Utility easement abandonment
Please place the above-referenced item on the City Commission
agenda for August 15, 1995 under Public Hearings.
DESCRIPTION: This is a request submitted by Deborah Bizzaro, agent
for Mary Miller, trustee of the Louis schnitzer Trust, property
owner of 2000 S.W. Golf Lane, for abandonment of a portion of a
five foot wide utility easement encroached by the home at this
address.
RECOMMENDATION: The planning and zoning Department unanimously
approved this request, subject to the comment received from
southern Bell. This comment will become part of the record, but
does not require any action by the applicant. Therefore, a
corresponding resolution has also been prepared for this Commission
to finalize the abandonment.

Abandonment of utility easement
NATURE OF REQUEST
Deborah L, Bizzark~ agent for Mary Miller, trustee of the Louis
Schnitzer trust, property owner, is requesting abandonment of a
portion of a 5 foot wide platted utility easement at 2000 S.W. Golf
Lane. The property is located in an R-1-AA, single-Family
Residential, zoning district. Attached is Exhibit "A" - location
map and Exhibl t liB" - legal descriptlon and survey of proposed
abandonment.
BACKGROUND
The existing home at 2000 S.W. Golf Lane encroaches a portion of
the referenced utill ty easement. The applicant states that the
encroachment occurred when the developer built the house in 1976.
The encroachment has existed approximately 19 years with no
problems reported to the city by any of the utility companies that
have rights to the easement. The utility easement was created when
the plat of Palm Beach V~isureville Section 5A was approved in
April of 1970. The subject address is Lot 12, Block 39 of this
recorded plat.
ANALYSIS
The requested abandonment has been submitted in order to allow the
closing on the sale of the property. The city's utility Department
has no objection to the abandonment. Of the utilities companies
notified of the abandonment, southern Bell was the only one to
indicate a concern and stated that they would not relocate their
lines if they were within the area to be abandoned. However, they
h.3.d no objection to the abandonment (see Exhibit "CII - letter from
Southern Bell) .
The city departments involved in review of .3. request for
abandonment and the utility companies notified of the request are
identified below. Public notice is given to the property owners
that abut the easement to be abandoned. The utility companies,
abutting property owners and the city department responses to the
abandonment request are identified below.
The applicant's reasons for filing this abandonment and the grounds
that support the request are included in the attached Exhibit liD".

RECOMMENDATION
staff recommends approval of the abandonment of that portion of the
utility easement shown and described on the attached Exhibit "B,"
including the comment from Southern Bell identified in Exhibit "C. II
This approval is also subject to the city commission's adoption of
the resolution finalizing the abandonment and recording same with
Palm Beach County.

Records of Palm Beach County, Florida. Said point being on
the arc of a curve concave Southwesterly, a radial bearing
at said point bears N 280 31' 41" E from the radius point;
thence Southeasterly along the arc of said curve having a
radius of 276.76 feet, a central angle of 40 04' 58" for an
arc distance of 19.72 feet to a point on the arc of said
curve; thence N 320 36' 39" E radial to the last described
curve, a distance of 3.70 feet to the Point of Beginning;

APPLICATION TO ABANDON/VACATE
The undersigned, pursuant to Ordinance No. 76-27 of the City
of Boynton Beach, Florida, hereby applies to the City Commission to
vacate, abandon and discontinue the special purpose easement as
described in attached Exhibit "A" and to renounce and disclaim any
right of the City and the public in and to any land in connection
therewith.
said application is to be filed with the Planning Department
in triplicate and applications involving more than one of the
nonfee interests shall be filed separately. Each application so
filed shall be complete in every respect. .
The undersigned hereby certify:
1. That a complete and accurate legal description with the
specific property interest sought to be vacated or abandoned,
including where possible a plat map or drawing showing the general
area and location involved, is set forth in Exhibit "A" attached
hereto.
2. That the title or interest of the City and the public in
and to the specific property interest described above was acquired
and is evidenced by dedication on the plat of PALM BEACH
LEISUREVILLE SECTION 5A, recorded in Plat Book 29, Page 34, of the
Public Records of Palm Beach County, Florida (a copy of which is
attached hereto as Exhibit "B").
3. That, to Affiant's knowledge, no similar application has
been considered by the City at any time within six (6) months of
the date hereof, and should this application be granted, such
abandonment and. vacation will prevent no other property owners from
access to and from their property and no other property owners in
the vicinity will be adversely. effected.

There is a contract pending for the sale and purchase of the
real property and improvements thereon located at 2000 S.W. Golf
Lane, Boynton Beach, Florida 33426. The Closing Date in the
contract was May 1, 1995, but the closing has been delayed due to
the encroachment of the existing home (built by the developer in
1976/1977) onto the public utility easement. In order for the
undersigned to convey marketable title of the real property and
improvements, that portion of the easement which is encroached upon
by the building and depicted on Exhibit nA" must be abandoned and
vacated by the City of Boynton Beach.

The 5 foot utility easement at the rear (southwest side) of 2000 SW
Golf Lane may not currently be in use. To abandon the entire
easement may compromise potential users, although Comcast Cable has
not objected to the abandonment. All other potential users have
not signed off to the best of my knowledge, including our own
Utility Department. Since the problem was caused by construction
of a residence encroaching into the easement, and since other
encroachments exist in the SE side yard drainage easement, perhaps
we should issue waivers for the encroachments and leave the
easements as they now exist. Do we really want to establish an
easement abandonment procedure in this development?
