PLANNING AND ZONING DIVISION MEMORANDUM #97- 362 CONDITIONAL USE/SITE PLAN REVIEW STAFF REPORT FOR PLANNING AND DEVELOPMENT BOARD AND CITY COMMISSION July 22, 1997 DESCRIPTION OF PROJECT Project Name: Enterprise Rent-a-car Applicant: Enterprise Rent-a-car Agent: Dee Monette, Gil Hyatt Construction Owner: Harry Hamilton, trustee Location: 1009 North Federal Highway (VVest side of North Federal Highway, approximately 135 feet south of Martin Luther King Boulevard) File No.: COUS 97-001 Land Use Plan Designation: Local Retail Commercial Zoning Designation: General Commercial District (C-4) Type of Use: Automobile rental establishment Number of Housing Units: Not applicable Area: Site Area: Building Area: 0.17 acres 528.0 square feet INTRODUCTION: Dee Monette of Gil Hyatt Construction, agent for Enterprise Rent-A-Car, is requesting a conditional use approval for an automobile rental establishment to be located at 1009 North Federal Highway (see Exhibit "A" - location map). The parcel of land is small, due to the shallow lot depth of this and other parcels abutting the railroad tracks in the Lake addition subdivision. Therefore, a 20 foot wide alley right-of-way located between the property and the F.E.C. railroad right-of-way is being concurrently requested for abandonment for land assemblage purposes. The unification of the property with the alley area will yield .17 acres for development. The total square footage of the proposed structure is 528 square feet (see I Page 2 Site Plan Review Staff Report Memorandum #97-362 Enterprise Rent-a-car enclosed Exhibit "B" - proposed site plan). The existing structure will be razed. The proposed use is allowed, by code, in C-4 (General Commercial District), only if granted a site specific conditional use approval. SURROUNDING LAND USES AND ZONING: (see Exhibit "A" -location map) North - take-out restaurant, zoned C-4; South - an automotive shop, zoned C-4; East - Federal Highway right-of-way, and farther east is the vacant "Old Dutch Mill" building and a restaurant, zoned C-4 West - FEC railroad right-of-way, and farther west is undeveloped land zoned C-2 STANDARDS FOR EVALUATING CONDITIONAL USES: Section 11.2.0 of the Zoning Code contains the following standards applicable to conditional uses. Following each of these standards is Planning and Zoning staffs evaluation of the application as it is measured against the standards: "The Planning and Development Board and City Commission shall consider only such conditional uses as are authorized under the terms of these zoning regulations and, in connection therewith, may grant conditional uses absolutely or conditioned upon restrictions and conditions including I but not limited to, the dedication of property for streets, alleys, recreation space and sidewalks, as shall be determined necessary for the protection of the surrounding area and the citizens' general welfare, or deny conditional uses when not in harmony with the intent and purpose of this section. In evaluating an application for conditional use, the Board and Commission shall consider the effect of the proposed use on the general health, safety and welfare of the community and make written findings certifying that satisfactory provision has been made concerning the following standards, where applicable: 1. Ingress and egress to the subject property and proposed structures thereon, with particular reference to automobile and pedestrian safety and convenience, traffic flow and control, and access in case of fire or catastrophe. " As shown in Exhibit "B" - site plan, the site has one, existing two-way driveway connecting the internal access aisles and parking spaces. All other existing curb cuts will be closed. There is one way circulation around the rear of the building. The proposed use is vested from traffic levels of service as the site is located within a platted subdivision (Lake Addition to Boynton) that was platted prior to d Page 3 Site Plan Review Staff Report Memorandum #97-362 Enterprise Rent-a-car the effective date of the city's concurrency management ordinance. In order for staff to determine whether the project complies with the vested traffic levels, the anticipated number of peak hour trips per day and total trips per day was requested to be provided, but not received. Prior to building permits being issued for the proposed development, the Palm Beach County Traffic Division will have to verify that the traffic generated by the use meets Palm Beach County traffic performance standards. No concurrency problem is anticipated due to the minimal traffic generated by the proposed use and the current operating levels of service for Federal Highway. "2. Off-street parking and loading areas where required, with particular attention to the items in Subsection 1 above, and the economic, glare, noise, and odor effects the conditional use will have on adjacent and nearby properties, and the city as a whole. " The use requires two, on-site parking spaces in connection with the building and one for outdoor storage of goods for rent, which are to be provided. The outdoor storage area is a car display area used to store rental vehicles on the premises. No noise or odors in excess of that generated by surrounding uses will be generated by this use. "3. Refuse and service areas, with particular reference to the items in Subsection 1 and 2 above. " No dumpster location is proposed. Due to the minimal on-site trash generated with this use, the petitioner is requesting trash curb pick up by the Public Works Department. "4. Utilities, with reference to locations, availability, and compatibility. " The Fire Department has requested a fire hydrant located on the western side of Federal Highway and within 200 feet from the proposed building as per code requirements. The existing fire hydrant (on the east side) does not meet distance requirements. Existing potable water and sewage are adequate to serve the use. "5. Screening, buffering and landscaping with reference to type, dimensions, and character. " All required landscaping is proposed to be provided. The existing development is void of landscaping. Signs, and proposed exterior lighting, with reference to glare, traffic safety, economic effect, and compatibility and harmony with adjacent and nearby properties. " The proposed signage consists of a free standing sign. The conformance of the exterior lighting with the city code will be determined at the permit stage. "7. Required setbacks and other open spaces. " Required setbacks are met. There are no open space requirements for this use. The existing building which is an eye-sore and encroaches the alley will be razed. "8. General compatibility with adjacent properties, and other property in the zoning district. " As previously discussed, the surrounding land uses include a "take-out" restaurant to the north, and an automotive shop to the south; both of which are zoned C-4 (General Commercial). The subject property is also bounded by North Federal Highway to the east and the F.E.C. Tracks to the west. Since the subject property lies within an established commercial corridor and is surrounded by general commercial uses with direct access to a major thoroughfare (North Federal Highway), it can be argued that the proposed use is generally compatible with the surrounding properties. It is not anticipated that the proposed rental car use will exacerbate existing conditions on the site and adjacent properties, nor have a significant negative effect on an area which has been developed for commercial uses for an extended period of time. The C-4 (General Commercial) zoning district permits uses which can be construed to be more intensive than a rental car use. For example, the C-4 zoning district permits automotive repair facilities and automobile paint and body shops. Automotive repair stations and paint and body shops can be considered to generate more noise, odor, and negative externalities than a used car lot which does not offer any repair services. Thus, it can be argued that a rental car use is generally compatible with and is within the scope of the C-4 zoning district. "9. Height of buildings and structures, with reference to compatibility and harmony to adjacent and nearby properties, and the city as a whole. " The height of the proposed building is limited to approximately 11 feet. This proposed height will meet the city's height regulations of a maximum of 45 feet in commercial districts and is no greater than surrounding buildings. Lf- Page 5 Site Plan Review Staff Report Memorandum #97-362 Enterprise Rent-a-car "10. Economic effects on adjacent and nearby properties, and the city as a whole. " Due to the small intensity of this commercial use, aesthetics are the only issue of concern. The proposed building is a 12 foot by 45 foot, pre-manufactured structure finished with "hardi-panel" siding and covered with a "barrel" roof. The massing of the proposed structure makes it compatible with the other small scale, existing commercial structures located along this section of Federal Highway. However, the barrel shaped roof configuration is not an asset in this location. It is recommended that the roof of the proposed building be changed to either a flat or gable roof. No information was provided with respect to the color of the proposed siding. "11. Conformance to the standards and requirements which apply to site plans, as set forth in Chapter 19, Article II of the City of Boynton Beach Code of Ordinances. [Part 11/ Land Development Regulations Chapter 4]. " The site plan drawings submitted comply with the above standards, subject to the attached staff comments. "12. Compliance with, and abatement of nuisances and hazards in accordance with the Performance Standards Section 4 of the zoning regulations; also, conformance to the City of Boynton Beach Noise Control Ordinance. " The proposed use complies with the above standards. RECOMMENDATION: The entire Federal Highway corridor is currently under an eleven month planning study as part of Vision 20/20. Recommendations from the consultant may include adoption of overlay zones, changes in land use, revisions to current zoning district regulations and/or expansion of the CRA to include more, or all (if it meets state blight criteria), of Federal Highway. In talking to the consultant, the study is not far enough along for the consultant to give a recommendation regarding his study vs. the proposed redevelopment. Therefore, since the use meets the above standards and the property has been an eye-sore, Planning and Zoning staff recommends approval of this site plan request, subject to the comments included in Exhibit C - Conditions of Approval. Curb side service would be available to them if they request in writing to the Director of Public Works (C. Larry Roberts) to start service. UTILITIES AND FIRE Comments: 2. Fire hydrants shall be within 200 feet of all points on every commercial building. The fire hydrant shown on the plan on the east side of Federal Hwy. is not considered accessible from the property in an emergency situation, (Chapter 6, Art. IV, Sec. 16). POLICE Comments: 3. The bushes/shrubbery line shall stop 10 feet west of the proposed painted stop bar at the ingress/egress. This will allow for unobstructed driver vision for vehicles exiting the property. Alternative suggestion is to plant foliage with a maximum one foot height of growth at its mature stage. '4. The handicapped parking spaces drawn in the "Typical Parking Space" shall match the ones drawn on the plans (show diagonal striping in access area). 5. Relocate the metal gate at the ingress/egress approximately 10 feet west to allow a single vehicle to pull off of Federal Highway, prior to unlocking the gate. ENGINEERING DIVISION Comments 6. Clarify handicap ramp location to trailer entrance (plan seems to indicate ramp going to door at end of the trailer which is in the back ofthe trailer) at time of permit application. 7. Provide a drainage plan [Chapter 4, Section 7.F.] at time of penn it application. 8. Clarify pavement construction (will there be new subgrade and new rock?) at time of permit application. /1 Page 3 Enterprise Rent-a-Car File No. caus 97-001 PLANNING AND ZONING Comments: 14. Any roof top equipment shall be screened from view at a distance of 600 feet. If such equipment is planned, indicate its location and the height of the equipment above the roof level. Provide elevations of the structure showing the roof top equipment and the required screening (all reduced to a small scale) and draw in on these elevations the lines-of-sight connecting the highest point of the equipment with eye level from a distance of 600 hundred feet from the building (LDR, Chapter 9, Section II.E). If no roof top equipment is planned, make an appropriate notation on the site plan and building elevations. IS. If a dumpster enclosure is required by the Public Works Department, detailed drawings of a dumpster enclosure, meeting the design standards as described in LDR, Chapter 9, Section 10.C and Chapter 7.5, Article II, Section 5.J. shall be submitted with the permit plans. 16. Lighting shall be shown on the landscape plan to eliminate potential conflicts with landscape material and existing and/or proposed, on-site e'asements. 17. City's Land Development Regulations, Chapter 4, Section 7.A requires that a survey, provided as a part of the site plan submittal contain a statement that the survey has been abstracted and researched for utility lines, right- of-ways, and/or easements. Provide such a statement on a copy of the survey submitted for permit. 18. Provide a traffic statement by a registered traffic engineer containing traffic information for the project. The statement shall contain, at minimum, an anticipated number of peak hour trips and average daily trips (this information should be based on lTE standards). Include these numbers in the site plan data summary. The submitted traffic statement shall be approved by the Palm Beach County Traffic Division, prior to building permit issuance. 19. On the elevation drawings note the color code and manufacturer's name of all exterior building finishes. Colors and materials shall be compatible with adjacent buildings. 20. They had no objections to any of the staff comments. Mr. Dube noticed that the layout does not show a wash rack. Ms. Covello advised that the only thing they will be doing there is spraying off the cars with water and vacuuming them in the back of the building. They either go to a gas station for a full wash or they wash them at the Delray Beach office, which is fully staffed and equipped. One of the main reasons they are opening an office in Boynton Beach is because most of the customers that they pick up in Boynton Beach have to be driven to the Delray Beach office. Ms. Frazier asked how many cars they plan to put on this location. Ms. Covello advised that no more than 8 or 9 cars can fit at that location, and they have a lot of drivers who can move cars in and out within an hour's notice. Mr. Aguila was concerned about the area between the bottom of the trailer and the ground. He asked how they are going to shield the hookup rack and wheels. He also inquired abGut the landscaping around the foundation of the building. Ms. Monette advised that the wheels will be removed from the modular building. The modular building will be placed on a footer and the tongue will be removed. Mr. Aguila was concerned about the island that has the sign. He was not sure that the stone that it is going to be filled with is going to be very attractive over time. He felt it would be a lot more attractive if there was some sort of ground covering and planting material at the base of the pole of that sign. Ms. Covello agreed to do whatever it takes to make it look nice. Mr. Rosenstock asked about the landscaping. Ms. Monette displayed a rendering of the existing site and what is being proposed. Mr. Aguila asked about the material that is being used as a screen where the wheels would have been. Ms. Covello said it is a type of fencing that you cannot really see through, and it will be jazzed up with more landscaping. She added that lapsiding on the modular building will be replaced with material that looks like stucco. Mr. Rosenstock asked about the Enterprise sign and its distance from the highway. Mr. Lewicki advised that it is in conformance with the sign regulations. It is ten feet from the highway. Chairman Wische opened the public hearing. 7 MINUTES PLANNING AND DEVELOPMENT BOARD MEETING BOYNTON BEACH, FLORIDA JULY 22, 1997 Lloyd Powell of Alpine Florist. 1112 N. Federal Highway, spoke against this conditional use at this location. He believes this is the wrong place for a car rental facility. He referred to where the vehicles are going to be washed and where minor repairs at the vehicles are going to be done. He asked jt this is going to be a used car lot. He felt the site is awfully small for a modular trailer. He also felt that it will be a little difficult for some people when they get through with the paving and closing at the one cut in the median on North Federal Highway. Bob Pocsik, 626 N.E. 10lh Avenue. lives behind this proposed project. He said this whole street is residential. He said entrances and exits on 10tn Avenue create a problem. Chairman Wische advised that this property is surrounded by C4 and C2. which is commercial. To the east is the FEC Railroad right-at-way and west is undeveloped land zoned C2. The parcel of land is small, due to the shallow lot depth of this and other parcels abutting the railroad tracks in the Lake addition subdivision. Therefore, a 20 foot wide alley right-of-way located between the property and the F.E.C. railroad right-of-way is being concurrently requested for abandonment for land assemblage purposes. The unification of the property with the alley area will yield .17 acres for development. The total square footage of the proposed structure is 528 square feet (see / Page 2 Site Plan Review Staff Report Memorandum #97-362 Enterprise Rent-a-car enclosed Exhibit "B" - proposed site plan). The existing structure will be razed. The proposed use is allowed, by code, in C-4 (General Commercial District), only if granted a site specific conditional use approval. SURROUNDING LAND USES AND ZONING: (see Exhibit "A" -location map) North - take-out restaurant, zoned C-4; South - an automotive shop, zoned C-4; East - Federal Highway right-of-way, and farther east is the vacant "Old Dutch Mill" building and a restaurant, zoned C-4 West - FEC railroad right-of-way, and farther west is undeveloped land zoned C-2 STANDARDS FOR EVALUATING CONDITIONAL USES: Section 11.2.0 of the Zoning Code contains the following standards applicable to conditional uses. Following each of these standards is Planning and Zoning staff's evaluation of the application as it is measured against the standards: "The Planning and Development Board and City Commission shall consider only such conditional uses as are authorized under the terms of these zoning regulations and, in connection therewith, may grant conditional uses absolutely or conditioned upon restrictions and conditions including, but not limited to, the dedication of property for streets, alleys, recreation space and sidewalks, as shall be determined necessary for the protection of the surrounding area and the citizens' general welfare, or deny conditional uses when not in harmony with the intent and purpose of this section. In evaluating an application for conditional use, the Board and Commission shall consider the effect of the proposed use on the general health, safety and welfare of the community and make written findings certifying that satisfactory provision has been made concerning the following standards, where applicable: 1. Ingress and egress to the subject property and proposed structures thereon, with particular reference to automobile and pedestrian safety and convenience, traffic flow and control, and access in case of fire or catastrophe. " As shown in Exhibit "B" - site plan, the site has one, existing two-way driveway connecting the internal access aisles and parking spaces. All other existing curb cuts will be closed. There is one way circulation around the rear of the building. The proposed use is vested from traffic levels of service as the site is located within a platted subdivision (Lake Addition to Boynton) that was platted prior to c2, Page 3 Site Plan Review Staff Report Memorandum #97-362 Enterprise Rent-a-car the effective date of the city's concurrency management ordinance. In order for staff to determine whether the project complies with the vested traffic levels, the anticipated number of peak hour trips per day and total trips per day was requested to be provided, but not received. Prior to building permits being issued for the proposed development, the Palm Beach County Traffic Division will have to verify that the traffic generated by the use meets Palm Beach County traffic performance standards. No concurrency problem is anticipated due to the minimal traffic generated by the proposed use and the current operating levels of service for Federal Highway. "2. Off-street parking and loading areas where required, with particular attention to the items in Subsection 1 above, and the economic, glare, noise, and odor effects the conditional use will have on adjacent and nearby properties, and the city as a whole. " The use requires two, on-site parking spaces in connection with the building and one for outdoor storage of goods for rent, which are to be provided. The outdoor storage area is a car display area used to store rental vehicles on the premises. No noise or odors in excess of that generated by surrounding uses will be generated by this use. "3. Refuse and service areas, with particular reference to the items in Subsection 1 and 2 above. " No dumpster location is proposed. Due to the minimal on-site trash generated with this use, the petitioner is requesting trash curb pick up by the Public Works Department. "4. Utilities, with reference to locations, availability, and compatibility. " The Fire Department has requested a fire hydrant located on the western side of Federal Highway and within 200 feet from the proposed building as per code requirements. The existing fire hydrant (on the east side) does not meet distance requirements. Existing potable water and sewage are adequate to serve the use. "5. Screening, buffering and landscaping with reference to type, dimensions, and character. " All required landscaping is proposed to be provided. The existing development is void of landscaping. The proposed plan is a visual improvement. 3 Page 4 Site Plan Review Staff Report Memorandum #97-362 Enterprise Rent-a-car "6. Signs, and proposed exterior lighting, with reference to glare, traffic safety, economic effect, and compatibility and harmony with adjacent and nearby properties. " The proposed signage consists of a free standing sign. The conformance of the exterior lighting with the city code will be determined at the permit stage. "7. Required setbacks and other open spaces. " Required setbacks are met. There are no open space requirements for this use. The existing building which is an eye-sore and encroaches the alley will be razed. "8. General compatibility with adjacent properties, and other property in the zoning district. " As previously discussed, the surrounding land uses include a "take-out" restaurant to the north, and an automotive shop to the south; both of which are zoned C-4 (General Commercial). The subject property is also bounded by North Federal Highway to the east and the F.E.C. Tracks to the west. Since the subject property lies within an established commercial corridor and is surrounded by general commercial uses with direct access to a major thoroughfare (North Federal Highway), it can be argued that the proposed use is generally compatible with the surrounding properties. It is not anticipated that the proposed rental car use will exacerbate existing conditions on the site and adjacent properties, nor have a significant negative effect on an area which has been developed for commercial uses for an extended period of time. The C-4 (General Commercial) zoning district permits uses which can be construed to be more intensive than a rental car use. For example, the C-4 zoning district permits automotive repair facilities and automobile paint and body shops. Automotive repair stations and paint and body shops can be considered to generate more noise, odor, and negative externalities than a used car lot which does not offer any repair services. Thus, it can be argued that a rental car use is generally compatible with and is within the scope of the C-4 zoning district. "9. Height of buildings and structures, with reference to compatibility and harmony to adjacent and nearby properties, and the city as a whole. " The height of the proposed building is limited to approximately 11 feet. This proposed height will meet the city's height regulations of a maximum of 45 feet in commercial districts and is no greater than surrounding buildings. 1- Page 5 Site Plan Review Staff Report Memorandum #97-362 Enterprise Rent-a-car "10. Economic effects on adjacent and nearby properties, and the city as a whole. " Due to the small intensity of this commercial use, aesthetics are the only issue of concern. The proposed building is a 12 foot by 45 foot, pre-manufactured structure finished with "hardi-panel" siding and covered with a "barrel" roof. The massing of the proposed structure makes it compatible with the other small scale, existing commercial structures located along this section of Federal Highway. However, the barrel shaped roof configuration is not an asset in this location. It is recommended that the roof of the proposed building be changed to either a flat or gable roof. No information was provided with respect to the color of the proposed siding. "11. Conformance to the standards and requirements which apply to site plans, as set forth in Chapter 19, Article II of the City of Boynton Beach Code of Ordinances. [Part 11/ Land Development Regulations Chapter 4]." The site plan drawings submitted comply with the above standards, subject to the attached staff comments. "12. Compliance with, and abatement of nuisances and hazards in accordance with the Performance Standards Section 4 of the zoning regulations; also, conformance to the City of Boynton Beach Noise Control Ordinance. " The proposed use complies with the above standards. RECOMMENDATION: The entire Federal Highway corridor is currently under an eleven month planning study as part of Vision 20/20. Recommendations from the consultant may include adoption of overlay zones, changes in land use, revisions to current zoning district regulations and/or expansion of the CRA to include more, or all (if it meets state blight criteria), of Federal Highway. In talking to the consultant, the study is not far enough along for the consultant to give a recommendation regarding his study vs. the proposed redevelopment. Therefore, since the use meets the above standards and the property has been an eye-sore, Planning and Zoning staff recommends approval of this site plan request, subject to the comments included in Exhibit C - Conditions of Approval. Fire hydrants shall be within 200 feet of all points on every commercial building. The fire hydrant shown on the plan on the east side of Federal Hwy. is not considered accessible from the property in an emergency situation, (Chapter 6, Art. IV, Sec. 16). POLICE Comments: 3. The bushes/shrubbery line shall stop 10 feet west of the proposed painted stop bar at the ingress/egress. This will allow for unobstructed driver vision for vehicles exiting the property. Clarify handicap ramp location to trailer entrance (plan seems to indicate ramp going to door at end of the trailer which is in the back of the trailer) at time of permit application. 7. The location of the proposed pole sign shown on the site plan does not meet the 10 foot minimum setback dimension from the east property line. Any roof top equipment shall be screened from view at a distance of 600 feet. If such equipment is planned, indicate its location and the height of the equipment above the roof level. Provide elevations of the structure showing the rooftop equipment and the required screening (all reduced to a small scale) and draw in on these elevations the lines-of-sight connecting the highest point of the equipment with eye level from a distance of 600 hundred feet from the building (LDR, Chapter 9, Section II.E). If no roof top equipment is planned, make an appropriate notation on the site plan and building elevations. 15. If a dumpster enclosure is required by the Public Works Department, detailed drawings of a dumpster enclosure, meeting the design standards as described in LDR, Chapter 9, Section 10.C and Chapter 7.5, Article II, Section 5.J. shall be submitted with the permit plans. 16. Lighting shall be shown on the landscape plan to eliminate potential conflicts with landscape material and existing and/or proposed, on-site easements. 17. City's Land Development Regulations, Chapter 4, Section 7.A requires that a survey, provided as a part of the site plan submittal contain a statement that the survey has been abstracted and researched for utility lines, right- of-ways, and/or easements. Provide such a statement on a copy of the survey submitted for permit. 18. Provide a traffic statement by a registered traffic engineer containing traffic information for the project. The statement shall contain, at minimum, an anticipated number of peak hour trips and average daily trips (this information should be based on ITE standards). Include these numbers in the site plan data summary. The submitted traffic statement shall be approved by the Palm Beach County Traffic Division, prior to building permit issuance. 19. On the elevation drawings note the color code and manufacturer's name of all exterior building finishes. Colors and materials shall be compatible with adjacent buildings. 20.
