We have reviewed the subject plans and offer the following comments that should be addressed prior to
the project being forwarded for Board review.

Site Specific Comments
1. Add to the site plan, paving & drainage, water & sewer and landscape plan notes, symbols, slopes and
dimensions that will represent the location, width and slope of at least one accessible route that is
required from the abutting public street to an accessible building and/or each tenant space entrance.

2. Add to the site plan and paving and drainage plan notes, symbols, slopes and dimensions that will
represent the location, width and slope of the accessible route that is required from the access aisles
located at each accessible parking space to an accessible building and/or each tenant space entrance.

Zones]
3. Place a note on the paving and drainage plan indicating that the site is designed in compliance with the
Florida Accessibility Code for Building Construction.
4. Add to the elevation view drawing of the building the size of the proposed wall sign including
separate square footage for the non-word depiction signage. The total aggregate sign area shall not
exceed the area allowed by Article IV, Section 5.C. ofthe Sign Code. [Chapter 21 - Sign Code of the
City's Land Development Regulations]
5. Amend the site plan drawing to indicate whether a site sign is proposed. Where applicable, show no
less than a ten (10) foot setback for the proposed sign. Also add to the drawings a detailed and
dimensioned elevation view drawing of the sign. The height and area of the sign shall comply with
the regulations found in Article IV, Section 5.B. of the Sign Code.
6. Identify the colors proposed for all signs by specifying the color name, color code and manufacturer.
Also indicate on the plan whether the signs will be illuminated. All signs shall comply with the sign
regulations specified in Section 10 of Chapter 9 - Community Design Plan.

3. If the existing east/west 10 foot Florida Power & Light easement running through and along the north
side of the existing 65 foot ingress/egress utility easement is in conflict with the new construction,
obtain the necessary abandonment.
4. The Master Site Plan" shall show all proposed traffic control markings and signage and all proposed
site lighting. [Chapter 4, Section 7.8.2. and 4.]
5. Phase (limit needs to include drainage from two catch basins in roadway (north of Building C) to the
control structure on the northeast corner of wet detention area. [LOR, Chapter 4, Section 7.F.l.]
6. Add note to plans that damaged concrete sidewalk to be replaced on Corporate Drive within property
limits. [LDR, Chapter 22, Article I, Section 5.]
General Comments
1. Provide an engineer's written certification that the drainage will conform with all rules, regulations
and codes of the City of Boynton Beach, including Chapter 6, Article IV, Section 3. and Chapter 4,
Section 7.F.2.
2. All plans submitted for specific permits shall meet the City's code requirements at time of application.
These permits include, but are not limited to the following: site lighting, paving, drainage, curbing,
landscaping, irrigation and traffic control devices. Permits required from agencies such as FOOT,
PBC, SFWMD, DERM, L WOO, DEP and any other permitting agency should be included with your
permit request.

1. The existing tree survey should be placed in a table form to quantify the total number of trees
on the site. There should be a statement for each tree on the table indicating which trees will
be preserved, relocated or removed / replaced on the site.
2. The areas shown on the tree survey indicated as "Heavy Brush Area" is native scrub
vegetation. This will require a flora and fauna survey. Permits from the Florida Game and
Fresh Water Fish Commission must address any protected species found on the site.
3. The flora survey results may require the preservation of 25% of all native plant communities.
SHEET L-l:
I. The areas shown on the plans as existing trees ( typ.) should be reviewed in the field and all
trees replaced which do not meet the City originally approved landscape plans.
2. The area shown on the plans as a 40 foot wide landscape buffer should be reviewed in the
field and all trees / vegetation replaced which do not meet the City originally approved
landscape plans. All exotic trees and vegetation should be removed from the 40-foot wide
landscape buffer.

1. Add to the tabular summary found on sheet A-I computations that would determine the minimum
number of required accessible parking spaces including identifying the number provided at the site.
The total number of accessible parking spaces provided at the site shall comply with the accessibility
code. To properly evaluate whether the number of accessible parking spaces provided on the plan is
in compliance with the code add to the survey the parking space layout of the existing parking that is
being redesigned as part of this submittal. This parking layout shall include delineating the location of
the existing regular and handicap spaces. Incorporate into the accessible parking data the number of
existing accessible parking spaces that are located within the already constructed parking area prior to
and after the proposed improvements. [Florida Accessibility Code for Building Construction, Section
4.1.2 (5) (a), Parking Spaces]
2. To properly identifY the site plan remove the word master from the title of sheet A-I.
3. Add to the proposed Site Plan and Floor Plan drawings a note and/or symbol that specifically

entrance of the building and each tenant space. Also identify the type of material proposed for the
route including specifying the slope and surface finish. Where the slope requires an accessible ramp
show and identifY the location of the ramp including specifying the type of material, surface finish,
width, length, slope and, where required, the appropriate handrails. The width, slope and surface
material of the accessible route shall comply with the regulations specified in the accessibility code.

We offer the following comments on this project:
GENERAL COMMENTS
1) All utilities easements shall be shown on the rectified landscaping drawings so that we may
determine which trees may interfere with utilities. In general, palm trees will be the only tree
species allowed within utilities easements. Canopy trees may be planted outside of the easement so
that roots and branches will not impact those utilities within the easement in the foreseeable future.
LD R Sec. 7.5-18.1 gives public utilities the authority to remove any trees that interfere with utility
services, either in utility easements or public rights-of-way.
2) Dept. of HRS permits will be required for the water and sewer systems serving this project. (Sec.
26-12).
3) Comp Plan policy 3C.3.4 requires the conservation of potable water. City water may, therefore, not
be used for irrigation where other sources are readily available.
4) Sec. 26-34(E) of the City Code requires that a capacity reservation fee be paid for this project
either upon my request for signature on the Health Dept. application forms or within 30 days of site
plan approval, whichever occurs first. This fee will be determined based upon final meter size, or
expected demand.
5) Comp Plan policy 3C.3.4 requires the conservation of potable water. City water may, therefore, not
be used for irrigation where other sources are readily available.
6) Provide an engineer's written certification that drainage will conform with all rules of the City and
the South Florida Water Management District. (LDR Chap. 4, sec. 7F)
SPECIFIC CONDITIONS
1) Water and sewer lines to be owned and operated by the City shall be included within utilities
easements. Please show all proposed easements on the engineering drawings, using a
minimum width of 12 feet. The easements shall be dedicated via separate instrument to the City as
stated in Sec. 26-33(a) of the Code.
2) The plan indicates proposed parking and landscaping along the east side of the property within the
existing 25-foot utilities easement, and also over two existing water supply wells. The proposed
parking cannot be built over the supply wells, and must be reduced in scope in order to allow this
Department continued access to the wells for operation and maintenance purposes. We require a
100 linear foot clear space within the easement, to the north and south of each well, for
effective operation and maintenance of the facilities. This is absolutely necessary in order to
protect the City's right to use that land within the easement for utilities purposes. Safe access
from paved areas to the easement must also be provided.
3) Approval from Palm Beach County Environmental Resources Management must be obtained for
the proposed construction within wellfield zones, under the County's Wellfield Protection Act. This
approval must be furnished to the City prior to our approval of sewer, and drainage plans.
4) Appropriate backflow preventers will be required on the domestic water service to the building,
and the fire sprinkler line if there is one, in accordance with Sec. 26-207. Note that fire sprinkler
systems with a booster pump will require installation of a reduced pressure zone device, as
specified in the City's Code.
5) The waste stream from the manufacturing process must meet the City's pretreatment requirements.
A sampling point must be provided to allow monitoring of this waste stream. (Sec. 26-143, 26-147)
6) Water mains shall be looped wherever possible, in compliance with Health Department Design
Standards. This item will be addressed during review of the Health Department permit set of
plans.

I. Based on the required parking spaces, show the total required number of handicap spaces for each
building per the Florida Accessibility Code [1997 Edition, page 16]

3. If the existing east/west 10 foot Florida Power & Light casement running through and along the north
side of the existing 65 foot ingress/egress utility easement is in conflict with the new construction,
obtain the necessary abandonment.

10. Show the "existing building" shown on the "master site plan" at the very south end of the development

11. Remove the word "master" from the title "Master Site Plan" to differentiate between the master plan

Find attached for your review the plans and exhibits for the above-referenced project. To ensure that
the project stays on line with the review time frame, I request that the plans and exhibits be
reviewed and formal written comments transmitted to the Director of Planning and Zoning no
later than 5:00 P.M. on November 21. 1997. The comments shall be separated into two
categories. The first category comments with code sections referenced and the second
category references recommendations that you believe will enhance the project.
If you believe the plans are substantially complete with regards to code compliance and that
your outstanding comments and/or recommendations may be addressed at time of permit
review rather than requiring the applicant to prepare amended plans for a 2nd submittal
indicate in your 1 st review written comments that you recommend the project proceed to the
Planning and Development Board and City Commission for approval. If you recommend the
project move forward for approval with one review, please attach the 1st review plans to your
written comments, with the exception of the Development Services Department which may
retain the plans as the control plans for the project.
Adhering to the following review guidelines will promote a comprehensive review and enable the
applicant to efficiently obtain Technical Review Committee approval:
1. Use the review standards specified in Part III, Land Development Regulations, Chapter 4, Site
Plan Review, Section 8 of the Code of Ordinances to review and formulate comments.

The documents submitted for the project were determined to be substantially complete based
on the submittal requirements identified in Section 7 of the Site Plan Review Ordinance.
However, if the data provided to meet the submittal requirements is insufficient to properly
evaluate and process the project based on the review standards or the documents show code
deficiencies, additional data and/or corrections should be requested by the reviewer through
Planning and Zoning.
3. Each comment shall reference the section of the code that is incorrectly depicted on the
documents.
4. Technical Review Committee member(s) shall identify in their comments when the plans depict
or when the location and installation of their departmental required improvements may conflict
with other departmental improvements.
5. When a TRC Member finds a code deficiency that is outside of his/her review responsibility,
the comment and the specific code section may be included in their review comments with the
name of the appropriate TRC Member that is responsible for the review specified.
6. If a TRC member finds the plans acceptable, he/she shall forward a memo, within the time
frame stated above, to the Director of Planning and Zoning stating that the plans are approved
and they do not have any comments on the plans submitted for review and recommend the
project be forwarded through the approval process.
All comments shall be typed, addressed and transmitted to the Director of Planning and Zoning for
distribution to the applicant. Please include the name and phone number of the reviewer on this
memo. Jerzy Lewicki will be the Planning and Zoning staff member coordinating the review of the
project.
Planning and Zoning will send the applicant a cover letter which includes the comment(s) and
directions to amend the plans to comply with the comments and the procedures for resubmission.
When Planning and Zoning receives the amended plans, they will distribute the plans with a cover
memo to all TRC Members for review and approval.

NA TURE OF REQUEST/DESCRIPTION OF PROJECT
Alan Gainsborg, Colliers Lehrer International, Inc., agent for Menorah Realty, Ltd.,
owners of the property located in the Boynton Commerce Center PID is requesting two,
approvals. The subject property is located approximately 800 feet south of Woolbright
Road and bounded on the east and west by the CSX railroad and the Lake Worth
Drainage District E-4 Canal, respectively (see Exhibit "A" - location map) and is zoned
PID (Planned Unit Development). The first request is for modification of the previously
approved PID master plan to combine parcels 3A, 3B and 3C by replacing the four (4)
previously approved office buildings consisting of 249,600 square feet with four (4)
warehousing/manufacturing/office operation centers totaling 134,241 square feet on
vacant property totaling 4.42 acres (see Exhibit "B" -proposed master plan). The
second request is for site plan approval of four operation centers.

The property (parcels 3A, 3B and 3C) is the remaining portion of
the Boynton Commerce Center PID. The property was cleared
thirteen years ago when phase I was constructed.
Four, one story buildings are proposed as follows:
Bldg. A -19,703 sq. ft.
Bldg. B - 39,059 sq. ft.
Bldg. C - 32,279 sq. ft.
Bldg. D - 43,200 sq. ft.
Some of the buildings are pre-leased, such as the majority of
building B which will be occupied by Motorola. The rest of the
space will be speculative and multi-tenant. The break down of the
total square footage, by use is 30% office, 20% manufacturing and
50% warehouse.
The property is vested for 249,600 square feet of office. The
total square footage of the four new buildings is 134,241
square feet together with the .two proposed future buildings
of 72,438 square feet is 206,679 square feet. Not only is
this a decrease in square footage, but it is also changing
from 100% office to 30% office. Since office generates more
traffic than warehousing and manufacturing, there is
expected to be a decrease in traffic. Palm Beach County
Traffic Engineering has not yet completed its review of this
request.
Drainage is to be handled via a master storm water area that
serves the entire PID. It is located on the west side of

Corporate Drive.
The property will be served access by six driveway connections to
Corporate Drive. Corporate Drive is an existing street owned and
maintained by the PID property owner's association. Corporate
Drive dead-ends into parking at the south extreme of the PID and
connects to a signalized intersection at Woolbright Road.
A total of 728 new parking spaces are to be provided. This is a
large surplus of parking given that only 574 new spaces are
required. There are approximately 38 existing spaces within the
phases lines associated with this new project. This parking is
needed ~o serve the existing three industrial buildings. For this
reason, a unity of title is being required to provide for one large
parking area to serve the new and existing buildings.
The landscape plan will fully meet the code requirements when
staff comments are incorporated.

Community Design
Plan: Each of the four buildings are similarly designed. Walls are a flesh
colored stucco and at the top % to 1/3 of the wall a pale yellow
wave accents the wall. At each of the tenant space entrances
there are rust colored scored stucco features that extend vertically
above the flat roof. Windows and doors are scored and glazed a
greenish blue.
BACKGROUND/MASTER PLAN MODIFICATION ANALYSIS
The purpose of this master plan modification is to reflect changes in anticipated
development of the Boynton Commerce Center PID property, adjusted to market
changes since the last master plan modification was approved on January 18, 1983,
and the original master plan/rezoning in 1980. Parcel 3G of the project, the southern
most parcel, and under separate ownership, received site plan approval from the city in
1997 for 35,715 square feet of manufacturing use.
Since the proposed changes are not resulting in an increase of the total floor area of
buildings located on the development and within the maximum allowed by the previous
approval, there is no increase in measurable impacts (traffic, sewage or water).

RECOMMENDATION
This master plan modification request was reviewed by the Technical Review
Committee (TRC) on November 25, 1997. The TRC recommended approval of the
request, subject to staff comments listed in Exhibit "C" - Conditions of Approval.
Staff recommends approval of this site plan request, subject to the comments included
in Exhibit liD" - Conditions of Approval. The Technical Review Committee (TRC)
recommends that the deficiencies identified in this exhibit be corrected on the set of
plans submitted for building permit.

UTILITIES
Comments:
1. All utilities easements shall be shown on the rectified landscaping
drawings and site plan so that the Utilities Department may determine
which trees may interfere with utilities. In general, palm trees will be the
only tree species allowed within utilities easements. Canopy trees may
be planted outside of the easement so that roots and branches will not
impact those utilities within the easement in the foreseeable future.
LDR, Sec. 7.5-18.1 gives public utilities the authority to remove any
trees that interfere with utility services, either in utility easements or
public rights-of-way.
2. Department of HRS permits will be required for the water and sewer
systems serving this project. (Sec. 26-12).
3. Comprehensive Plan, Policy 3C.3.4 requires the conservation of potable
water. City water may, therefore, not be used for irrigation where other
sources are readily available.
4. The plan indicates proposed parking and landscaping along the east side
of the property within the existing 25 foot utilities easement, and also
over two existing water supply wells. The proposed parking cannot be
built over the supply wells, and must be reduced in scope in order to
allow the Utilities Department continued access to the wells for
operation and maintenance purposes. Provide a 100 linear foot clear
space within the easement, to the north and south of each well, for
effective operation and maintenance of the facilities. This is.absolutely
necessary in order to protect the city's right to use that land within the
easement for utilities purposes. Safe access from paved areas to the
easement must also be provided.
5. Approval from Palm Beach County Environmental Resources
Management must be obtained for the proposed construction within
wellfield zones, under the county's Wellfield Protection Act. This
approval must be furnished to the city prior to approval of sewer and
drainage plans.
6. Appropriate backflow preventers will be required on the domestic water

service to the building, and the fire sprinkler line if there is one, in
accordance with Sec. 26-207. Note that fire sprinkler systems with a
booster pump will require installation of a reduced pressure zone device,
as specified in the city's code.
7. The waste stream from the manufacturing process must meet the city's
pretreatment requirements. A sampling point must be provided to allow
monitoring of this waste stream. (Sec. 26-143,26-147).
8. Water mains shall be looped wherever possible, in compliance with
Health Department Design Standards. This item will be addressed
during review of the Health Department permit set of plans.
FIRE
Comments:
9. Locations of Fire Department connections for sprinkler system hook-ups
must be shown. The Fire Department is unable to determine if adequate
access to connections is assured.
POLICE
Comments:
10. Handicap parking areas shall be striped and signed to current code.
11. Add pavement markings and traffic control on plans.
12. Draw on the plans the line of sight triangles for the exits onto Corporate
Drive to insure that landscaping poses no safety problem.
ENGINEERING DIVISION
Comments:
13. All plans submitted for specific permits shall meet the City's code
requirements at time of application. These permits include, but are not
limited to the following: site lighting, pavmg, drainage, curbing,
landscaping, irrigation and traffic control devices. Permits required from
agencies such as FDOT, PBC, SFWMD, DERM, LWDD, DEP and any
other permitting agency should be included with your permit request.
14. Based on the required parking spaces, show the total required number of
handicap spaces for each building per the Florida Accessibility Code
[1997 Edition, page 16].

16. If the existing east/west 65 foot ingress/egress utility easement is in
conflict with the new construction, obtain the necessary abandonment.
Application is available in the Planning and Zoning office.
17. The "Master Site Plan" shall show all proposed traffic control markings
and signage and all proposed site lighting. [Chapter 4, Section 7.B.2. and
4.]
18. Paving and drainage plan needs to be modified to agree with the master
site plan drawing (building letters do not match and parking spaces and

19. Add note to plans that damaged concrete sidewalk is to be replaced along

including identifying the number provided at the site. The total number
of accessible parking spaces provided at the site shall comply with the
accessibility code. To property evaluate whether the number of
accessible parking spaces provided on the plan is in compliance with the
code add to the survey the parking space layout of the existing parking
that is being redesigned as part of this submittal. This parking layout
shall include delineating the location of the existing regular and handicap
spaces. Incorporate into the accessible parking data the number of
existing accessible parking spaces that are located within the already
constructed parking area prior to and after the proposed improvements.

PLANNING AND ZONING
Comments:
32. Provide a clause on the survey stating that the property was abstracted
for rights-of-way and easements, as required by LDR, Chapter 4 Section
7.A.
33. Land Development Regulations, Chapter 4, Section 7.B.2 requires that
size, design and color of proposed site and wall signage consistent with
Chapter 9 - Community Design Plan, Section 10. I. And Chapter 21 -
Sign Code, Article IV, Section 7 be provided at the time of site plan
submittal. Since this information is missing it will be required to be
reviewed by the Planning and Development Board and Commission
prior to sign permits being issued. Place a note on plans to this effect.
34. Site lighting shall be shown on both the site plan and landscaping plan as
required by LDR Chapter 4, section 7.B.2, to eliminate potential
conflicts with landscape material and existing or proposed on site
easements.
35. Show all property lines on the site plan and label them in accordance
with the approved master plan and plat. The site plan shall encompass
all combined parcels and the site data table shall be revised to reflect all
data pertaining to the combined area (include existing parking provided
and required).
