Application for Extension for Filing of Plat
Attached for your review and consideration and as previously provided
to you, please find Mr. Enrico Rossi's August 3, 1993 request letter
seeking a time extension for filing of plat documents and associated
development plans.
A copy of Mr. Rossi's letter was transmitted to all affected City
departments and having received responses from the Building Official,
Public Works Director, Planning Department and utility Department, I
herein forward to your attention their comments in this matter.
I concur ~ith all of the submitted comments and herein provide my
feelings regarding the time extension.
I especially concur with the utilities Director Memo No. 93-253,
wherein the developer must pay an additional reservation fee of
$15,661.80 as the initial reservation fee of one year has, no doubt,
expired.
I again especially concur with Building Department Memo No. 93-169, )
wherein the Building Official indicates that the subject project w~
granted a time extension for filing of a plat document for Citrus
Park conditioned upon bringing the entire site into a state of code
compliance within 30 days of the granting of the extension. A period
of over one year has expired since the City Commission's last granting
of a time extension and the project remains in a state of non-compliance
with City codes relative to on-site dead trees, vegetation, hurricane
hazards, etc.
I concur with your recommendation that the project should receive a
time extension of six months if the site is brought into a state of
compliance, relative to City codes, within 30 days from City Commissioh
action and should the property not be brought into a state of compliance
with City codes, the time extension should be granted for no more than
3 months. In any event, the property owners will be provided a formal
Notice of Violation on September 1, 1993 and Code Enforcement action
should continue unabated.

In any event, the Code Enforcement Division of the Police Department
should be urged to continue in the pursuit of compelling the property
owner(s) to clean up the ~ite.
Tambri Heyden's memo, dated August 13, 1993, will have no impact
relative to the required submission of reservation fees as stated
within Mr. Guidry's memo dated August 11, 1993.

extension)
NATURE OF REQUEST
Rafael Saladrigas of Val-Sal Investment Company, Inc., property
owner, is requesting an additional six months that would expire
June 4, 1995, to extend the concurrency exemption and the
previously approved preliminary plat. Find attached Exhibit "A"
letter of request from the applicant.
BACKGROUND
The Citrus Park PUD is located on the east side of Lawrence Road,
approximately 1,750 feet north of Gateway Boulevard (N.W. 22nd
Avenue), between the Citrus Glen PUD and Citrus Cove Elementary
School, as shown on the attached location map. A master plan and
PUD zoning were originally approved on November 1, 1988 for 106,
single family, detached, zero lot line units and a five acre public
park. A rezoning application for a new PUD master plan was
approved on September 19, 1989 for 113, single-family, detached,
zero lot line units. Preliminary plat approval was granted on
March 20, 1990 (see attached preliminary plat). Since the
preliminary plat was filed prior to the effective date of the
City's Concurrency Management Ordinance (June 1, 1990), the
preliminary plat is exempt from all levels of service (traffic,
drainage, neighborhood parks, district parks, recreational
facilities, solid waste, potable water and sanitary sewer).
A preliminary plat expires if within one year of the approval date,
a final plat has not been submitted and if a final plat has not
been recorded within 18 months of the approval of the preliminary
plat. Four time extensions have been granted to date. The last
extension, approved for one year, expired December 4, 1994.
Section 19-92(e) of Chapter 19, Article IV of the Code of
Ordinances states that such requests for time extensions "may be
filed not later than 60 days after the expiration of said
certificate or exemption". It further states that "time extensions
may be granted for any length of time which does not exceed one
year". Although this language is not clear whether more than one
time extension can be granted as long as each does not exceed one
year, it has been interpreted as such.

ANALYSIS
As noted in Mr. Saladrigas' letter of request, a contract to
purchase the Citrus Park property is currently in negotiation. It
has been announced to the City that Target Development Company has
purchased the property and the final plat and final construction
plans have been submitted to the Development Department. It should
be noted that despite the fact the requested time extension would
continue exemption from all of the City's concurrency levels of
service, the design proposals and infrastructure improvements
approved in connection with the 1990 preliminary plat, meet the
City's current levels of service, with the exception of traffic.
RECOMMENDATION
The Technical Review Committee (TRC) met on Tuesday, November 22,
1994 and recommended approval of the six month time extension, as
requested, subject to payment of water and sewer reservation fees
and property maintenance. These fees have been calculated and are
indicated within the attached memorandum from the Utilities
Department (memorandum #94-376). The Fire Department has indicated
that the property is in need of maintenance, i.e.- mowing, etc.
(Fire Department Memorandum No. #94-301).

preliminary plat)
NATURE OF REQUEST
Rafael Saladrigas of Val-Sal Investment Company, Inc., property
owner, is requesting a one year time extension to the expiration of
the Citrus Park PUD concurrency exemption and of the previously
approved preliminary plat.
BACKGROUND
The Citrus Park PUD is located on the east side of Lawrence Road,
approximately 1,750 feet north of Gateway Boulevard (N.W. 22nd
Avenue), between Citrus Glen PUD and Citrus Cove Elementary School,
as shown on the attached location map. A master plan and PUD
zoning were originally approved on November 1, 1988 for 106, single
family, detached, zero lot line units and a five acre public park.
A rezoning application for a new PUD master plan was approved on
September 19, 1989 for 113, single-family, detached, zero lot line
units. Preliminary plat approval was granted on March 20, 1990
(see attached preliminary plat). Since the preliminary plat was
filed prior to the effective date of the City's Concurrency
Management Ordinance (June 1,1990), the preliminary plat is exempt
from all levels of service (traffic, drainage, neighborhood parks,
district parks, recreational facilities, solid waste, potable water
and sanitary sewer).
A preliminary plat expires if within one year of the approval date,
a final plat has not been submitted and if a final plat has not
been recorded within 18 months of the approval of the preliminary
plat. Three time extensions have been granted to date. The last
extension, approved for six months, expired December 4, 1993. A
six month extension, rather than one year, was granted due to
pending code enforcement violations related to lack of maintenance
(dead trees, hurricane hazards, and perimeter fire buffer), which
were outstanding at the time of the last request.
Section 19-92(e) of Chapter 19, Article IV of the Code of
Ordinances states that such requests for time extensions "may be
filed not later than 60 days after the expiration of said
certificate or exemption". It further states that "time extensions
may be granted for any length of time which does not exceed one
year". Although this language is not clear whether more than one
time extension can be granted as long as each does not exceed one
year, it has been interpreted as such.
ANALYSIS
As noted in Mr. Saladrigas I letter of request, a contract to
purchase the Citrus Park property is currently in negotiation. In
addition, I have met with the potential contract purchaser
regarding an optional minor change to the preliminary plat as it
relates to completion of the final plat. It should be noted that
despite the fact the requested time extension would continue

exemption from all of the City's concurrency levels of service, the
design proposals and infrastructure improvements approved in
connection with the 1990 preliminary plat meet the City's current
levels of service, with the exception of traffic.
RECOMMENDATION
The Technical Review Committee (TRC) met on Tuesday, December 28,
1993 and recommended approval of the one year time extension, as
requested, subject to payment of water and sewer reservation fees.
These fees have been calculated and are indicated within the
attached memorandum from the Utilities Department (memorandum #93-
530) .
