The impact on the fire department mostly results from a "crammed" site. (PCD-1, 2-8, C; 4-c; 7.C). Portions of the PCD requirements were programs, agreements, binders, etc., that are to be presented seem to be missing in the application. Access to the site is through four narrow driveways. Should vehicles be at rest at stop signs, fire engines and ladders could not make the turn into the site. Further, turning movements within the site are rarely possible because of the parking lot configuration. In no case should minimum land areas for the use be dropped (7 -A, 7 -C). Submit a copy of the purchase contract. 3. The request indicates the project will be phased delineate on the plan the phasing scheme and define on the master plan the time frame of the proposed phasing. 4. The applicant submitted a "Comparison of Impacts" that did not include water and sewer demands for the project. Therefore the applicant shall indicate the proposed water consumption and sewer generated for the subject project. 5, Submit the signature page of the application with original names and signatures of the property owner and property owner and agent. 6. The property owners list submitted by the applicant is incomplete, The applicant shall complete the list and submit mailing labels and postage fee for all property owners within a 400 foot radius of the subject property. 7, Submit a legal document that constitutes evidence that the entire site is under unified control. [Chapter 2 - Zoning, Section 6, F. 3. of the Land Development Regulations] The legal document shall be titled Unified Control Document. The document shall include text similar to the following: a) I property owner of the property described within the attached Exhibit "A" and Exhibit "B" declare that that this document shall bind in perpetuity all heirs, assignees, successors and future property owner or owners, if any, to develop, operate and maintain said property under unified control, in compliance with the City of Boynton Beach Code of Ordinances and conditions of approval of all Development Orders or Development Permits issued for the property, without recourse to the city or any other public agency. The name or title of the entity responsible for developing, operating and maintaining the subject property under unified control shall be . This entity shall be identified on the plat and plat dedications with the signatures of the controlling party or parties identified on the plat. This document shall not be amended or modified without written consent from the City of Boynton Beach City Attorney or attorney designated by the city attorney. b) Exhibit "A" shall include the recorded deed or deeds of all properties included within the subject request and the deeds shall include the legal description of each property, c) Exhibit "B", shall include a separate legal description of the entire property included in subject request. Where applicable, the legal description shall combine all individual properties that are part of the request into one legal description. The legal description shall indicate the total acres and be signed and sealed by the surveyor of record for the project. One of the intents and purposes of establishing a planned commercial zoning district is to mitigate negative impacts which result from land development, it is the opinion of this reviewer that the design of the building that houses the Detail Shop, Oil Change and Tire Store & Installation uses creates a negative impact by allowing visibility of the several overhead doors located on the facade of the automotive repair building and the visibility of inside of the building through the overhead doors from Congress Avenue and Woolbright Road, This area of Congress Avenue and Woolbright Road is a prominent existing developed commercial corridor of the city. The abutting residential area is also developed with fee simple single-family homes. Therefore, it is recommended that the building design be changed to show all overhead doors located on walls that are internal to the project rather than facing a property line. It is further recommended that if the city commission approves the subject request that additional landscaping above what is required by the landscape code be added to the perimeter greenbelts to screen the view of the overhead doors from the adjacent property lines, It is believed that these recommendations are in-line with the following intended purposes of the planned commercial district shall be maintained: a) create a more desirable environment for commercial development in relation to existing development and b) provide a harmonious design so arranged as to create an attractive project readily integrated with and having no adverse effect on adjoining and surrounding areas and developments. [Chapter 2 - Zoning, Section 6. F. 1, and 2.b, of the Land Development Regulations] 9, As required by the code, place a statement, on the master plan indicating that all utilities such as, but not limited to; telephone, electricity, water, sewer, gas, cable, etc, are available and will be provided by the appropriate agency, [Chapter 3 - Master Plan Review, Article IV, Section 3. O. and P. of the Land Development Regulations] 10. On the master plan indicate, in note form, that the project will be subject to plat and site plan approval consistent with the regulations specified in the Boynton Beach Code of Ordinances. [Chapter 2 - Zoning, Section 6, F. 12, of the Land Development Regulations] 11. Change the title of sheet 1 of 2 from Final Site Plan to Master Plan. [Chapter 2 - Zoning, Section 6, F. 8.a.(2) of the Land Development Regulations] 12, The planned commercial development design criteria requires one off-street loading zone for the subject project. Amend the plans to delineate the location, size and design of the required loading zone facilities in compliance with the zoning code regulations. Add to the master plan a distinguishable symbol that identifies the location and dimension of the PCD district building setbacks around the entire development. Also identify whether Congress Avenue or Woolbright Road is the front of property. 14. More specifically, the proposed automotive use is not allowed within parcels of land smaller than 5 acres. Code amendment approval allowing automotive uses on parcels of 3 acres, or more in PCD (Planned Commercial Development), is necessary prior to rezoning approval. 2. Submit a deed that contains a legible legal description. 3. The applicant submitted a "Comparison of Impacts" that did not include water and sewer demands for the project. Therefore the applicant shall indicate the proposed water consumption and sewer generated for the subject project. 4. Submit the signature page of the application with original names and signatures of the property owner and property owner's agent. 5. Submit a legal document that constitutes evidence that the entire site is under unified control. [Chapter 2 - Zoning, Section 6. F. 3. of the Land Development Regulations] The legal document shall be titled Unified Control Document. The document shall, at minimum, contain the following statements: a) I property owner of the property described within the attached Exhibit "A" and Exhibit "B" declare that that this document shall bind in perpetuity all heirs, assignees, successors and future property owner or owners, if any, to develop, operate and maintain said property under unified control, in compliance with the City of Boynton Beach Code of Ordinances and conditions of approval of all Development Orders or Development Permits issued for the property, without recourse to the city or any other public agency. The name or title of the entity responsible for developing, operating and maintaining the subject property under unified control shall be . This entity shall be identified on the plat and plat dedications with the signatures of the controlling party or parties identified on the plat. This document shall not be amended or modified without written consent from the City of Boynton Beach City Attorney or attorney designated by the city attorney. b) Exhibit "A" shall include the recorded deed or deeds of all properties included within the subject request and the deeds shall include the legal description of each property. c) Exhibit "B", shall include a separate legal description of the entire property included in subject request. Where applicable, the legal description shall combine all individual properties that are part of the request into one legal description. The legal description shall indicate the total acres and be signed and sealed by the surveyor of record for the project. The building that houses the Detail Shop, Oil Change and Tire Store & Installation contains overhead doors facing Congress Avenue, which is prohibited by Land Development Regulations, Chapter 9, Section 11.J.1. Redesign the building by eliminating the prohibited exposure of overhead doors along Congress Avenue. If the community design appeal from this requirement will be granted, it is recommended, that additional landscaping, above what is required by the landscape code, be added to the perimeter greenbelt to screen the view of the overhead doors from the west. It is believed, that these recommendations are in-line with the following intended purposes of the planned commercial district: a) create a more desirable environment for commercial development in relation to existing development, and b) provide a harmonious design so arranged as to create an attractive project readily integrated with and having no adverse effect on adjoining and surrounding areas and developments.
