(3)(a) The state land planning agency shall not review or issue a notice of intent for small
scale development amendments which satisfy the requirements of paragraph (l)(c). Any
affected person may file a petition with the Division of Administrative Hearings pursuant to ss.
120.569 and 120,57 to request a hearing to challenge the compliance of a small scale
development amendment with this act within 30 days following the local government's
adoption of the amendment, shall serve a copy of the petition on the local government, and
shall furnish a copy to the state land planning agency. An administrative law judge shall hold a
hearing in the affected jurisdiction not less than 30 days nor more than 60 days following the
filing of a petition and the assignment of an administrative law judge. The parties to a hearing
held pursuant to this subsection shall be the petitioner, the local government, and any
intervenor. In the proceeding, the local government's determination that the small scale
development amendment is in compliance is presumed to be correct. The local government's
determination shall be sustained unless it is shown by a preponderance of the evidence that the
amendment is not in compliance with the requirements of this act. In any proceeding initiated
pursuant to this subsection, the state land planning agency may intervene.
(b) I. If the administrative law judge recommends that the small scale development
amendment be found not in compliance, the administrative law judge shall submit the
recommended order to the Administration Commission for final agency action. If the
administrative law judge recommends that the small scale development amendment be found in
compliance, the administrative law judge shall submit the recommended order to the state land
planning agency.
2. If the state land planning agency determines that the plan amendment is not in
compliance, the agency shall submit, within 30 days following its receipt, the recommended
order to the Administration Commission for final agency action. If the state land planning
agency determines that the plan amendment is in compliance, the agency shall enter a final
order within 30 days following its receipt of the recommended order.
--J7' (c) Small scale development amendments shall not become effective until 31 days after
adoption. If challenged within 30 days after adoption, small scale development amendments
shall not become effective until the state land planning agency or the Administration
Commission, respectively, issues a final order determining the adopted small scale
development amendment is in compliance.
(4) Each governing body shall transmit to the state land planning agency a current copy of
its comprehensive plan not later than December I, 1985. Each governing body shall also
transmit copies of any amendments it adopts to its comprehensive plan so as to continually
update the plans on file with the state land planning agency.
(5) Nothing in this part is intended to prohibit or limit the authority oflocal governments to
require that a person requesting an amendment pay some or all of the cost of public notice.
(6)(a) No local government may amend its comprehensive plan after the date established by
the state land planning agency for adoption of its evaluation and appraisal report unless it has
submitted its report or addendum to the state land planning agency as prescribed by s.
163.3191, except for plan amendments described in paragraph (I )(b).
(b) A local government may amend its comprehensive plan after it has submitted its adopted
evaluation and appraisal report and for a period of I year after the initial determination of
sufficiency regardless of whether the report has been determined to be insufficient.
(c) A local government may not amend its comprehensive plan, except for plan amendments
described in paragraph (l)(b), if the I-year period after the initial sufficiency determination of

Enclosed is the City of Boynton Beach Development Order for site plan approval granted on
May 2, 2000.
To continue this project through the development process, please submit to this office four (4)
sets of rectified plans. A rectified plan is a site plan revised to incorporate all applicable
conditions of approval, except those clearly specified to be met at time of permit review, A
person managing your permit applications should be made aware of any such conditions and
submit required documents with your permit package.
Additional engineering plans or other pages which will be required for your permit package but
were not part of the approved site plan set should not be submitted with the rectified site plan
sets.
Please note that a rectified plan must be signed off by all TRC members prior to submittingfor
building permits. Our staff is committed to speedy and efficient completion of your site plan
rectification process. However, failure to meet all applicable conditions in the first rectified plan
submission will require further revisions and subsequent reviews by the TRC members and thus
produce unnecessary delays. Feel free to contact any TRC member for additional clarification of

Dear Mr, Morrison:
In response to your request, I have provided the following summary or documentation for the
above-referenced meeting.
With respect to the plans for the east side of the property, you will recall that staff recommended
that owners of adjacent property be contacted to obtain information relative to support of, or
opposition toward the desired expansion to the parking lot. It is the intent that this early contact
facilitate possible negotiations to address needs of both parties.
As for the west side expansion plan, including the rezoning of property, I must respond
negatively. The rezoning of Lots 1-5 would represent an encroachment into this stable single
family subdivision. This change would alter the current, continuous boundary that exists
between the two zoning districts, establish precedence from which future changes to this
boundary could be justified, and allow the impact of the hospital to penetrate into this single
family neighborhood. For the reasons stated herein, city staff could not support the rezoning of
parce1s1-5 for hospital parking.

We wish to inform you that the drainage calculations for the above referenced
project have been revised as described below, improving (lowering) staging
elevations,
1. The "Average" Water Table, previously shown as 5 feet NGVD, has
been adjusted according to the geotechnical reports to 8 feet NGVD.
This elevation actually reflects "historical high" water table. Because
this elevation is lower than the 6 foot maximum from ground (8.8
NGVD) permissible by SFWMD, it has no bearing on the remainder
of the calculations. The SCS Curve Number does not change.

The storm stages and discharges were recalculated based upon the
design exfiltration trench section. The area of the design section is
greater than the original presumed 5' x 5' section. This has lowered
the staging elevations. The site grading was not adjusted providing an
additional safety factor during the design storm events.

Traffic Analysis for 2450 Sea crest Property 8

It is proposed to construct a parking lot with approximatel~rking spaces on
property located on the east side of Seacrest Boulevard between S.E. 24" Avenue
and S.E. 25" Avenue in Boynton Beach, Florida, The parking lot would help to
alleviate demand during peak periods at Bethesda Memorial Hospital, which is
located south and west of the proposed parking lot. Construction of the parking lot
is projected to occur in 2001. '
Two issues were addressed in consideration of the traffic impacts of this project.
One is the additional traffic that will be generated by rezoning a portion of the
property that is currently residential. The other issue is to analyze the operation of
the intersection along Seacrest Boulevard that is to serve as the access point to the
proposed parking lot.
Trip Generation Comparison
The parking lot is proposed to be built on approximately 1.45 acres of land that is
currently divided into four smaller lots. The two lots with frontage on Seacrest
Boulevard, which combined comprise approximately 0,95 acres, are currently zoned
for commercial use and would not require rezoning in order to construct a parking
facility for the hospital. The other two lots, which are on the south side of S,E. 24"
Avenue, measure a combined total of approximately 0,5 acres and are currently
zoned for residential use. These two lots would need to be rezoned for commercial
use also in order to construct a portion of the parking lot on the two lots.
To analyze the impact of this zoning change, trip generation was estimated for a
likely use at the site, Although the site is proposed to be used only for a parking lot,
trip generation was conducted for a medical office building assuming a floor area
ratio (FAR) of 0,25. Medical office building was used for the trip generation
comparison because it represents the highest trip generating land use that can
reasonably be expected on the property, Parking lots do not have any inherent trip
generation potential. The increase in traffic was determined by comparing the trip
generation for the currently zoned uses with the trips that would be generated by the
proposed rezoning of the two residential lots. This analysis is shown in attached
Table I. The projected net daily increase in traffic is 162 trip ends per day.
Driveway Analysis
The parking lot is proposed to be constructed with one full-access driveway
connecting the driveway to S.E. 24" A venue, To determine the impact caused by
vehicles accessing the parking lot from this driveway, the intersection of Seacrest
Boulevard & S.E. 24" Avenue was analyzed.

Kimley-Hom and Associates conducted an existing turning movement count at S.E.
24'h Avenue & Seacrest Boulevard during the a,m, and p,m, peak periods on
December 21,1999, Intersection volumes were factored to peak season conditions
using the peak season adjustment factor published by the Florida Department of
Transportation, These peak season volumes were then projected for 2001
conditions by applying growth rate of 0.82 percent per year, compounded annually.
The result was the 2001 peak season background traffic conditions,
To provide a conservative analysis of traffic to and from the parking lot during the
a.m. and p,m. peak periods, it was assumed that each parking space generates one
trip during both of the peak periods. Based on a proposed capacity of eighty
parking spaces, eighty trips into and out of the parking lot were evaluated during
each of the peak periods, During the a,m. peak period, 90 percent of these eighty
trips were calculated to be inbound trips and 10 percent were calculated to be
outbound trips. The opposite was assumed for the trips during the p.m. peak period,
All of the parking lot traffic was assigned to Seacrest Boulevard via S,E. 24"
A venue in order to travel to and from the parking lot. An assignment to Seacrest
Boulevard of 50 percent north and 50 percent south was used in the analysis.
Turning movement volumes were developed for traffic to and from the parking lot.
These volumes were then added to the 200 I peak season background volumes to
determine the total 200 I traffic conditions at the intersection of Seacrest Boulevard
& S,E, 24'h Avenue after construction of the parking lot.
Using methodology from the 1987 Highway Capacity Manual, the total traffic
conditions were analyzed at the intersection of Seacrest Boulevard & S.E. 24'h
A venue in order to determine the Level of Service at the intersection. As shown in
the attached analyses, the intersection is projected to operate acceptably in both the
a.m. and p,m. future peak hours.
Conclusions
The construction of a parking lot on the property will not create adverse traffic
conditions, The increase in potential trip generation caused by rezoning the two
residential lots would potentially add a total of 162 trip ends per day, A peak hour
analysis showed that, even with conservative assumptions regarding parking
demand and turnover at the site, the intersection at Seacrest & S.E. 24'h Avenue will
operate acceptably,

Forester (Kevin Hallahan) 742-6267, along with Planner (Lusia) are
concerned with screening from residential. They would prefer landscaping
to be on exterior side of wall, and be allowed to grow freely (not sheared).
But that's not required. My concern is maintenance. Lusia suggested that
the wall be "decorative" and in keeping with "residential character". I
drove the neighborhood immediately adjacent to site. There exists several
residential styles, which make no particular neighborhood character
statement (i.e" Colonial, Spanish, etc.). A majority of the homes are
stucco finish with no distinguishing architectural elements to suggest a
character, We need to look at pre-cast finish options (i.e,. split face, etc,)
and be prepared to offer something pleasing to the residents,
Also of concern was lighting overflow into residential properties, We will
install deflector shields. I have field located existing adjoining landscape,
1bcre is a generous amount of existing vegetation and trees existing to
offer shielding of the light and wall. Plus homes have a large rear yard
(10' - 80' :!: deep), Be prepared to state hours of use for the lot imd for the
lighting system,
Kevin also preferred to see replacement trees be placed in buffer adjoining
with residential uses on exterior of wall However, after my site visit, I
den't think this is a concern, LusiaiKevin prefer canopy trees be used
rather than slash pine along frontage, except where near power lines. (See
FPL approved species list) they like the Live Oak trees used elsewhere.
Landscape Plan has I slash pine in utility easement. We need to adjust
location per original c.omments. Also, Banyon Tree is native and needs to

be factored in replacement value, subject to Kevin's site visit (he wants to
verify species), We must note landscape buffer on the Landscape Plan.
Also, place note on Landscape Plan that Cypress Mulch is not allowed.
April 25'" is Commission Meeting, The following Tuesday (May 2), the
Board will review again. Bring 4 sets of "rectified" plans (not
construction) and colored landscape plans, If approved, we can submit for
building permit anytime thereafter.

We have reviewed the comments, dated March 14, 2000 for the above
referenced project. Revised plans are attached. Below is a summary of
revisions/responses to said comments. The number correlates directly to
the "Review Comments" for each commenting Department, which are
attached for reference:
UTILITIES:
I) All known utility easements are shown. The Landscape Plan is
reflective of the Department's concern with trees in/near utility
easements.
2) The Landscape Plan utilizes water conserving designs to the extent
practical. Upon design of the Irrigation Plan, we shall consider
alternate water sources, if readily available.
3) We have attached written acknowledgement by the Engineer
stating that the drainage design shall conform to all applicable
requirements by the City and SFWMD.
4) Our drainage calculations conclude that we can meet said 3 day/72
hour event with 224 LF of 5' x 5' exfiltration trench. Additionally,
a 100 year, 3 day storm event can be contained on site by grading
the' exterior parameters of the parking at elevation 16.5 feet.
Therefore, the proposed facility will not contribute to the flooding
of surrounding buildings. Attached please find preliminary
Drainage Plans for your review.

Access Plan". This plan depicts the proposed parking expansion in
relation to the Hospital Building. Handicap accessible entry doors
have been indicated on this new plan sheet.
Existing handicap accessible parking is depicted on the
aforementioned "Pedestrian Access Plan', along with its
disbursement.
The number of existing handicap accessible parking spaces meets
that required. The requirement for handicap spaces is met at the
Hospital Building. The aforementioned "Pedestrian Access Plan"
depicts the movement of pedestrians from proposed parking
expansion to the Hospital Building. The proposed new
construction will be designed to meet the requirements of the
Florida Accessibility Code 4.1.5 and 4.1.6 up to the "existing
facility" which, being in existence prior to October 1997, is not
required to comply with said code, although accessible features are
provided.
