parcel.
(2) A computation of the total acreage of the subject
parcel to the nearest hundredth (1/100) of an
acre.
A tree survey, which conforms to the requirements
of the City of Boynton Beach Tree Preservation
Ordinance. (Also refer to Page 6, Sec. II h.(12)
of this application if property is occupied by
native vegetation.) This requirement may be
waived by the Planning Director where found to be
unrelated to the land use or zoning issues
involved with the application.
e. A complete certified list of all property owners,
mailing addresses, and legal descriptions for all
properties within at least four hundred (400) feet of
the subj~ct parcel as recorded in the latest official
tax rolls in the county courthouse shall be furnished
by the applicant. Postage, and mailing labels or
addressed envelopes must also be provided. Said list
shall be accompanied by an affidavit stating that to
the best of the applicant's'knowledge said list is
complete and accurate. Notification of surrounding
property owners will be done by the City of Boynton
Beach.

A copy of the Palm Beach County Property Appraiser's
maps showing all of the properties referred to in
paragraph e. above, and their relation to the subject
parcel.
A statement by the applicant justifying the zoning
requested, including reasons why the property is
unsuitable for development under the existing zoning
and more suitable for development under the proposed
zoning.
A comparison of the impacts that would be created by
development under the proposed zoning, with the impacts
that would be created by development under the existing
zoning, which will include:
(1) A comparison of the potential square footage or
number and type of dwelling units under the
existing zoning with that which would be allowed
under the proposed zoning or development.
(2) A statement of the uses that would be allowed in
the proposed zoning or development, and any
particular uses that would be excluded.
(3) Proposed timing and phasing of the development.
(4) For proposed zoning of property to commercial or
industrial districts, where the area of the
subject parcel exceeds one (1) acre, projections
for the number of employees.
(5) A comparison of traffic which would be generated
under the proposed zoning or development, with the
traffic that would be generated under the current
zoning; also, an analysis of traffic movements at
the intersections of driveways that would serve
the property and surrounding roadways, and
improvements that would be necessary to
accommodate such traffic movements. For projects
that generate more than five hundred (500) net
trips per day, a traffic impact analysis must be
submitted which complies with the Municipal
Implementation Ordinance of the Palm Beach County
Traffic Performance Standards Ordinance.
(a) For projects that generate two thousand
(2,000) or more net trips per day, the
traffic impact analysis must be submitted to
the City at least 30 days prior to the
deadline for land use amendment and/or
rezoning, in order to allow for timely
processing of the application and review by
the City's traffic consultant and Palm Beach
County. The applicant shall be billed for
the cost of review by the City's traffic
consultant.
(b). For projects that generate between five
hundred (500) and two thousand (2,000) net
trips per day, . the traffic impact analysis
must be submitted at the application deadline
for land use amendment and/or rezoning, in
order to allow for timely processing of the
application and review by Palm Beach County.

However, if it is the desire of the applicant
to utilize the City's traffic consultant for
review of the traffic impact analysis prior
to review by Palm Beach County, then the
procedure and requirements outlined under
item "a" above shall be followed.
NOTE:
Failure to submit traffic impact analysis in the manner
prescribed above may delay approv~l of the application.

For parcels larger than one (1) acre, a comparison
of the water demand for development under the
proposed zoning or development with water demand
under the existing zoning. Water demand shall be
estimated using the standards adopted by the Palm
Beach County Health Department for estimating such

by a registered engineer. Commitment to the'
provision of improvements to the water system
shall also be included, where existing facilities
would b.e inadequate to serve development under
the proposed zoning.

of sewage flows that would be generated under the
proposed zoning or development with that which
would be generated under the ~existing zoning.
Sewage flows shall be estimated using the
standards adopted by the Palm Beach County Health
Department for estimating such flows, unless
different standards are justified by a registered
engineer. Commitment to the provision of
improvements to the sewage collection system shall
also be included, where the existing facilities
would be inadequate to serve development under the
proposed zoning.
For proposed residential developments ~arger than
one (1) acre, a comparison of the projected
population under the proposed zoning or
development with the projected population under
the existing zoning. Population projections
according to age groups for the proposed
development shall be required where more than
fifty (50) dwellings, or 50 sleeping rooms in the
case of group housing, would be allowed under the
proposed zoning.
At the request of the Planning Department,
Planning and Zoning Board, or City Commission, the
applicant shall also submit proposals for
minimizing land use conflicts with surrounding
properties. The applicant shall provide a summary
of the nuisances and hazards associated with
development under the proposed zoning, as well as
proposals for mitigation of such nuisances and
hazards. Such summary shall also include, where
applicable, exclusion of particular uses,
limitations on hours of operation, proposed
location of loading areas, dumpsters, and
mechanical equipment, screening of service areas
and mechanical equipment, location of driveways
and service entrance, and specifications for site

lighting. Nuisances and hazard,S shall be abated
or mitigated so as to conform to the performance
standards contained in the City's zoning
regulations and the standards contained in the
City's noise control ordinance. Also, statements
concerning the height, orientation, and bulk of
structures, setbacks from property lines, and
measures for screening and buffering the proposed
development shall be provided. At the request of
the Planning and Zoning Board or City Commission,
the applicant shall also state the type of
construction and architectural styles that will be
employed in the proposed development.
(10) At the request of the Planning Department,
Planning and Zoning Board, or City Commission, the
applicant shall also submit the following
information:
(a)
Official soil conservation service
classification by soil associations and all
areas subject to inundation and high ground
water leyels.
(b) Existing and proposed grade elevations.
(c) Existing or proposed water bodies.
( d) Form of ownership and form of organization to
maintain common spaces and recreation
facilities.

A written commitment to the provision of all
necessary facilities for storm drainage,
water supply, sewage collection and
treatment, solid waste disposal, hazardous
waste disposal, fire protection, easements or
rights-of-way, roadways, recreation and park
areas, school sites, and other 'public
improvements or dedications as may be
required.
For rezonings to planned zoning districts, the
specific requirements for submission of
applications for rezoning to such districts shall
also be satisfied. Furthermore, all materials
required for a subdivision master plan shall also
be submitted.

The traffic conditions along the two lane section of South Seacrest Blvd. are
very poor.
The amount of traffic generated by school buses and emergency vehicles, in
addition to already heavy traffic on South Seacrest Blvd., makes turning left
into and out of all the avenues and driveways extremely difficult.
Add to that the flooding that occurs regularly, and you have the impossible
situation of four lanes of traffic going into two lanes and, during flooding,
into one lane.
To add the road impact from an additional 234 dwelling units to an already
bad s i tua t ion s hou 1 d not even be cons i dered.

INSTRUCTIONS FOR COMPLETION OF APPLICATION FOR
ALTERATION OF ENVIRONMENTALLY SENSITIVE LANDS
An fiJ application for development or alteration of property containing
environmentally sensitive lands, as identified in Palm Beach County's
Environmentally Sensitive Lands Ordinance No. 90-47 (ESLO), must include an
environmental impact study. Section 11 of the ESLO sets forth the minimum
information the study should include to enable staff to identify the
envi ronmenta 1 effects that the proposed 1 and a lterat ion woul d have on the
property. .
The environmental impact study is intended to provide information t6 assist the
Palm Beach County Board of County Commissioners (the Board) and municipalities,
as appropriate, in making decisions concerning developments having impacts on
environmentally sensitive lands. Based on the approval criteria for proposed
land alteration specified in Section 12 of the ESLOand recommendations of the
Department of Environmental Resources Management (ERM), the Board and/or the
appropriate municipality shall determine whether public acquisition of the site
is necessary to preserve the environmental values significant to Palm Beach
County. If public acquisition is not deemed necessary, the project will proceed
through the development approval process, subject to appropriate conditions.
ERM has the responsibility to prepare an evaluation and recommendation to the
Board'or appropriate municipality. In fulfilling its responsibilities under
Section 10 of the Environmentally Sensitive Lands Ordinance, ERM will use the
information prOVided by the applicant to determine whether development will have
a favorable or unfavorable impact on the environment and natural resources of
Palm Beach County and the extent of this impact.

information supplied must be accurate, up-to-date, and complete. Where a
format and units of measurement for information are specified, these must

C. Any information pertinent to the development which has not been
specifically requested in this form may be incorporated by the applicant
within Part VI of this application.

with the specified form from this application as the title page and a
table of contents after the title page.
E. Include a bibliography of the information sources utilized in answering
this application, along with the names, addresses and telephone numbers of
,any consultants, agencies, or other persons who contributed to or
completed sections of this application.
F. Identify all methodologies, models, assumptions, and standards used in
obtaining or evaluating any information provided in this application.
G. Applicant~ must be prepared to supply, upon request, relevant' background
data used to obtain any information contained in this application.
H. At least two copies of the completed application must be submitted to the
Palm Beach County Department of Environmental Resources Management. Be
prepared to supply additional copies upon request. One copy will be
provided to the appropriate municipality after the review or the
app 1 i cat i on has been completed by ERM and recommendations have been
developed.

PART I. Application Form
Complete the information requested on the form titled "APPLICATION FOR ALTERATION
OF ENVIRONMENTALLY SENSITIVE LANDS - ENVIRONMENTAL IMPACT STUDY - PART I". This
form is attached at the end of these instructions. This form should be used as
page 1 of the Environmental Impact, Study.
PART II. Site Conditions

Site Location Map (Map A) - A map depicting the exact location of the study site
in relation to'major and minor roads must be provided on 8-1/2" x 11"
,paper as page 2 of the study.
Aerial Photograph (Map B) - A 1989 or later, 1:600 or less scale, vertical aerial
photograph of the site with the specific project boundaries and acreage
'clearly indicated. Aerial photographs taken in 1989 are available through
the Palm Beach County Property Appraiser's Office. The aerial photograph
should be folded and inserted (not attached) into a large envelope, marked
"Aerial Photograph (Map B)", at the end of the report.
Vegetation Map (Map C) - A map of existing terrestrial and aquatic vegetation,
including exotic species and native plant community types, should be
inserted into a large envelope, marked "Vegetation Map (Map C)", at the
end of the report. Indicate the total acreage of each vegetation
community type. The vegetation map should be at the same scale as the
aerial pnotograph (Map B).
Soils Map (Map D) - A map of soil types found on the site should be inserted
into a large envelope, marked "Soils Map (Map 0)", at the end of the
report. Disturbed areas from past human activities should be delineated
on the map(s). Soil maps may be obtained from the U.S. Department of
'Agriculture, Soil Conservation Service.
Land Use Map (Map E) - A land use map showing existing uses and zoning on and
abutting the site should be inserted into a large envelope, marked "Land
. Use Map (Map E)", at the end of the report.
Narrative
The narrative portion of Part II should include a discussion of each of the
following categories.. If the category does not apply to the site, the
appropriate heading should be provided, followed by the statement "None known on
site."
A. Vegetation
Describe, in detail, each native plant community type, including canopy,
understory, and ground cover, found on site. Provide the acreage of each

community type found within the site. Identify the dominant species and
other unusual or unique features of the vegetation associations delineated
on Map C, and specify their ecological function, health and conditions.
Th is section will be the longest portion of the Envi ronmenta 1 Impact
'Study, and will provide the baseline information for all evaluations of
the proposed project.
B. Soil Types & Conditions
Provide a description of past human activities which have caused"
disturbance to surface soils.
C. Identification of Listed Species on Site
Do any endangered, threatened, or rare species or species of special
concern occur, or potentially occur, on the site? If so, identify each
species and identify its present legal status. Where were they found,
known to exi st, or expected to be found on site? What measures are
proposed to protect these species?
D. Colonial Bird/Migratory Bird Information
What colonial or migratory birds are known to or portneially nest, feed,
reside on or migrate, to the site? Identify the location of any known
roost i ng areas (Map E). What measures are proposed to protect these
species and thei~ habitats?
E. 'Archaeological/Historical Features
Are there any historical or archaeological sites on or immediately
adjacent to the development site? If so, describe them and indicate their
locations on Map E. Documentation may be attached in the form of a letter
from the Secretary of State's Office, Division of Archives, History and
Records Management, indicating the need for, or results of, an
archaeol ogi calor hi stori cal survey. What measures are proposed to
protect these features?
F. Geologically Significant Features
Are there any geologically significant features present on the site? If
so, describe them and indicate their locations on Map E. What measures
are proposed to protect or enhance these features?
G. Areas of Past or Present Disturbance
Describe areas of previous human disturbance or degradation, including
present and past uses of the site. Examples of such land uses include
known agricultural activities, grazing of livestock, mining activities,
homestead activities, etc.

H. Surrounding Land Uses
Identify any land uses outside of the project site which'have impacted the
functions and values of the site's natural resources. Examples of such
land uses include alteration of ground water levels, isolation by road
construction, disturbance by off-road vehicles, etc.
PART III.
Project Design
A. Provide a conceptual site plan of the proposed development project. The.,
site plan must be at the same scale as the vegetation map (Map C). The
'site plan must indicate the locations of buildings, roadways, parking
areas, utilities, water features, flood control structures, stormwater
systems, well field locations, landscaped areas, buffer areas, preserve
areas, agricultural activities, and other open-space areas. The site plan
should be labeled "Plan A" and enclosed in a large envelope, marked "Plan
A", at the end of the.report.
B.ldentify the status of any development approvals or permit applications.
One copy of each approval obtained to date should be included in the study
at this point.
PART IV.
Project 'Operation
A. Describe the proposed operations to be performed on the site, including
use, storage, handling, or production of substances known to be harmful to
plants, ~rrima1s, or humans.
B. Identify any pollutants expected to be emitted to the air, ground, and
water during project operation. Include both particulate and gaseous
pollutants.
C. Discuss the handling of solid wastes generated and the disposal methods
expected to be used.
D. Discuss the operation of the stormwater system.
PART V.
Project Alternatives
A. 'Discuss project alternatives considered, including options considered and
rejected and the rationale for rejection of each option considered.
B. Mitigation considerations should be discussed in detail as they relate to
possible loss of habitat or impacts on endangered, threatened or rare
. animal and plant species, or species of special concern.

PART VI.
Other Pertinent Information
Provide additional information as deemed necessary by the applicant to describe
the proposed development, or as requested by ERM.
The last page of the Environmental Impact Study is for the signatures of the
preparer of the report and the applicant. The signature of the investigator
indicates verification that all information is complete and accurate to the best
of-his or her knowledge. The last page of the study should appear as below:
