" I. 1, i j: ORDINANCE NO. 82- 'If AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AI.lENDING ORDINANCES NO. 82-26 and 82-27 BY PROVIDING FOR THE ANNEXATION OF CERTAIN RIGHTS-OF-WAY LOCATED WITHIN PALM BEACH COUNTY CONTIGUOUS TO RECENTLY ANNEXED LANDS WHICH WHEN ANNEXED WILL CONSTITUTE A REASONABLY COMPACT ADDITION TO THE CITY LIMITS; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVID~ ING FOR A SAVINGS CLAUSE; AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, The City of Boynton Beach, Florida annexed ~ I certain real properties into the municipal corporate limits i, .. ;i i; by Ordinances No. 82-26 and 82-27; and, . - WHEREAS, it was contemplated that as a part of Ordinances No. 82-26 and 82-27 certain contiguous rights-of- way were to be annexed simultaneously therewith; and, WHEREAS, the City' Planning and Zoning Board conducted public hearings in this regard on August 10, 1982, and the City Council conducted public hearings in this regard on August 17, 1982; and, ~VHEREAS, owing to a clerical error, the legal descripEions for these contiguous rights-of-way were in- advertently omitted, and, WHEREAS, it is the intent of the City Council to annex these ~ights-of-way. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTOH BEACH, FLORIDA: Section I. Section 5. Specific authority is hereby granted to codify this Ordinance. Section 6. This Ordinance shall become effective immediately upon its ~inal passage. Section 7. BENJAMIN, II, and POINT MANALAPAN DEVELOPMENT CORPORATION, owner of the following tract of land described as: SEE EXHIBIT "A" ATTACHED filed a Petition for Annexation to the City of Boynton Beach direct to the City Council pursuant to Article 7(32) of the Charter of the city of Boynton Beach, Florida, and Florida Statutes, Section 171.044 (1980); and WHEREAS, the said tract of land lying and being within Palm Beach County is contiguous to the existing City limits of the City of Boynton Beach, Florida, and will upon its annexation constitute a reasonably compact addition to the City territory; and WHEREAS, the proposed use of said land and land use designation has been determined to be consistent with the future land uses of the city of Boynton Beach and the Palm Beach County commission has no objection to the designated use. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1. Pursuant to Section 7(32) of the Charter of the City of Boynton Beach, Florida~ and Florida Statutes, Section ~7l.D44. the following described unincorporated and contiguous tract of land situated and lying and being in the County of Palm Beach, Florida, to wit: SEE EXHIBIT "A" ATTACHED is hereby annexed to the City of Boynton Beach and such land so annexed shall be and become part of the City with the same force and effect as though the same had been originally incorporated in the territorial boundaries thereof. Section 2. That Section 6 and 6(a) of the Boynton Beach City Charter is hereby amended to reflect the annexation of that tract of land more particularly described in Section 1 of this Ordinance. Section 3. That by Ordinances adopted simultaneous herewith, the proper zoning designation and land use category is being determined. Section 4. That all Ordinances or parts of Ordinances in conflict herewith be and the same are hereby repealed, Section 5. Should any section or provision of this Ordinance or any portion thereof, any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof other than the Dart declared to be invalid. Section 6. Specific authority is hereby granted to codify this Ordinance. Section 7. This Ordinance shall not be passed until the same has been advertised for four (4) consecutive weeks in a newspaper of general circulation in the City of Boynton Beach as required by the City Charter and Florida Statutes ~17l.044. BENJAMIN, II submit to the City Council of the CITY OF BOYNTON BEACH, Florida, this their Petition for Voluntary Annexation, and state as follows: 1. Petitioners are the Owners of that certain real property, hereinafter referred to as the "property", situated in Palm Beach County, Florida, and more particularly described in Exhibit "A", attached hereto. 2. The City of Boynton Beach has jurisdiction to annex the property pursuant to Chapter 171, Florida Statutes, in tha t : (a) The property proposed to be annexed is in the unincorporated area of Palm Beach County; (b) The property proposed to be annexed is reasonably compact and is contiguous to the present corporate boundaries of the City of Boynton Beach; (c) Annexation of the property proposed to be annexed shall not result in the creation of enclaves. 3. Petitioners submit this Petition for Voluntary Annexation with the understanding that it shall be specifically contingent upon the following conditions: J (a) Rezoning of the property now zoned RS (residential), to permit development of a planned unit development and planned industrial development in accordance with the si te plan attached hereto as Exhibi t "B". EXHIBIT "c" 1. OFF-SITE ROAD AND TRAFFIC IMPROVEMENTS A. Road Improvements: (1) The extension of High Ridge Road from the Southwest corner of Section 9, Township 45 South, Range 43 East, to the existing right-of-way of Northwest 22nd Avenue, as more particularly described in Exhibit "c" of the attached Map, Plan & Survey file. In the event a hiatus is placed across High Ridge Road as is presently under discussion by the Palm Beach County Commission, the off-site road improvements will be modified as noted in the addendum ~o- the traffic impact statement con- tained in the Map, Plan & Survey file submitted with this application. (2) Construction' of a turning lane on High Ridge Road at the intersection of High Ridge Road and Hypoluxo Road. (3) Construction of a turning land on High Ridge Road at the intersection of High Ridge Road and Northwest 22nd Avenue. (4) Construction of a turning lane on High Ridge Road at in intersection of High Ridge Road and the main entrance to the proposed development. (5) Construction of a turning lane on Hypoluxo Road at the intersection of Hypoluxo Road and High Ridge Road. (6) Construction of a turning lane on Northwest 22nd Avenue at the intersection of Northwest 22nd Avenue and High Ridge Road. B. Traffic Light Improvement: (1) Installation of a traffic light at the intersection of High Ridge Road and Hypoluxo Road. C. Time for Completion of the Aforesaid Road and Traffic Light Improvements: (1) Construction of the road and traffic light improvements set forth above in paragraphs I.A. and 1.B. hereof, to be completed prior to the issuance of any Certificate of Occupancy in the PID or PUD. 2. UTILITIES AND ON-SITE ROAD IMPROVEMENTS A. Construction: Construction of all, utilities and road improvements shall be pursuant to the plans drawn by Robert E. Owen & Associates, Inc. Said plans are collectively located in the Map, Plan & survey tile. . -~ Peti~ioner and the city of Boynton Beach acknow~edge and agree that, ln tne event Petitloner is required by tne Clty to construct any water or sanltary sewer facilitiE in a Slze or capacity larger than tnat required by the Petitloner to service the developments contemp~ated by this Petition, Petitioner shall receive a credit equal to the additlonal cost incurred by Petitioner in so constructing said facilities in a size larger than that required to service said development contemplated by this Petition. Said credit shall be applied against water and sanitary sewer captial facility charges with the said credit available for a period not to exceed five (5) years and said credits to be computed consistent with City ordinances as amended from time to time. B. Time for Completion of Construction: Construction of on-site road paving, on and off-site water and sanitary sewer and on-site drainage to proceed ratably with the actual construction of improvements for sale or lease' by the Petitioner and located in the said Planned Unit Development and the Planned Industrial Development. 3. RECREATIONAL FACILITIES A. Construction: Petitioner shall construct the recreational facilities identified on the site plan located in the Map, Plan & Survey file. B. Time for Completion of Construction: Petitioner shall complete all recreational facilities within one (1) year of the issuance of the first Certi- ficate of Occupancy in the Planned Unit Development. 4. ADDITIONAL COMMITMENTS: .. Other commitments, if any, that may be required by City ordinances including the subdivision regulations will be c?mplied with according to the usual procedures for developing property.
