Schnitzer Trust, in her capacity as owner of the above- referenced property. The improvements located at this address encroach onto a five (5') foot public utility easement at the rear of the property. Actually, as you can see from the survey attached hereto, the home constructed on the lot encroaches onto the easement. This situation creates a marketability of title problem for my client and therefore, she will not be able to sell her property without having that portion of the easement which is encroached upon by the building vacated or abandoned. The undersigned has made application to the City of Boynton Beach for the abandonment of a portion of this easement, and the City has requested that I contact the utility companies directly in order to expedite the process.
