Parking Lot Variance (back up reduction)
section 5-145(c) (4) of the Code of Ordinances requires that when a
variance to Section 5, Article X, Parking Lots is requested, the
Technical Review Board (Technical Review Committee) shall forward
to the Planning and Zoning Board (Planning and Development Board)
a recommendation, and that the recommendation forwarded is to be
made part of the public hearing proceedings. This memorandum is
forwarded to you consistent with Section 5-145(c)(4).
Tony Harvey, owner and applicant for Harvey's Restaurant to be
located at 119 Martin Luther King Boulevard, is requesting a
variance in connection with a future, major site plan modification
request for a restaurant. The existing building was licensed as a
30 seat restaurant from 1983 to 1991, however the parking lot does
not meet current standards. Due to the applicant's desire to
construct an addition to the existing building, the parking lot
must now be brought up to code to establish the proposed use.
The variance requested is to Section 5-142 (i) (1) Parking Lot
Layout which requires that parking lots meet or exceed the
dimensional requirements for stalls, driveways, and access aisles
as provided for in the Ci ty standards. As illustrated on the
attached site plan, the applicant is requesting relief from the
minimum 27 feet required for access aisles (back-up width) for the
90 degree parking space layout proposed. The back-up width
proposed is 23.91 feet; a reduction of 3.09 feet. It should be
noted that the reduced back-up is requested for eight (the front
spaces) of the twenty-two parking spaces shown. The parking
layout proposed provides the required 27 feet back-up for the
remaining 14, rear spaces shown. For an explanation of the code
requirement, the nature of the variance request, and the variance
justification, please refer to the attached "Notice of Public
Hearing" and application.
On Thursday, October 14, 1993, the Technical Review Committee (TRC)
met to review the plans and documents submitted, and to formulate
a recommendation with regard to the variances requested. After
review and discussion, the TRC unanimously recommended approval of
the variance, as submitted. Since the substandard access aisle is
proposed to be lined with raised, concrete curbing, the point was
raised that at worst, vehicles backing out of the front eight
parking stalls may impact the curb.

Harvey's Restaurant
The City Engineer has requested that I correspond with you and
summarize the concensus opinion of the City's Technical Review
Committee regarding their deliberations on the above referenced
variance application.
City Code of Ordinances, Chapter 5, Section 5-142 (i), "Parking
Lot Layout" (Appendix) requires that each parking stall shall be
provided a free unobstructed back-up area of twenty seven (27')
feet.
The applicant's plans indicate an approximate back up area of
twenty four (24') feet.
TECHNICAL REVIEW COMMITTEE RECOMMENDATION
The unanimous concensus of the T.R.C. is to favorably recommend
the granting of the variance to allow for a twenty four (24') foot
back up area as the limit(s) of this area is lined with continuous
concrete curb and there~ore, a vehicle that was backing into the
proposed twenty-four (24') foot area would at worst, impact raised
concrete curbing.

Harvey's Restaurant
The City Engineer has requested that I correspond with you and
summarize the concensus opinion of the City's Technical Review
Committee regarding their deliberations on the above referenced
variance application.
City Code of Ordinances, Chapter 5, Section 5-142 (i), "Parking
Lot Layout" (Appendix) requires that each parking stall shall be
provided a free unobstructed back-up area of twenty seven (27')
feet.
The applicant's plans indicate an approximate back up area of
twenty four (24') feet.
TECHNICAL REVIEW COMMITTEE RECOMMENDATION
The unanimous concensus of the T.R.C. is to favorably recommend
the granting of the variance to allow for a twenty four (24') foot
back up area as the limit(s) of this area is lined with continuous
concrete curb and there~ore, a vehicle that was backing into the
proposed twenty-four (24') foot area would at worst, impact raised
concrete curbing.

Section 5-145(c)(4) of the Code of Ordinances requires that when a
variance to Section 5, Article X, Parking Lots is requested, the
Technical Review Board (Technical Review Committee) shall forward
to the Planning and Zoning Board (Planning and Development Board)
a recommendation, and that the recommendation forwarded is to be
made part of the public hearing proceedings. This memorandum is
forwarded to you consistent with Section 5-145(c)(4).
Tony Harvey, owner and applicant for Harvey's Restaurant to be
located at 119 Martin Luther King Boulevard, is requesting a
variance in connection with a future, major site plan modification
request for a restaurant. The existing building was licensed as a
30 seat restaurant from 1983 to 1991, however the parking lot does
not meet current standards. Due to the applicant's desire to
construct an addition to the existing building, the parking lot
must now be brought up to code to establish the proposed use.
The variance requested is to Section 5-142 ( i) ( 1) Parking Lot
Layout which requires that parking lots meet or exceed the
dimensional requirements for stalls, driveways, and access aisles
as provided for in the City standards. As illustrated on the
attached site plan, the applicant is requesting relief from the
minimum 27 feet required for access aisles (back-up width) for the
90 degree parking space layout proposed. The back-up width
proposed is 23.91 feet; a reduction of 3.09 feet. It should be
noted that the reduced back-up is requested for eight (the front
spaces) of the twenty-two parking spaces shown. The parking
layout proposed provides the required 27 feet back-up for the
remaining 14, rear spaces shown. For an explanation of the code
requirement, the nature of the variance request, and the variance
justification, please refer to the attached "Notice of Public
Hearing" and application.
On Thursday, October 14, 1993, the Technical Review Committee (TRC)
met to review the plans and documents submitted, and to formulate
a recommendation with regard to the variances requested. After
review and discussion, the TRC unanimously recommended approval of
the variance, as submitted. since the substandard access aisle is
proposed to be lined with raised, concrete curbing, the point was
raised that at worst, vehicles backing out of the front eight
parking stalls may impact the curb.
