The developer is proposing construction of a 7,886 sq. ften
a 1.68 acre parcel of land south of the Boynton C-16 Cana and
west of Congress Avenue (see Exhibit "B" - proposed site plan).
The restaurant will contain 224 seats. The parking associated with
this development will contain 136 parking spaces, including five
handicap accessible spaces, as required by the ADA.
A traffic statement was prepared and sent to the Palm
Beach County Traffic Division for evaluation. It was
determined that the traffic generated by this project meets
the Traffic Performance Standards of Palm Beach County
and no off-site improvements are warranted as a result of
this construction.
According to the applicant's engineer, the site drainage, as a
part of the Boynton Beach Mall drainage system, was
presented to, and approved by the South Florida Water
Management District. Certification by the developer's
engineer is required stating that the drainage system
complies with all applicable city codes and standards. The
Engineering Division is recommending that this be
postponed to time of permit review.
There is an existing 24 feet wide ingress/egress access drive onto
Congress Avenue just south of the restaurant property. The
access drive will be used as a shared access between the
proposed restaurant and the existing bank located south of the
restaurant. The off-site access drive provides a connection to a
loop-shaped parking aisle serving the parking facility for the bank
and restaurant.
There are 136 parking spaces to be provided for this use including
five handicap accessible spaces as required by the ADA. This
meets the minimum standard of 90 parking spaces required by the
Land Development Regulations, Chapter 2 - Zoning for the size
and use of the building proposed.
There are trees and a hedge located on the adjacent property
already in place that the applicant wishes to receive credit for with
respect to pl;!rimeter landscape buffer requirements. The petitioner
needs to verify that this material meets the city requirements and
design standards. Also, minor modifications are needed to
properly screen the proposed dumpster. Landscaping will fully
meet the code requirements when staff comments are
incorporated.

Community Design
Plan: The building is facing a major arterial street, Congress Avenue,
providing good exposure and visibility of the business. The building
walls are finished with a combination of beige stucco and red-
brown brick. The entrance and the belvedere structure are covered
with a dark green, standing seam metal roof. The balance of the

restaurant is covered with a flat roof. Windows adjacent to the
seating area are decorated with canvas awnings having a red-
green striped pattern.
The architectural character of the building, as well as the use of the
combination of stucco and brick as a wall finish, makes this building
architecturally compatible with the adjoining buildings, especially
with the architecture of the Catalina Shopping center located north
of the Boynton Canal.
Signage:
Signage, although requested by staff and required to be submitted
at time of site plan approval, was not submitted with this site plan.
It is recommended that signs be approved administratively, subject
to compliance with the Land Development Regulations.
RECOMMENDA liON:
The Planning and Zoning Department recommends approval of this site plan request,
subject to the comments included in Exhibit C - Conditions of Approval. The Technical
Review Committee recommends that the deficiencies identified in this exhibit be
corrected on the set of plans submitted for building permit.

2. A capacity reservation fee will be required within thirty (30) days
of City Commission approval, or upon request for Utility
Department signature on the HRSIDEP permit applications. The
fee amount will be determined based upon meter size or
expected demand, (Sec. 26-34[E].
3. Palm Beach Health Department permit will be required, (Sec. 26-
12).
4. City water will not be supplied for irrigation. Please show source
and location on your plans, (City Compo Plan, Policy 3C.3.4).
5. Utilities requests a meeting with the project engineer to discuss
alternate locations of the proposed water main to minimize
conflicts with the proposed landscaping.

8. All plans submitted for specific permits shall meet the city's code
requirements at time of application. These permits include, but
are not limited to the following; site lighting, paving, drainage,
curbing, landscaping, irrigation and traffic control devices.
Permits required from agencies such as the FOOT, PBC,
SFWMD and any other permitting agency shall be included with
any permit request. Chap. 1 , Art.!, Sec.6, pag.A, pg.1-3.
9. County road entrance sign requires PBC approval and state road
entrance sign requires FOOT approval.
10. Provide certification by developer's engineer that drainage plan
complies with all city codes and standards. Chap.6, Art.V, Sec. SA,
pg.6-7 and Chap.23, Art.IIF, pg.23-8.
11. Provide details for pavement, grates, pipes, catch basins, etc.
Chap.6, Art.V, Sec.4B2e, pg.6-20.
12. Stormwater shall be contained on site. Provide for the retainment
of the first one-half inch of stormwater runoff prior to conveyance

on Uniform Traffic Control Devices". Chap.23, Art.IIB2, pg.23-7.
16. It is recommended that the width of the perimeter sidewalk be
increased from 5' to 7' and the wheel stops be eliminated.
17. It is recommended that the width of the H/C access path on the
southernmost H/C stall be reduced from 8' to 5' and standard
stalls made slightly wider. (The 12' wide H/C stall and 5' wide
path meets criteria of a "universal stall" which includes "van
accessible stalls"). Also the wider 8' path creates the impression
of being a separate parking stall.

Comments:
18. Any roof top equipment will have to be screened from view at a
distance of 600 feet. If such equipment is planned, indicate its
location and the height of the equipment above the roof level.
Provide elevations of the structure showing the roof top
equipment and the required screening (all reduced to a small
scale) and draw in on these elevations the lines-of-sight
connecting the highest point of the equipment with eye level from
a distance of 600 hundred feet from the building (LDR, Chapter 9,
Section 11.E). If no roof top equipment is planned, make an
~ appropriate notation on sheets A-4 and A-5.
ICV Provide a detailed drawing of a dumpster enclosure meeting the
design standards as described in LDR, Chapter 9, Section 10.C
and Chapter 7.5, Article II, Section 5.J. The dumpster walls
shown on sheet A-4 indicate a height in excess of the allowed 6
feet. Correct the drawings to depict the appropriate height of the
dumpster walls of 6 feet.
20. Eliminate inconsistencies between the landscape plan and the
site plan with respect to dumpster location and its configuration
on the site.
21. Lighting shall be shown on the landscape plan to eliminate
potential conflicts with landscape material and existing on-site
and/or proposed easements.
22. Indicate the use of the building in the northwest corner of the
property.
23. On the Landscape Plan, Sheet 2 of 2, provide a tabular summary
of the planting material to include a "landscape material required
by the code" category. Also, provide relevant calculations for this
category. For the landscape buffer adjacent to rights-of way and
along abutting properties, provide perimeter distances of the
parcel for which the landscape buffer material is being calculated
(Chapter 7.5, Article II - Landscape Code).
24. Incorporate the above calculation into the tabulation of the
landscape material provided for the site. All native species shall
be distinguished from non-native species with a recognizable
symbol. The native requirement is fifty percent of the required
landscape planting (Comprehensive Plan Policy 4.4.6).
25. Eliminate back lit awnings and lighting fixtures directing lighting
on the awnings (LDR, Chapter 9, Section 10.F.5).
26. Provide information regarding size, design and color of
proposed signs on the property. It is recommended that signs

be approved administratively, subject to compliance with LDR.
27. Remove the proposed sign from the 20 feet wide utility
easement along Congress Avenue.
28. Provide for staff review a cross easement and parking agreement
to allow shared common access from Congress Avenue for both
properties: the subject property and the property located
immediately to the south of the subject property.
29. The above ground transformer structure located south of the
restaurant building shall be screened, as a service area, at
minimum, with an 18 inch high hedge (at the time of planting) and,
after reaching its maturity, maintained at a height of six feet.
30. Vehicular use areas shall be screened from adjacent rights-of-
way with a vegetative buffer, as required by LDR, Chapter 7.5,
Article II, Section 5.E. If such landscape material already exists
on adjacent lots, the on-site buffer requirement can be waived,
but only when this existing landscape buffer meets the city
standards. Existing vegetative buffers along the east, north and
west property lines do not meet the fifty percent native species
requirement as mandated by Comprehensive Plan Policy 4.4.6.
In addition to the existing off-site landscape material credited
towards the required peripheral, vegetative buffer provide
sufficient, on-site, landscape material (for both trees and hedge)
to meet the 50 percent requirement.
31. Verify on the permit set of drawings that the "back-up" space for
the parking stalls located south of the proposed restaurant meets
the minimum city standard of 27 feet.

division a memorandum containing a description of the unresolved conditions. If the unresolved conditions
are not permit related, please notify the owner or the owner's agent to ensure that the matters are rectified.

We have reviewed subject project and have the following comments:

1. All plans submitted for specific permits shall meet the City's code requirements at time of
application. These permits include, but are not limited to the following; site lighting,
paving, drainage, curbing, landscaping, irrigation and traffic control devices. Permits
required from agencies such as the FDOT, PBC, SFWMD and any other permitting agency
shall be included with your permit request. Chap. 1 , Art.I, Sec.6, par.A, pg.I-3
2. County road entrance sign requires PBC approval & State road entrance sign requires FDOT
approval.
3. Provide certification by Developers' Engineer that drainage plan complies with all City
codes & standards. Chap.6, Art.V, Sec.5A, pg.6-7 and Chap.23, Art.IIF, pg.23-8
4. Provide details for pavement, grates, pipes, catch basins, etc. Chap.6, Art.V, SecAB2e,
pg.6-20
5. Stormwater shall be contained on site. Provide for the retainment of the first one-half inch
of storm water runoff prior to conveyance to offsite receiving waters. Chap.23, Art.IIF,
pg.23-8 and Chap.6, Art.IV, Sec.5B, pg.6-8
6. Specify clear sight triangles at all driveways and adjust landscape plan if needed. Chap.7.5,
Art.II, Sec.5H2, pg.7.5-17
7. Align access paths from sidewalks with HlC accessible paths including stop bars and signs.

Recommendations
1. Increase widths of perimeter sidewalk from 5' to 7' and eliminate requirement for wheel
stops.
2. Reduce width ofHlC access path on southernmost HlC stall from 8' to 5' and make
standard stalls slightly wider. (The 12' wide HlC stall and 5' wide path meets criteria of a
"universal stall" which includes "van accessible stalls"). Also the wider 8' path creates the
impression of being a separate parking stall.

The following is a list of 1 st review comments regarding the site plan review of the plans
for the above-referenced project. The applicant shall understand that all documents
and plans submitted for site plan review are subject to additional comments. I
recommend that the applicant/agent contact me regarding questions related to the
comments. If the applicant is not intending to correct code deficiencies, he should
contact me regarding the procedures, application forms, fees and submittal deadline
dates for seeking relief from the code requirement.
1. Any roof top equipment will have to be screened from view at a distance of 600
feet. If such equipment is planned, indicate its location and the height of the
equipment above the roof level. Provide elevations of the structure showing the
roof top equipment and the required screening (all reduced to a small scale) and
draw in on these elevations the Iines-of-sight connecting the highest point of the
equipment with the eye level from a distance of 600 hundred feet from the
building (LOR, Chapter 9, Section 11.E). If no roof top equipment is planned,
make an appropriate notation on sheets A-4 and A-5.
2. Provide a detailed drawings of dumpster enclosures meeting the design
standards as described in LOR, Chapter 9, Section 10.C and Chapter 7.5, Article
II, Section 5.J. The dumpster walls shown on sheet A-4 indicate the height in
excess of allowed 6 feet. Correct the drawings to depict the appropriate height
of the dumpster walls of 6 feet.
3. Eliminate inconsistencies between landscape plan and landscape plan in respect
to dumpster location and its configuration on the site.
4. Lighting shall be shown on the landscape plan to eliminate potential conflicts with
landscape material and existing on-site and/or proposed easements.
5. Indicate the use of the other building in the northwest corner of the property.
6. On the Landscape Plan, Sheet 2 of 2, provide a tabular summary of the planting
material to include a "landscape material required by the code" category. Also,
provide relevant calculations for this category. For the landscape buffer adjacent
to rights-of way and along abutting properties, provide perimeter distances of the
parcel for which the landscape buffer material is being calculated (Chapter 7.5,
Article II - Landscape Code).
7. Incorporate the above calculation into the tabulation of the landscape material
provided for the site. All native species shall be distinguished from non-native
species with a recognizable symbol. Note, that the native requirement is fifty
percent of the required landscape planting (Comprehensive Plan Policy 4.4.6).

8. The submitted traffic statement shall be approved by the Palm Beach County
Traffic Division prior to the City Commission meeting.
9. Eliminate back lit awnings and shine-on lights directing light on the awnings.
10. Provide information regarding size, design and color of proposed signs on the
property. It is recommended that signs will be approved administratively, subject
to compliance with LOR.
11. Remove proposed sign from the 20 feet wide utility easement along Congress
Avenue.
12. Provide for city staff review a cross easement agreement in regard to a common
access from Congress Avenue for both properties: the subject property and a
property located immediately to the south of the subject property.
13. It is recommended that the above ground transformer located south of the main
restaurant structure be screened, as a service area, at minimum with a 1.5 feet
high hedge (at the time of planting) and, after reaching its maturity, at the height
of six feet.
14. Vehicular use areas should be screened from adjacent rights-of-way with a
vegetative buffer, as required by LOR, Chapter 7.5, Article II, Section 5.E. If
such landscape material already exists on adjacent lots, the on-site buffer
requirement can be waived, but only when this existing landscape buffer meets
the city standards. Existing vegetative buffers along east, north and west
property lines do not meet the fifty percent native species requirement as
mandated by Comprehensive Plan Policy 4.4.6. In addition to the existing off-
site landscape material credited towards the required peripheral, vegetative
buffer provide sufficient, on-site, landscape material (for both trees and hedge) to
meet the 50 percent requirement.

The 52-restaurant chain has a contract
to buy land on Congress Avenue near the
Boynton Beach Mall. If all goes as '
planned, it will be the first of several Palm
Beach County sites featuring a Cooker
Bar and Grille.
Well-known in the Midwest, Cooker is
a casual dining chain on the order of T. G.1.
Friday's or Applebee's, whom it counts
among its competitors.
But Cooker says its fresh ingredients
and from-scratch cooking set it apart from
those restaurants. And the company is so
sure you'll like it that if you aren't
100 percent satisfied with your meal, you
get it free.
If that seems hard to believe, consider
this: Cooker gave away $2.1 million in
food last year, representing nearly 2 per-
cent of its sales.
"If you're not happy, we don't expect
you to pay," President ;:nd Chief Operat-
ing Officer Phillip Pritchard said.
"We don't like to mess up," he added,
"but when we do, recovery is what it's all
about."
Cooker does no advertising, aside
from the occasional billboard or holiday
newspaper ad. Instead, the company di-
rects the money it might otherwise spend
on promotion into the guarantee program.
"The most efficient and effective way
of advertising is by word of mouth," said
Pritchard, who spent more than 20 years
with the Red Lobster chain before joining
Cooker in late 1994.
Cooker's net income rose 52 percent
to $6.7 million in 1996, while sales were
up 20 percent to $110.3 million. The sales
growth is attributable to new stores since
same.store sales fell 1.6 percent for the
year.

Ohio, which initially drew sales
away from existing Cooker sites
that were close by.
"We think it was the right
thing to do to penetrate the mar-
ket," he said.
The company opened 11 new
sites in 1996 and expects to open
12 this year, including two in Palm
Beach County. In addition to the
pending contract in Boynton
Beach, it's looking at sites in Palm
Beach Gardens, West Palm Beach
and Boca Raton.
It' closed one restaurant last
year in Palm Harbor, Fla., be~ause
the company had an opportumty to
make more money leasing the
facility to another establishment,
Pritchard said.
Cooker's Florida restaurants
arc in Gainesville, Orlando, Fort
Myers, Tampa and Melbourne.
The publicly traded company
moved its base to Palm Beach
County from Columbus, Ohio, be-
cause several of its officers have
homes in the area.
Chainnan G. Arthur See\-
binder has a home on Middle Road
in Palm Beach, where his neigh-
bors include billionaire John
Kluge, founder of Metromedia In-
ternational Group, and singer/
songwriter Jimmy Buffett.
Seelbinder founded Cooker in
1984 with three others, including
senior vice president of operations
Glenn Cockburn, a trained chef
who has created most of the items
on the Cooker menu.
Cooker, whose restaurants are
all company-owned, stumbled in
the early 1990s primarily because
it grew too fast.
While the company has always
been profitable, same-store sales,
the primary measure of a restau-
rant chain's health, fell about 2
percent in 1993 and about 3 per-
cent in 1994.
"They pushed the pedal to the
metal too hard and opened some
restaurants that underper-
formed," said Robert Derrington.
an analyst with Equitable Securi-
ties Corp. in Nashville, where
Cooker opened its first restau-
rants.
The company's stock, which
traded as high as $23.75 a share in
late 1992, had fallen to $6 a share
by the end of 1994. That's about
the time Seelbinder hired Pritch-
ard, who analysts credit with engi-
neering a turnaround.

new chief financial officer and a
new director of real estate.
Todd Sonin, the real estate
director, who formerly handled
Boston Market sites in South
Vlorida, came to Cooker in Octo-
ber. He's been busy looking for
sites, a task formerly perfonned
by Seelbinder himself.
"Our game plan is to get four,
tnaybe five in Palm Heach Coun-
ty," Sonin said, "and the same in
Broward and t!wn in Dade."
That's another reason the
company decided to move. It start-
ed out in Nashville and later
moved to Ohio when it was ex-
panding in that area. Now its ex-
pansion target is the Southeast.
"It makes sense to be closer to
the market you're trying to pene-
trate," said Richard Wayman, an
analyst who follows Cooker for
The Ohio Co., a Columbus-based
investment banking finn.
Wayman, who was cOJ?1fortable
with Cooker's modest stnp-center
digs in Columbus, admits to being
a bit wary of Cooker's move south.
He worried the company would
blow a lot of money on an ostenta-
tious headquarters.
But when he visited the offices
at 5500 Village Blvd., just north of
45th Street, he was pleasantly
surprised. Cooker bought the
32 OOO-square-foot building out of
fo;eclosure for a bargain $1.9 mil-
lion.
Cooker, which employs about
25 at the site, occupies the second
floor. The bottom floor is leased.
But while Cooker is comfort-
ably established in its new home,
Palm Beach County consumers
still haven't been able to sample
the company's fare.
What can they expect?
"Cooker is like going to your
parents' house to cat," Wayman
said. "The decor is comfortable
and subtle."
A Cooker is quieter than say a
Friday's, Wayman said. And the
menu, with an average check of
$10.70, features what Cooker calls
regional American food: me~t1oaf,
prime rib, salads and pasta dIshes.
And if for any reason custom-
ers are unhappy with their meals,
they don't pay for them. That way,
the company reasons, they're like-
ly to come back.
Restaurant broker Richard
Lackey, of the Lackey Coso in
Palm Beach, said while Cooker's
satisfaction guarantee is good
business it's not so different from
. what m~st top restaurant chains
do.
"They are just using it as a
marketing item," Lackey said.
Cooker, which analysts say has
more servers and seaters than
most other chains at peak hours,
had been criticized for over-staff"
ing its restaurants.
Since early 1994, the company
has lowered its managers-per-res-
taurant average from 8.3 to 5.5,
which still is slightly above the
industry average of 4-5.
Serving lunch and dinner sev-
en days a week, an average Cook-
er restaurant employs about 100
people. According to a recent re-
port by San Francisco-based
Montgomery Securities, a Cooker
general manager's salary and bo-
nus can exceed $85,000.
That's on par with most casual
dining chains, analysts said. But
Cooker spends a higher-than-av-
erage percentage of sales on labor
because it typically has more em-
ployees per restaurant.
Cookcr last year spent 34.5
percent of sales on labor and bene-
fits. By contrast, Applebee's spent
31 percent and Chili's 27.6 per-
cent, according to an Equitable
Securities report.
"We spcnd a lot more money
011 labor," Pritchard said. "That's
on purnose."
