RECOMMENDATION: Please place the request below on the August 19, 1997 City Commission meeting under Public
Hearing.
The Planning and Development Board, with a 7-0 vote, recommends approval of the abandonment of a twenty foot wide
strip of land just west of lots 3 and 4 of Block 1 of the Lake Addition to Boynton Beach subdivision in connection with
Enterprise Rent-a-Car conditional use request, subject to all staff comments in Exhibit "E" - Conditions of Approval (see
attached). For further details pertaining to this request, see attached Planning and Zoning Department Memorandum No. 97-

Alley abandonment
NA lURE OF REQUEST
Dee Monette of Gill Hyatt Construction, the contract purchaser of the property to be
developed as a Enterprise Rent-A-Car facility, is requesting abandonment of a portion
of a public alley (right-of-way), 20 feet in width by 90 feet in length.
The attached Exhibit "A" shows the location of the alley. The attached Exhibit "B"
contains a survey and Exhibit "C" - contains a legal description of the portion of the
alley right-of-way to be abandoned.
BACKGROUND
The requested abandonment was approved by the City Commission on August 20,
1991 in connection with a used car facility. The approval, however, was subject to staff
comments, that were never rectified, as the conditional use application proposed at that
time was denied. Therefore, no resolution for abandonment was adopted by the City
Commission.
The site to be developed as an Enterprise Rent-A-Car facility contains a non
conforming structure built over the property line and encroaching the subject portion of
the alley by 13 feet. This structure, according to the proposed development site plan,
will be removed. The Enterprise Rent-A-Car property is too small to accommodate the
needs of the proposed use. Therefore, this application for abandonment has been
submitted to expand the size of the lot to be developed.

ANALYSIS
The applicant's reasons for filing this abandonment and the grounds that support the
request are included in. the attached Exhibit "0" - Application. The city departments
involved in the review of the request for abandonment and the utility companies notified
of the request are identified below. Public notice was given to the property owners that
abut the alley and has been advertised in the newspaper. The utility companies and
the city departments' responses to the abandonment request are as follows:

Alley abandonment
NATURE OF REQUEST
Dee Monette of Gill Hyatt Construction, the contract purchaser of the property to be
developed as a Enterprise Rent-A-Car facility, is requesting abandonment of a portion
of a public alley (right-of-way), 25 feet in width by 90 feet in length.
The attached Exhibit "A" shows the location of the alley. The attached Exhibit liB"
contains a survey and Exhibit "C" - contains a legal description of the portion of the
alley right-of-way to be abandoned.
BACKGROUND
The requested abandonment was approved by the City Commission on August 20,
1991 in connection with a used car facility. The approval, however, was subject to staff
comments, that were never rectified, as the conditional use application proposed at that
time was denied. Therefore, no resolution for abandonment was adopted by the City
Commission.
The site to be developed as an Enterprise Rent-A-Car facility contains a non
conforming structure built over the property line and encroaching the subject portion of
the alley by 13 feet. This structure, according to the proposed development site plan,
will be removed. The Enterprise Rent-A-Car property is too small to accommodate the
needs of the proposed use. Therefore, this application for abandonment has been
submitted to expand the size of the lot to be developed.

ANALYSIS
The applicant's reasons for filing this abandonment and the grounds that support the
request are included in the attached Exhibit "0" - Application. The city departments
involved in the review of the request for abandonment and the utility companies notified
of the request are identified below. Public notice was given to the property owners that
abut the alley and has been advertised in the newspaper. The utility companies and
the city departments' responses to the abandonment request are as follows:

Beach, Florida on the date of hearing stated above. The City Commission having considered the
relief sought by the applicant and heard testimony from the applicant, members of city administrative
staff and the public finds as follows:
1. Application for the relief sought was made by the Applicant in a manner consistent with
the requirements of the City's Land Development Regulations.

RECOMMENDATION: Please place the request below on the April 7, 1998 City Commission meeting agenda under
Consent Agenda - Resolutions. The public hearing for the abandonment of a twenty foot wide strip of land just west of lots 3
and 4 of Block 1 of the Lake Addition to Boynton Beach subdivision was conducted before the Commission August 19,
1997. There were conditions of approval needed to be addressed by the applicant prior to the utility abandonment resolution
adoption. All these conditions have now been met. Therefore, staffhas prepared the attached resolution to fmalize the
abandonment.
