1982, the City Council approved on second reading, Ordinances
# 82-26, 82-32, and 82-34,which annex and zone the so-called
Point Manalapan properties. Also, as a part of the approval
of these Ordinances, the Master Plans for the Cedar Ridge
Estates PUD, and the High Ridge Commerce Park PID are approved
subject to agreements and stipulations listed in the Petition
for Voluntary Annexation and staff comments, (see attached).

BOYNTON BEACH, FLORIDA, AI.lENDING ORDINANCES NO.

COUNTY CONTIGUOUS TO RECENTLY ANNEXED LANDS WHICH
WHEN ANNEXED WILL CONSTITUTE A REASONABLY COMPACT
ADDITION TO THE CITY LIMITS; REPEALING ALL ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVID~
ING FOR A SAVINGS CLAUSE; AN EFFECTIVE DATE; AND FOR
OTHER PURPOSES.
WHEREAS, The City of Boynton Beach, Florida annexed

WHEREAS, it was contemplated that as a part of
Ordinances No. 82-26 and 82-27 certain contiguous rights-of-
way were to be annexed simultaneously therewith; and,
WHEREAS, the City' Planning and Zoning Board conducted
public hearings in this regard on August 10, 1982, and the
City Council conducted public hearings in this regard on
August 17, 1982; and,
~VHEREAS, owing to a clerical error, the legal
descripEions for these contiguous rights-of-way were in-
advertently omitted, and,
WHEREAS, it is the intent of the City Council to
annex these ~ights-of-way.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF BOYNTOH BEACH, FLORIDA:
Section I. Pursuant to Section 7 (32) of the Charter
of the City of Boynton Beach, Florida, and Florida Statutes,
Section 171.044, the following described unincorporated and
contiguous rights-of-way situated and lying and being in
the County of Palm Beach, Florida, to wit:
(1) Rights-of-way for Congress Avenue, the Boynton Canal
aod Lake Worth Drainage District Canal # L-21 adjacent
to the real property annexed by Ordinance No. 82-27;
(2) A dedicated right-of-way located in Sections 7, 8, 17,18,
and 19 all in Township 45 South, Range 43 East, Palm
Beach County, Florida, more particularly described as

Section 4. Should any section or provision of this
Ordinance or any portion thereof, any paragraph, sentence
or word be declared by a court of competent jurisdiction to
be invalid, such decision shall not affect the validity of
the remainder hereof as a whole or any part hereof other
than the part declared to be invalid.
Section 5. Specific authority is hereby granted to
codify this Ordinance.
Section 6. This Ordinance shall become effective
immediately upon its ~inal passage.
Section 7. This Ordinance after adoption, shall be
filed with the Clerk of the Circuit Court of Palm Beach
County.

AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING ORDINANCE NO. 80-19 OF SAID
CITY, BY ZONING A PORTION OF A CERTAIN PARCEL
OF LAND MORE PARTICULARLY DESCRIBED HEREIN
WHICH IS BEING SIMULTANEOUSLY HEREWITH ANNEXED
INTO THE CITY OF BOYNTON BEACH BY ORDINANCE AS
P.U.D. (PLANNED UNIT DEVELOPMENT) WITH LAND USE
INTENSITY 5 (L.U.I.); AND ANOTHER PORTION OF
THAT LAND MORE PARTICULARLY DESCRIBED HEREIN AS
P.I.D. (PLA~rnED INDUSTRIAL DEVELOPMENT);
PROVIDING FOR A SAVINGS CLAUSE; REPEALING
PROVISIONS; AN EFFECTIVE DATE AND FOR OTHER
PURPOSES.
WHEREAS, the City Council of the City of Boynton Beach,
Florida, has heretofore adopted Ordinance No. 80-19, in which a
Revised Zoning Map was adopted for said City; and,
~mEREAS, the City Council of the City of Boynton Beach,
simultaneously herewith adopted an Ordinance annexing a parcel of
land more particularly described herein into the City limits of
said City; and,
WHEREAS, the owners and agents of said property have
requested the above mentioned zoning category; and,
vlliEREAS, the Planning and Zoning Board of the City of
Boynton Beach, Florida, has heretofore approved said development
and has recommended approval thereof; and,
WHEREAS, the City Council deems it the best interest
of the inhabitants of said City to amend the aforesaid Revised
Zoning Map as hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF BOYNTON BEACH, FLORIDA:
Section I. That the following described land, located
in the City of Boynton Beach, Florida:
SEE ATTACHED LEGAL DESCRIPTION (EXHIBIT "A")
be and the same is hereby zoned as P.U.D. (Planned Unit Develop-
ment) with a Land Use Intensity of 5.00.
Section 2. That the application of WILLIAM E. BENJAMIN
II and POINT MANALAPAN DEVELOPMENT CORP. for rezoning of subject
tract is hereby granted for the pu~ose of permitting the
development of said land as a Planned Unit Development (P.U.D.)
is specific in accordance' with development plans and specifications
therefore now on file in the office of the City Planner in the
City of Boynton Beach, Florida, and all requirements, terms and
conditions established and set forth in the minutes of the
Municipal Planning and Zoning Board and the City Council of the
City of Boynton Beach pertaining to the review and approval of
said application which minutes are hereby made a part hereof for
reference and staff conunents as attached hereto as Exhibit "B".
Except as provided herein, the applicant shall proceed
in strict accordance with all ordinances of the City of Boynton
Beach, including, but not limited to, its building, electrical,
plumbing, subdivision, planning and zoning codes, and all rules
and regulations of the State of Florida Department of Environmental
Regulation. In satisfaction of the recreation dedication require-
ments of the City Ordinances, this approval incorporates a payment
by the Developer consistent with City Planning and Zoning Board
approval.
Section 3. That the following described land located
in the City of Boynton Beach, Florida,
SEE ATTACHED LEGAL DESCRIPTION (EXHIBIT "C")
be and the same is hereby zoned as P.I.D. (Planned Industrial
Development).
Section 4. That the application of WILLIAM E. BENJAMIN

CITY, BY AMENDING LAND USE ELEMENT OF THE
COMPREHENSIVE PLAN OF THE CITY BY ADOPTING
THE PROPER LAND USE OF CERTAIN PROPERTY WHICH
IS BEING ANNEXED INTO THE CITY BY ORDINANCE
SIMULTANEOUSLY HEREWITH WHICH IS MORE
PARTICULARLY DESCRIBED HEREINAFTER; A PORTION
OF SAID LAND USE DESIGNATION IS BEING CHANGED
FROM PALM BEACH COUNTY LOW-MEDIUM DENSITY
RESIDENTIAL TO LOW-DENSITY RESIDENTIAL; ANOTHER
PORTION OF SAID LAND USE DESIGNATION IS BEING
CHANGED FROM PALM BEACH COUNTY LAND USE

WHEREAS, a certain parcel of land more particularly
described hereinafter is being annexed into the City by Ordinance
being adopted simultaneous herewith; and,
WHEREAS, the procedure for amendment of a Land Use
Element of Comprehensive plan is set forth in Florida Statutes
~163.3184 has been followed; and,
WHEREAS, after public hearing and study, the City
Council deems it in the best interest of the inhabitants of said
City to amend the aforesaid Land Use Element of Comprehensive plan
as adopted by the City herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1. That Ordinance No. 79-24 of the City is
hereby amended to reflect the following: That the land use of the
following described land which is being annexed into the City of
Boynton Beach, Florida, by Ordinance simultaneously herewith shall
be designated Low-Density Residential. Said land is more
particularly described as follows:

Section 3. That any maps adopted in accordance with
the Land Use Element of said Comprehensive Plan shall be amended
accordingly.
Section 4. That should any section or provision of

affect the remainder of this Ordinance.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY ~
OF BOYNTON BEACH, FLORIDA, ANNEXING A CERTAIN
UNINCORPORATED TRACT OF LAND THAT IS CONTIGUOUS
TO THE CITY LIMITS WITHIN PALM BEACH COUNTY AND
THAT WILL UPON ITS ANNEXATION, CONSTITUTE A
REASONABLY COMPACT ADDITION TO THE CITY TERRITORY
PURSUANT TO A PETITION OF THE OWNER OF SAID
TRACT OF LAND, REQUESTING ANNEXATION PURSUANT
TO SECTION 7(32) OF THE CHARTER OF THE CITY OF
BOYNTON BEACH, FLORIDA, AND FLORIDA STATUTES
171.044; PROVIDING THAT THE PROPER LAND USE

WHEREAS, WILLIAM E. BENJAMIN, II, and POINT MANALAPAN
DEVELOPMENT CORPORATION, owner of the following tract of land
described as:
SEE EXHIBIT "A" ATTACHED
filed a Petition for Annexation to the City of Boynton Beach
direct to the City Council pursuant to Article 7(32) of the
Charter of the city of Boynton Beach, Florida, and Florida
Statutes, Section 171.044 (1980); and
WHEREAS, the said tract of land lying and being within
Palm Beach County is contiguous to the existing City limits of
the City of Boynton Beach, Florida, and will upon its annexation
constitute a reasonably compact addition to the City territory;
and
WHEREAS, the proposed use of said land and land use
designation has been determined to be consistent with the future
land uses of the city of Boynton Beach and the Palm Beach County
commission has no objection to the designated use.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA:
Section 1. Pursuant to Section 7(32) of the Charter of
the City of Boynton Beach, Florida~ and Florida Statutes, Section
~7l.D44. the following described unincorporated and contiguous
tract of land situated and lying and being in the County of Palm
Beach, Florida, to wit:
SEE EXHIBIT "A" ATTACHED
is hereby annexed to the City of Boynton Beach and such land so
annexed shall be and become part of the City with the same force
and effect as though the same had been originally incorporated
in the territorial boundaries thereof.
Section 2. That Section 6 and 6(a) of the Boynton
Beach City Charter is hereby amended to reflect the annexation
of that tract of land more particularly described in Section 1
of this Ordinance.
Section 3. That by Ordinances adopted simultaneous
herewith, the proper zoning designation and land use category is
being determined.
Section 4. That all Ordinances or parts of Ordinances
in conflict herewith be and the same are hereby repealed,
Section 5. Should any section or provision of this
Ordinance or any portion thereof, any paragraph, sentence or
word be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the validity of the
remainder hereof as a whole or any part hereof other than the
Dart declared to be invalid.
Section 6. Specific authority is hereby granted to
codify this Ordinance.
Section 7. This Ordinance shall not be passed until the
same has been advertised for four (4) consecutive weeks in a
newspaper of general circulation in the City of Boynton Beach
as required by the City Charter and Florida Statutes ~17l.044.
Section 8. This Ordinance shall become effective
immediately upon its final passage.
Section 9. This Ordinance after adoption, shall be
filed with the Clerk of the Circuit Court of Palm

PETITION FOR VOLUNTARY ANNEXATION
Petitioners, POINT MANA LAPAN DEVELOPMENT CORPORATION, a
Florida corporation, and WILLIAM E. BENJAMIN, II submit to the
City Council of the CITY OF BOYNTON BEACH, Florida, this their
Petition for Voluntary Annexation, and state as follows:
1. Petitioners are the Owners of that certain real property,
hereinafter referred to as the "property", situated in
Palm Beach County, Florida, and more particularly described
in Exhibit "A", attached hereto.
2. The City of Boynton Beach has jurisdiction to annex the
property pursuant to Chapter 171, Florida Statutes, in
tha t :
(a) The property proposed to be annexed is in the
unincorporated area of Palm Beach County;
(b) The property proposed to be annexed is reasonably
compact and is contiguous to the present corporate
boundaries of the City of Boynton Beach;
(c) Annexation of the property proposed to be annexed
shall not result in the creation of enclaves.
3. Petitioners submit this Petition for Voluntary Annexation
with the understanding that it shall be specifically
contingent upon the following conditions:

(a) Rezoning of the property now zoned RS (residential),
to permit development of a planned unit development and
planned industrial development in accordance with the
si te plan attached hereto as Exhibi t "B".
(b) Adoption of a resolution by the County Commission of
Palm Beach County consenting to the rezoning of the
property and development of the property in accordance
wi th the si te plan attached hereto as Exhibi t "B".
(c) Provision by the City of Boynton Beach of water and seWE
service to the property to permit development of the
property in accordance with the site plan attached heret
as Exhibi t "B".
(d) Submission by the Petitioners of a Declaration of
Restrictive Covenants, By-Laws and Articles of Incorpor-
ation in connection with the Owners Association, all in
a form acceptable to the City of Boynton Beach, Florida.
Petitioner shall submit said documents prior to the
issuance of any certificate of occupancy, either in the
Planned Unit Development or the Planned Industrial
Development.
4. In the event of acceptance by the City of Boynton Beach of
this Petition for Voluntary Annexation, Petitioners agree to
provide the improvements set forth in the plans and specifi-
cations collectively attached hereto as Exhibit "C".

For Voluntary Annexation at any time prior to enactment

1. OFF-SITE ROAD AND TRAFFIC IMPROVEMENTS
A. Road Improvements:
(1) The extension of High Ridge Road from the Southwest
corner of Section 9, Township 45 South, Range 43 East,
to the existing right-of-way of Northwest 22nd Avenue,
as more particularly described in Exhibit "c" of the
attached Map, Plan & Survey file. In the event a hiatus
is placed across High Ridge Road as is presently under
discussion by the Palm Beach County Commission, the
off-site road improvements will be modified as noted
in the addendum ~o- the traffic impact statement con-
tained in the Map, Plan & Survey file submitted with
this application.
(2) Construction' of a turning lane on High Ridge Road at
the intersection of High Ridge Road and Hypoluxo Road.
(3) Construction of a turning land on High Ridge Road at
the intersection of High Ridge Road and Northwest 22nd
Avenue.
(4) Construction of a turning lane on High Ridge Road at
in intersection of High Ridge Road and the main entrance
to the proposed development.
(5) Construction of a turning lane on Hypoluxo Road at
the intersection of Hypoluxo Road and High Ridge Road.
(6) Construction of a turning lane on Northwest 22nd Avenue
at the intersection of Northwest 22nd Avenue and High
Ridge Road.
B. Traffic Light Improvement:
(1) Installation of a traffic light at the intersection of
High Ridge Road and Hypoluxo Road.
C. Time for Completion of the Aforesaid Road and Traffic Light
Improvements:
(1) Construction of the road and traffic light improvements
set forth above in paragraphs I.A. and 1.B. hereof, to
be completed prior to the issuance of any Certificate
of Occupancy in the PID or PUD.
2. UTILITIES AND ON-SITE ROAD IMPROVEMENTS
A. Construction:
Construction of all, utilities and road improvements shall be
pursuant to the plans drawn by Robert E. Owen & Associates,
Inc. Said plans are collectively located in the Map, Plan &
survey tile.

Peti~ioner and the city of Boynton Beach acknow~edge
and agree that, ln tne event Petitloner is required by
tne Clty to construct any water or sanltary sewer facilitiE
in a Slze or capacity larger than tnat required by the
Petitloner to service the developments contemp~ated by
this Petition, Petitioner shall receive a credit equal
to the additlonal cost incurred by Petitioner in so
constructing said facilities in a size larger than that
required to service said development contemplated by this
Petition. Said credit shall be applied against water
and sanitary sewer captial facility charges with the
said credit available for a period not to exceed five (5)
years and said credits to be computed consistent with
City ordinances as amended from time to time.
B. Time for Completion of Construction:
Construction of on-site road paving, on and off-site water
and sanitary sewer and on-site drainage to proceed ratably
with the actual construction of improvements for sale or
lease' by the Petitioner and located in the said Planned
Unit Development and the Planned Industrial Development.
3. RECREATIONAL FACILITIES
A. Construction:
Petitioner shall construct the recreational facilities
identified on the site plan located in the Map, Plan &
Survey file.
B. Time for Completion of Construction:
Petitioner shall complete all recreational facilities
within one (1) year of the issuance of the first Certi-
ficate of Occupancy in the Planned Unit Development.
4. ADDITIONAL COMMITMENTS:

Other commitments, if any, that may be required by City
ordinances including the subdivision regulations will be
c?mplied with according to the usual procedures for
developing property.
