Dear Mr. Huckill: Compliance of La~d Development Regulations (LDR) is required prior to issuance of Certificate of Occupancy. The Director of Development has the final authority to ensure compliance. With that in consideration, the Clear Copy Project violates LDR as follows: 1. Per Chapter 23, Clear Copy has violated Chapter 23, Parking Lots, code with the following violations: )\ ~\ Lighting design. Per Chapter 23, Article II., Section A. ~, a .minimum average light level of one foot candle wit h .~not less than 10 percent readings below one foot candle and \ ~~~no foot candle readings below one-half foot candle. N The Clear Copy property does not maintain these m~nl.mum requirements in the loading zone area of the parking lot. B) Access. As per Chapter 23, Article II. Section 1.2, each parking lot or stall shall have sufficient access from a street. Clear Copy does not provide sufficient access for many standard, type delivery trucks. Maneuvering and access areas shall be of sufficient size to permit vehicles to enter and exit the parking lot and parking stalls 1n a safe and efficient manner. The off-street loading zone was not designed to have adequate maneuvering or access for many standard delivery trucks. In no instance shall a parking lot be designed to allow vehicles to back out into a street. J~ C) Landscaping. See items #2 and #3 below. D) Sidewalks. See item #5 below. Per Chapter 7.5, Article II, Section 5.E, a landscape strip of 2-1/2 feet minimum width shall be provided along interior property lines between the off street parking or vehicular use area abutting property lines. This required landscape area has not been provided on the Clear Copy site. A note on the approved site plans indicate the City shall verify that the existing hedge on the neighboring property meets minimum City standards. City records from 1989 show that the existing adjacent hedge does not meet minimum standards. The available plantinq strip on the neighboring property is only 20 inches. The note on the approved site plans also indicate Clear Copy will modify their site plans shoul~ the hedge not meet minimum City standards. This is the instant case. Per Chapter 7.5, Article II, Section 5.0.1, a minimum landscaping strip of 5' in width shall be provided between off street parking and adjacent right-of-way lines. The south border of Clear copy's property adjacent to N.W. 1st Ave provides only a 3' 3" landscape strip (It should be noted, the sidewalk is one foot outside the right-of-way line)., The west border of Clear copy's property adjacent to N.W. 7th Street provides only a 4'5" landscape strip. Both landscaping strips do not meet the minimum City standards and therefore are violating LDR. 4. Per Chapter 4, Section S.e.5, safe and efficient access to the proposed development shall be provided for emergency vehicles and service vehicles. The fire department emergency vehicles cannot by means of lawful ingress/egress navigate the site without traversing through designated parking spaces, over the planting areas, and onto the adjacent property. See diagram attached. .r~1 'I The City's standard garbage trucks required to pick up the approved on-site recyclable waste pickup cannot by means of lawful ingress/egress navigate the parking lot without traversing through designated parking spaces and over planting areas to access the required dumpster area. It should be noted that Clear Copy has not provided the required dumpster area. See diagram attached. It is doubtful that many standard delivery trucks can by means of legal ingress/egress, with the exception of vans and small trucks, service the site without encroaching into the designated parking spaces or planting areas to obtain access to the approved loading zone. (]) Per Chapter 6, Article IV, Section 10.T, driveways and commercial areas shall be six (6) inches thick reinforced with six inch mesh by six inch (6" x 6") ten gauge wire mesh. Both driveways at the Clear Copy site are four (4) inches or less in thickness and are not reinforced with the required mesh. 6. Per Chapter 2, Section 4.B.1, detached storage structures of any type may not exceed one hundred (100) square feet in floor area. Clear Copy modified the site plan to eliminate the required dumpster area. This created a cart storage area. While the dumpster area met size requirements of the LOR, the. storage area exceeds the maximum allowable size for a detached storage structure. Chapter 1, Article II. definitions, defines floor area to be measured from the centerline of the exterior walls to the centerline of the dividing walls. This equates the storage area to be approximately 131 square feet, almost a third larger than allowed by LOR. 7. Per Boynton Beach, Florida Code of Ordinances, Article II. Refuse, Garbage and Trash: Section 10-25 requires commercial establishments to have containerized refuse service. Section 10-23 states that "containerized" means a detachable metal container provided by the City designed and intended to be mechanically dumped into a packer-type sanitation vehicle and varying in size from two (2) cubic yards to eight (8) cubic yards adaptable to city equipment. The City Commission on September 19, 1995 approved curbside trash pickup and on-site recyclable waste pick up for the Clear Copy project. The completed site is unable to meet the on-site containerized recyclable garbage pickup requirement since the required dumpster was unlawfully eliminated. The Clear Copy site does not provide by lawful ingress/egress the needed access for the City's recyclaple or regular garbage trucks that can pick up containerized' refuse. Clear Copy will be unable to properly store and remove garbage from it's property as required by City ordinances. It is apparent Clear Copy does not meet the required site plan requirements with regard to recyclable garbage pickup. 8. Per Chapter 7.5, Article 2, Section 5.J, All dumpsters are to be placed on a concrete pad appropriately screened as described in Chapter 9, Section 10, C.3. Florida Code of Ordinances, Article II as described above in #7 requires dumpster pick up of garbage on all commercial properties. Since no variance to this ordinance was granted for the Clear Copy site, Clear Copy must provide a dumpster area, and it has not. This violates LDR requirements. 9. As per Chapter 2, Section 6.B" no building or portion thereof shall be erected or constructed unless the premises of the building shall comply with a 30 feet minimum front yard setback and a 15 feet side yard setback. Clear Copy has not provided the required minimum standards the City's LDR sets forth. A copy of the City of Boynton Beach Agenda Memorandum #96-143, page 4, dated March 15, 1996 I indicates the tie-in survey shows a ten inch encroachment of the setback. It is attached to this letter. It is unlawful for any person to violate or fail to comply with any provision of the Land Development Regulations (Chapter 1.; Article I, Section 6.A). Your failure to enforce the City's regulations is contrary to your LDR. responsibilities and your Department of Professional Regulation license which require you to lawfully perform your duties. After accepting the site plan modification, Ms. Heyden made a determination to call this a minor site plan modification. RHS Corporation already submitted an appeal to the Board of Zoning Appeals for this determination. . The Planning and Zoning Director must determine whether each modification to the approved site plan in the revised site plan complies with Land Development Regulations (LDR). The Planning and Zoning Director determined each change was in compliance with LDR, except where she required Staff's recommendations become conditions of the approval. Many changes Ms. Heyden determined met LDR, and therefore she accepted these changes unconditionally. For each determination, that in fact doesn't meet LDR, RHS Corporation is filing an appeal to that determination.
