UNIFIED CONTROL DOCUMENT
A) r, Boynton Shoppes, Inc., property owner of the property described within the attached Exhibit "A"
and Exhibit "B" declare that this document shall bind in perpetuity all heirs. assignees. successors and
future property owner or owners, if any, to develop, operate and maintain said property under unified
control, in compliance with the City of Boynton Beach Code of Ordinances and conditions of approval
of all Development Orders or Development Permits issued for the property, without recourse to the
city or any other public agency. The name or title of the entity responsible for developing, operating
and maintaining the subject property under unified control shall be Boynton Shoppes. rnc.. This entity
shall be identified on the Plat and Plat dedications with the signatures of the controlling party or parties
identified on the plat. This document shall not be amended or modified without written consent from
the City of Boynton Beach City Attorney or attorney designated by the city attorney.
B) Exhibit "A" shall include the recorded deed or deeds of all properties included within the subject
request and the deeds shall include the legal description of each property.
C) Exhibit "B" shall include a separate legal description of the entire property included in the subject
request. Where applicable, the legal description shall combine all individual properties that are part of
the request into one legal description. The legal description shall indicate the total acres and be signed
and sealed by the surveyor of record for the project. The surveyor shall certify that the legal
description is a correct representation of the property identified in Exhibit "A" and is the same
property identified for the Boynton Shoppes, PCD property request to rezone the subject property form
Community Commercial, C-3 to a Planned Commercial Development (PCD) zoning district. as
identified in the application submitted to the City of Boynton Beach on March 5,1997,

master plan will be available for your use to perform the review.

Regarding Item # 1 :
1. Applicant has not met the requirements of Chapter 2, Section 9C, items 3 thru 15,

Recommendation:

Regarding Item #2:
1. Traffic circulation provides for east and westbound Woolbright Road traffic and

retail and commercial buildings. Recommend denial of site plan and do not forward

Recommendation:
Eliminate retail store and resubmit for consideration or reduce building size to incorporate

I have reviewed the above plans and have the following comments/recommendations:
1. The FAST FOOD parcel shows some serious traffic flow concerns. The plans do not show the details of the
drive-thru (ie. order board location, drive-up window location,etc.) I foresee a congested area where the drive-thru
connects with east parking area of the Tire Store & Installation. As vehicles stack up for the drive-thru, traffic will
also be trying to exit the property through the same driveway. See attached sheet for blow-up of area of concern.
2. The "parking detail" for the Handicapped parking spaces are not to current guidelines and need to be amended.
3. All ingress/egress areas need to have a D.O.T. approved Stop Sign and pavement painted Stop bar.
4. The North Elevation (page 5 of 6) plans do not reflect the finallook(bay doors).
5. The North Elevation & South Elevation (page 6 of 6) are not consistent with the plans on page 1 of 6 of the
Retail Building plans.

In reviewing the requirements from the LDR zoning for PCD, it appears that a strip
center by any other name is still a strip center. The impact on the fire department
mostly results from a "crammed" site. (PCD-1, 2-8, C; 4-c; 7.C). Portions of the PCD
requirements were programs, agreements, binders, etc., that are to be presented seem
to be missing in the application.
Access to the site is through four narrow driveways. Should vehicles be at rest at stop
signs, fire engines and ladders could not make the turn into the site. Further, turning
movements within the site are rarely possible because of the parking lot configuration.
In no case should minimum land areas for the use be dropped (7 -A, 7 -C). We feel, as
presented, this parcel does not condone the specific PCD requirement.

Building Division
1. Considering the site and building sign age depicted on the plans does not reflect code
specifications regarding color, size, style or type, either amend the plans to show the
specifications in compliance with the code or place the following note on the master
plan and building elevation drawings:
"See sign program for specifications regarding site and building signage."
[Chapter 21 - Sign Code, Article IV, Section 7]
2. Amend all plan view drawings to show compliance with the Florida Accessibility Code
regarding an accessible path leading to the entrances ofthe buildings from the existing
sidewalk located within the abutting right-of-way. [Chapter 20 - Building, Housing
and Construction Regulations, Art. I, Sec.5 of the City's Land Development
Regulations]
Engineering Division
1. Provide a master stormwater management plan as specified in Chap.3, Art.IV, Sec.3T.
2. Provide a generalized statement of subsurface conditions plus location and results as
they affect the site. [Chap.3, Art.IV, Sec.3P]
3. Obtain Palm Beach County approval to outfall into Congress Ave. storm sewer system.
4. If the change in zoning (C-3 to P.C.D.) does not create any significant changes in items
3 thru 15 of Chapter 2, Sec.9C, provide a certified statement to that effect, or conform
to said code reference.
5. All other comments can be met at time of permitting.
6. All documents submitted shall be signed, sealed and dated by the appropriate design
professionals per F.S. 471.025.
7. Owner to provide the city with an acceptable hold harmless letter to insure against any
errors or omissions on the survey submitted by R.L. Vaught & Assoc., Inc,
Recommendations
1. Recommend 8' sidewalks around building and eliminate wheel stops (tripping hazard).
2, Recommend that loading zone screen walls be eliminated and areas striped
appropriately. Walls will impact safe and efficient traffic circulation.
3. Recommend proj ect be forwarded to the Planning and Development Board if items
6 & 7 are submitted no later than 5:00 P.M. on 5/30/97.
4. Make all ingress driveways 14' wide to facilitate entrance from high speed arterials.

Please be advised of the following comments relative to the first (1st) review of the master
plan for the above-referenced project:
1, Submit a deed that has a legible legal description,
2. Submit a copy of the purchase contract.
3. The request indicates the project will be phased delineate on the plan the phasing
scheme and define on the master plan the time frame of the proposed phasing.
4. The applicant submitted a "Comparison of Impacts" that did not include water and sewer
demands for the project. Therefore the applicant shall indicate the proposed water
consumption and sewer generated for the subject project.
5, Submit the signature page of the application with original names and signatures of the
property owner and property owner and agent.
6. The property owners list submitted by the applicant is incomplete, The applicant shall
complete the list and submit mailing labels and postage fee for all property owners
within a 400 foot radius of the subject property.
7, Submit a legal document that constitutes evidence that the entire site is under unified
control. [Chapter 2 - Zoning, Section 6, F. 3. of the Land Development Regulations]
The legal document shall be titled Unified Control Document. The document shall
include text similar to the following:
a) I property owner of the property described
within the attached Exhibit "A" and Exhibit "B" declare that that this document shall
bind in perpetuity all heirs, assignees, successors and future property owner or
owners, if any, to develop, operate and maintain said property under unified control,
in compliance with the City of Boynton Beach Code of Ordinances and conditions of
approval of all Development Orders or Development Permits issued for the property,
without recourse to the city or any other public agency. The name or title of the
entity responsible for developing, operating and maintaining the subject property
under unified control shall be . This entity shall be identified
on the plat and plat dedications with the signatures of the controlling party or parties
identified on the plat. This document shall not be amended or modified without
written consent from the City of Boynton Beach City Attorney or attorney designated
by the city attorney.
b) Exhibit "A" shall include the recorded deed or deeds of all properties included within
the subject request and the deeds shall include the legal description of each
property,
c) Exhibit "B", shall include a separate legal description of the entire property included
in subject request. Where applicable, the legal description shall combine all
individual properties that are part of the request into one legal description. The legal
description shall indicate the total acres and be signed and sealed by the surveyor of
record for the project. The surveyor shall certify that the legal description is a
correct representation of the property identified in Exhibit "A" and is the same

property identified for the Heise property request to rezone the subject property from
Community Commercial, C-3 to a Planned Commercial Development (PCD) zoning
district as identified in the application submitted to the City of Boynton Beach on
March 5, 1997.
d) The original executed and notarized document shall be submitted to the city for
review by the city attorney.
8. One of the intents and purposes of establishing a planned commercial zoning district is
to mitigate negative impacts which result from land development, it is the opinion of this
reviewer that the design of the building that houses the Detail Shop, Oil Change and Tire
Store & Installation uses creates a negative impact by allowing visibility of the several
overhead doors located on the facade of the automotive repair building and the visibility
of inside of the building through the overhead doors from Congress Avenue and
Woolbright Road, This area of Congress Avenue and Woolbright Road is a prominent
existing developed commercial corridor of the city. The abutting residential area is also
developed with fee simple single-family homes. Therefore, it is recommended that the
building design be changed to show all overhead doors located on walls that are internal
to the project rather than facing a property line. It is further recommended that if the city
commission approves the subject request that additional landscaping above what is
required by the landscape code be added to the perimeter greenbelts to screen the view
of the overhead doors from the adjacent property lines, It is believed that these
recommendations are in-line with the following intended purposes of the planned
commercial district shall be maintained:
a) create a more desirable environment for commercial development in relation to
existing development and
b) provide a harmonious design so arranged as to create an attractive project
readily integrated with and having no adverse effect on adjoining and

9, As required by the code, place a statement, on the master plan indicating that all utilities
such as, but not limited to; telephone, electricity, water, sewer, gas, cable, etc, are
available and will be provided by the appropriate agency, [Chapter 3 - Master Plan
Review, Article IV, Section 3. O. and P. of the Land Development Regulations]
10. On the master plan indicate, in note form, that the project will be subject to plat and site
plan approval consistent with the regulations specified in the Boynton Beach Code of

11. Change the title of sheet 1 of 2 from Final Site Plan to Master Plan. [Chapter 2 - Zoning,
Section 6, F. 8.a.(2) of the Land Development Regulations]
12, The planned commercial development design criteria requires one off-street loading zone
for the subject project. Amend the plans to delineate the location, size and design of the
required loading zone facilities in compliance with the zoning code regulations. Indicate in
the site data the number of required and provided loading areas. [Chapter 2 - Zoning,
Section 6. F, 7.b, of the Land Development Regulations]
13. Add to the master plan a distinguishable symbol that identifies the location and dimension
of the PCD district building setbacks around the entire development. Also identify
whether Congress Avenue or Woolbright Road is the front of property.
14. If the title of the project is not Heise PCD, correctly identify the title of the project on the
master plan, [Chapter 2 - Zoning, Section 6. F. 8,(2)(a) of the Land Development

Also show the location and dimension of the driveways and vehicle use area of this
adjacent property and all abutting and adjacent properties within 400 feet of the subject
property,
18, Amend the master plan submittal to include those items specified in Chapter 2 - Zoning,
Section 6. F, and Chapter 3 - Master Plan Review, Article IV, Section 3, Of the Land
Development Regulations.
19, Add to the master plan the results of the Palm Beach County Traffic Division review of the
submitted traffic study.

1. The FAST FOOD parcel shows some serious traffic flow concerns. The plans do not show the details of the
drive-thru (ie. order board location, drive-up window location,etc.) I foresee a congested area where the drive-thru
connects with east parking area of the Tire Store & Installation. As vehicles stack up for the drive-thru, traffic will
also be trying to exit the property through the same driveway. See attached sheet for blow-up of area of concern.

In reviewing the requirements from the LOR zoning for PCD, it appears that a strip
center by any other name is still a strip center. The impact on the fire department
mostly results from a "crammed" site. (PCD-1, 2-8, C; 4-c; 7-C). Portions of the PCD
requirements were programs, agreements, binders, etc., that are to be presented seem
to be missing in the application.
Access to the site is through four narrow driveways. Should vehicles be at rest at stop
signs, fire engines and ladders could not make the turn into the site. Further, turning
movements within the site are rarely possible because of the parking lot configuration.
In no case should minimum land areas for the use be dropped (7 -A, 7 -C). We feel, as
presented, this parcel does not condone the specific PCD requirement.

In discussion at the TRC Meeting last week, this application should not be considered for site

Such was the consensus of the TRC Committee, therefore, the application should be rejected

Please be advised of the following comments relative to the 2-nd review of the rezoning master
plan for the above-referenced project:
1, Current zoning designation does not allow the proposed use. More specifically, the
proposed automotive use is not allowed within parcels of land smaller than 5 acres.
Code amendment approval allowing automotive uses on parcels of 3 acres, or more in
PCD (Planned Commercial Development), is necessary prior to rezoning approval.
2. Submit a deed that contains a legible legal description.
3. The applicant submitted a "Comparison of Impacts" that did not include water and sewer
demands for the project. Therefore the applicant shall indicate the proposed water
consumption and sewer generated for the subject project.
4. Submit the signature page of the application with original names and signatures of the
property owner and property owner's agent.
5. Submit a legal document that constitutes evidence that the entire site is under unified
control. [Chapter 2 - Zoning, Section 6. F. 3. of the Land Development Regulations]
The legal document shall be titled Unified Control Document. The document shall, at
minimum, contain the following statements:
a) I property owner of the property described
within the attached Exhibit "A" and Exhibit "B" declare that that this document shall
bind in perpetuity all heirs, assignees, successors and future property owner or
owners, if any, to develop, operate and maintain said property under unified control,
in compliance with the City of Boynton Beach Code of Ordinances and conditions of
approval of all Development Orders or Development Permits issued for the property,
without recourse to the city or any other public agency. The name or title of the
entity responsible for developing, operating and maintaining the subject property
under unified control shall be . This entity shall be identified
on the plat and plat dedications with the signatures of the controlling party or parties
identified on the plat. This document shall not be amended or modified without
written consent from the City of Boynton Beach City Attorney or attorney designated
by the city attorney.
b) Exhibit "A" shall include the recorded deed or deeds of all properties included within
the subject request and the deeds shall include the legal description of each
property.
c) Exhibit "B", shall include a separate legal description of the entire property included
in subject request. Where applicable, the legal description shall combine all
individual properties that are part of the request into one legal description. The legal
description shall indicate the total acres and be signed and sealed by the surveyor of
record for the project. The surveyor shall certify that the legal description is a
correct representation of the property identified in Exhibit "A" and is the same
property identified for the PCD property request to rezone the subject
property from Community Commercial, C-3 to a Planned Commercial Development
(PCD) zoning district, as identified in the application submitted to the City of
Boynton Beach on March 5, 1997.

d) The original executed and notarized document shall be submitted to the city for
review by the city attorney.
6. The building that houses the Detail Shop, Oil Change and Tire Store & Installation
contains overhead doors facing Congress Avenue, which is prohibited by Land
Development Regulations, Chapter 9, Section 11.J.1. Redesign the building by
eliminating the prohibited exposure of overhead doors along Congress Avenue. If the
community design appeal from this requirement will be granted, it is recommended, that
additional landscaping, above what is required by the landscape code, be added to the
perimeter greenbelt to screen the view of the overhead doors from the west. It is
believed, that these recommendations are in-line with the following intended purposes of
the planned commercial district:
a) create a more desirable environment for commercial development in relation to
existing development, and
b) provide a harmonious design so arranged as to create an attractive project
readily integrated with and having no adverse effect on adjoining and
surrounding areas and developments. [Chapter 2 - Zoning, Section 6. F. 1. and
2.b. of the Land Development Regulations]
7, Provide consistency regarding depictions of setback requirements for the site. Note,
that the front yard setback in PCD is 40 feet.
8. On the master plan, show required setback along Woolbright Road.
9. Provide consistency in regard to the name of the project, as it appears on the master
plan (Boynton Shoppes, PCD) and in the application (Heise PCD).
10. The submitted traffic statement shall be approved by the Palm Beach County Traffic
Division prior to the City Commission meeting.
11. With the site plan submittal provide a unity of title document for Tract "A" and Tract "B".
12. It is recommended, that design standards will be established for the perimeter
landscape buffer. The buffer should contain, at minimum, ground cover, dense 6 foot
high hedge and canopy trees with a maximum spacing of 40 feet of center. Fifty (50)
percent of the landscape material in each of the above categories should be native
Florida specie.
13, Provide a storm water management plan, as required by Land Development
Regulations, Chapter 3, Article IV, Section 3. T.
14. Include in your submittal a vicinity sketch, as required by the code, showing existing
development on adjacent properties in the immediate vicinity of the subject site and
other natural features.
15. Provide statement of the of the subsurface conditions.
16. Indicate location of all proposed easements.
17. Eliminate conflict between proposed utility and access easement and the proposed 25
feet wide peripheral greenbelt at the southern end of the property.
18. Provide tree survey and tree management plan, as required by Land Development

driveway from/onto Woolbright Road. If this area is to be an open space it is

22 feet east to a more central location of this part of the parcel. Also, it is recommended
that this entrance be appropriately landscaped to emphasize an entrance from
Woolbright Road to the development.
20. If the above recommendation regarding the egress/ingress driveway from/onto
Woolbright Road driveway relocation will not be approved, align the egress/ingress
driveway from/onto Woolbright Road and the internal driveway in the central part of the
property to improve safety of the internal vehicular system.
