THIS MATTER came on to be heard before the City Commission of the City of Boynton
Beach, Florida on the date of hearing stated above. The City Commission having considered the
relief sought by the applicant and heard testimony from the applicant, members of city administrative
staff and the public finds as follows:
1. Application for the relief sought was made by the Applicant in a manner consistent with
the requirements of the City's Land Development Regulations.

l. This site does not have a dumpster location shown. Curb side service would / /
be available to them if they request in writing to the Director of Public ~
Works (C. Larry Roberts) to start service.
UTILITIES AND FIRE
Comments:
2. Fire hydrants shall be within 200 feet of all points on every commercial
building. The fire hydrant shown on the plan on the east side of Federal V
Hwy. is not considered accessible from the property in an emergency
situation, (Chapter 6, Art. IV, Sec. 16).
POLICE
Comments:
3, The bushes/shrubbery line shall stop 10 feet west of the proposed painted
stop bar at the ingress/egress. This will allow for unobstructed driver vision V
for vehicles exiting the property. Alternative suggestion is to plant foliage
with a maximum one foot height of growth at its mature stage,
'4. The handicapped parking spaces drawn in the "Typical Parking Space" shall /
match the ones drawn on the plans (show diagonal striping in access area).
5. Relocate the metal gate at the ingress/egress approximately 10 feet west to vi
allow a single vehicle to pull off of Federal Highway, prior to unlocking the
gate.

6. Clarify handicap ramp location to trailer entrance (plan seems to indicate V
ramp going to door at end of the trailer which is in the back of the trailer) at
time of permit application.
7. Provide a drainage plan [Chapter 4, Section 7.F,] at time of permit V

8. Clarify pavement construction (will there be new subgrade and new rock?) at V
time of permit application.

if appropriate, that there shall be no more vehicles on the site at any time
than there are parking spaces.

BUILDING DIVISION
Comments:
11. The location of the proposed pole sign shown on the site plan does not meet /
the 10 foot minimum setback dimension from the east property line. Either
amend the plans to show, with dimensions, the location of the sign in
compliance with the code or remove the sign from the submission.

12. The site plan and other plan view drawings of the site do not indicate the
location of the handicapped accessible path that is required between the
handicapped accessible entrance of the building and the existing sidewalk vi
located within the abutting public right-of-way. Amend the plans to
identify the location of the accessible path including specifying the width
and grade elevations consistent with the Accessibility Code requirements,

PLANNING AND ZONING
Comments:
14. Any roof top equipment shall be screened from view at a distance of 600
feet. If such equipment is planned, indicate its location and the height of
the equipment above the roof level. Provide elevations of the structure vi
showing the roof top equipment and the required screening (all reduced to
a small scale) and draw in on these elevations the lines-of-sight connecting
the highest point of the equipment with eye level from a distance of 600
hundred feet from the building (LDR. Chapter 9, Section Il.E). If no roof
top equipment is planned, make an appropriate notation on the site plan
and building elevations.
15. If a dumpster enclosure is required by the Public Works Department, V
detailed drawings of a dumpster enclosure, meeting the design standards as
described in LDR, Chapter 9, Section 10.C and Chapter 7.5, Article II,
Section 5.J. shall be submitted with the permit plans.
16. Lighting shall be shown on the landscape plan to eliminate potential V'
conflicts with landscape material and existing and/or proposed, on-site
easements.
17. City's Land Development Regulations, Chapter 4, Section 7.A requires that
a survey, provided as a part of the site plan submittal contain a statement V
that the survey has been abstracted and researched for utility lines, right-
of-ways, and/or easements. Provide such a statement on a copy of the
survey submitted for permit.
18. Provide a traffic statement by a registered traffic engineer containing traffic
information for the project. The statement shall contain, at minimum, an
anticipated number of peak hour trips and average daily trips (this V
information should be based on ITE standards). Include these numbers in
the site plan data summary. The submitted traffic statement shall be
approved by the Palm Beach County Traffic Division, prior to building
permit issuance.
19. On the elevation drawings note the color code and manufacturer's name of V-
all exterior building finishes. Colors and materials shall be compatible
with adjacent buildings.
20. Submit to the Planning and Zoning Department samples of all exterior V
building materials and/or finishes to be used for construction.

21. No building permit will be issued until the abandonment of the 20-foot wide ~
alley right-of-way is approved by the City Commission and unity of title
document is recorded.
22. Land Development Regulations, Chapter 4, Section 7.B.l. require that all ~
proposed buildings shown on the site plan be dimensioned. On the permit
drawings, indicate required dimensions.
23. Land Development Regulations, Chapter 4, Section 7.D.I require that all V
floor plans of proposed buildings be scaled and dimensioned. On the set of
permit drawings indicate required dimensions.
24. On the sheet containing building elevations, note the height of the building V
as required by L.D.R., Chapter 4, Section 7.D.I.
25. On the site plan, provide a tabular summary of the project as required by V'
Land Development Regulations, Chapter 4, Section 7.E.
26. Indicate on the site plan all required and provided setbacks as required by vi
L.D.R., Chapter 4, Section 7.B.1.
27. On the set of permit drawings, correct the number of parking spaces V
provided for the site.
28. Eliminate inconsistencies between the floor plan, cross section and V
elevations of the proposed building with respect to shape of roof.
29. It is recommended that, in order to achieve architectural compatibility and
improved visual appearance for redeveloped properties on Federal vi'
Highway, the "barrel roof' spanned over the building shall be replaced
with either a flat roof screened with parapet walls on all four sides of the
building, or with a gable roof.
30. Exterior lighting shall not exceed code minimums so as not to produce V
glare on Federal Highway.
ADDITIONAL PLANNING AND DEVELOPMENT BOARD CONDITIONS
31. The building shall be designed to match the elevations presented to the V
Planning and Development Board which comply with the above staff
