DESCRIPTION: This is a request submitted by Deborah Bizzaro, agent for Mary Miller, trustee of the Louis schnitzer Trust, property owner of 2000 S.W. Golf Lane, for abandonment of a portion of a five foot wide utility easement encroached by the home at this address. RECOMMENDATION: The planning and zoning Department unanimously approved this request, subject to the comment received from southern Bell. This comment will become part of the record, but does not require any action by the applicant. Golf Lane - File No. ABAN 95-002 Abandonment of utility easement NATURE OF REQUEST Deborah L, Bizzark~ agent for Mary Miller, trustee of the Louis Schnitzer trust, property owner, is requesting abandonment of a portion of a 5 foot wide platted utility easement at 2000 S.W. Golf Lane. The property is located in an R-1-AA, single-Family Residential, zoning district. Attached is Exhibit "A" - location map and Exhibl t liB" - legal descriptlon and survey of proposed abandonment. BACKGROUND The existing home at 2000 S.W. Golf Lane encroaches a portion of the referenced utill ty easement. The applicant states that the encroachment occurred when the developer built the house in 1976. The encroachment has existed approximately 19 years with no problems reported to the city by any of the utility companies that have rights to the easement. The utility easement was created when the plat of Palm Beach V~isureville Section 5A was approved in April of 1970. The subject address is Lot 12, Block 39 of this recorded plat. ANALYSIS The requested abandonment has been submitted in order to allow the closing on the sale of the property. The city's utility Department has no objection to the abandonment. Of the utilities companies notified of the abandonment, southern Bell was the only one to indicate a concern and stated that they would not relocate their lines if they were within the area to be abandoned. However, they h.3.d no objection to the abandonment (see Exhibit "CII - letter from Southern Bell) . The city departments involved in review of .3. request for abandonment and the utility companies notified of the request are identified below. Public notice is given to the property owners that abut the easement to be abandoned. The utility companies, abutting property owners and the city department responses to the abandonment request are identified below. The applicant's reasons for filing this abandonment and the grounds that support the request are included in the attached Exhibit liD". To abandon the entire easement may compromise potential users, although Comcast Cable has not objected to the abandonment. All other potential users have not signed off to the best of my knowledge, including our own Utility Department. Since the problem was caused by construction of a residence encroaching into the easement, and since other encroachments exist in the SE side yard drainage easement, perhaps we should issue waivers for the encroachments and leave the easements as they now exist. Do we really want to establish an easement abandonment procedure in this development?
