New Site Plan (reconsideration of 7/18/95 Commission
action)

Please place the above-referenced request on the September 19,
1995 Commission agenda under Development Plans.
At the september 5, 1995 Commission meeting, the Commission voted
to reconsider their July 18, 1995 action of denial of the above-
referenced site plan on September 19, 1995. Planning and Zoning
Department Memorandum No. 95-352 and 325, previously transmitted
to you for the July 18th meeting, are attached for reference
regarding the specifics of the site plan.
Upon your receipt of the attached July 20, 1995 letter from Dr.
Roberts, the property owner adjacent to (east of) the subject
property, you requested staff to research and respond to the five
points in Dr. Roberts' letter in preparation for the September
19th reconsideration by the Commission. The following response
is provided based on information I have gathered from the city
attorney, the Engineering Division (see attached Engineering
Division Memorandum No. 95-333), the Public works Department and
the applicant (see attached letter dated August 3, 1995 from
Gecrge Davis):
1. Article II, Section 5.E of Chapter 7.5 regarding the
landscape hedge and strip between the subject property and
Dr. Roberts' property -
Pursuant to the above section of the landscape code, a two
and one-half foot wide landscape strip with hedge must be
provided along int@rior property lines where vehicular use
areas (driveways and parking lots) abut interior property
lines. Clear Copy has not provided a landscape strip and
hedge (and has no room to provide it without significantly
altering their site plan) due to a code exemption that
allows satisfaction of the landscape requirements where
there is an existing hedge, provided the "hedqe meets all
applicable standards of the landscape code".
Dr. Roberts states that the code exemption cannot be applied
to Clear Copy because although there is a hedge on Dr.
Roberts' property, adjacent to Clear Copy, the strip is 10
inches short of the required 2 1/2 feet. Therefore, he
states that neither Dr. Roberts', nor Clear Copy meet code,
and that Clear Copy, by code, needs to provide a 10 inch
wid~ landscape strip adjacent to Dr. Roberts' nonconforming
strlp or Clear Copy must be granted a variance (appeal).
Please note that Dr. Roberts cites a section which does not
exist and therefore I cannot verify his first sentence.
From BUilding Division records, the tie-in survey for Dr.
Roberts' property that was prepared at time of inspection of
the improvements on Dr. Roberts' property shows that Dr.
Roberts' parking lot encroaches into his landscape strip and
conflicts with ~he bUilding plans which show the necessary 2
1/2 feet. The lnspectlon was accepted and there is no

documentation noting whether this ever became an issue
during inspections. Therefore, the city either knowingly,
or unknowingly, accepted this "problem" as is.
, Based on the above information, the city attorney states
~~~~hat the city shall not require Dr. Roberts to remedy this
problem on his property and that Clear Copy, on their
property, is not required to make up the difference in width
of the landscape strip.
2. Article IV, section 10.T of Chapter 6 regarning sidewalk
width -
Pursuant to the above section, the width of the sidewalk
Clear Copy is to provide is four feet wide (Dr. Roberts
indicates five feet wide) since the sidewalks Clear Copy is
to install are on local streets. The site plan submitted
shows the sidewalk diminishing to a width of two feet at the
intersection of N.W. 7th Street and N.W. 1st Avenue.
According to the Engineering Division, there is no city
standard detail for how sidewalks are to be designed at an
intersection. In fact you will f\nd existing sidewalks at
intersections designed in a couple of different ways. The
existing sidewalk on the west side of the street is also
desiqned with a diminished width at the intersection. The
Engineering Division has indicated verbally that due to the
way the eastbound turn lane on N.W. 7th Street is
constructed, the applicant shall complete the sidewalk by
taking up eXisting conditions and constructing it to the
attached sketch that has been prepared by George Davis.
This design would not reduce any area of the parking lot or
the minimum five foot wide landscape strip required adjacent
to rights-of-way.
3. Chapter 9, Section 11.3 regarding overhead doors -
The above section states " Due to the high degree of
visibility of bUildings located on Hypoluxo Road, Miner
Road, congress Avenue, Lawrence Road, Gateway Boulevard,
Quantum Lakes Drive, Old Boynton Road, Knuth Road,
Woolbright Road, Boynton Beach Boulevard, Winchester
Boulevard, High R~dge Road, Seacrest Boulevard, Golf Road,
Ocean Avenue, Federal Highway, old Dixie Highway, N.E. 10th
Avenue and S.E. 36th Avenue, most of which are considered
entrances to the city, the following additional exterior
design requirements apply:
1. Overhead doors shall not be located on a building
facade(s) that faces a public or private street."
The intent of this' section was - overhead doors shall not be
located on a building facade(s) that faces one of the above
public or private streets. To require that overhead doors
not be located on a building facade that faces guy public or
private street would render many bUildings nonconforming
(particularly in industrj~l ?"'-:'~,_\ . " ..;,;;'."! ~~-,'" ~l!.O\'1
construction, without an appeal, of an industrial building
having overhead doors on a small lot because lot size
constraints would not enable flexibility to reorient a
building and parking on a lot. However, the city attorney
states that this amendment should be made to the community
design plan and that Clear Copy's overhead door which Mould
face N.W. 1st Avenue must be removed, even though N.W. 1st
Avenue is not one of the streets listed above.

As stated in G~orge Davis' August 3rd letter, the applicant
agrees to replace the overhead doors with a pair of side-
hinged swinging doors.

4. Chapter 23, Article II.H.3 regarding the distance driveways
shall be from street right-of-way lines -
The above section states that "Parking lot drivewways shall
be constructed at least thirty (30) feet from the
intersection of the right-of-way lines along local streets
and one hundred eighty (180) feet along streets of a higher
classification". Both N.W. 7th Street and N.W. 1st Avenue
are local streets and Boynton Beach Boulevard is a street of
"higher classification"; an arterial. Therefore, a driveway
onto N.W. 7th Street, a local street, is required to be 30
feet, not the 180 feet stated by Dr. Roberts, from the
intersecting right-of-way lines of N.W. 7th Street and
Boynton Beach Boulevard. The Clear Copy site plan reflects
a driveway distance of over 65 feet and therefore complies
with code without a variance.
Dr. Roberts adds that Engineering Division Memorandum No.
95-156, dated May 15, 1995 states that a variance is needed.
The attached Engineering Division Memorandum No. 95-333,
dated August 31, 1995 states that their May 15th memorandum
incorrectly interpreted the code, therefore a variance is
not needed.
In addition, it was mentioned at the July 18th Commission
meeting that the Texaco service station and Wendy's
restaurant on Boynton Beach Boulevard, which are on corner
lots and have driveways onto the side street they abut, were
required to seek variances. Staff researched the approvals
of these projects and neither one was required to obtain a
variance for their driveways on side streets and the same
code requirement was in place at the time of their project
approvals.
5. Light pole in paved area obstructs back-up aisle -
Dr. Roberts states one of the light pole locations does not
permit the required, unobstructed back-up space of 27 feet,
therefore he believes a variance is needed (or a parking
space deleted which would cause the building to have to be
,reduced in size). George Davis addresses this in his August
,- -' 3rd letter and states that the error was not caught when
revised plans were'submitted which flip-flopped the parking
lot and the lighting plan was not correspondingly revised.
He states that the light pole can be relocated to the west
side of the parking lot to within the landscape strip, which
is permissible. Therefore, no variance and no alteration to
the parking lot deSign are needed.
In addition to the above, there are three other issues that have
unfolded since the July Commission meeting; building design,
traffic concurrency and dumpster access.
Building deSign - You will recall that there was a great deal of
discussion at the July meeting relative to the design of the
bUilding and additional landscaping. Things discussed were
changing the building color to a shade of tan or orange
rathe~ than pink (addressed in staff's July comments),
lowerlng the height of the bUilding (the two stories
proposed are allowed), putting shutters and raised stucco
sills on, all windows, adding tile accents, installing a
false ~hlmne~ or cupola on the roof (would require a height
exc~ptlon, Slnce the proposed building height is at the
m~xlmum allowed for the C-2 district), increaSing the roof
pltch to 4:12 (since the bUilding height is at the maximum
one story would have to be removed), providing an 18 inch'
ov~rh~ng on all four sides of the bUilding (since the
bUll~lng is at the minimum setback, a variance would be
reqUIred) and raised stucco bands, reducing the sign size,

increasing the size of hedges and trees and adding more
landscaping along the three street frontages. As indicated
in his August 3rd letter, the applicant offers adding
shutters to the south side of the building and adding arched
windows.
Trdffic concurrency - By the time of the July Commission meeting,
Palm Beach county was not provided enough information to
certify for concurrency (addressed in staff's July
comments). Since this meeting, staff has received the
attached August 16, 1995 letter regarding this issue wherein
Palm Beach County states that although it appears as if the
project meets the county's traffic ordinance, there was
additional information that they needed to request of the
I traffic engineer. Palm Beadh County has not contacting
staff since this letter to notify us that the information
has been submitted. Also, they indicate that a restricted
covenant needs to be placed on the property limiting its use
to a print shop (a new traffic study would be needed and
must be approved for any other use in the future).
Dumpster access - You will recall that there was a great deal of
discussion at the July Commission meeting regarding whether
access to the proposed dumpster was actually available. The
Public Works Department has revisited this again and states
that because of the landscape island south of the driveway
onto N.W. 7th Street, their standard sanitation vehicles
would not be able to maneuver their vehicles on site to
access the dumpster. Based on additional information the
Public Works Department obtained from the applicant
regarding type and quantity of solid waste anticipated to be
generated, can pick-up will be the method of solid waste
disposal, except for recyclables which will be picked up by
the recycling truck. The city's recycling trucks are
smaller and will be able to maneuver on site. Recyclables
and cans will be stored within the enclosure that was
planned for the dumpster (same location). The applicant
will be required to bring his cans out to curbside on pick
up days.
If the Commission determines that this site plan request is
approvable, it is recom~ended that the approval be conditioned
upon all staff comments transmitted in July and compliance with
Palm Beach County's August 16th letter (as well as any
forthcoming comments from the county) and the contents of George
Davis' August 3rd letter.

Dear Ms. Parker:
I am writing this letter in response to Mr. Gene Moore's
letter ,to you dated July 19,1995. As a businessman and owner of
the adjacent property to the project under consideration, I have
serious concern that the project as it now stands is an
inappropriate use of the site.
On July 18, the application for site plan approval was
denied. Several neighbors and myself attended the public hearing
to voice concerns about the proposed parking, position and size
of the building, and style of architecture (or lack of it). I
believe that the commission has worked diligently the past few
years to improve the appearance of the buildings within the city.
The city coIlllllissioners also denied the application because
the site plan does not comply with Land Development Regulations.
When the Planning and Zoning Board recommended approval of this
project they were not aware that there was noncompliance of the
required building codes. I believe that the denial qf the
application was rightly based on this additional information.

1. Article 7.5-16E. This article states that where parking
and vehicular use abuts an existing hedge on an adjacent property
that meets requirements of th~ 2 1/2 feet hedge buffer, the

states that if the site abuts a property with a non-conforming
hedge buffer, the proposed site will have to make up the

buffer and should be required to add an additional 10 inches to the
existing non- complying buffer hedge as required by code to become
conforming. By providing this ten inches, this decreases the
required 27 feet of backup space to 26 feet 2 inches for 12 parking
spaces. Since this is not allowed by code because of a possible
safety hazard, a variance should be required of the applicant to
proceed with the project. Sealed surveys were presented to all
city commissioners verifying this fact.
2. Article 4-10T. This states that sidewalks shall be 5 feet
wide. At the southwest corner of the project, the site plan
indicates a sidewalk that narrows down to almost 2 feet at the
intersecting points of NW 7th Street and NW 1st Ave. If the
sidewalk remains a continuous 5 feet wide as required by code, then
not enough distance exists to allow for the closest parking space
and/or 5 feet hedge buffer zone. Eliminating this parking space
will leave this project with one too few parking spaces.
3. Article 9-11J. This states that buildings along Boynton
Beach Blvd., due to their high degree of visibility, shall not have
overhead doors on a building facade that faces a public or private
street. This proposed building does have an overhead door that
faces NW 1st Ave. and could easily be seen from NW 7th Street.
This does not meet the required Land Development Regulations thus
requiring a variance to build as submitted per requested plans.
4. Chapter 23 Article 2B3 states that parking lot driveways
shall be constructed at least 180 feet from the intersection of the
right of way lines along streets of higher classification. Since
the proposed driveway is only approximately 65 feet from the
intersection to Boynton Beach Blvd., to proceed would require a
variance. The Engineering opinion from memo #95-156, dated May
15,1995 to the Planing a~ Zoning director, clearly states their
position is that this property requires a variance.
5. The lighting design submitted for site plan approval will
not permit the required backup space for one parking space. The
light fixture pole locations are indicated on the engineering
drawing, but are inadvertently left off the master site plan.
Placing the poles at the indicated locations on the engineering
drawing encroaches on the required 27 feet of unobstructed backup
space for a parking space. Placing this light pole at the
indicated position would require a variance because it eliminates
the required backup space needed.
Mr. Moore stated in hi. letter that hi. glient wa. denied the
opportunity to speak at the public hearing. This i. just not
accurate. I did not see his client at the public hearing. If he
had attended the meeting, he could have taken the opportunity to
address these issues as every one'else did.

For the petitioner to threaten to file a law suit against the
city for injunctive relief and compensatory damages without
conforming to the required Land Development Regulations is
nonproductive. Be should revise his site plan proposal and/or file
variances where required.
I would like Staff to review the aforementioned items that I
feel are in non-compliance with the Building Regulations. If the
city knowingly approves this project without requiring variances
then the city may be leaving themselves open for a possible
conflict.

In the July 20, 1995 Roberts' letter to you, Item 4, implies to you
that LOR Chapter 23, Article II, Section H3, page 23-8 requires 180
feet from the R-O-W line of Boynton Beach Boulevard to a driveway.
That is an incorrect interpretation. What it actually says is "at
least 30 feet from the intersection of the right-of-way lines along
local streets and 180 feet along streets of a higher
classification." N.W. 7th Street is a local street, not a street
of higher classification.
He also cited Engineering Division Memo 95-156 dated May 18, 1995
from Mr. Hall to Ms. Heyden which did, in fact, incorrectly
interpret that portion of the code. However, that was corrected
within a few days with the following notation on the memo: "waived,
Chapter 6, Article IV, Section 1 access 30' to local streets.

That section reads "points of access to lots developed within a
subdivision shall be located a minimum of thirty feet from
intersecting right of way lines on local streets...-
The Roberts' comment in Note 5 simply says a variance may be
required for a light pole. If he is correct, the applicant will
have to receive a variance to proceed. Either way, approval of the
site plan can be conditioned on a possible variance.
With respect to Note 2, the sidewalk i..ue rai.ed can becoma a
condition, and/or a variance if it is as Roberts states.

Dear Bob,
Responding to your telephone call yesterday, here are my comments regarding
Mark Roberts' letter to Carrie Parker:
Item 1: The hedge buffer is nonconforming because it falls 10" short of the code
specified width. The intent of the ordinance is to require an acceptable degree of density
in a hedge between two parking lots.
Item %: The sidewalk can be constructed to the required width without reducing
the parking area. See attached sketch.
Item 3: The overhead, doors may be replaced by a pair of side-hinged swinging
doors.
Item 4: The parking area, now with two driveways, was changed as recommend
by the engineering department, from the original having only one entry/exit on N.W. 7th
Street. In their comments to the planning and zoning board, engineering asks for
clarification of the 180' dimension policy.
Item 5: The light pole in question will be relocated to the green area at the south-
west corner of the property and wilJ not intorforo with car parkins. The enaineflred plan
that we submitted was made using the original parking lot layout with one entry/exit on
N. W. 7th Street.

As far as general appearances go, I believe the site is zoned C-2 where there is a
twenty-five foot building height limit. The roof is shown as high as it is legal to build.
Louvered shutters can be added on the south side. Arched windows may help a little, but
because of the height restriction, they will still be of conventional t o~pfiions.

printing business on a .225 acre parcel located at the southeast
corner of Boynton Beach Boulevard and N.W. 7th street (please refer

RECOMMENDATION: The Planning and Development Board, with a 5-1

As a point of information, there was much discussion regarding the

The landscape plan submitted reflects all required

The proposed development meets the requirements of
the building and site regulations. The total site
area 1s 9,788 square feet with a building coverage
of thirty-seven percent (37%). The building height
is twenty-five (25) feet.

The proposed color of the two-story stucco building
will be light pink with white trim, doors and
window shutters. The roof will be brick colored s-
tile. These colors are generally compatible with
the colors of the neighboring structures which are
predominantly of a Spanish/Mediterranean style.
However, the shade of pink selected for the stucco
does not appear to compliment the brick colored
roof tile; a more orange shade of pink 1s
recommended.
A freestanding sign is proposed between Boynton
Beach Boulevard and the front of the building.

RECOMMENDATIONS
I. Engineering recommends that the subject plan be forwarded to the P & D Board.
2. We also recommend a discussion with the Board regarding clarifying the location of driveways
when a parcel abuts a looal road and ono ofa higher classification (Chap. 23, Art.2H3). If there is
general agreement that the code needs revision, it should be done quickly.

The following modifications are also suggested:
a) Chap. 23. Art.2H I: Change the maximum driveway width from 32' to 36'. Most driveways
have three lanes - one in and two out, usually a right turn lane and one for crossing maneuvers.
Usually these lanes arc 12' each: however, if the 36' dimension is acceptable. I would like to see
the city specify that the two egress lanes be II' wide each and the Ingress lane, 14'. The
purpose of this code requirement would be to allow a wider lane for vehicles coming in from a
collector or arterial roadway to negotiate the turn as they decelerate. Having II' lanes for
outgoing traffic is no hardship because they arc traveling at a low speed and then stopping at the
stop sign.
b) Chap 23, Art.2H2: Provide that the 25' driveway radii be a minimum dimension. For the
same reason above, vehicles entering a shopping center, etc. from a 40 to SO mph spced (actual
speed, not posted speed) should ha~e a larger, "forgiving" radius.

RE:
In order to assist you in your response to Tambri Heyden'S
mem9randum 95-383, I researched the files and offer the following
facts and comments:
The Technical Review Board (TRB) plans were signed off by Don
Jaeger during his tenure as the department's representative. The
building plans were reviewed by Michael Haag and ultimately
signed off by Warren DeLoach in Mr. Haag's absence in 1989. My
review shows the building plans match the TRB plans and those
that were reviewed by the Community Appearance Board. All plans
show a 2~' setback for the extreme western section of the
property adjacent to the parking lot.
During this era, Mr. Jaeger then became Building Official and Mr.
Haag was appointed in charge of site review which was handled by
this department during that time. Site plan approval permit 88-
0873 was generated to track the site plan process for all site
improvements and administered by the Site Development Division of
the Building Department under Mr. Haag's supervision. The
project has been completed and all paperwork is on microfilm.
Therefore, all original documents are no longer available.
Attached are copies of the site plan and the tie-in survey along
with a print-out of the inspection history. From my observation
of the tie-in survey, the paving appears to be 1.58' from the
west property line and not 2~' as shown on the building plans. I
would assume that the survey is correct in that it has a
certification date showing August 23, 1989 and I found that the
paving was approved August 18, 1989 by Roger Kuver, former
Engineering Inspector who is now with the Utilities Department.
From that same survey. it appears that the building is in the
correct location and 1t would be fair to assume that the only
problem is with the size of the paved area. I found no
documentation in the file giving any explanation, etc. as to any
resolution trom the narrow landscape strip or whether it ever
became an issue.

Our records do show that the CAB inspection was made by Med
Kopczynski who was the former Deputy Building Official and
appointed to handle CAB inspections by Mr. Jaeger when he became
Building Official. That inspection was approved August 25, 1989.
I can only assume that the proper position to take would have
been to cut off the additional paving to comply with the 3011
landscape strip. It could have been assumed that it was not
necessary since we did then, and do now, allow bumper stops to
set back on paved areas less than the code requires so that the
bumpers overhang the landscape strip. I see no reason why this
would be an issue, especially as it relates to the adjacent
property since our code also exempts landscaping on property that
already has existing landscaping. My interpretation of the code
is that the landscaping strip itself has a dimension requirement
and the code specifies what must be located within that strip but
not necessarily that the plantings must be as wide as the strip.
It should be our position that the neighboring property owner
should not be penalized for the paving on Dr. Roberts' property
being closer to his property line than what was permitted.
If any controversy arose during the construction of Dr. Roberts'
permits, Mr. Haag could shed some light on it since he was
involved in the site plan process and the final site approval was
signed by him on November 19, 1991.

plan approval to construct a 3,780 square foot, two-story, retail
printing business on a .225 acre parcel located at the southeast
. corner of Boynton Beach Boulevard and N. W. 7th Street (please refer

for further details regarding the site plan).
RECOMMENDATION: The Planning and Development Board, with a 5-1
vote, recommended approval of this request, subject to staff

will 'be light pink with white trim, doors and
window shutters. The roof will be brick colored S-
tile. These colors are generally compatible with
the colors of the neighboring structures which are
predominantly of a Spanish/Mediterranean style.
However, the shade of pink selected for the stucco
does not appeal' to compliment the brick coloL'ed
roof tile; a more orange shade of plnk is
recommended.
A freestanding sign is proposed between Boynton
Beach Boulevard and the front of the building.

RECOMMENDA nONS
I. Engineering recommends that the subject plan be forwarded to the P & 0 Board.
2. We also recommend a discussion with the Board regarding clarifying the location of driveways
when a parcel abuts a local road and one ofa higher classification (Chap. 23. Art.2H3). If there is
general agreement that the code needs revision. it should be done quickly.
One point that needs clarification is ... To what point on the driveway dclh~ 30' or 180'
dimensions g01 - to the centerline of the DIW1 or to the outside edge or the ingress/egress D/W?
The following modifications are also suggested:
a) Chap. 23. Art.2H I: Change the maximum driveway width from 32' to 36'. Most driveways
have three lanes - one in and two out. usually a right turn lane and one for crossing maneuvers.
Usually these lanes arc 12' each; however. if the 36' dimension is acceptable. I would like to see

DESCRIPTION: This is a request from George C. Davis, agent for Bob
Feldman, property owner and owner of Clear Copy, Inc., for site
plan approval to construct a 3,780 square foot, two-story, retail
printing business on a .225 acre parcel located at the southeast
corner of Boynton Beach Boulevard and N.W. 7th Street (please refer
to attached Planning and Zoning Department Memorandum No. 95-325
for further details regarding the site plan).
RECOMMENDATION: The Planning and Development Board, with a 5-1
vote, recommended approval of this request, subj ect to staff
comments (Public Works Department Memorandum #95-102, utilities
Department Memorandum #95-204, Police Memorandum #95-0148,
Engineering Division Memorandum #95-205, Building Division #95-210
and Planning and Zoning Memorandum #95-326.
As a point of information, there was much discussion regarding the
accessibility (turning radius of the approach) to the proposed
dumpster location, the egress only design of the driveway onto N.W.
7th Street (there was some concern as to whether motorists would
obey this driveway design as egress only) and the building design
(possible inappropriateness of the shutters and lack of additional
design features). -

The landscape plan submitted reflects all required
landscaping.
The proposed development meets the requirements of
the bUilding and site regulations. The total site
area is 9,788 square feet with a building coverage
of thirty-seven percent (37%). The building height
is twenty-five (25) feet.
The proposed color of the two-story stucco building
will be light pink with white trim, doors and
window shutters. The roof will be brick colored s-
tile. These colors are generally compatible with
the colors of the neighboring structures which are
predominantly of a Spanish/Mediterranean style.
However, the shade of pink selected for the stucco
does not appear to compliment the brick colored
roof tile; a more orange shade of p1nk is
recommended.
A freestanding sign is proposed between Boynton
Beach Boulevard and the front of the building.

I. Engineering recommends that the subject plan be forwarded to the P & D Board.
2. We also recommend a discussion with the Board regarding clarifying the location of driveways
when a parcel abuts a local road and one ofa higher classification (Chap. 23. Art.2H3). If there is
general agreement that the code needs revision. it should be done quickly.
One point that needs clarification is ... To what point on the driveway dJh~ 30' or 180'
dimensions go? - to the centerline of the D/W" or to the outside edge ofthe ingress/egress D/W?
The following modifications are also suggested:
a) Chap. 23. Art.2H I: Change the maximum driveway width from 32' to 36'. Most driveways
have three lanes - one in and two out. usually a right turn lane and one for crossing maneuvers.
Usually these lanes are I~' each; however. if the 36' dimension is acceptable. I would likc to see

obtain an environmental review permit prior to occupying
the premises.

Traffic Division after their review of the traffic
statement, must be complied with at time of permitting.
II. RECOMMENDATIONS
10. It is recommended that a recycling container be provided
in compliance with the criteria specified by the Public
Works Department.
11. It is recommended that a more orange shade of pink is
selected for the building stucco to better compliment the
color of the roof tile.
NOTE: If recommendations are approved, they shall be
incorporated into the working drawings required for
permits for the project.

thirteen (13) parking spaces, including one (1)

The landscape plan submitted reflects all required
landscaping.
The proposed development meets the requirements of
the building and site regulations. The total site
area is 9,788 square feet with a building coverage
of thirty-seven percent (37%). The building height
is twenty-five (25) feet.
The proposed color of the two-story stucco building
will be light pink with white trim, doors and
window shutters. The roof will be brick colored s-
tile. These colors are generally compatible with
the colors of the neighboring structures which are
predominantly of a Spanish/Mediterranean style.
However, the shade of pink selected for the stucco
does not appear to compliment the brick colored
roof tile; a more orange shade of pink is
recommended.
A freestanding sign is proposed between Boynton
Beach Boulevard and the front of the building.

The following commentslrecommendations are submitted for your review:
I. The plan is subject to the parking lot regulations for paving, drainage, site lighting, curbing,
landscaping, and irrigation permits.
RECOMMENDATIONS
I. Engineering recommends that the subject plan be forwarded to the P & D Board.
2. We also recommend a discussion with the Board regarding clarifying the location of driveways
when a parcel abuts a local road and one of a higher elassification (Chap. 23, Art.2H3). If there is
general agreement that the code needs revision, it should be done quickly.
One point that needs clarification is ... To what point on the driveway dJh~ 30' or 180'
dimensions go? -- to the centerline ofthe D/W? or to the outside edge ofthe ingresslegress D/W?
The following modifications are also suggested:
a) Chap. 23, Art.2H I: Change the maximum driveway width from 32' to 36'. Most driveways
have three lanes - one in and two out, usually a right turn lane and one for crossing maneuvers.
Usually these lanes are 12' each; however, if the 36' dimension is acceptable, I would like to see
the city specify that the two egress lanes be 11' wide each and the ingress lane, 14'. The
purpose of this code requirement would be to allow a wider lane for vehicles coming in from a
collector or arterial roadway to negotiate the turn as they decelerate. Having II' lanes for
outgoing traffic is no hardship because they arc traveling at a low speed and then stopping at the
stop sign.
b) Chap 23, Art.2H2: Provide that the 25' driveway radii be a minimum dimension. For the
same reason above, vehicles entering a s~opping center, etc. from a 40 to 50 mph speed (actual
speed, not posted speed) should ha~e a larger, "forgiving" radius.

The Building Division has reviewed the amended plans for the
above project and offers the following comments:
1. Thirteen parking spaces are required; only 12 are shown.
There is no handicap parking shown.
2 . Handicap access from the right-of-way to the entrance of
building is required.
3 . Sidewalk on N.W. 1st Avenue is required.
The above comments can be met at time of building permit;
therefore, we recommend that the project be forwarded to the
Planning and Development Board.

7. Although the use is located within a C-2 district, print
shops require environmental review. The applicant must
obtain an environmental review permit prior to occupying
the premises.
8. State on the plans the hours that the loading zone will
be utilized and that these hours have been coordinated
with Public Works so as to not conflict with trash pick.
9. Any conditions of approval received by Palm Beach County
Traffic Division after their review of the traffic
statementr must be complied with at time of permitting.
II. RECOMMENDATIONS
10. It is recommended that a recycling container be provided
in compliance with the criteria specified by the Public
Works Department.
11. It is recommended that a more orange shade of pink is
selected for the building stucco to better compliment the
color of the roof tile.
NOTE: If recommendations are approved, they shall be
incorporated into the working drawings required for
permits for the project.

The following is a list of comments regarding the second review of
the above-referenced project. It should be noted that the comments
are divided into two (2) categories. The first category is a list
of comments that identify unresolved comments either from the first
review or new comments as a result of the second review. To show
compliance with these comments will not substantially alter the
configuration of the site and design of the building. The second
category is a list of recommendations I believe will enhance the
aesthetics and function of the project.
All comments and recommendations can be rectified on the plans at
time of permitting if the site plan request is approved. The
applicant must understand that additional comments may be generated
upon review of the documents and working drawings submitted to the
Building Division for permits for the proposed project.
I. SITE PLAN REVIEW COMMENTS:
1. Please show and identify on the plans all curbing,
wheelstops and landscaped areas. Areas that must be
protected by raised continuous curbing or wheelstops
include all landscaped islands, landscaping adjacent to
a parking stall and landscaping adjacent to curvilinear
driveways where encroachment is likely to occur. Curb
design shall comply with City standards.
2. State on the plans that Boynton Beach Boulevard is the
front of the property.
3. Provide a note adjacent to the dumpster location
identifying the type of landscaping material that is
required to screen three sides of the dumpster enclosure.
4. Add to the landscape plan/site plan all existing and
proposed easements. Identify the type of easement and
dimension the width. Note: Some landscape material is
not allowed to be planted with an easement and under
overhead lines.
5. Show on the plan that the proposed landscaping adjacent
to the intersection of N. W. 7th Street and N. W. 1st
Street does not violate line-of-site requirements for
areas within twenty-five feet of the intersection.
6. Submit and identify on the architectural elevation view
drawings the color of all exterior materials depicted on
the plan by name, manufacturer and model or style number.

The following comments/recommendations are submitted for your review:
]. The plan is subject to the parking lot regulations for paving, drainage, site lighting, curbing,
landscaping, and irrigation permits.
RECOMMENDATIONS
]. Engineering recommends that the subject plan be forwarded to the P & D Board.
2. We also recommend a discussion with the Board regarding clarifying the location of driveways
when a parcel abuts a local road and one ofa higher classification (Chap. 23, Art.2H3). If there is
general agreement that the code needs revision, it should be done quickly.
One point that needs clarification is... To what point on the driveway dJhe 30' or ]80'
dimensions go? -- to the centerline of the D/W? or to the outside edge ofthe ingresslegress D/W?
The following modifications are also suggested:
a) Chap. 23, Art.2Hl: Change the maximum driveway width from 32' to 36'. Most driveways
have three lanes - one in and two out, usually a right turn lane and one for crossing maneuvers.
Usually these lanes are ]2' each; however, if the 36' dimension is acceptable, I would like to see
the city specify that the two egress lanes be 11' wide each and the ingress lane, 14'. The
purpose of this code requirement would be to allow a wider lane for vehicles coming in from a
collector or arterial roadway to negotiate the turn as they decelerate. Having II' lanes for
outgoing traffic is no hardship because they are traveling at a low speed and then stopping at the
stop sign.
b) Chap 23, Art.2H2: Provide that the 25' driveway radii be a minimum dimension. For the
same reason above, vehicles entering a shopping center, etc. from a 40 to 50 mph speed (actual
speed, not posted speed) should have a larger, "forgiving" radius.

AS a point of information, there was much discussion regarding the
accessibility (turning radius of the approach) to the proposed
dumpster location, the egress only design of the driveway onto N.W.

area is 9.788 square feet with a bUilding coverage
of thirty-seven percent (37%). The building height
is twenty-five (25) feet.

The proposed color of the two-story stucco building
will be light pink with white trim, doors and
window shutters. The roof will be brick colored s-
tile. These colors are generally compatible with
the colors of the neighboring structures which are
predominantly of a Spanish/Mediterranean style.
However, the shade of pink selected for the stucco
does not appear to compl iment the brick colored
roof tile; a more orange shade of pink is
recommended.
A freestanding sign is proposed between Boynton
Beach Boulevard and the front of the building.

RECOMMENDATIONS
I. Engineering recommends that the subject plan be forwarded to the P & D Board.
2. We also recommend a discussion with the Board regarding clarifying the location of driveways

general agreement that the code needs revision. it should be done quickly.

One point that needs clarification is ... To what point on the driveway dd~~ 30' or 180'

The following modifications arc also suggested:
a) Chap. 23, Art.2H I: Change the maximum driveway width from 32' to 3". Most driveways
have three lanes - one in and two out, usually a right turn lane and one for crossing maneuvers.
Usually these lanes arc 12' each~ however, if the 36' dimension is acceptable, I would like to see
the city specify that the two egress lanes he II' wide each and the ingress lane, 14'. The
purpose of this code requirement would be to allow a wider lane for vehicles coming in from a
collector or arterial roadway to negotiate the turn as they decelerate. Having II' lanes for
outgoing traffic is no hardship because they arc traveling at a low speed and then stopping at the
stop sign.
b) Chap 23, Art.2H2: Provide that the 25' driveway radii be a minimum dimension. For the
same reason above, vehiclcs entcring a shopping center. ctc. from a 40 to 50 mph speed (actual
speed, not posted specd) should hav.c a larger, "forgiving" radius.

I. SITE PLAN REVIEW COMMENTS:

LANDSCAPING DISCREPANCY
In order to assist you in your response to Tambri Heyden's
memorandum 95-383, I researched the files and offer the following
facts and comments:
The Technical Review Board (TRB) plans were signed off by Don
Jaeger during his tenure as the department's representative. The
building plans were reviewed by Michael Haag and ultimately
signed off by Warren DeLoach in Mr. Haag's absence in 1989. My
review shows the building plans match the TRB plans and those
that were reviewed by the Community Appearance Board. All plans
show a 2~' setback for the extreme western section of the
property adjacent to the parking lot.
During this era, Mr. Jaeger then became Building Official and Mr.
Haag was appointed in charge of site review which was handled by
this department during that time. Site plan approval permit 88-
0873 was generated to track the site plan process for all site
improvements and administered by the Site Development Division of
the Building Department under Mr. Haag's supervision. The
project has been completed and all paperwork is on microfilm.
Therefore, all original documents are no longer available.
Attached are copies of the site plan and the tie-in survey along
with a print-out of the inspection history. From my observation
of the tie-in survey, the paving appears to be 1.58' from the
west property line and not 2~' as shown on the building plans. I
would assume that the survey is correct in that it has a
certification date Showing August 23, 1989 and I found that the
paving was approved August 18, 1989 by Roger Kuver, former
Engineering Inspector who is now with the Utilities Department.
From that same survey. it appears that the building is in the
correct location and 1t would be fair to assume that the only
problem is with the size of the paved area. I found no
documentation in the file giving any explanation, etc. as to any
resolution from the narrow landscape strip or whether it ever
became an issue.

Our records do show that the CAB inspection was made by Med
Kopczynski who was the former Deputy Building Official and
appointed to handle CAB inspections by Mr. Jaeger when he became
Building Official. That inspection was approved August 25, 1989.
I can only assume that the proper position to take would have
been to cut off the additional paving to comply with the 30"
landscape strip. It could have been assumed that it was not
necessary since we did then, and do now, allow bumper stops to
set back on paved areas less than the code requires so that the
bumpers overhang the landscape strip. I see no reason why this
would be an issue, especially as it relates to the adjacent
property since our code also exempts landscaping on property that
already has existing landscaping. My interpretation of the code
is that the landscaping strip itself has a dimension requirement
and the code specifies what must be located within that strip but
not necessarily that the plantings must be as wide as the strip.
It should be our position that the neighboring property owner
should not be penalized for the paving on Dr. Roberts' property
being closer to his property line than what was permitted.
If any controversy arose during the construction of Dr. Roberts'
permits, Mr. Haag could shed some light on it since he was
involved in the site plan process and the final site approval was
signed by him on November 19, 1991.

printing business on a .225 acre parcel located at the southeast
corner of Boynton Beach Boulevard and N.W. 7th Street (please refer

vote, recommended approval of this request, subject to staff

RECOMMENDATIONS
I. Engineering recommends that the subject plan be forwarded to the P & ~ Board.
2. We also recommend a discussion with the Board regarding clarifying the location of driveways
when a parcel abuts a local road and one of a higher classification (Chap. 23. Art.2H3). If there is.
general agreement that the eode needs revision. it should be done quickly.
One point that needs clarification is ... To what point on the driveway dch.~ 30' or I RO'
dimensions go? - to the centerline of the DIW? or to the outside edge orthe ingress/egress D/W?
The following modifications are also suggested:
a) Chap. 23. Art.2H I: Change the maximum driveway width from 32' to 36'. Most driveways
have threc lanes - one in and two out, usually a right turn lane and one for crossing maneuvers.
Usually these lanes arc 12' each; however. if the 36' dimension is acceptable. I would like to see
the city spccify that the two egress lanes be II' wide each alld the Inlresl lane, 14'. The
purpose of this code requirement would be to allow a wider lane for vehicles coming in from a
collector or arterial roadway to negotiate the turn as they decelerate. Having II' lanes for
outgoing traffic is no hardship because they arc traveling at a low speed and then stopping at the
stop sign.
b) Chap 23. A L. Provide that the 25' driveway radii be a minimum dimension. For the
same reason ~icles entering a snapping center. etc. from a 40 to 50 mph speed (actual
speed. not posted speed) should hav.e a larger. "forgiving" radius.

The following is a list of comments regarding the second review of
the above-referenced project. It should be noted that the comments
ar8 divided into two (2) categories. The first category is a list
of comments that identify unresolved comm~nts either from the first
review o~ new comments as a result of the second review. To show
compliance with these comments will not substantially alter the
configuration of the site and design of the building. The second
category is a list of recommendations I believe will enhance the
aesthetics and function of the project.
All comments and recommendations can be rectified on the plans at
time of permitting if the site plan request is approved. The
applicant must understand that additional comments may be generated
upon review of the documents and working drawings submitted to the
BUilding Division for permits for the proposed project.
I. SITE PLAN REVIEW COMMENTS:
1. .1ease show and identify on the plans all curbing,
wl1eelstops and landscaped areas. AL"eaS that must be
protected by raised continuous curbing or wheelstops
include all landscaped islands, landscaping adJacent to
a parking stall and landscaping adjacent to curvilinear
driveways where encroachment is likely to occur. Curb
design shall comply with city standards.
2. State on the plans that Boynton Beach Boulevard is the
front of the property.
3. Provide a note adjacent to the dumpster location
identifying the type of landscaping material that is
reqUired to screen three sides of the dumpster enclosure.
4. Add to the landscape plan/site plan all existing and
proposed easements. Identify the type of easement and
dimension the wldth. Note: Some landscape material is
not ,"111 nwed to be planted wi th an easement and under
overhead lines.
5. Show on the plan that the proposed landscaping adjacent
to the intersection of N.W. 7th Street and N.W. 1st
Street does not violate line-of-site requirements for
areas within twenty-five feet of the intersection.
6. Submit and identify on the architectural elevation view
drawings the color of all exterior materials depicted on
the plan by name, manufacturer and model or style number.

7. Although the use is located within a C-2 district, print
shops require environmental review. The applicant must
obtain an environmental review permit prior to occupying
the premises.
8. State on the plans the hours that the loading zone will
be utilized and that th~se hours have been coordinated
with Public Works so as to not conflict with trash pick.
9. Any conditions of approval rece1ved by Palm Beach County
Traffic Division after their review of the traffic
statement, must be complied with at time of permitting.
II. RECOMMENDATIONS
10. It is recommended that a recycling container be provided
in compliance with the criteria specified by the Public
Works Department.
11. It is recommended that a more orange shade of pink is
selected for the bUilding stucco to better compliment the
color of the roof tile.
NOTE: If recommendations are approved, they shall be
incorporated into the working drawings required for
permits for the project.

On September 19, 1995, the City Commission approved, subject to
comments, the site plan request for Clear Copy to allow a new print
shop to be located at the southeast corner of Boynton Beach
Boulevard and N.W. 7th Street (660 W. Boynton Beach Boulevard).
RHS Corporation subsequently filed a Notice of Administrative Appeal
to appeal through the circuit court system the City's decision to
approve Clear Copy's site plan. RHS owns and occupies the abutting
property immediately east of Clear Copy's parcel. There is a
medical/dental office building located on this abutting property.
Subsequent to site plan approval, the applicant submitted a request to
modify the previously approved site plan. The modified site plan was
approved by the City Commission on March 19, 1996. Prior to the
outcome of the RHS Corporation appeal, the applicant progressed
through the permit and construction process and obtained a certificate
of occupancy. The court subsequently determined that insufficient
notice was given by the city to the adjacent property owners at the
time of the initial approval and quashed the city's approval of the site
plan. Therefore, the city required the applicant to resubmit and
reprocess the site plan. This request is submitted in compliance with
the court order.
As requested by Palm Beach County Traffic Division, the
applicant filed a restrictive covenant that limits the use of the
structure to a print shop. A change in use can be requested in
the future, but will require further review for traffic by the
County.
The Engineering Division has determined that the drainage
plans meet the city code and drainage levels of service.
Two, one-way driveways to the parking lot are reflected on the plans
submitted. Both driveways are located on N.W. 7th Street. The south

driveway is ingress only and the north driveway is egress only. The
Engineering Division, Police Department, Fire Department and Public
Works Department have determined that this design meets code and
provides adequate access for emergency and sanitation vehicles.
The parking facility illustrated on the plans submitted contains the
required thirteen (13) parking spaces, including one (1) handicapped
space.
The landscape design reflected on the plans submitted meets the city
code requirements. It is noted that the perimeter landscape
requirements of Section 5.E of the city's landscape code do not apply
to the parking area along Clear Copy's eastern property line. This is
because there is an existing hedge on the adjacent property to the
east. Although the width of the planting strip, within which the hedge
is planted, tapers from 2 ~ feet to twenty inches, "said existing hedge
may be used to satisfy the landscape requirements of this subsection
provided that said existing hedge meets all applicable standards of
this article", The standard for such a hedge is a height of not less
than four feet. The existing hedge meets this standard.
The plans submitted meet the requirements of the building and site
regulations. The total site area is 13,700 square feet, the building
coverage is thirty-seven percent (37%) and the building height is
twenty-five (25) feet.
Community Design
Plan: The elevations submitted indicate the building to be two stories with
brick colored tile roofing. The exterior walls are finished with a
pink/peach stucco with white raised stucco bands. Windows are
arched with bronze shutters. The building has a Spanishl
Mediterranean style which complements the adjacent commercial
buildings having the same style.
Signage:
A free-standing sign, between Boynton Beach Boulevard and the front
of the building, is reflected on the plans submitted. The free-standing
sign meets the sign code requirements (see Exhibit "C" - Signage).
RECOMMENDA TION:
Planning and Zoning recommends approval of this site plan request as submitted as all
staff comments have been addressed (see Exhibit "0" - Conditions of Approval).

Please place under Legal - Other, on the March 19, 1996 City
Commission agenda, discussion of 1) a minor site plan modification
that has been submitted for Clear Copy and 2) Commission
legislative intent for commercial building overhangs as it relates
to the pending RHS Corporation v. City of Boynton Beach case.
INTRODUCTION
On September 19, 1995, the City Commission approved, subject to
comments, the site plan request for Clear Copy; a new print shop to
be located at the southeast corner of Boynton Beach Boulevard and
N.W. 7th Street (660 W. Boynton Beach Boulevard) - see attached
Planning and Zoning Department Memorandum No. 96-142 - Exhibit A
for location map. RHS Corporation subsequently filed a Notice of
Administrative Appeal to appeal through the circuit court system
the City's decision to approve Clear Copy's site plan. RHS owns
and occupies the abutting property immediately east of Clear Copy's
parcel. There is a medical/dental office building located on this
abutting property. Since the September approval, the applicant has
moved forward with construction permits and the building is
currently under construction and nearing completion.
On February 27, 1996, I received from the city engineer, William
Hukill, a memorandum notifying the department that the applicant
for Clear Copy had submitted, through permitting and in response to
Mr. Hukill's request for a code compliance certification, a site
plan drawing showing several modifications to the permit that had
been previously approved for Clear Copy's site improvements. For
expediency and simplification, all applicants are allowed to submit
modifications directly through the permitting application process
for determination of minor vs. major change or may submit
modifications directly to the Planning and Zoning Department, with
a letter describing the changes (although we have also allowed
modification plans to be evaluated for determination by meeting
with Planning and Zoning Department staff).
Since the development is the subject of pending litigation, city
policy requires staff to notify the legal department of any actions
related to pending litigation. Such notification occurred and on
March 4, 1996, the legal department advised staff of the following:
a) that the City Commission be apprised, expeditiously (at their
next available meeting), of the minor site plan modification
that has been submitted;
b) that the City Commission ratify staff's determination and
c) that the RHS Corporation be notified that the modified site
plan will be presented to the Commission at this meeting.
As previously discussed with you, on March 8, 1996, the legal
department filed a Motion for Extension of Time with the circuit
court regarding the subject case. Reference in the motion was made

indicating that the modified site plan would come before the City
Commission at their March 19, 1996 meeting. On or about March 5,
1996, the legal department notified the RHS Corporation that the
minor site plan modification would be discussed at the March 19th
Commission meeting. In addition, copies of this memorandum will be
provided to the RHS Corporation, specifically Dr. Mark E. Roberts,
today, after transmittal of this memorandum to you.
It is the Planning and Zoning Department's responsibility to
determine which departments review minor site plan modifications
and to inform the applicant of the completeness of his submittal.
After receipt of engineering plans to accompany the modified site
plan received, staff distributed the submittal to the Technical
Review Committee (TRC) for comments and placed the request on the
agenda of the next available TRC meeting (March 12, 1996). It is
noted that the standard method for obtaining comments from
designated TRC members for minor site plan modifications is by
telephone request to review plans held in the Building Division.
However, the TRC meeting forum was used in this case due to the
pending litigation and to more quickly and effectively assemble the
attached materials for the March 19th Commission meeting.
The modifications are described in the attached Planning and Zoning
Department Memorandum #96-142 and are illustrated in the attached
copy of the modified site plan (Planning and Zoning Department
Memorandum #96 -142 Exhibi t B). After comparison with the
September 1995 approved site plan (copy provided in attached
Planning and Zoning Department Memorandum #96-142 - Exhibit B),
these modifications have been determined to be minor in nature and
can, therefore, be approved administratively through the permit
process. For clearer Commission understanding of the modifications
requested, the original site plan staff report has been attached
and revised to reflect the changes. Also attached in Planning and
Zoning Department Memorandum No. 96-142 - Exhibit C is a list of
all administrative comments that condition this minor site plan
modification approval. For reference purposes, the applicable
sections of the Boynton Beach Land Development Regulations (Part
III of the Boynton Beach Code of Ordinances) used to determine the
processing of a modification to an approved site plan are provided
below. Following each criterion, staff's conclusion is included
and appears in brackets:
"Section 9. Modification of approved site plan.
C. In making a minor/major modification determination, the
planning and zoning director shall consider the
following:
1. Does the modification increase the buildable square
footage of the development by more than five (5)
percent." [No change in the size of the building
is requested.)
2. "Does the modification reduce the provided number
of parking spaces below the required number of
parking spaces." [No change in the number of
parking spaces is requested.]
3. "Does the modification cause the development to be
below the development standards for the zoning
district in which it is located or other applicable
standards in the Land Development Regulations."
[The modification does not change, and continues to
meet, the C-3 zoning district development standards
(building and site regulations). In addition,
compliance with the attached staff comments will
ensure that all safety and technical concerns, as
well as code requirements, have been addressed.)

4. "Does the modification have an adverse effect on
adj acent or nearby property or reduce required
physical buffers, such as fences, trees, or
hedges." [The modifications include replacement of
the N. W. 1st Avenue ingress only driveway for a
N,W. 7th Street ingress only driveway, a flip-flop
of the location of the row of parking spaces with
the access aisle to the parking spaces, switching
of the handicapped space location, addition of
window sills to the building exterior. The
building exterior modification does not lessen the
appearance of the building. In fact, the change
lends a more finished look to the building, making
it more compatible with the exterior appearance of
adjacent buildings. The driveway change meets code
locational requirements and does not negatively
affect adjacent properties. The parking lot "flip-
flop" and handicapped space change are internal to
the development and have no negative impact
(virtually no impact at all) on adjacent
properties; nor do they diminish the function of
the parking lot.
With regard to reduction of physical buffers, the
modifications do not diminish the degree of
buffering afforded by the september 1995 approved
site plan. No change in the landscaping proposed
as part of the original site plan approval for the
area between the Clear Copy parking lot and Dr.
Roberts' parking lot is requested, consistent with
the September 19, 1995 city determination that this
landscape buffer is acceptable.]
5. "Does the modification adversely affect the
elevation design of the structure below the
standards stated in the community design plan."
[The modification to the elevation design of the
structure meets the community design plan and as
stated in criterion 4 above, the building exterior
modification does not lessen the appearance of the
building. In fact, the change lends a more
finished look to the building, making it even more
compatible with the exterior appearance of adjacent
bui ldings . ]
6. "Does the modified development meet the concurrency
requirements of the Boynton Beach Comprehensive
Plan. " [The modifications have no impact on the
previously granted concurrency certification.]
7. "Does the modification alter the site layout so
that the modified site plan does not resemble the
approved site plan." [This criterion grants a
certain degree of staff authority and requires
application of judgement and common sense to assess
the magnitude of change. Consistent application of
this criterion is apparent through the quarterly
reporting to the Commission of site plan waivers
and minor modifications processed by the
department. When magnitude of change and
similarity, or lack thereof, is.evaluated between
the approved site plan and the modification, the
following comparisons are noted:
a) no change in building location;

b) same building to parking relationship -
building in front, parking in rear;
c) no change in number of driveways or type
of driveways (two-way va. one-way and
ingress VB. egress);
d) service areas are in same general
location and method of refuse collection

e) degree, quality, quantity and location of
landscaping is unchanged;
f) type of parking spaces is unchanged;

Therefore, based on the above evaluation, staff concluded that the
changes requested constitute a minor site plan modification and
meet the following definition of minor modification: II a non-
impacting modification which will have no adverse effect on the
approved site and development plan and no impact upon adjacent and
nearby properties, and no adverse aesthetic impact when viewed from
a public right -of -way as determined by the planning and zoning
director II .
In addition to ratification of staff's action on the modified site
plan, the legal department advised that staff seek from the
Commission a determination of their legislative intent when
adopting the following section of the city's zoning code:
Section 4. General Provisions.
J. Other Structures. The following structures shall
be permitted in front, rear or side setbacks as
provided in this ordinance, in any zone, except
where so noted; taking into consideration existing
easements:
3. House eaves shall not overhang or exceed
the setback lines for more than two (2)
feet.
Specifically the question is whether commercial buildings are
allowed to overhang into setbacks, so long as the overhang does not
exceed two feet. The Development Department states that
historically overhangs of commercial buildings have been allowed,
at time of inspection, to exceed the setback lines. These
overhangs, which include building surface treatments, as well as
window sills and cornices, have been reported to range from one
inch to six inches.
This determination is necessary because the tie-in survey submitted
for the Clear Copy building indicates a 10 inch overhang into the
front (north) and east side setbacks. Clear Copy's window sills,
plaster, raised stucco bands and the cornice extend beyond the

setback by three inches, 1 1/4 inches and 10 inches respectively.
The window sills were not part of the original approval and the
cornice was extended a greater distance than originally planned in
order to add roof ventilation; a design detail that is not
considered until the construction drawing stage - after time of
site plan approval.
CONCLUSION
In conclusion, two actions are requested by the Commission as
follows:
a) ratification of staff's action to process the submitted
modifications as a minor site plan modification and
b) a determination as to whether the Commission's action
when approving the zoning code included various
commercial building features to be treated as house
eaves, thereby permitting such features on commercial
buildings to extend into the setback by no more than two
feet.

seven percent (37%) and the building height is

A free standing sign is proposed between Boynton

to the plan that indicates the
landscaping within the line-of-sight
triangles between thirty (30) inches
and six (6) feet in height shall be
maintained to allow an unobstructed
cross visibility. Also, show on the
site/landscape plan the zoning code
visual obstruction safe sight corner.

Recommendation(s) :
17. It is recommended that the oversized
parking space located directly west of

recommended that a distinguishable
symbol (cloud) be used to identify the
areas of the site/landscape plan that
are being revised from the original
