress/egress, utility easement. To ensure
that there is not a conflict with the location of trees in easements it is
recommended that all existing and proposed easements be shown, identified and
dimensioned on the landscape plan.

17. The configuration of the site around the auto repair building depicted on the plan
view drawings and the configuration of the building shown on the elevation view
drawing are not consistent with the configuration of the building shown on the floor
plan drawing. Amend the drawings to show consistency on all drawings.
18. Add to the submittal a roof plan drawing showing the location of the roof mounted
equipment on all buildings. Identify the elevation of the top of each piece of
equipment and the elevation of the top of the perimeter of each building. All roof
mounted equipment shall be screened from pubic view a distance of 600 feet in all
directions. Add to the elevation view drawings of each building a labeled symbol
that shows the location of all of the roof mounted equipment including identifying
the elevation of the top of the perimeter of the building and the top of all
equipment. Where applicable amend the drawings to show compliance with the
required screening. Indicate on the plans the type of screening material and
specify the color. It is recommended that the color of the screening material
match the color of the walls of the building and the texture and finish of the
screening match the walls of the building. [Chapter 9 - Community Design Plan,
Section 11. E. of the Land Development Regulations]
19. On the site plan indicate the degree of the diagonal parking spaces. Show the
horizontal control dimensions for the spaces in compliance with the city standards.
The control dimension of 27 feet shown on the site plan exceeds all standard city
dimensions. [City Standard drawing 8-90013]
20. Add to the site plan an off-street loading area. The location, size and design of
the loading area and screening shall comply with the city regulations. [Chapter
2 - Zoning, Section 6. F. 7. b. and Section 11. J. 1., 2.a. of the Land Development
Regulations]
21. Add to the site plan horizontal control dimensions that clearly identify the width of
all access aisles and back-up distances including the width and length of the
landscaped areas located within or adjacent to the vehicle use areas throughout
the entire site. All dimensions shall comply with city regulations. [Chapter 23 -
Parking Lots, Article II, Section I. 1. and Section C. of the Land Development
Regulations]
22. Add to the site plan the location and type of traffic control signs and pavement
markings proposed for the project. The traffic control signs and pavement
markings shall comply with city regulations. [Chapter 23 - Parking Lots, Article II,
Section B. 1 and 2 of the Land Development Regulations]
23. Add to the site plan a detailed plan view and section view drawing of the dumpster
enclosure. The design of the enclosure shall comply with the city regulations.

24. Add to sheet 3 of 6 and 5 of 6 detailed and dimensioned section view drawings of

27. To screen from public view the parked vehicles located in the off-street loading
area (parked vehicles located outside of the automotive building bays waiting to
enter the building for service) add to the plan view drawings the screening
required to comply with the zoning code regulations. Also provide a detailed
section drawing of the required screening. [Chapter 2 - Zoning, Section 6. F. 7.
b. of the Land Development Regulations]
28. To further conceal the view of the inside of the automotive building from public
view it is recommended that the maximum height of all overhead doors be
established at eight (8) feet and that the area above the overhead doors be solid
and match the material and color of the walls of the building.
29. Show and dimension on the landscape plan the line-of-sight triangles required on
both sides of all ingress/egresses. Also specify in the form of a note the size of
the unobstructed cross visibility space that is required within the triangular areas.

30. Place a note on the site plan indicating the total trip count generated by the
project and where applicable conditions of approval relating to compliance with
Palm Beach County's Traffic Performance regulations.
31. It is recommended that where mulch is used for landscaping beds that the plans
specify the specie of mulch be non-cypress.
32. Recommendations will be forwarded for board and commission review. If the
recommendations are approved with the project, they shall be incorporated into the
working drawings required for permits for the project.
33. The content of the plans are subject to compliance with all applicable city code of
ordinances and previous conditions of approval. It is the applicant's responsibility
to show compliance.
34. For the presentation of the project to the Planning and Development Board and City
Commission, submit to the Planning and Zoning Department eight and one-half (8
1/2) inch by eleven (11) inch transparencies of the proposed site plan, landscape
plan, wall and site signage. The documentation depicted on the transparencies
shall match the documentation shown on the amended plans submitted for second
(2nd) review. The amended plans required for 2nd review and the transparencies
are required by April 14, 1997.
35. For the presentation of the project to the Planning and Development Board and City
Commission, submit to the Planning and Zoning Department color samples of all
exterior materials shown on the elevation view drawings of the building, wall and
site signage and where applicable other site appurtenances. The color samples
shall identify the color name, color code and color manufacture that matches the
colors specified on the elevation view drawings submitted for second (2nd) review.
The color samples are due by April 14, 1997.
36. For the presentation of the project to the Planning and Development Board and City
Commission, submit to the Planning and Zoning Department elevation view
drawings of the proposed buildings, site signage and building signage in

compliance with the code regulations that are colored (not mounted). The colored
drawings shall specify the color name, color code and manufacturer of the colors of
all proposed colors. The colors depicted on the color elevation view drawings shall
match the colors specified on the elevation view drawings submitted with the plans
for 2nd review. The Planning and Zoning Department staff will mount the colored
elevation view drawings for presentations to the Planning and Development Board
and City Commission. The colored elevation view drawings are required by April
14, 1997.
37. To compare the proposed design of the buildings and landscaping of the proposed
request to the adjacent properties, the applicant shall submit four (4) inch by six (6)
inch colored photographs of the adjacent properties. The photographs shall be
taken on the subject site outward to the adjacent property in all four compass
directions. More than one photograph from each side of the property may be
required to fully illustrate the architectural design and landscaping on the adjacent
property. To delineate what the picture is representing, place a label on the front of
the photographs identifying the compass direction with respect to the subject site.
The Planning and Zoning Department staff will mount the photographs for
presentations to the Planning and Development Board and City Commission. The
photographs are required by April 14, 1997.
38. Where applicable, the data identified on the site plan review application shall be
modified to be compatible with the data and information that is shown and identified
on the twelve (12) sets of plans that were amended to comply with staff comments.
The 12 sets of amended plans, including survey, are required to be
submitted no later than 5:00 PM, April 14, 1997. If the amended plans,
revised application and the other required supporting documentation are
submitted on April 14, 1997 before 5:00 PM the site plan review request will
be presented to the Planning and Development on May 13, 1997 and
forwarded to the City Commission on May 20, 1997 for final determination.
39. Following review of the amended plans staff will prepare a staff report which
includes supporting documentation regarding the request. The staff report
(Planning and Zoning Department project package) will be transmitted to the
Planning and Development Board for their review. The Planning and Zoning
Department staff will notify the applicant's agent, as identified on the site plan
review application, when the documentation will be available for their review.

I have reviewed the above plans and have the following comments/recommendations:
-The positioning of the TIRE STORE & INSTALLATION has the bay doors exposed to
the south. It also accesses the major driveway from Congress Ave and Woolbright Road.
This business will be continually pulling vehicles into the bays and backing them out
onto this major driveway. It is also closely located to a blind curve located on the east
side of the building. I do not recommend this configuration as it appears to be a traffic
safety concern.
- The driveway on the south side of the RETAIL building appears to be planned for one-
way traffic-eastbound. This is acceptable, but additional signs (DO NOT ENTER,and
NO RIGHT TURN) are needed at the parking aisles at the east side of the building, to
prohibit wrong direction travel.

4. Palm trees will be the only tree species allowed within utility easements,
(Sec. 7.5-18.1).
5. Backflow preventors are required for certain uses, (Sec. 26-207).
6. A Capacity Reservation Fee will be required within thirty (30) days of City
Commission approval, or upon request for my signature on the HRS/DEP
permit applications. The fee amount will be determined based upon meter
size or expected demand, (Sec. 26-34[ED.
7. Utilities requests a meeting with the project engineer to discuss possible
alternatives to the proposed sanitary sewer main due to conflicts with the
buffer wall and landscaping.

We rccommend approval of the above referenced project subject to the following comments.
Building Division (Michael Haag 561-375-6352)
1. The applicant did not submit a completed sign program proposal for review and approval with the
subject site plan review request. A sign program would include detail plan and elevation view
drawings of the proposed tenant and project identification signage including, but not limited to
showing and identifying signage height, color(s), style, type, area, form of illumination and location.
Note: Structural drawings, wind load calculations and electrical data are not required to be
submittcd with a sign program, however, a note shall indicate that such issues will be in compliance
with the applicable code regulations. Therefore to avoid confusion regarding the status of the
signage identified and illustrated on the submitted plans remove the project identifications sign from
all plan view drawings of the site and remove the tenant building signage depicted on the elevation
vicw drawings of the buildings. To further clarify the status of the signage for the proposed project
place a notc on the site plan and each sheet depicting elevation view drawings of the buildings
indicating that a subsequcnt site plan review is required for a sign program. [Chapter 21 - Sign
Code, Article IV, Section 7]. Note: All signage shall comply with the applicable regulations
specified in the Sign Code and Community Design Plan. [Land Development Regulations~ Chapter
21 - Sign Code, Articles I through IV and Chapter 9 - Community Design Plan, Section 10.1]
2. The site plan and other plan view drawings ofthe site do not indicate the location of the handicap
accessible path that is required to connect all three proposed buildings. Amend the plans to show
and identify the accessible path including specifying the width, slope and type of material for all
handicap accessible paths. All specifications shall comply with the regulations of the Accessibility
Code. [Florida Accessibility Code for Building Construction, Section 4.1.2. ill (1) through (4)].
Where applicable, specify with notes and symbols the location of the curb cut ramps and built up
ramps that are required to make the site meet the Accessibility Code.
3. On the paving and drainage plan place a note indicating that the required handicap accessible path
leading to thc handicap accessible entrance of each tenant space from the abutting public right-of-
way and the handicap accessible path leading to the building entrance from the handicap parking
spaces will be designed and constructed in compliance with the regulations specified in the Florida
Accessibility Code for Building Construction, Section 4.1.2. m (1) through (4). Where applicable,
specify with notes and symbols the width of the path and the location of the curb cut ramps and
build up ramps that arc required to make the site mcet the Accessibility Code. Also indicate the
finish floor elevation of each building and specify the finish surface elevation and/or the slope of
each accessible path leading to the accessiblc entrance to each tenant space.

4. As indicated on the paving and drainage plan provide detail architectural drawings of the

5. The Palm Beach County tax map depicts the project contains two (2) parcels ofland. Therefore,
to meet the Zoning Code regulations regarding setbacks the two parcels shall be combined by

6. It is the applicant's responsibility to design and construct the project in compliance with the

2. If any of the recorded easements shown on the boundary survey are not necessary for site
development, provide verification that they have been abandoned.
3. At both southbound egress aisles in the southeastern corner of the site, provide appropriate traffic
control devices to deny westbound traffic (Do Not Enter signs).
4. Correct the scale of the conceptual paving and drainage plan at time of permit application.
5. Change "Typical Parking Detail" to show 8' sidewalk as shown on 2nd review site plan.
6. All plans submitted for specific permits shall meet the City's code requirements at time of
application. Thesc pcrmits include, but are not limited to the following; site lighting, paving,
drainage, curbing, landscaping, irrigation and traffic control devices. Permits required from
agcncies such as the FDOT, PBC, SFWMD, LWDD and any other permitting agency shall be
included with your permit request.
7. Show proposed location of your site lighting and traffic control markings and signage. [Chapter 4,
Scction 7.B.]
8. Provide Engineer's certification letter that drainage will conform with all rules, regulations, codes,
etc. [LDR, Chapter 4, Section 7.F.2.]
9. Locate stop bars and signs 4' bchind sidewalk at both Congress Avenue driveways (MUTCD).

Staff has reviewed the above referenced project and offer the following comments:
1. A Capacity Reservation Fee will be required within thirty (30) days of City
Commission approval, or upon request for my signature on the HRS/DEP
permit applications. The fee amount will be determined based upon meter
size or expected demand, (Sec. 26-34[ED.
2. Plan shall show location of all utility easements, existing or proposed,
(Sec. 26.33(a)).
3. Palm Beach Health Department permits will be required for water and sanitary
sewer mains, (Sec. 26-12).
4. Palm trees will be the only tree species allowed within utilities easements,
(Sec. 7.5-18.1).
5. Fire hydrants shall be within 200' of all points on every commercial building,
(Chapter 6, Art. IV Sec. 16).
6. City water will not be supplied for irrigation. Please remove your note on plan
sheet 2 of2 (Preliminary Landscape Plan) and show source and location of
proposed water source, (City Compo Plan, Policy 3C.3.4).
7. The Utilities Department requests a meeting with the Project Engineer to
discuss alternate connection points to the existing water and sanitary sewer
systems.
It is our recommendation that the plan proceed through the review process.

In discussion at the TRC Meeting last week, this application shoUld not be considered for site
plan review, since the project as proposed would not be permitted in the existing C-3 Zone.

Such was the consensus of the TRC Committee, therefore, the application should be rejected

Regarding Item #2:
1. Traffic circulation provides for east and westbound Woolbright Road traffic and
southbound traffic to use fast food building parking lot as a major driveway into the
retail and commercial buildings. Recommend denial of site plan and do not forward
to Planning & Development Board.
Recommendation:
Eliminate retail store and resubmit for consideration or reduce building size to incorporate
fast food parcel and use access off Woolbright Road primarily for ingress and egress.

The Public Works Department will be unable to provide solid waste removal for this
project as shown on the site plan. City Code #10-26, Item A., requires that the Sanitation
Division has clear access to all dumpster enclosure. Sanitation vehicles require a
minimum of fifty five feet of clear access to each dumpster which these drawings do not
provide.
We would be ailable to discuss this with the applicants to discuss viable solutions at

I have reviewed the above plans and have the following comments/recommendations:
1. The FAST FOOD parcel shows some serious traffic flow concerns. The plans do not show the details of the
drive-thru (ie. order board location, drive-up window location,etc.) I foresee a congested area where the drive-thru
connects with east parking area of the Tire Store & Installation. As vehicles stack up for the drive-thru, traffic will
also be trying to exit the property through the same driveway. See attached sheet for blow-up of area of concern.
2. The "parking detail" for the Handicapped parking spaces are not to current guidelines and need to be amended.
3. All ingress/egress areas need to have a D.O.T. approved Stop Sign and pavement painted Stop bar.
4. The North Elevation (page 5 of 6) plans do not reflect the finallook(bay doors).
5. The North Elevation & South Elevation (page 6 of 6) are not consistent with the plans on page 1 of 6 of the
Retail Building plans.

Find attached for your review the plans and exhibits for the above-referenced project. Site
Plan Review approval for this project will be granted by the City Commission. To ensure
that the project stays on line with the review time frame, I request that the plans and
exhibits be reviewed and formal written comments transmitted to the Director of the
Planning and Zoning Department no later than 5:00 P.M. on March 24. 1997. Do not
return plans and exhibits. Retain same for the review of the amended plans (second
review).
Adhering to the following review guidelines will promote a comprehensive review and
enable the applicant to efficiently obtain Technical Review Committee approval:
1. Use the review standards specified in Part III, Land Development Regulations,
Chapter 4, Site Plan Review, Section 8 of the Code of Ordinances to review and
formulate comments.
2. The documents submitted for the project were determined to be substantially
complete based on the submittal requirements identified in Section 7 of the Site
Plan Review Ordinance. However, if the data provided to meet the submittal
requirements is insufficient to properly evaluate and process the project based on
the review standards or the documents show code deficiencies, additional data
and/or corrections should be requested by the reviewer through the Planning and
Zoning Department.
3. Each comment shall reference the section of the code that is incorrectly depicted
on the documents.

4. Technical Review Committee member(s) shall identify in their comments when the

review comments with the name of the appropriate TRC Member that is responsible for
the review specified.
6. If a TRC member finds the plans acceptable, he/she shall forward a memo, within the
time frame stated above, to the Planning and Zoning Director stating that the plans are
approved and they do not have any comments on the plans submitted for review and
recommend the project be forwarded through the approval process.
All comments shall be typed, addressed and transmitted to the Director of the Planning and
Zoning Department for distribution to the applicant. Please include the name and phone
number of the reviewer on this memo. Jerzy Lewicki will be the Planning and Zoning
Department staff member coordinating the 1 st review of the project.
The Planning and Zoning Department will send the applicant a cover letter which includes the
comment(s) and directions to amend the plans to comply with the comments and the
procedures for resubmission. When the Planning and Zoning Department receives the
amended plans, they will distribute the plans with a cover memo to all TRC Members for review
and approval.

The following is a list of 1 st review comments regarding the site plan review of the plans for the above-
referenced project. The applicant shall understand that all documents and plans submitted for site plan
review are subject to additional comments. I recommend that the applicant/agent contact me regarding
questions related to the comments. If the applicant is not intending to correct code deficiencies, he should
contact me regarding the procedures, application forms, fees and submittal deadline dates for seeking
relief from the code requirement.
1. Current zoning does not allow the use as proposed. Rezoning approval is necessary
before issuance of building permits.
2 Provide survey of the property - a unity of title may be required
3. Provide a uniform control document.
4. Indicate distances between the buildings
5. On the master plan, show proposed setbacks.
6. At all entry driveways, show visibility triangles as required by the code.
7. It is recommended, that design standards will be established for the perimeter
landscape buffer. The buffer between the PUD property on the south and the subject
site should contain, at minimum, ground cover, dense 6 foot high hedge and canopy
trees 40 feet of center.
8. Provide a tree survey and a tree management plan.
9. Provide a storm water management plan and relevant calculations.
10. Include in your submittal a vicinity sketch, as required by the code, showing existing
development on adjacent properties in the immediate vicinity of the subject site, streets,
walkways and other natural features. Show compliance of the proposed driveways with the
code requirements.
11. Provide statement of the of the subsurface conditions
12. Indicate location of all proposed easements
13. Eliminate conflict between proposed utility and access easement and the proposed 25 feet
wide peripheral greenbelt at the southern end of the property.
14. It is recommended that irrelevant to site plan drawings will be eliminated with the future
submittal and replaced with the drawings and information as required by Chapter 3 of
LDR.
