Dear Mike:
Pursuant to our conversation enclosed is a copy of the survey, Plat Book 11, Page 71 and Plat
Book 1, Page 50, Please note that the twenty (20) foot right of way that is being abandoned is
part of the Plats and that all of the twenty (20) foot right of way would revert to the owner as
opposed to one-half (112) to the lot owner and one.half (1/2) to the FEe Railway (see Attorneys
Title Guarantee Fund Note No. 24.01,03), I have also enclosed the Minutes of the City
Commission meeting of August 19, 1997 which require under PlaMing and Zoning a letter from
the FEe forfeiting any rights in the western half of the abandoned right-of-way,
As we discussed, [ feel that this is unnecessary to obtain a letter from the FEe and hope that
the enclosed information will be sufficient to make such determination.

For ownership of vacated unplaned streets. see TN 24.01.08.
Platted streets must be vacated by proper governmental action before
they can be insured. A FUnd Agent may rely on II recorded ordinance or
resolution of the a~ropri't8 goveming body, as a release of public r{ghu to the
vacated area, provided a sC)ecific legill description of it is roet forth, and it states
unequivocallV mat the governmental interest is vacated. Private rights must be
considered.
A. Ownership: Dedicator or Remore Grantees
After a p~.d street is vacated, who has better title to tbe vacated
street-the dedicator or the remote wrantees, the purchasers of lots abutting
the street? The primary guide in such iiituations is the intention of the
dedicator as reflected in the dedicaticn.
Where there is no specific dedication of streets on a p18t or where the
dedication is silent 8$ to the reversionary interest after vacation of m. streets,
lhe general rule is that the owners of lots abutting the streets take' title, The
difficulty arises when the dedication contains a reversion clause that may
indicate II contrary iMention.
Dedications of streets often cootain a reversion clause suc:l1 as:
. . , reserving to ourselves, our heirs, administrators,
executors, or assigns, the reversion or reversions tl'l.reof if
ever discontinued by law.
In Peninsular Point; Inc.' v. South Georgia O.'1y Co-Qp, 251 So,2d 690
(Fla. 1st DCA 1971), the First District Court of Appeal held that a reversion
clause similar to the one set out above manifested a elear intent by the
dedicator that upon vacation 01 the street the title should not revert to the
abutting lot owner. Probably to overcome the effect of the Pen;n#ular Paint,
Inc. ease, the Florida legislature enacted Sec. 1 n .085, F.S., effective

In the United srat~$ ease, the Suprem~ Court of Florida held that upCt'\
conveyanCe of JIl the lots in a plat, without dear reseNation of the
reversionary interest in the deeds, the reversionary interest of the dedicator
was distributed among the lot owners and the dedicator had no interest in the
property.
. Therefore, for issuing .. Fund policy, if the dedication contains a
reversion clause to the dedicatOt' and all tots were convev8<1 wi1h<lut
reservation of the reversionary inter~t in the deeds, ownerShip of the vacated
str"t can generally be insured wit~ut an exception for or the clearing of any
interest of the dedicator. See Title Standard 11.3.
B. If the re'llersionary interest iI'I the vlleated ~treet remains in the
dedicator, the dedicator takes title to tne entire street: If, as is the usual
situation, the reversionary interest is distributed to the a~utting owners, what
is the width of their ownership?
1. Interior Streets. The general rule is that the owners of lots abutting
l!n interior street take title to the center of the vaeatea street. litle Standards
, , .4 and 11 .5; Bulkatt v. City of Fort Lauderdllle, t 68 So.2d 85 (Fla. t 9641.
2. Perimeter Streets. With at least one repqrted exception, the
general rule is thet owners of lots abutting a per;meter street teke title to the
entire width of the vacated 'freet. In Caples v. Taliaferro. 197 $0.861 at 867
(Fla. 1 940), the Supreme Court of Florida stated that whiln 8 street is platted
on tl'\e margin of the grantor's land, a conveyance Qf the land abutting the
street cames the fee to the entire width of the street \Jlllu$ expressly reserved.

An apparent exception to the perimeter street rule is reported in
Calvert v. Morgan, 436 So.2d 314 (Fla. 1 st OCA 19831. All the land in
Question was owned at one time by the W~ham Corporatioo. in 1961.
Woodham filed J plat and dedicated to the City of Jacksonville, without
reserving the reversionary interest, a perimeter right cf ~WV for clrainage and
utilities on the north margin of the plat. At thi1; time Woodham was the owner

of the land immediately nOrth of and contiguous to the right of way. In other
words, the rear pro.,.rty lines of the platted 'and fcontlllning the dedication)

ill the southem plat only took title to the center of the vacated rignt Of way.
The abutting lot owners in the n~~ plat tQok title to the northern portion
of the vacated right of way, that is. they took title to I.md lying beyond the
boundary of their plat,
The re$l.Ilt in Calvert may be inconsistent with Cap/~s, Sec. 177.085.
F.S., and the principle tha1 "reversion rights of 8 lot adjQining a subdivision
boundary extend along the bOundary line of the subdivision and c..nnot exten(l
beyond the bound.ry line." See ROBllLA~ & WILSON, BROWN'S
BOUNDARY CONTROL AND LEGAL PRINCIPLES (4th ed. 19961, Sec. 8.15.
The~fore, for issuing a fund policy, if the issue of common ownership
is eliminated, ownership of the vacated perimeter street can generally be
insured for its entire width in the abutting 101 owners of the plat in wllich the
street appears.
c. Private RiiiJhts of Other Lot Owners
Regardless of 'Who owns the reversionary iMerest and the width of the
ownership, the prlvate rights of other owners acquiring IoU by reference to the
plat must be considered. The vaeation of a street by a governmental authority
does not eliminate the prb,ate rights of other owners acquiring lots "according
to the I)\at," Their interest must be released or s" appropriate exception must
be made in Schedule B of the policy. An appropriate exception may be:

Orange Heights. as recorded in Plat BOOK 6, Page 7, of the

Find attached for your review the plans and exhibits for the above-referenced project. Site
Plan Review approval for this project will be granted by the City Commission. To ensure that
the project stays on line with the review time frame, I request that the plans and
exhibits be reviewed and formal written comments transmitted to the Director of the
Planning and Zoning Department no later than 5:00 P.M. on May 13. 1997. The
comments shall be separated into two categories. The first category comments with
code sections referenced and the second category references recommendations that
you believe will enhance the project. Do not return plans and exhibits. Retain same
for the review of the amended plans (second review).
Adhering to the following review guidelines will promote a comprehensive review and enable
the applicant to efficiently obtain Technical Review Committee approval:
1. Use the review standards specified in Part III, Land Development Regulations,
Chapter 4, Site Plan Review, Section 8 of the Code of Ordinances to review and
formulate comments.
2. The documents submitted for the project were determined to be substantially complete
based on the submittal requirements identified in Section 7 of the Site Plan Review
Ordinance. However, if the data provided to meet the submittal requirements is
insufficient to properly evaluate and process the project based on the review
standards or the documents show code deficiencies, additional data and/or
corrections should be requested by the reviewer through the Planning and Zoning
Department.
3. Each comment shall reference the section of the code that is incorrectly depicted on
the documents.
4. Technical Review Committee member(s) shall identify in their comments when the
plans depict or when the location and installation of their departmental required
improvements may conflict with other departmental improvements.

5. When a TRC Member finds a code deficiency that is outside of his/her review
responsibility, the comment and the specific code section may be included in their
review comments with the name of the appropriate TRC Member that is responsible for

time frame stated above, to the Planning and Zoning Director stating that the plans are

This is in response to Department of Development, Engineering Division Memorandum
No. 97-081. dated May 8, 1997.
ISSUE:
Pursuant to Section 177.081, Florida Statutes, "[I]f a tract of land is subdivided
into 3 parcels and one of the parcels is sold prior to submission of the plat, is the
new owner required to join in on the plat?"
DISCUSSION:
Based on the broad issue presented in Department of Development, Engineering Division
Memorandum No. 97-081, if a tract ofland is subdivided into 3 parcels and one of those parcels
is sold before the plat is submitted, the new owner is required to 'Join in on the plat" by, for
example, executing a separate instrument joining in and ratifying the plat and all dedications and
reservations thereon. This assures that the purpose of Section 177.081 is met, that is, to assure
that there is a dedication on the plat which applies to each of the subdivided parcels. Accordingly,
Section 177.081, F. S. requires the "new owner," as referenced above, to join in on the plat.

The following is a list of 1 st review comments regarding the conditional use/site plan review of
the plans for the above-referenced project. It should be noted that the comments include
recommendations we believe will enhance the aesthetics and function of the project.
The comments that identify deficiencies from the City's Land Development Regulations (L.D.R.)
or previous conditions of approval are required to be corrected and shown in compliance on the
plans and/or documents submitted for second (2nd) review in order for the project to continue
through the conditional use review process.
The applicant shall understand that all documents and plans submitted for conditional use
approval are subject to additional comments. It is recommend that the applicant/agent contact
this office regarding questions related to the comments. If the applicant is not intending to
correct code deficiencies or deficiencies from previous conditions of approval and he/she .
requests that the project remain on the review schedule identified, he/she should contact this
office regarding the procedures, application forms, fees and submittal deadline dates for
seeking relief from the code requirement or previous condition of approval.
1. Any roof top equipment will have to be screened from view at a distance of 600
feet. If such equipment is planned, indicate its location and the height of the
equipment above the roof level. Provide elevations of the structure showing the
roof top equipment and the required screening (all reduced to a small scale) and
draw in on these elevations the lines-of-sight connecting the highest point of the
equipment with the eye level from a distance of 600 hundred feet from the
building (LDR, Chapter 9, Section 11.E). If no roof top equipment is planned,
make an appropriate notation on site plan and building elevations.
2. If the dumpster enclose will be required by the Public Works Department
detailed drawings of a dumpster enclosure meeting the design standards as
described in LDR, Chapter 9, Section 10.C and Chapter 7.5, Article II, Section
5.J. shall be submitted with the second submittal.
3. Lighting shall be shown on the landscape plan to eliminate potential conflicts with
landscape material and existing and/or proposed, on-site easements.
4. City's Land Development Regulations, Chapter 4, Section 7.A requires that a
survey provided as a part of the site plan submittal contains a statement that the
survey has been abstracted and researched for utility lines, right-of-ways, and/or
easements. Provide such statement on a copy of the survey submitted for a
second submittal.
5. Provide a traffic statement by a registered traffic engineer containing traffic
information for the project. The statement shall contain, at minimum, an
anticipated number of peak hour trips and average daily trips (this information
should be based on ITE standards). Include these numbers in the site plan data

summary. The submitted traffic statement shall be approved by the Palm Beach
County Traffic Division prior to the City Commission meeting.
6. With the second submittal provide signage information, as required by the Land
Development Regulations, Chapter 2, Section 7.B.2. If this information will not
be submitted, signage shall be processed as a separate application.
7. On the elevation drawings depict color code and manufacturer's name of all
exterior building finishes.
8. Prior to the Planning and Development Board meeting submit to the Planning
and Zoning Department a presentation board containing samples of all exterior
building materials and/or finishes to be used for construction.
9. Prior to the Planning and Development Board meeting submit to the Planning
and Zoning Department a presentation board containing color rendering of all
elevations of the proposed building.
10. No building permit will be issued until the abandonment of 20-foot wide alley
right-of-way will be approved by the City Commission and for all lots and parcels
of land that this development is being proposed, a Unity of Title document will be
provided.
11. Eliminate inconsistencies between floor plan, cross section and elevations of the
proposed building in respect to shape of roof.
12. On the sheet containing building elevations depict the height of the building as
required by L.DR., Chapter 4, Section 7.D.1.
13. On the site plan provide a tabular summary of the project as required by Land
Development Regulations, Chapter 4, Section 7.E.
14. On the site plan designate parking spaces that will be used for storage of rental
units. Exclude these parking spaces from parking calculations
15. It is recommended that, in order to maintain architectural consistency with the
neighboring structures, the roof of the proposed structure will be changed to:
. a double-slope roof, or
. a flat roof
16. It is recommended that for aesthetics reason a foundation landscaping
consisting of combination of ground cover and/or shrubs be introduced along
south, east and north sides of the building.

The following is a list of 2nd review comments regarding the conditional use/site plan review of
the plans for the above-referenced project
1. Any roof top equipment will have to be screened from view at a distance of 600
feet. If such equipment is planned, indicate its location and the height of the
equipment above the roof level. Provide elevations of the structure showing the
roof top equipment and the required screening (all reduced to a small scale) and
draw in on these elevations the lines-of-sight connecting the highest point of the
equipment with the eye level from a distance of 600 hundred feet from the
building (LDR, Chapter 9, Section 11.E). If no roof top equipment is planned,
make an appropriate notation on site plan and building elevations.
2. If the dumpster enclose will be required by the Public Works Department
detailed drawings of a dumpster enclosure meeting the design standards as
described in LDR, Chapter 9, Section 10.C and Chapter 7.5, Article II, Section
5.J. shall be submitted with the second submittal.
3. Lighting shall be shown on the landscape plan to eliminate potential conflicts
with landscape material and existing and/or proposed, on-site easements.
4. City's Land Development Regulations, Chapter 4, Section 7.A requires that a
survey provided as a part of the site plan submittal contains a statement that the
survey has been abstracted and researched for utility lines, right-of-ways, and/or
easements. Provide such statement on a copy of the survey submitted for a
second submittal.
5. Provide a traffic statement by a registered traffic engineer containing traffic

information for the project. The statement shall contain, at minimum, an
anticipated number of peak hour trips and average daily trips (this information
should be based on ITE standards). Include these numbers in the site plan data
summary. The submitted traffic statement shall be approved by the Palm Beach
County Traffic Division prior to building permit issuance.
7. On the elevation drawings depict color code and manufacturer's name of all
exterior building finishes.
8. Prior to the Planning and Development Board meeting submit to the Planning
and Zoning Department a presentation board containing samples of all exterior
building materials and/or finishes to be used for construction.
9. Prior to the Planning and Development Board meeting submit to the Planning
and Zoning Department a presentation board containing color rendering of all
elevations of the proposed building.

"barrel roof' spanned over the building will be replaced with either a flat roof
screened with parapet walls on all four sides of the building, or with a gable roof.
