City Attorneys' Office City of Boynton Beach RE: Enterprise Rent A Car Dear Mike: Pursuant to our conversation enclosed is a copy of the survey, Plat Book 11, Page 71 and Plat Book 1, Page 50, Please note that the twenty (20) foot right of way that is being abandoned is part of the Plats and that all of the twenty (20) foot right of way would revert to the owner as opposed to one-half (112) to the lot owner and one.half (1/2) to the FEe Railway (see Attorneys Title Guarantee Fund Note No. 24.01,03), I have also enclosed the Minutes of the City Commission meeting of August 19, 1997 which require under PlaMing and Zoning a letter from the FEe forfeiting any rights in the western half of the abandoned right-of-way, As we discussed, [ feel that this is unnecessary to obtain a letter from the FEe and hope that the enclosed information will be sufficient to make such determination. DISCUSSION: Based on the broad issue presented in Department of Development, Engineering Division Memorandum No. 97-081, if a tract ofland is subdivided into 3 parcels and one of those parcels is sold before the plat is submitted, the new owner is required to 'Join in on the plat" by, for example, executing a separate instrument joining in and ratifying the plat and all dedications and reservations thereon. This assures that the purpose of Section 177.081 is met, that is, to assure that there is a dedication on the plat which applies to each of the subdivided parcels. Accordingly, Section 177.081, F. S. requires the "new owner," as referenced above, to join in on the plat. It should be noted that the comments include recommendations we believe will enhance the aesthetics and function of the project. The comments that identify deficiencies from the City's Land Development Regulations (L.D.R.) or previous conditions of approval are required to be corrected and shown in compliance on the plans and/or documents submitted for second (2nd) review in order for the project to continue through the conditional use review process. The applicant shall understand that all documents and plans submitted for conditional use approval are subject to additional comments. It is recommend that the applicant/agent contact this office regarding questions related to the comments. If the applicant is not intending to correct code deficiencies or deficiencies from previous conditions of approval and he/she . requests that the project remain on the review schedule identified, he/she should contact this office regarding the procedures, application forms, fees and submittal deadline dates for seeking relief from the code requirement or previous condition of approval. 1. Any roof top equipment will have to be screened from view at a distance of 600 feet. If such equipment is planned, indicate its location and the height of the equipment above the roof level. Provide elevations of the structure showing the roof top equipment and the required screening (all reduced to a small scale) and draw in on these elevations the lines-of-sight connecting the highest point of the equipment with the eye level from a distance of 600 hundred feet from the building (LDR, Chapter 9, Section 11.E). If no roof top equipment is planned, make an appropriate notation on site plan and building elevations. 2. If the dumpster enclose will be required by the Public Works Department detailed drawings of a dumpster enclosure meeting the design standards as described in LDR, Chapter 9, Section 10.C and Chapter 7.5, Article II, Section 5.J. shall be submitted with the second submittal. 3. Lighting shall be shown on the landscape plan to eliminate potential conflicts with landscape material and existing and/or proposed, on-site easements. 4. City's Land Development Regulations, Chapter 4, Section 7.A requires that a survey provided as a part of the site plan submittal contains a statement that the survey has been abstracted and researched for utility lines, right-of-ways, and/or easements. Provide such statement on a copy of the survey submitted for a second submittal. 5. Provide a traffic statement by a registered traffic engineer containing traffic information for the project. The statement shall contain, at minimum, an anticipated number of peak hour trips and average daily trips (this information should be based on ITE standards). On the elevation drawings depict color code and manufacturer's name of all exterior building finishes. 8. Prior to the Planning and Development Board meeting submit to the Planning and Zoning Department a presentation board containing samples of all exterior building materials and/or finishes to be used for construction. 9. Prior to the Planning and Development Board meeting submit to the Planning and Zoning Department a presentation board containing color rendering of all elevations of the proposed building. 10. No building permit will be issued until the abandonment of 20-foot wide alley right-of-way will be approved by the City Commission and for all lots and parcels of land that this development is being proposed, a Unity of Title document will be provided. 11. Eliminate inconsistencies between floor plan, cross section and elevations of the proposed building in respect to shape of roof. 12. On the sheet containing building elevations depict the height of the building as required by L.DR., Chapter 4, Section 7.D.1. 13. On the elevation drawings depict color code and manufacturer's name of all exterior building finishes. 8. Prior to the Planning and Development Board meeting submit to the Planning and Zoning Department a presentation board containing samples of all exterior building materials and/or finishes to be used for construction. 9.
