Heyden, AICP Planning and Zoning Director FROM: Jerzy Lewicki Acting Senior Planner DATE: July 22, 1997 SUBJECT: Enterprise Rent-A-Car - ABAN 97-002 Alley abandonment NA lURE OF REQUEST Dee Monette of Gill Hyatt Construction, the contract purchaser of the property to be developed as a Enterprise Rent-A-Car facility, is requesting abandonment of a portion of a public alley (right-of-way), 20 feet in width by 90 feet in length. The attached Exhibit "A" shows the location of the alley. The attached Exhibit "B" contains a survey and Exhibit "C" - contains a legal description of the portion of the alley right-of-way to be abandoned. BACKGROUND The requested abandonment was approved by the City Commission on August 20, 1991 in connection with a used car facility. The approval, however, was subject to staff comments, that were never rectified, as the conditional use application proposed at that time was denied. Therefore, no resolution for abandonment was adopted by the City Commission. The site to be developed as an Enterprise Rent-A-Car facility contains a non conforming structure built over the property line and encroaching the subject portion of the alley by 13 feet. This structure, according to the proposed development site plan, will be removed. The Enterprise Rent-A-Car property is too small to accommodate the needs of the proposed use. Therefore, this application for abandonment has been submitted to expand the size of the lot to be developed. I Page 2 Memorandum #97-375 ABAN 97-002 ANALYSIS The applicant's reasons for filing this abandonment and the grounds that support the request are included in. the attached Exhibit "0" - Application. The city departments involved in the review of the request for abandonment and the utility companies notified of the request are identified below. Public notice was given to the property owners that abut the alley and has been advertised in the newspaper. The utility companies and the city departments' responses to the abandonment request are as follows: CITY DEPARTMENTS Engineering No concern (verbal response). Utilities No concern (verbal response). Planning and Zoning No objection. PUBLIC UTILITY COMPANIES Florida Power and Light No objection Bell South No objection, subject to granting a 12 foot easement for existing facilities or a payment and easement rights for facilities relocation. Florida Public Utilities Company - No objection. Cable Company (Comcast) No objection. The following is a description of the zoning districts and land uses of the properties that surround the subject request (see Exhibit "A" - Location Map). Heyden, AICP Planning and Zoning Director FROM: Jerzy Lewicki - ...-"l 'V Acting Senior Planner ~ DATE: July 22, 1997 SUBJECT: Enterprise Rent-A-Car - ABAN 97-002 Alley abandonment NATURE OF REQUEST Dee Monette of Gill Hyatt Construction, the contract purchaser of the property to be developed as a Enterprise Rent-A-Car facility, is requesting abandonment of a portion of a public alley (right-of-way), 25 feet in width by 90 feet in length. The attached Exhibit "A" shows the location of the alley. The attached Exhibit liB" contains a survey and Exhibit "C" - contains a legal description of the portion of the alley right-of-way to be abandoned. BACKGROUND The requested abandonment was approved by the City Commission on August 20, 1991 in connection with a used car facility. The approval, however, was subject to staff comments, that were never rectified, as the conditional use application proposed at that time was denied. Therefore, no resolution for abandonment was adopted by the City Commission. The site to be developed as an Enterprise Rent-A-Car facility contains a non conforming structure built over the property line and encroaching the subject portion of the alley by 13 feet. This structure, according to the proposed development site plan, will be removed. The Enterprise Rent-A-Car property is too small to accommodate the needs of the proposed use. Therefore, this application for abandonment has been submitted to expand the size of the lot to be developed. I Page 2 Memorandum #97-375 ABAN 97-002 ANALYSIS The applicant's reasons for filing this abandonment and the grounds that support the request are included in the attached Exhibit "0" - Application. The city departments involved in the review of the request for abandonment and the utility companies notified of the request are identified below. Public notice was given to the property owners that abut the alley and has been advertised in the newspaper. The utility companies and the city departments' responses to the abandonment request are as follows: CITY DEPARTMENTS Engineering No concern (verbal response). Utilities No concern (verbal response). Planning and Zoning No objection. PUBLIC UTILITY COMPANIES Florida Power and Light No objection Bell South No objection, subject to granting a 12 foot easement for existing facilities or a payment and easement rights for facilities relocation. Florida Public Utilities Company - No objection. Cable Company (Comcast) No objection. The following is a description of the zoning districts and land uses of the properties that surround the subject request (see Exhibit "A" - Location Map).
