This correspondence shall serve to confirm that the
undersigned represents Mary Miller, as Successor Trustee of the
Louis G. Schnitzer Trust, in her capacity as owner of the above-
referenced property.
The improvements located at this address encroach onto a five
(5') foot public utility easement at the rear of the property.
Actually, as you can see from the survey attached hereto, the home
constructed on the lot encroaches onto the easement. This
situation creates a marketability of title problem for my client
and therefore, she will not be able to sell her property without
having that portion of the easement which is encroached upon by the
building vacated or abandoned.
The undersigned has made application to the City of Boynton
Beach for the abandonment of a portion of this easement, and the
City has requested that I contact the utility companies directly in
order to expedite the process. Kindly review the enclosed survey
and then issue your confirmation/authorization letter to the City
of Boynton Beach or to the undersigned at your earliest
convenience.
In a few days, I will have a sketch and legal description of
the pertinent area of encroachment and will forward the same onto
you as soon as it is delivered to me.

APPLICATION TO ABANDON/VACATE
The undersigned, pursuant to Ordinance No. 76-27 of the City
of Boynton Beach, Florida, hereby applies to the City commission to
vacate, abandon and discontinue the special purpose easement as
described in attached Exhibit "A" and to renounce and disclaim any
right of the City and the public in and to any land in connection
therewith.
Said application is to be filed with the Planning Department
in triplicate and applications involving more than one of the

specific property interest sought to be vacated or abandoned,
including where possible a plat map or drawing showing the general
