Heyden, AICP 1;j:,6J- Planning and Zoning Director DATE: April 24, 1997 SUBJECT: High Ridge Commerce Park PID Buffer Easement Abandonment (#95-010) Please place the above-referenced item on the May 6, 1997 City Commission agenda under Legal-Resolutions. DESCRIPTION: The easement to be abandoned is a 25 foot wide buffer easement located on property owned by Condor Investments. The easement is located along the south perimeter of lots 15, 16, 17, and 18 of the High Ridge Commerce Park PID. The 25 foot wide buffer easement was dedicated to the City of Boynton Beach by recordation of the 1983 plat of Cedar Ridge PUD and High Ridge Commerce Park PID. The easement was created to contain the 25 foot wide peripheral greenbelt that is required along the perimeter of the PID. With the abandonment of the adjacent Miner Road right-of-way, this greenbelt, and buffer easement should be abandoned at the existing location and relocated within the abandoned right-of-way. The applicant had requested abandoning only that portion of the easement located on Lots 15, 16, 17, and 18, rather than for the entire portion adjacent to the subject right-of-way, as this request was in preparation for the planned expansion to the adjacent maintenance facility of Waste Management. This resolution will simultaneously create a new easement buffer within that area that is now becoming (following abandonment of Miner Road) the southern portion of the perimeter of the PID This request for abandonment first went to the Commission as a public hearing on December 19, 1995 and was approved with conditions. The conditions have now been satisfied and the request is therefore ready for resolution adoption. RECOMMENDATION: Staff recommends that the attached resolution, which would finalize the abandonment, be approved for adoption. Heyden ~--6J- Planning and Zoning Director TO: DATE: December 8, 1995 SUBJECT: High Ridge Commerce Park PID buffer easement abandonment File No. ABAN 95-010 NATURE OF REQUEST Richard Harris, agent for Condor Investments of Palm Beach County, is requesting abandonment of a 25 foot wide buffer easement located on property owned by Condor Investments. The easement is located along the south perimeter of lots 15, 16, 17 and 18 of the High Ridge Commerce Park PID. The lots are approximately 300 feet east of High Ridge Road and the south property line of the lots abuts the north right-of-way line of the undeveloped portion of Miner Road between High Ridge Road and 1-95. The attached Exhibit "All is a location map which shows the buffer easement in relationship to the lots and the Miner Road right -of -way. The attached Exhibit "B" is a legal description and survey of the easement requested to be abandoned. The subject easement is identified on the survey as Parcel 4. BACKGROUND The 25 foot wide buffer easement was dedicated to the City of Boynton Beach by recordation of the 1983 plat of Cedar Ridge PUD and High Ridge Commerce Park PID. It is anticipated that the purpose of the dedication was to envelop the 25 foot wide peripheral greenbelt that is required along the perimeter of the PID. ANALYSIS The requested abandonment has been submitted in order to allow expansion of Waste Management's solid waste facilities across Miner Road and further north into lots 15, 16, 17 and 18 of the High Ridge Commerce Park PID. Exhibit "CIl illustrates the location of the proposed easement abandonment in relationship to the existing Waste Management site and the area of the proposed expansion. The applicant is concurrently requesting two additional abandonments to be considered separately; abandonment of the Miner Road right-of- way and an associated access control easement. The site plan for the proposed Waste Management expansion is also scheduled to be considered at the December 12, 1995 Board meeting. In addition, Waste Management is requesting a Board of Adjustment variance (File No. BOAV 95-013, case #212) to eliminate the requirement of the 25 foot wide peripheral greenbelt. The variance is scheduled for the December 18, 1995 Board of Adjustment meeting. The applicant's reasons for filing this abandonment and the grounds that support the request are included in the attached Exhibit "DIl. The city departments involved in review of a request for abandonment and the utility companies notified of the request are identified below, as well as their responses. Public notice is given to the property owners that abut the easement to be abandoned.
