SUBJECT: Proposed ordinance to clarify overhangs and eaves allowed
to encroach setbacks
I would like to take advantage of this opportunity when revising
the code regarding the above, to also include other miscellaneous
structures that the Planning and Zoning Department, as well as the
Building Division, has encountered. These structures are either
not addressed in our code, or are unclear, and need to be included
as they are in other jurisdictions' codes. I have read Mr.
Huki II's suggest ion to address the house eaves, and al though opt ion
3 will suffice, it would assist us all if we took the following
approach:
Under City of Boynton Beach Code of Ordinances, Part III - Land
Development Regulations, Chapter 2 - Zoning, Section 4.J. OTHER
STRUCTURES, add the new subsections 7 through 27 below _
7. Arbors and trellises which may extend no more than five (5)
feet from the side of the principal building or extend more
than two (2) feet from the front or rear of the principal
building, provided that there shall be maintained a minimum
three (3) foot setback from property line. In addition there
shall be a maximum height cf 8 feet.
8. Permanent or retractable awnings, canopies, marquees or
covered walkways projecting from a building wall over a
required yard setback not more than two and one-half (2~)
feet, and having no supports other than provided by the wall
or its integral part.
9. Chimneys proj ecting not more than three (3) feet into the
required yard setback.
10. Fire escapes or unenclosed staircases, the riser of which
shall be at least fifty (50) percent open, provided that the
vertical proj ection downward onto a required yard setback
shall not project more than five (5) feet into, and shall not
exceed ten (10) percent of, the area of the required yard
setback.
11. Flagpoles having only one structural ground member.
12. Fountains; provided that non-portable fountains shall not
exceed nine (9) feet in height, shall be setback three (3)
feet from side and rear property lines and shall occupy no
more than 100 square feet.
13. Heating, ventilation and air conditioning units (including
compressors and condensers) for single-family or duplex
dwellings, provided the exhaust air from such units is
directed vertically or away from the adjacent property line.
Heating, ventilation and air conditioning units and intake and
exhaust fans for non-residential uses shall be setback a
minimum of five (5) feet from property line.

14. Mailboxes.
15. Open terraces, including walkways, unenclosed decks and slabs
and natural plant landscaping.
16. Open, uncovered stoops, steps and platforms for the principal
building, but not to exceed three (3) feet in height.
17. Recreational equipment (of the type not requiring a permit) in
the rear yard setback in residential districts.
18. Sculpture or other similar objects of art, provided they meet
the same requirements above for fountains.
19. Signs, subject to the provisions of the sign code.
20. Trees, shrubbery or other objects of natural growth.
21. Wells.
22. Utility, cable and telephone transmission lines and associated
structures, such as poles.
23. Basketball goals, provided there is a minimum three (3) feet
setback from the rear and side interior property lines and a
minimum fifteen (15) feet setback from front and side street
property lines.
24. Light poles having only one (1) structural ground member.
25. Barbecue pits not to exceed six (6) feet by six (6) feet and
provided they are set back three (3) feet from side and rear
property lines.
26. Raised planters, provided they are set back three (3) feet
from side and rear property lines and shall have a maximum
height of six (6) feet.
Lastly, add to existing subsection 3 the underlined words and
delete the struck through words:
3. HouGe Eaves, cornices, gutters, facia boards, copinqs,
soffits, downspouts, belt courses, window sills, widow and/or
door trim. applied finish materials. roof and/or eauipment
vents, sillcocks, fire hose connections, meters. liaht
fixtures, hardware, shutters, bay windows, and ornamental
architectural features shall not overhang or exceed the
setback lines for more than two (2) three (3) feet.

We have reviewed the proposed minor site modifications dated February 13, 1996, and marked
"Proposed Parking, ete", sheet ST -I and have no objection to the new parking arrangement or the
relocated driveway.
Do not proceed with sitework, however, until you have complied with the fol1owing:
1 . All previous comments,
2. Submit a certification from a Florida Registered Architect or Engineer that al1
work wil1 comply with all rules, regulations, laws, ordinances, etc., and win be
similarly constructed,

the Clear Copy project, a building being constructed next door to his office.
His request is for the State lieense of everyone who signed Clear Copy permits and that is no one
sinee only the contractor or his agent signs the permit. However, he did give the names of Bill
Hukill, Jim Du Vall, Tambri Heyden, Bill Cavanaugh and Bob Eichorst to our clerk, Beverly
Snyder and told her that he needed the information for his attorney's investigation.

The Florida League recently amended the Public Records Law to exempt the home address
and phone number of Code Inspectors and Code Enforcement Officers. The City Attorney's
office advised the intent of the bill was to cover individuals issuing citations in the field. Based on
this information any employee holding the following job classification titles will be covered by this
exemption:

CLEAR COpy - ROBERTS' COMMENTS
In the July 20, 1995 Roberts' letter to you, Item 4, implies to you
that LDR Chapter 23, Article II, Section H3, page 23-8 requires 180
feet from the R-O-W line of Boynton Beach Boulevard to a driveway.
That is an incorrect interpretation. What it actually says is "at
least 30 feet from the intersection of the right-of-way lines along
local streets and 180 feet along streets of a higher
classification." N.W. 7th Street is a local street, not a street
of higher classification.
He also cited Engineering Division Memo 95-156 dated May 18, 1995
from Mr. Hall to Ms. Heyden which did, in fact, incorrectly
interpret that portion of the code. However, that was corrected
within a few days with the following notation on the memo: "waived,
Chapter 6, Article IV, Section 1 access 30' to local streets.
WVH. "
That section reads "points of access to lots developed within a
subdivision shall be located a minimum of thirty feet from
intersecting right of way lines on local streets..."
The Roberts' comment in Note 5 simply says a variance may be
required for a light pole. If he is correct, the applicant will
have to receive a variance to proceed. Either way, approval of the
site plan can be conditioned on a possible variance.
with respect to Note 2, the sidewalk issue raised can become a
condition, and/or a variance if it is as Roberts states.

Effect of Substandard Perimeter Landscape Strip on
Adjacent Property
Upon the Commission's July 18th, 1995 denial of the above-
referenced site plan, the applicant's request for reconsideration
and the City Manager's receipt of the attached letter from the
adjacent property owner, Dr. Roberts, the City Manager has asked
that I respond in writing to each of the points in Dr. Roberts'
letter.
With respect to Item 1 of Dr. Roberts' letter, I have obtained from
Al Newbold (see attached BUilding Division Memo # 95-267)
information regarding the circumstances behind the City having
finaled an inspection for a landscape strip that is Ii feet wide,
rather than the required 21 feet wide, on Dr. Roberts' property and
adjacent to the Clear Copy site. I believe that although the tie-
in survey showed that the pavement was too close to the property
line to provide the reqUired 21 feet wide landscape strip, it was
probably not thought to be of any consequence by the pavement
inspector, since the same person that does landscape inspections
does not check tie-in surveys. So, I don't believe the City caught
the error and only now has it been brought to light (although it
was Dr. Roberts himself that brought it to my attention). It,
therefore, seems that the City cannot now expect Dr. Roberts to
remedy the error. However, must Clear Copy make up the difference
in width on the Clear Copy property? Page 7.5-16 of the City of
Boynton Beach Land Development Regulations (Chapter 7.5, Article
II, Section 5.E.2 - attached) says that an applicant does not have
to comply with Section 5.E. (the requirement to install a 4-6 foot
tall hedge in a 21 foot wide strip along a common lot line), if a
hedge that meets Section 5. E. exists on the adj acent property.
Since the City is "accepting" Dr. Roberts' hedge as meeting Code,
it would seem that the City should not have Clear Copy make up the
difference in width.
As I will be on vacation the last two weeks of August, I only have
until .AUgust 17th to provide to Carl~1e a response on all Or.
Roberts' issues. Therefore, please call me as soon as pOSSible to
discuss this.

LANDSCAPING DISCREPANCY
In order to assist you in your response to Tambri Heyden's
memorandum 95-383, I researched the files and offer the following
facts and comments:
The Technical Review Board (TRB) plans were signed off by Don
Jaeger during his tenure as the department's representative. The
building plans were reviewed by Michael Haag and ultimately
signed off by Warren DeLoach in Mr. Haag's absence in 1989. My
review shows the building plans match the TRB plans and those
that were reviewed by the Community Appearance Board. All plans
show a 2~' setback for the extreme western section of the
property adjacent to the parking lot.
During this era, Mr. Jaeger then became Building Official and Mr.
Haag was appointed in charge of site review which was handled by
this department during that time. Site plan approval permit 88-
0873 was generated to track the site plan process for all site
improvements and administered by the Site Development Division of
the Building Department under Mr. Haag's supervision. The
project has been completed and all paperwork is on microfilm.
Therefore, all original documents are no longer available.
Attached are copies of the site plan and the tie-in survey along
with a print-out of the inspection history. From my observation
of the tie-in survey, the paving appears to be 1.58' from the
west property line and not 2~' as shown on the building plans. I
would assume that the survey is correct in that it has a
certification date showing August 23, 1989 and I found that the
paving was approved August 18, 1989 by Roger Kuver, former
Engineering Inspector who is now with the Utilities Department.
From that same survey, it appears that the building is in the
correct location and it would be fair to assume that the only
problem is with the size of the paved area. I found no
documentation in the file giving any explanation, etc. as to any
resolution from the narrow landscape strip or whether it ever
became an issue.

Our records do show that the CAB inspection was made by Med
Kopczynski who was the former Deputy Building Official and
appointed to handle CAB inspections by Mr. Jaeger when he became
Building Official. That inspection was approved August 25, 1989.
I can only assume that the proper position to take would have
been to cut off the additional paving to comply with the 3D"
landscape strip. It could have been assumed that it was not
necessary since we did then, and do now, allow bumper stops to
set back on paved areas less than the code requires so that the
bumpers overhang the landscape strip. I see no reason why this
would be an issue, especially as it relates to the adjacent
property since our code also exempts landscaping on property that
already has existing landscaping. My interpretation of the code
is that the landscaping strip itself has a dimension requirement
and the code specifies what must be located within that strip but
not necessarily that the plantings must be as wide as the strip.
It should be our position that the neighboring property owner
should not be penalized for the paving on Dr. Roberts' property
being closer to his property line than what was permitted.
If any controversy arose during the construction of Dr. Roberts'
permits, Mr. Haag could shed some light on it since he was
involved in the site plan process and the final site approval was
signed by him on November 19, 1991.

I would like to respectfully request research be conducted of
whatever Building Division files are necessary to determine whether
the permitted set of construction drawings for the above-referenced
building, located on the south side of W. Boynton Beach Boulevard,
reflect a 2} foot wide landscape strip along the western property
line. Research is also needed to determine whether the inspection
noted construction of a landscape strip that was less than 2} feet
wide and, if so, whether there is any documentation indicating how
the matter was resolved.
As you know, this issue, among others, will be discussed by the
Commission when they reconsider their denial of the Clear Copy site
plan. In order for me to forward the results of your department's
research to the City Attorney for his opinion, which will be
included within my response to the Commission of all the issues
that have been raised, I respectfully request notification to me of
the results of this research by August 7, 1995.

The following is a list of 1st review comments regarding the site
plan review of the plans for the above-referenced proj ect. It
should be noted that the comments are divided into two (2)
categories. The first category is a list of comments that identify
deficiencies from the City's Land Development Regulations that are
required to be corrected and shown in compliance on the plans
and/or documents submitted for second (2nd) review in order for the
project to continue through the site plan review process. The
second set of comment(s) lists recommendations that the Planning
and Zoning Department staff believe will enhance the proposed
development. The applicant shall understand that all documents and
plans submitted for site plan are subject to additional comments.
I recommend that the applicant/agent contact me regarding questions
related to the comments. If the applicant is not intending to
correct code deficiencies, they should contact me regarding the
procedures, application forms, fees and submittal deadline dates
for seeking relief from the code requirement.
I. SITE PLAN REVIEW COMMENTS:
1. Place on the plans a typical maximum spacing dimension of
forty (40) feet on center for the required trees along
N.W. 7 Street, N.W. 1st Avenue and the southwest corner
of the vehicle use area that is visible from Boynton
Beach Boulevard (Chapter 7.5, Article II, Section
5.0.1.).
2. Please show and identify on the plans all curbing and
wheelstops at landscaping areas. Areas to be protected
by raised continuous curbing or wheel stops include all
landscaped islands, landscaping adjacent to a parking
stall and landscaping adjacent to curvilinear driveways
where encroachment is likely to occur. Curb design shall
comply with City standards [Chapter 23, Article II, E]
3. Add to the landscape notes that one half of the total
number of required trees and hedges shall be a native
landscape material. [Comprehensive Plan policy 4.4.6]
4. Provide a note and symbol identifying the type of
landscaping material that is required to screen three
sides of the dumpster enclosure. [Chapter 7.5, Article
II, Section 5.J.]
5. Add to the dumpster enclosure gates and note on the plans
that a clear opening on ten (10'011) feet excluding all
gate hardware is being provided. Also specify on the
plans the exterior finish material and color of the
enclosure walls and gate.

6. Show and dimension on the plans a loading zone in
compliance with Section 11. J. of Chapter 2 Zoning.
7. Add to the landscaping/site plan all eXisting and
proposed easements, including the location of overhead
utility lines. Identify the type of easement and
dimension the width. Note: Some landscape material is
not allowed to be planted with an easement and under
overhead lines. [Chapter 7.5, Article I, Section 18.1]
8. Show and dimension on the plans the landscape code and
zoning code line-of-sight triangles that are required on
both sides of each ingress/egress and at the intersection
of rights-of-way (N.W. 1st Avenue and N.W. 7th Street _
N. W. 7th Street and Boynton Beach Boulevard). Also,
provide a typical note on the plan that indicates the
size of the clear unobstructed cross visibility space
that is required within the triangular areas. Amend the
plans accordingly. [Chapter 2, Section 4. E. and Chapter
7.5, Article II, Section 5. H. 1, and 2.]
9. Submit and identify on the architectural elevation view
drawings the color of all exterior materials depicted on
the plan by name, manufacturer and model or style number.
A color sample shall be submitted as an example. The
sample shall match the color or product identified on the
plans. [Chapter 9, Community Design Plan Section 5]
Note:
The sample will be used for the final site
inspection to ensure that the correct product
and color were used for the project.
10. Add to the submittal specifications showing style,
colors, scale of lettering of all signage proposed for
the building and site. The signage shall be shown in
compliance with the specifications listed in the Sign
Code and Community Design Plan.
11. The project is located within the C-2 neighborhood
commercial district. The use of print shops is permitted
provided an environmental review permit is secured in
accordance with standards and procedures set forth in
Chapter 2 Section 11.3.
12. You have indicated that you would like to use the
existing hedge located on the adjacent property to the
east for satisfying the vehicle use area screening
required for your property. This is acceptable, however,
the material is required to be field verified by the
City's landscape inspector during construction of the
project. If the existing material meets the minimum
requirements it will be accepted, but if it does not meet
minimum standards, you will have to provide the hedge
material on your property. To request to use the
eXisting hedge to satisfy your required screening place
the following note on the landscape plan: The City
landscape inspector will field verify the existing hedge
that is identified in the landscape legend with an
asterisk, meets the minimum vehicle use area screening
requirements. If the existing material does not meet the
minimum standards, the plans and site will be revised to
show the proper vehicle use area screening in compliance
with City standards.

Place on the plans a typical maximum spacing dimension of
forty (40) feet on center for the required trees along
N.W. 7 Street, N.W. 1st Avenue and the southwest corner
of the vehicle use area that is visible from Boynton
Beach Boulevard (Chapter 7.5, Article II, Section
5.D.1.).
Please show and identify on the plans all curbing and
wheelstops at landscaping areas. Areas to be protected
by raised continuous curbing or wheel stops include all
landscaped islands, landscaping adjacent to a parking
stall and landscaping adjacent to curvilinear driveways
where encroachment is likely to occur. Curb design shall
comply with City standards [Chapter 23, Article II, E]

colors, scale of lettering of all signage proposed for
the building and site. The s ignage shall be shown in
compliance with the specifications listed in the Sign
Code and Community Design Plan.
The project is located within the C-2 neighborhood
commercial district. The use of print shops is permitted
provided an environmental review permit is secured in
accordance with standards and procedures set forth in
Chapter 2 Section 11.3.
You have indicated that you would like to use the
eXisting hedge located on the adjacent property to the
east for satisfying the vehicle use area screening
required for your property. This is acceptable, however,
the material is required to be field verified by the
Ci ty I S landscape inspector durinQ construction of the
project. If the existing material meets the minimum
requirements it Will be accepted, but if it does not meet
minimum standards, you will have to provide the hedge
material on your property. To request to use the
eXisting hedge to satisfy your required screening place
the following note on the landscape plan: The City
landscape inspector will field verify the existing hedge
that is identified in the landscape legend with an
asterisk, meets the minimum vehicle use area screening
requirements. If the existing material does not meet the
minimum standards, the plans and site will be revised to
show the proper vehicle use area screening in compliance

I am confused as to why I and Mr. Hukill are being asked to comment on the above-
referenced letter. My reading of the June 26th letter is an issue that appears to be a legal
one (not a technical one) that would be best reviewed by the City Attorney. The issue as
I see it is - Does Chapter 1.5, which says the decisions of the Planning and Development
Board are advisory to the Commission, overrule the conflict in Chapter 7.5, which says,
in general, that at the local level, the Planning and Development Board has the fmal
authority to make Landscape Code decisions?
My position continues to be that we cannot rely on the code company editor to "fIx" all
conflicts with editor's notes (because they involve interpretation) when we adopt an
ordinance that changes one section of the code, without simultaneously changing confficting
sections of the code.
H you'd like my legal opinion, I would be more than happy to take the time to provide one,
as I do have one, as most of us do. However, please understand that there are technical
matters in my offIce that require my attention at this time that are important as well.

My comment on subject letter is quite simple, and is in the form of a question. It is simply "Why
are we (ineluding you) responding to material from a non attorney regarding a matter involving
litigation with the author?" Your instructions to me were to send everything to you for eontact
between legal representatives of the litigating parties. The Roberts' claim that landscaping is not
part of site litigation appears to be nonsense.

nonsensical for at least two valid reasons. Firstly, he works for the Recreation and Parks

Proposed ordinance to clarify overhangs and eaves allowed
to encroach setbacks
I would like to take advantage of this opportunity when revising
the code regarding the above, to also include other miscellaneous
structures that the Planning and Zoning Department, as well as the
Building Division, has encountered. These structures are either
not addressed in our code, or are unclear, and need to be included
as they are in other jurisdictions' codes. I have read Mr.
Hukill's suggestion to address the house eaves, and although option
3 will suffice, it would assist us all if we took the following
approach:
Under City of Boynton Beach Code of Ordinances, Part III - Land
Development Regulations, Chapter 2 - Zoning, Section 4.J. OTHER
STRUCTURES, add the new subsections 7 through 27 below -
7. Arbors and trellises which may extend no more than five (5)
feet from the side of the principal building or extend more
than two (2) feet from the front or rear of the principal
building, provided that there shall be maintained a minimum
three (3) foot setback from property line. In addition there
shall be a maximum height of 8 feet.
8. Permanent or retractable awnings, canopies, marquees or
covered walkways proj ecting from a building wall over a
required yard setback not more than two and one-half (2~)
feet, and having no supports other than provided by the wall
or its integral part.
9. Chimneys proj ecting not more than three (3) feet into the
required yard setback.
10. Fire escapes or unenclosed staircases, the riser of which
shall be at least fifty (50) percent open, provided that the
vertical proj ection downward onto a required yard setback
shall not project more than five (5) feet into, and shall not
exceed ten (10) percent of, the area of the required yard
setback.
11. Flagpoles having only one structural ground member.
12. Fountains i provided that non-portable fountains shall not
exceed nine (9) feet in height, shall be setback three (3)
feet from side and rear property lines and shall occupy no
more than 100 square feet.
13. Heating, ventilation and air conditioning units (including
compressors and condensers) for single-family or duplex
dwellings, provided the exhaust air from such units is
directed vertically or away from the adjacent property line.
Heating, ventilation and air conditioning units and intake and
exhaust fans for non-residential uses shall be setback a
minimum of five (5) feet from property line.

14. Mailboxes.
15. Open terraces, including walkways, unenclosed decks and slabs
and natural plant landscaping.
16. Open, uncovered stoops, steps and platforms for the principal
building, but not to exceed three (3) feet in height.
17. Recreational equipment (of the type not requiring a permit) in
the rear yard setback in residential districts.
18. Sculpture or other similar objects of art, provided they meet
the same requirements above for fountains.
19. Signs, subject to the provisions of the sign code.
20. Trees, shrubbery or other objects of natural growth.
21. Wells.
22. Utility, cable and telephone transmission lines and associated
structures, such as poles.
23. Basketball goals, provided there is a minimum three (3) feet
setback from the rear and side interior property lines and a
minimum fifteen (15) feet setback from front and side street
property lines.
24. Light poles having only one (1) structural ground member.
25. Barbecue pits not to exceed six (6) feet by six (6) feet and
provided they are set back three (3) feet from side and rear
property lines.
26. Raised planters, provided they are set back three (3) feet
from side and rear property lines and shall have a maximum
height of six (6) feet.
Lastly, add to existing subsection 3 the underlined words and
delete the struck through words:
3. HOUDe Eaves, cornices. qutters. facia boards, copinqs.
soffits. downspouts. belt courses. window sills. widow and/or
door trim. applied finish materials. roof and/or eauipment
vents. sillcocks, fire hose connections, meters, liqht
fixtures, hardware. shutters. bay windows. and ornamental
architectural features shall not overhang or exceed the
setback lines for more than t.,.'O (2) three (3) feet.

Applicant Feldman has submitted a slightly modified site plan in response to a request for
compliance certification from this offic(:. We have no objections to the suggested minor
modifications and recommend that you waive formal review as allowed under LDR Chapter 4,
Seetion 2C with the following two conditions:
1. The submission by the applieant of certification from a Florida registered Architeet
or Engineer that the work complies with all laws, ordinanc~s, rules, regulations,
etc. and will be constructed in conformance therewith,
2. Submission of a permanent easement or other property transfer document
acceptable to the City Attorney for the piece of sidewalk at the SW property
eorner containing sidewalk pavement.
With respect to the Haag comments regarding failure of the adjacent property owner to comply
with buffer requirements wherein his (the neighbor's) buffer is a few inches less than the required
width, please refer to the opinion of the City Attorney (presented orally to the City Commission in
public session) that this applicant is not responsible to correct his neighbor's error, and therefore
need not provide the missing narrow strip, Please also recall that the site plan was approved by
the City Commission subsequent to that rendering of opinion, but without a buffer condition.
We will not allow sitework to proceed until our two conditions are met.

We have reviewed the proposed minor site modifications dated February 13, 1996, and marked
"Proposed Parking, etc", sheet ST-I and have no objection to the new parking arrangement or the
relocated driveway.
Do not proceed with sitework, however, until you have complied with the following:
I. All previous comments.
2. Submit a eertification from a Florida Registered Architect or Engineer that all
work will comply with all rules, regulations, laws, ordinances, etc., and will be
similarly constructed.
3. Transfer sufficient right-of-way at the southwest property comer to provide for the

since only the contractor or his agent signs the permit. However, he did give the names of Bill

CLEAR COPY - ROBERTS' COMMENTS
In the July 20, 1995 Roberts' letter to you, Item 4, implies to you
that LDR Chapter 23, Article II, Section H3, page 23-8 requires 180
feet from the R-O-W line of Boynton Beach Boulevard to a driveway.
That is an incorrect interpretation. What it actually says is "at
least 30 feet from the intersection of the right-of-way lines along
local streets and 180 feet along streets of a higher
classification." N.W. 7th Street is a local street, not a street
of higher classification.
He also cited Engineering Division Memo 95-156 dated May 18, 1995
from Mr. Hall to Ms. Heyden which did, in fact, incorrectly
interpret that portion of the code. However, that was corrected
within a few days with the following notation on the memo: "waived,
Chapter 6, Article IV, section 1 access 30' to local streets.

That section reads "points of access to lots developed within a
subdivision shall be located a minimum of thirty feet from
intersecting right of way lines on local streets..."
The Roberts' comment in Note 5 simply says a variance may be
required for a light pole. If he is correct, the applicant will
have to receive a variance to proceed. Either way, approval of the
site plan can be conditioned on a possible variance.
with respect to Note 2, the sidewalk issue raised can become a
condition, and/or a variance if it is as Roberts states.

Effect of Substandard Perimeter Landscape Strip on
Adjacent Property
Upon the Commission's July 18th, 1995 denial of the above-
referenced site plan, the applicant's request for reconsideration
and the City Manager's receipt of the attached letter from the
adjacent property owner, Dr. Roberts, the City Manager has asked
that I respond in writing to each of the points in Dr. Roberts'
letter.
With respect to Item 1 of Dr. Roberts' letter, I have obtained from
Al Newbold (see attached BUilding Division Memo # 95-267)
information regarding the circumstances behind the City having
finaled an inspection for a landscape strip that is Ii feet wide,
rather than the required 21 feet wide, on Dr. Roberts' property and
adjacent to the Clear Copy site. I believe that although the tie-
in survey showed that the pavement was too close to the property
line to provide the required 2i feet wide landscape strip, it was
probably not thought to be of any consequence by the pavement
inspector, since the same person that does landscape inspections
does not check tie-in surveys. So, I don't believe the City caught
the error and only now has it been brought to light (although it
was Dr. Roberts himself that brought it to my attention). It,
therefore, seems that the City cannot now expect Dr. Roberts to
remedy the error. However, must Clear Copy make up the difference
in width on the Clear Copy property? Page 7.5-16 of the City of
Boynton Beach Land Development Regulations (Chapter 7.5, Article
II, Section S.E.2 - attached) says that an applicant does not have
to comply with Section S.E. (the requirement to install a 4-6 foot
tall hedge in a 21 foot wide strip along a common lot line), if a
hedge that meets Section 5. E. exists on the adj acent property.
Since the City is "accepting" Dr. Roberts' hedge as meeting Code,
it would seem that the City should not have Clear Copy make up the
difference in width.
As I will be on vacation the last two weeks of August,
until .August 17th to provide to Carrie a response
Roberts' issues. Therefore, please call me as soon as
discuss this.

In order to assist you in your response to Tambri Heyden'S
memorandum 95-383, I researched the files and offer the following
facts and comments:
The Technical Review Board (TRB) plans were signed off by Don
Jaeger during his tenure as the department's representative. The
building plans were reviewed by Michael Haag and ultimately
signed off by Warren DeLoach in Mr. Haag's absence in 1989. My
review shows the building plans match the TRB plans and those
that were reviewed by the Community Appearance Board. All plans
show a 2M' setback for the extreme western section of the
property adjacent to the parking lot.
During this era, Mr. Jaeger then became Building Official and Mr.
Haag was appointed in charge of site review which was handled by
this department during that time. Site plan approval permit 88-
0873 was generated to track the site plan process for all site
improvements and administered by the Site Development Division of
the Building Department under Mr. Haag's supervision. The
project has been completed and all paperwork is on microfilm.
Therefore, all original documents are no longer available.
Attached are copies of the site plan and the tie-in survey along
with a print-out of the inspection history. From my observation
of the tie-in survey, the paving appears to be 1.58' from the
west property line and not 2M' as shown on the building plans. I
would assume that the survey is correct in that it has a
certification date showing August 23, 1989 and I found that the
paving was approved August 18, 1989 by Roger Kuver, former
Engineering Inspector who is now with the Utilities Department.
From that same survey, it appears that the building is in the
correct location and it would be fair to assume that the only
problem is with the size of the paved area. I found no
documentation in the file giving any explanation, etc. as to any
resolution from the narrow landscape strip or whether it ever
became an issue.

Our records do show that the CAB inspection was made by Med
Kopczynski who was the former Deputy Building Official and
appointed to handle CAB inspections by Mr. Jaeger when he became
Building Official. That inspection was approved August 25, 1989.
I can only assume that the proper position to take would have
been to cut off the additional paving to comply with the 30"
landscape strip. It could have been assumed that it was not
necessary since we did then, and do now, allow bumper stops to
set back on paved areas less than the code requires so that the
bumpers overhang the landscape strip. I see no reason why this
would be an issue, especially as it relates to the adjacent
property since our code also exempts landscaping on property that
already has existing landscaping. My interpretation of the code
is that the landscaping strip itself has a dimension requirement
and the code specifies what must be located within that strip but
not necessarily that the plantings must be as wide as the strip.
It should be our position that the neighboring property owner
should not be penalized for the paving on Dr. Roberts' property
being closer to his property line than what was permitted.
If any controversy arose during the construction of Dr. Roberts'
permits, Mr. Haag could shed some light on it since he was
involved in the site plan process and the final site approval was
signed by him on November 19, 1991.

included within my response to the Commission of all the issues

2. The plan is subject to meeting the parking lot regulations at time of permitting for paving,
drainage, site lighting, curbing, landscaping, and irrigation.
3. Provide a satisfactory drainage design including calculations indicating that the stormwater
shan be retained on-site for the first hour of a thrce year storm. Also, cateh basins shan be located
in grassy areas unless otherwise approved by the Dircctor of Devclopment. Chap.23,Art. JIF.
RECOMMENDATIONS
1. If possible, consider making the proposed driveway one way out and construct a one way in
driveway on N,W. Ist Ave. This wi11 place the parking on the west side of the parking lot and
more importantly, disal10w a backup of vehicles out towards the "Blvd." trying to enter the
proposed driveway. The handicap stal1 may have to be located northward several feet to provide
a 27' backup. The dumpster could remain where is or be locatcd to the west and face southward
for truck accessibility.

L Plan shall specify meter size, (26. 16(c)).
2. A Capacity Reservation Fee will be required within thirty (30) days of City
Commission approval. The fee amount will be determined based upon meter size
or expected demand, (Sec. 26-34[E]).
3. Please show location of existing or proposed fire hydrant. Fire hydrants shall be
within 200' of all points on every commercial building, (Appendix C, Art. X, Sec.
16).
4. Plan shall show location of existing or proposed sanitary sewer lateral and c1eanout
at property line, (Sec. 26. 16(a)).
It is our recommendation that the plan proceed through the review process.

Find attached for your review the plans and exhibits for the above-
referenced project. Site Plan Review approval for this project
will be granted by the City Commission. To ensure that the project
stays on line with the review time frame, I request that the plans
and exhibits be reviewed and formal written conments transmitted to
the Director of the Planning and zoning Department no later than
5:00 P.M. on May 15, 1995. Do not return plans and exhibits.
Retain same for the review of the amended plans (2nd review).
Adhering to the following review guidelines will promote a
comprehensive review and enable the applicant to efficiently obtain
Technical Review Committee approval:
1. Use the review standards specified in Part III, Land
Development Regulations, Chapter 4, Site Plan Review, Section
8 of the Code of Ordinances to review and formulate comments.
2. The documents submitted for the project were determined to be
substantially complete based on the submittal requirements
identified in Section 7 of the Site Plan Review Ordinance.
However, if the data provided to meet the submittal
requirements is insufficient to properly evaluate and process
the project based on the review standards or the documents
show code deficiencies, additional data and/or corrections
should be requested by the reviewer through the Planning and
Zoning Department.
3. Each comment shall reference the section of the code that is
incorrectly depicted on the documents.
4. Technical Review Committee member (s) shall identify in their
comments when the plans depict or when the location and
installation of their departmental required improvements may
conflict with other departmental improvements.

5. When a TRC Member finds a code deficiency that is outside of
his/her review responsibility, the comment and the specific code
section may be included in their review comments with the name of
the appropriate TRC Member that is responsible for the review
specified.
6. If a TRC member finds the plans acceptable, he/she shall forward
a memo, within the time frame stated above, to the Planning and
Zoning Director stating that the plans are approved and they do
not have any comments on the plans submitted for review and
recommend the project be forwarded through the approval process.
All comments shall be typed, addressed and transmitted to the Director
of the Planning and Zoning Department for distribution to the
applicant. Please include the name and phone number of the reviewer
on this memo. Michael E. Haag will be the Planning and Zoning
Department staff member coordinating the 1st review of the project.
The Planning and Zoning Department will send the applicant a cover
letter which includes the comment(s) and directions to amend the plans
to comply with the comments and the procedures for resubmission. When
the Planning and Zoning Department receives the amended plans, they
will distribute the plans with a cover memo to all TRC Members for
review and approval.
