The undersigned as applicant for Final Site Plan Approval does
hereby acknowledge, represent and agree that all plans,
specifications, drawings,' engineering, and other data
submitted with this application for review by the City of
Boynton Beach shall be reviewed by the various boards,
commissions, staff personnel and other parti6s designated,
appointed or employed by the City of Boynton beach, and any
such party reviewing the same shall rely upon the accuracy
thereof, and any change in any item submitted shall be deemed
material and substantial.
The undersigned hereby agrees that all plans,
specifications, drawings, engineering and other data which may
be approved by the City of Boynton Beach, or its boards,
commissions, staff or designees shall be constructed in strict
compliance with the form in which they are approved, and any
change to the ~ame shall be deemed material and shall place
the applicant in violation of this application and all
approvals and permits which may be granted.
The applicant agrees to allowing the City of Boynton
Beach all rights and remedies as provided for by the

Consider this letter an application to the Planninq and
Development Board appealing the final landscaping approval for
the Clear Copy Project as per Chapter 7.5, Article II, Section
11, of the Land Development Regulations. The basis of the appeal
is Clear Copy's violations with Chapter 7.5, Article II, Section
5,0.1, and Section 5.E of the Land Development Regulations.

1. The unlawful construction, erection, reconstruction,
alteration, rehabilitation, expansion, maintenance or
use of any building, structure or parking area, or
2. The occupancy and/or use of such building, structure
or parking area, or
3. The illegal act, conduct, business of use of, in or
about such premises.
D. Other administrative remedies; building permits and
certificates of occupancy and use.
1. Issuance. No building permit or certificate of
occupancy and use shall be issued by the development
department for any purpose except in compliance with
the provisions of this code and other applicable
ordinances and laws, a decision of the planning and
development board or court decision.
2. Revocation, The development department may revoke a
building"permit or certificate of occupancy in those
cases where an administrative determination has been
duly made that false statements or misrepresentations
existed as to material fact(s) in the application or
plans upon which the permit or approval was based.
3. Suspension. The development department may suspend a
building permit or certificate of occupancy and use
where an administrative determination has been duly
made that an error or omission on either the part of
the permit applicant or government agency existed in
the issuance of the permit or certificate approval.
A valid permit or certificate shall be issued in
place of the incorrect permit or certificate after
correction of the error or omission.
4. Notice and appeal. All development department
decisions concerning the issuance, revocation or
suspension of building permits and certificates of
occupancy shall be stated in official written notice
to the permit applicant, Any decision of an
administrative official may be appealed to planning
and development board within thirty (30) days of the
action that the aggrieved party wishes to appeal.
Section 11. Appeals.
Appeals to the planning and development board may be taken~

Dear Mr. Huckill:
Compliance of La~d Development Regulations (LDR) is required
prior to issuance of Certificate of Occupancy. The Director of
Development has the final authority to ensure compliance. With
that in consideration, the Clear Copy Project violates LDR as
follows:
1. Per Chapter 23, Clear Copy has violated Chapter 23, Parking
Lots, code with the following violations:
)\ ~\ Lighting design. Per Chapter 23, Article II., Section A.
~, a .minimum average light level of one foot candle wit h
.~not less than 10 percent readings below one foot candle and
\ ~~~no foot candle readings below one-half foot candle.

The Clear Copy property does not maintain these m~nl.mum
requirements in the loading zone area of the parking lot.
B) Access. As per Chapter 23, Article II. Section 1.2, each
parking lot or stall shall have sufficient access from a
street.
Clear Copy does not provide sufficient access for many
standard, type delivery trucks.
Maneuvering and access areas shall be of sufficient size to
permit vehicles to enter and exit the parking lot and parking
stalls 1n a safe and efficient manner.
The off-street loading zone was not designed to have adequate
maneuvering or access for many standard delivery trucks.
In no instance shall a parking lot be designed to allow
vehicles to back out into a street.
The fire trucks, garbage trucks and larger standard delivery
trucks will have to back out into the public streets.

Per Chapter 7.5, Article II, Section 5.E, a landscape strip
of 2-1/2 feet minimum width shall be provided along interior
property lines between the off street parking or vehicular use
area abutting property lines.
This required landscape area has not been provided on the
Clear Copy site. A note on the approved site plans indicate
the City shall verify that the existing hedge on the
neighboring property meets minimum City standards. City
records from 1989 show that the existing adjacent hedge does
not meet minimum standards. The available plantinq strip on
the neighboring property is only 20 inches. The note on the
approved site plans also indicate Clear Copy will modify their
site plans shoul~ the hedge not meet minimum City standards.
This is the instant case.
Per Chapter 7.5, Article II, Section 5.0.1, a minimum
landscaping strip of 5' in width shall be provided between off
street parking and adjacent right-of-way lines.
The south border of Clear copy's property adjacent to N.W.
1st Ave provides only a 3' 3" landscape strip (It should be
noted, the sidewalk is one foot outside the right-of-way
line)., The west border of Clear copy's property adjacent to
N.W. 7th Street provides only a 4'5" landscape strip. Both
landscaping strips do not meet the minimum City standards and
therefore are violating LDR.
4. Per Chapter 4, Section S.e.5, safe and efficient access to the
proposed development shall be provided for emergency vehicles
and service vehicles.
The fire department emergency vehicles cannot by means of
lawful ingress/egress navigate the site without traversing
through designated parking spaces, over the planting areas,
and onto the adjacent property. See diagram attached.

The City's standard garbage trucks required to pick up the
approved on-site recyclable waste pickup cannot by means of
lawful ingress/egress navigate the parking lot without
traversing through designated parking spaces and over planting
areas to access the required dumpster area. It should be
noted that Clear Copy has not provided the required dumpster
area. See diagram attached.
It is doubtful that many standard delivery trucks can by means
of legal ingress/egress, with the exception of vans and small
trucks, service the site without encroaching into the
designated parking spaces or planting areas to obtain access
to the approved loading zone.

Per Chapter 6, Article IV, Section 10.T, driveways and
commercial areas shall be six (6) inches thick reinforced with
six inch mesh by six inch (6" x 6") ten gauge wire mesh.
Both driveways at the Clear Copy site are four (4) inches or
less in thickness and are not reinforced with the required
mesh.
6. Per Chapter 2, Section 4.B.1, detached storage structures of
any type may not exceed one hundred (100) square feet in floor
area.
Clear Copy modified the site plan to eliminate the required
dumpster area. This created a cart storage area. While the
dumpster area met size requirements of the LOR, the. storage
area exceeds the maximum allowable size for a detached storage
structure. Chapter 1, Article II. definitions, defines floor
area to be measured from the centerline of the exterior walls
to the centerline of the dividing walls. This equates
the storage area to be approximately 131 square feet, almost
a third larger than allowed by LOR.
7. Per Boynton Beach, Florida Code of Ordinances, Article II.
Refuse, Garbage and Trash:
Section 10-25 requires commercial establishments to have
containerized refuse service.
Section 10-23 states that "containerized" means a detachable
metal container provided by the City designed and intended to
be mechanically dumped into a packer-type sanitation vehicle
and varying in size from two (2) cubic yards to eight (8)
cubic yards adaptable to city equipment.
The City Commission on September 19, 1995 approved curbside
trash pickup and on-site recyclable waste pick up for the
Clear Copy project. The completed site is unable to meet the
on-site containerized recyclable garbage pickup requirement
since the required dumpster was unlawfully eliminated. The
Clear Copy site does not provide by lawful ingress/egress the
needed access for the City's recyclaple or regular garbage
trucks that can pick up containerized' refuse. Clear Copy
will be unable to properly store and remove garbage from it's
property as required by City ordinances. It is apparent Clear
Copy does not meet the required site plan requirements with
regard to recyclable garbage pickup.
8. Per Chapter 7.5, Article 2, Section 5.J, All dumpsters are to
be placed on a concrete pad appropriately screened as
described in Chapter 9, Section 10, C.3.
Florida Code of Ordinances, Article II as described above in
#7 requires dumpster pick up of garbage on all commercial
properties. Since no variance to this ordinance was granted
for the Clear Copy site, Clear Copy must provide a dumpster
area, and it has not. This violates LDR requirements.
9. As per Chapter 2, Section 6.B" no building or portion thereof
shall be erected or constructed unless the premises of the
building shall comply with a 30 feet minimum front yard
setback and a 15 feet side yard setback.
Clear Copy has not provided the required minimum standards the
City's LDR sets forth. A copy of the City of Boynton Beach
Agenda Memorandum #96-143, page 4, dated March 15, 1996 I
indicates the tie-in survey shows a ten inch encroachment of
the setback. It is attached to this letter.
It is unlawful for any person to violate or fail to comply with any
provision of the Land Development Regulations (Chapter 1.; Article
I, Section 6.A). Your failure to enforce the City's regulations is
contrary to your LDR. responsibilities and your Department of
Professional Regulation license which require you to lawfully
perform your duties. Please inform Clear Copy of these violations
so they can correct these violations prior to issuance of
certificate of occupancy.

On April 27, 1995, your submittal for site plan review of the
above-referenced project was reviewed for completeness. It has
been determined that the submittal is substantially complete and
accepted for further processing. However, please submit three (3)
copies of a traffic analysis to this department, which we will
forward to the Palm Beach County traffic division. I have assigned
Mike Haag of my department to review and coordinate your site plan
through the remainder of the site plan review process.
The next step in the review process is for the Technical Review
Committee to review the submittal for compliance with the review
standards identified in Part III, Land Development Regulations,
Chapter 4, Site Plan Review, Section 8 and all applicable sections
of the Boynton Beach Code of Ordinances. The results of the review
will be available to you on Friday, May 26, 1995.

application(s) for appeal. I concur with the City Attorney's evaluation that the issues you
have now raised are incidental and subordinate to your original appeal which was denied.
Section 10 of Chapter 2 of the City's Land Development Regulations provides:
"1(1) Upon the denial of an application for relief hereunder, in
whole or in part, a period of one (1) year must run prior to the
filing of a subsequent application affecting the same property
or any portion thereof".

In our short conve~sation after the Board of Zoning Appeals
meeting last night, I requested the date of the next Board of
Zoning Appeals meeting when the additional appeals will be heard.
Please advise me of this date as soon as possible so RHS
Corporation (RHS) and its legal counsel will have adequate time to
prepare for the additional appeals filed.
You appeared somewhat annoyed that RHS would filed additional
appeals for additional administrative determinations. As you may
remember, I advised you in advance that these appeals would be
forthcoming. As an attorney, I believe you understand RHS had to
follow' proper procedure. RHS can only proceed through avenues the
City ordinances allow.
An appeal to the Board of Zoning Appeals for an administrative
determination stays all work on the premises. Land Development
Regulations (LOR) state that an appeal to the Board of Zoning
Appeals stays all work on the premises unless a stay will cause
imminent peril of life or property. The City previously determined
a stay will not cause imminent peril of life or property for Clear
Copy's property.
Continued development of the Clear
appeals is clearly in violation of LOR.

Dear Mr. Cherof:
On March 15, 19~6 Ms. Tambri Heyden, Director of Planning and
Zoning, submitted the 17 page memorandum #96-143 determining to
accept a new site plan of the Clear Copy project as a modification
to the approved site plan. After accepting the site plan
modification, Ms. Heyden made a determination to call this a minor
site plan modification. RHS Corporation already submitted an
appeal to the Board of Zoning Appeals for this determination.

The Planning and Zoning Director must determine whether each
modification to the approved site plan in the revised site plan
complies with Land Development Regulations (LDR). The Planning and
Zoning Director determined each change was in compliance with LDR,
except where she required Staff's recommendations become conditions
of the approval. Many changes Ms. Heyden determined met LDR, and
therefore she accepted these changes unconditionally. For each
determination, that in fact doesn't meet LDR, RHS Corporation is
filing an appeal to that determination.
Attached with this letter are sixteen additional applications
for appeals to the Board of Zoning Appeals. If any application is
incomplete, please advise me as soon as possible.

Copy's building, which does not conform to required setbacks, and
which the tie in survey indicates is 10 inches into setback lines,
met Land Development Regulations.
NATURE OF APPEAL (DESCRIPTION OF CODE VIOLATION): This
determination violates Land Development Regulation, Chapter 2,
Section 6, B.3. No building or portion thereof shall be erected,
constructed, converted, established, altered, enlarged or used
unless the premises and buildings shall comply with the following
regulations:
Minimum front yard setback - 30 feet
Minimum side yard setback - 15 feet

ADMINISTRATIVE DECISION OF APPEAL: Ms. Heyden made the
administrative determination to grant approval of the site plan
modification, subject to comments of Administrative Conditions.
NATURE OF APPEAL (DESCRIPTION OF CODE VIOLATION): The modified
site plan violates many Land Development Regulations. The
determination to grant approval of the modified site plan does not
make provisions for correcting obvious violations in the modified
site plan, except those subject to comments of Administrative
Conditions. If a Certificate of Occupancy should be granted to the
Clear Copy project as per the approved modified site plan,
therefore not meeting Land Development Regulations, a lawsuit will
be filed.
