LEGAL APPROVAL II I ORDINANCE NO. 097-$5 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, REGARDING THE APPLICATION OF CONDOR INVESTMENTS OF PALM BEACH COUNTY (A 6.37 ACRE PARCEL LOCATED ADJACENT SOUTH AND EAST OF LAKE WORTH CHRISTIAN SCHOOL, EAST OF HIGH RIDGE ROAD, APPROXIMATELY ONE-HALF MILE SOUTH OF HYPOLUXO ROAD); AMENDING ORDINANCE 91-70 OF SAID CITY BY REZONING A CERTAIN TRACT OF LAND MORE RARTICULARL Y DESCRIBED HEREIN, FROM P.U.D. (PLANNED UNIT DEVELOPMENT) TO R-1AA (SINGLE FAMILY RESIDENTIAL) ON THE NORTHEAST PORTION OF THE ORIGINAL PLAT OF CEDAR RIDGE; AMENDING THE REVISED ZONING MAP ACCORDINGLY; PROVIDING FOR CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Boynton Beach, Florida has adopted Ordinance No. 91-70, in which a Revised Zoning Map was adopted for said City; and WHEREAS, Joe Basil and Cedar Ridge Development Inc., as agent for Condor Investments of Palm Beach County, owners of the property more particularly described hereinafter, has heretofore filed a Petition, pursuant to Section 9 of Appendix A-Zoning, of the Code of Ordinances, City of Boynton Beach, Florida, for the purpose of rezoning a certain tract of land consisting of 6.37 acres, said land being more particularly described hereinafter, from P.U.D. (Planned Unit Development) to R-1AA (Single Family Residential), I which requests that the 6.37 acre tract be removed from the boundaries of the P.U.D. zone to allow for the processing of the rezoning : application; and WHEREAS, the City Commission deems it in the best interests of the inhabitants of said City to amend the aforesaid Revised Zoning Map as hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1: The following described land, located in the City of Boynton Beach, Florida as set forth as follows: Parcel "B" and lots 35 through 45, inclusive, of Cedar Ridge, a P.U.D. and High Ridge Commerce Park, a P.I.D., according to the plat thereof recorded in the office of the Clerk of the Circuit Court in and for Palm Beach County, Florida, at Plat Book 46, Page 58. Containing 6.37 acres, more or less be and the same is hereby rezoned from P.U.D. (Planned Unit Development) to R-1AA (Single Family Residential). A location map is attached hereto as Exhibit "A" and made a part of this Ordinance by reference. Section 2: That the aforesaid Revised Zoning Map of the City shall be amended accordingly. Section 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4: Should any section or provision of this Ordinance or any portion thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance. " , .'- .:..1 - 1AP. MINUTES REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA DECEMBER 19, 1995 Commissioner Rosen inquired about the distance between the ingresses and egresses. Mr. Hearing explained that the proposed egress would be 250' from the entrance. The entrance to the new location is approximately 160' from the existing location, then 300', 200' and 200'. Commissioner Rosen feels there are quite a few entrances and egresses based on the possible traffic flow in the future. There will be traffic interruption based on the number. After some explanation from the applicant with respect to how the service vehicles would circulate through the site, Mayor Taylor was uncomfortable having lfash trucks pulling up to the front door. He would not have a problem with the southernmost drive being approved as an "egress only". Motion Commissioner Rosen moved to approve a request for relief from the City of Boynton Beach Land Development Regulations, Chapter 23 - Parking Lots, Article II, Section H.7, "Number of Driveways" to allow two (2) additional driveways onto NW 7th Court, providing that the southernmost driveway is an "egress only" driveway. Mayor Pro Tern Matson seconded the motion which carried 4-0. Mr. Hearing thanked staff for the time and effort they expended on this application. They did a good job and the applicant appreciates their help. F. PROJECT NAME: Cedar Ri. PUD and High Ridge Commerce Park PIO (buffer easement) Richard Harris of Scott, Royce, Harris, Bryan, Barra & Jorgensen, P.A. Condor Investments of Palm Beach County, Inc. South perimeter of Lots 15, 16, 17 and 18 within the High Ridge Commerce Park PID ABANDONMENT - Request for abandonment of a 25 foot wide buffer easement. AGENT: OWNER: LOCATION: DESCRIPTION: RickJ:lauis, Attorney for the applicant, said the 1<Xs in this request will be part of a site plan for Waste Management which will appear later in the meeting. The reason for the 25' buffer in this area is eliminated if the site plan is approved. The conditions imposed by staff are related to the approval the Commission already considered except for the condition that the Board of Adjustment request be granted allowing the elimination of the 25' peripheral greenbelt. The Board of Adjustment was supposed to have met last night, but failed to do so for lack of a quorum. Attorney Cherof advised that this item would be difficult to handle without con'sidering Item D under Development Plans. He suggested that this public hearing be conducted, but that the vote be delayed until the site plan modification is reviewed. Then both items can be considered. Waste Management of Palm Beach High Ridge Commerce' Park PIO Lots 15, 16, 17 and 18 (South side of Commerce Road, approximately 304 feet east of High Ridge Drive) SITE PLAN MOD.FICA T'ON - Request to amend the previously approved site plan to add land area to construct additional exterior paved truck storage and an expanded exterior container storage yard. DESCRIPTION: Joe Handley and Rick Harris had no objection to combining the review of their applications. Joe.._ Handle)' _oL Cra.v~Thompsoll....&....Ass.ociat~, represented Waste Management,. requested combining the use approval and Mr. Harris' additional easement abandonment since they are tied together. Mr. Handley advised that the existing Waste Management facility is located south of the Miner Road abandonment. The applicant would like to modify the site plan to include property within the High Ridge PIO' The property will be utilized for the same use which is currently on Waste Management's property. The use is truck storage and solid waste container storage. The applicant has concerns about two of the staff comments and agrees with all other staff conditions. · Comment #8 - The requirement to replat was never brought up. Mr. Handley received that comment the day of the Planning and Development Board meeting as a new comment. Both parcels were recently platted and the property in between is being vacated. · Comment #27 . Mr. Handley advised that this was a new comment in the staff report on the day of the Planning and Development Board meeting. When Waste Management considered purchasing the property, Mr. Handley contacted staff to see what was necessary to allow the property to be incorporated into ~e Waste Management property. He was told a use approval was necessary to allow the use in a PID along with site plan and some right-of-way vacations, etc. They have gone through the process. The Planning and Development Board approved the use, and the next item was the site plan in which a comment exists requiring rezoning of the property.
