R98-SciG A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING ABANDONMENT Of A TWENTY FOOT WIDE ALLEY LOCATED JUST WEST OF LOTS 3 AND 4 OF BLOCK 1 OF THE LAKE ADDmON TO BOYNTON BEACH SUBDIVISION; BEING MORE PARTICULARLY DESCRIBED IN EXHIBIT "A" ATTACHED HERETO; AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A DISCLAIMER FOR SAID ABANDONMENT; PROVIDING THAT THE ATTACHED DISCLAIMER BE RECORDED IN THE PUBLIC RECORDS OF PALM BEACH COUNTY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Dee Monette of GiI Hyatt Construction, agent for Harry Hamilton Trustee, the owner of the property has requested the abandonment of a twenty (20) foot wide alley located just west of lots 3 and 4 of Block 1 of the Lake Addition to Boynton Beach subdivision, in connection with the Enterprise Rent-A-Car Conditional Use request; and WHEREAS, comments have been solicited from the appropriate City Departments, and public hearings have been held before the City's Planning and Development Board Ci:1d the City Commission on the proposed abandonment; and WHEREAS, based on the foregoing information, the said alley to be abandoned no longer serves any useful purpose. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA THAT: Section 1. The City Commission of the City of Boynton Beach, Florida by and through its City Commission, does hereby abandon a twenty (20) foot wide alley located just west of lots 3 and 4 of Block 1 of the Lake Addition to Boynton Beach subdivision, in connection with the Enterprise Rent-A-Car Conditional Use request, as depicted on the attached Exhibit "A", located in the City of Boynton Beach, Florida. Section 2. The Mayor and City Clerk are hereby authorized and directed to execute and deliver the attached Disclaimer and cause the same to be filed in the Public Records of Palm Beach County, Florida. The following people made up the committee: Steve Sills - Principal of Congress Middle Schoof Mrs, Anna Noe. Chief Prosecutor, Delray Beach Branch of State Attorney's Office Maurice Rosenstock. representing the local court system Mrs. Claudia Kirk Barto. Palm Beach County United Way Marshall Gage, Police Chief - City of Boynton Beach The Police Department selected technology as the area of application for the funds. They specifically targeting mobile computing in order to expedite report writing in the field, immediately loading them into the records management system and accessing FCICMCIC which is a state-wide and nation-wide criminal information system, This technology has been available for a few years. but the department did not have funds available for it. The Police Department is hopeful that this program will cut report writing time in half for officers in the field. freeing up time for more road patrol. improve report writing accuracy and research capabilities, free up air time on a radio frequency that is drastically clogged with talk. and the freeing up of clerical staff inside the department to be utilized for other department tasks. The committee met on June 26 to review the recommendation, There was a considerable amount of discussion, and the committee unanimously agreed to support the department in this endeavor, They made a recommendation to move forward with the proposal. The last requirement of this program requires a public hearing. If there are no objections. there are no other reqUIrements other than to move forward with this project. MAYOR TAYLOR ANNOUNCED THE PUBLIC HEARING. THERE WAS NO ONE PRESENT WHO WISHED TO SPEAK ON THIS ISSUE. Chief Gage thanked the committee for their input. The department will move forward with this project immediately. Chief Gage confirmed for Mayor Taylor that no action from the Commission was required. Mayor Taylor thanked the committee for their work on this project. B. Attorney Cherof administered the oath to all who would be speaking on this issue tonight. Dee Monette was present and had no comments. Mayor Taylor advised the Commission that the Planning and Development Board unanimously recommended approval of this application, 13 MINUTES PLANNING AND DE"eLO,..MENT BOARD MEETING BOYNTON BEACH, FLORIDA JULY 22, 1997 Lloyd Powell of Alpine Florist. 1112 N, Federal Highway, spoke against this conditional use at this location. He believes this is the wrong place for a car rental facility, He referred to where the vehicles are going to be washed and where minor repairs of the vehicles are going to be done, He asked if this is going to be a used car lot. He felt the site is awfully small for a modular trailer. He also felt that it will be a little difficult for some people when they get through with the paving and closing of the one cut in the median on North Federal Highway, Bob Pocsik. 626 N.E. 10th Avenue. lives behind this proposed project. He said this whole street is residential. He said entrances and exits on 10th Avenue create a problem, Chairman Wische advised that this property is surrounded by C4 and C2, which is commercial. To the east is the FEe Railroad right-ot-way and west is undeveloped land zoned C2. This proposed project is on the west side at Federal Highway, No one else wishing to speak. Chairman Wische closed the Public Audience. Motion Mr. Rosenstock moved to approve the petitioner's request to raze an existing building and construct a 528 square foot modular building/trailer with parking and landscaping for automobile leasing on a .17 acre lot, located on 1009 North Federal Highway, subject to any staff comments and subject to the landscape plan and renderings presented to this board at this evening's meeting. Mr, Aguila advised her that Railroad Avenue is west of the FEC Railroad right-ot-way, This project is east of the railroad and there is 20 feet of property between the back of the property in question and the right-of-way of the railroad, He advised that this does not affect her at all.
