DESCRIPTION: Morton Group, Inc., agent for Howard Scharlin, trustee of the Shoppes of Woolbright PCD, is requesting site plan approval to construct a 2,911 square foot Burger King restaurant with a drive-thru lane on .918 acres within the PCD. The subject parcel is located on the northeast corner of S. W. 8th Street and Woolbright Road (a part of Tract "C" of Shoppes of Woolbright PCD). For further details pertaining to this request, please see attached Planning and Zoning Department Memorandum No. 96-497. RECOMMENDATION: The Planning and Development Board, with a 5-1 vote, recommends approval of this request subject to all staff comments in attached Exhibit "C", Conditions of Approval, with modifications to comments 9, 23 and 27, pertaining to timing and type of construction of the proposed ingress/egress road and haul road before the site is utilized; and screening from view, at a distance of 600 feet, roof top equipment. Submit to the Planning and Zoning Department a presentation board containing samples of all exterior building materials to be used for construction. Since this submittal is incomplete without this, the applicant may be at risk of additional building design comments being generated by staff that may have to be appealed to the Commission if this is received after the Board and Commission meetings. 42. A rectified master plan showing compliance with all conditions of approval, shall be submitted prior to issuance of a buildinQ permit. ADDITIONAL PLANNING AND DEVELOPMENT BOARD CONDITIONS 43. Reword #9 as follows: Proposed ingress/egress road "by others" shall be stabilized rock construction before construction of Burger King begins. Access (haul road) shall be provided before construction of Burger King begins. 44. Reword #23 as follows: A certificate of occupancy will not be issued until the access road is completed. 45. Reword #27 as follows: Any roof top equipment will have to be screened from view at a distance of 600 feet, excluding the view from the 1-95 ramp. Proposed Development: The developer is proposing construction of a Burger King restaurant with a seating capacity of 84 and a drive-through window for food pick-up located on the west elevation of the building. The parking associated with this development will contain 36 spaces (see Exhibit "B" - proposed site plan). / Page 2 Site Plan Review Staff Report Memorandum #96-497 Burger King Restaurant Concurrency: a. Traffic b. Drainage- Driveways: Parking Facility: Landscaping: Building and Site Regulations: The project, as a part of Shoppes of Woolbright PCD and Woolbright Place PUD settlement agreements, was reviewed by the Palm Beach County Traffic Division. It was determined at that time that the PCD and PUD met the requirements of the Traffic Performance Standards of Palm Beach County in effect in 1986. A traffic study has been submitted, to compare this use with the use previously planned for this parcel and to monitor the traffic vesting of the overall PCD. The study shows that the project will meet the Palm Beach County Traffic Performance Standards. Insufficient drainage information has been submitted for the Engineering Division to certify compliance with the City's drainage levels of service. Certification is required at the time of site plan approval. The Engineering Division is recommending that this be postponed to time of permit review. A 27 foot wide ingress/egress major driveway access aisle is proposed just north of the property. It will be constructed to serve both the Burger King property and the vacant property to the north. The major driveway access aisle will connect S.W. 8th Street with the Home Depot parking. The driveway access for the subject site is on the south side of the major access aisle, approximately 110 feet east of S.W. 8th Street. There is a pre-constructed curb-cut in S.W. 8th Street for this driveway, however, its location has to be moved approximately 25 feet to the south to accommodate the current configuration of lots. There are 36 on-site parking spaces to be provided including 2 handicap accessible spaces as required by the ADA. It exceeds the minimum standard of 34 parking spaces required by the Land Development Regulations, Chapter 2 - Zoning for the restaurant use. The landscaping of the site will fully meet the code requirements when staff comments are incorporated. Community Design Plan: The proposed building represents the standard design of the corporation; colored stucco walls with red tile horizontal accent strips. Three sides of the building are embellished with a three foot roof overhang covered with bronze standing seam sheet metal. Signage: The west side of the building elevation (S.W. 8th Street side) contains a drive-through facility. Community Design Plan requirements for the drive-through operation will be fully met when staff comments are incorporated. Signage submitted is not part of the approved sign program. Provide peak flow demand, based on gpm (gallons per minute), to justify water meter size. 2. Palm Beach County Health Department permits will be required (Sec. 26.12). 3. Plan shall show location of all utility easements, existing or proposed, on or off site, (Sec. 26.33(a)). 4. Only palm trees will be permitted in utility easements, (Sec. 26.33(a)). 5. Utility easements shall be a minimum of 12' (twelve feet), (Chapter 6, Art. IV, See, 6.A). 6. City water will not be supplied for irrigation. City's Land Development Regulations require that every site plan submittal contain a building floor plan. Provide a current floor plan of the structure. Include in this floor plan features required by the Community Design Plan relative to drive up windows. 26. The required setbacks for the PCD zoning district are correctly noted on the site plan, sheet C-1, however, they are not drawn on the site plan. Draw in the required setbacks on sheet C-1 to comply with the submittal requirements. 27. Any rooftop equipment will have to be screened from view at a distance of 600 feet. If such equipment is planned, indicate its location and the height of the equipment above the roof level. Take into consideration the elevation change on the 1-95 westbound ramp (Woolbright Road). 28. The design standards for loading zones require the minimum area of 12 feet wide by 35 feet long. Correct the size of the loading zone proposed on the site plan. 29. City's Land Development Regulations require that each site plan submittal contain a current survey. Provide the document as required. 30. Chapter 9 of the LDR, Community Design Plan, requires that no drive-up windows shall be located on a building facade that faces a public or private street, unless several requirements are met as outlined In adopted City Commission ordinance No. 096-31. The submitted drawings show the following deficiencies: A. A pitched roof and facade off-set is required for every drive-up window. Provide an appropriate architectural treatment for the southern drive-up window. B. Within the required landscape buffer screening the entire drive-through lane shall contain a minimum two foot tall earth berm meeting the specifications as described in LDR, Chapter 9, Section 11.H.5. Provide required berm and indicate its location on sheet C-1, site plan. C. On the Landscape Plan, Sheet L-1, amend the tabular summary of the planting material to include a "landscape material required by the code" category. Also, provide relevant calculations for this category. For the landscape buffer adjacent to the right-of way, provide perimeter distances of the parcel for which the landscape buffer material is being calculated. 32. Incorporate the above calculation into the tabulation of the landscape material provided for the site. All native species shall be distinguished from non-native species with a recognizable symbol. Preliminary calculations by city staff indicate that the 50 percent ratio of native species for required amount of trees and shrubs is not met. Verify the amount of required and native species by providing corresponding calculations. 33. Indicate the spacing of required trees. 34, A continuous hedge shall be provided in all landscape buffers adjacent to rights-of-way. It is recommended that the hedge located on both sides of the main entrance to the property be extended further to better screen the vehicular use area. 35, On the Site Plan, sheet C-1 and on Landscape Plan, Sheet L-1, indicate the width of the required, 10 feet wide, peripheral greenbelt. 36. It is recommended that the peripheral greenbelt be enhanced by providing more diversified planting material including, but not limited to hedges. 37. The approved master plan requires that two deceleration lanes be provided for vehicular traffic on S.W. 8th Street as it approaches the access road to the subject property from the north and the south. Alter the median within S.W. 8th Street to reflect these requirements of the master plan. 38. Provide details of the dumpster enclosure including its dimensions (including the height), exterior finish and landscaping, as required by the code. 39. To minimize the visual impact of the service area, buffer the loading zone as required by the code using a screen wall and accent shrubs or a vegetative buffer. 40. Remove the trees from the 6-foot wide utility easement located in the easternmost part of the parcel.
