We have reviewed the subject plans and recommend that the request be forwarded for Board
review with the understanding that all remaining comments will be shown in compliance on the
working drawings submitted for permits.
Buildin~ Division (Site Specific and Permit Comments) - Michael E. Haag (561) 742-6352
1. To determine what improvements are required to be made to the buildings, it is required
that the occupancy classification of the existing buildings be identified on the site plan or
floor plan drawing as well as the proposed occupancy classification. The occupancy
classifications shall be consistent with those specified in the Standard Building Code. If
there is a change of occupancy, the plans shall be amended to comply with applicable
regulations for the new occupancy as required by Chapter 34 of the Standard Building
Code. A change of occupancy requires certification be provided that verifies the existing
floor loads comply with the specifications of the new occupancy. Certification will be
required at time of permit review.
2. Show on the site plan no less than the required number of accessible parking spaces that
are required by the Florida Accessibility Code for Building Construction. The accessible
route from the accessible parking spaces to the building shall be no less than forty-four
(44) inches wide rather than the forty-two (42) inches that is indicated on the plans.
Amend the plans accordingly. Add to the floor plan drawing the width of the accessible
ramp. The accessible parking spaces and the path leading to the accessible building
entrance shall comply with the regulations specified in the Florida Accessibility Code for
Building Construction.
3. Indicate on the floor plan drawings submitted for permit how the elevation of the finish
floor of the north building was raised to match the elevation of the south building. The
areas of the site and building that are located on the required accessible path shall have
surface elevations that comply with the vertical clearance regulations specified in the
Florida Accessibility Code for Building Construction.

4. At time of permit review, identify on the site plan the setback dimensions from each
property line to the leading edge of both buildings. Add to the survey the setback
dimension from the east face of the building to the east property line.
5. The applicant did not provide detail drawings ofthe building signage. Therefore, add a
note to the elevation view drawing indicating that building signage is not approved and
separate site plan review is required for building signage.

We have reviewed the subject plans and offer the following comments that should be addressed
prior to the project being forwarded tor Board review:

I. To determine what improvements are required to be made to the facility and buildings
identify, on the site plan, the occupancy classification of the existing buildings. Also
specify, on the site plan, the occupancy classification that is proposed for the facility. The
existing and proposed occupancy shall be consistent with the occupancy classifications
specified in the Standard Building Code. If there is a change of occupancy the plans shall
be amended to comply with applicable regulations for the new occupancy as required by
Chapter 34 of the Standard Building Code. A change of occupancy requires certification be
provided that verifies the floor loads comply with the specifications of the new occupancy.
Certification will be required at time of permit review.
2. On the site plan clarify the location of the property lines by labeling a symbol that
represents a property line.
3. At time of permit review submit a recorded unity of title that combines all lots and parcels
as one lot. Find attached a copy of the City approved Unity of Title form.
4. Show on the site plan no less than the required number of accessible parking spaces as
required by the Florida Accessibility Code for Building Construction. On the site plan
label a symbol that represents the accessible route that is required from the accessible
parking spaces to the accessible building entrance. Identify the width of the route through
its entire length. Also, identify the slope and cross slope of the sidewalk located along the
route. Place a note on the site plan indicating that the accessible route between the
accessible parking spaces and the accessible entrance to the building is in compliance with
the Florida Accessibility Code for Building Construction.
5. Indicate on the floor plan the elevation of the finish floor of the building. A]so show the
contiguration and size of the finish surface that is proposed for the exterior of the building
at the accessible entrance. Specify the elevation of the surface. The size, configuration
and vertical clearance between the interior and exterior of the building shall comply with
the regulations specified in the Florida Accessibility Code for Building Construction.

6. Show and label on the site plan a symbol that represents the accessible path that leads to the
pool from the building. Also, show on the plan the method that will be used to allow
accessibility into the pool. Accessibility to and into the pool shall comply with the Florida
Accessibility Code for Building Construction.
7. At time of permit review identi(y, on the site plan, the setback dimensions from each
property line to the leading edge of both buildings. Add to the survey the setback
dimension from the southeast corner of the building to the east property line.
8. Add to the site plan the location of the proposed site sign or place a note on the site plan
indicating that site signage will not be provided. Where signage is proposed provide detail
drawings of the signage. The signage shall comply with the applicable sign regulations
specified in the Sign Code, Chapter 21 of the Land Development Regulations. If the
applicant is not prepared to provide site signage details the following note shall be placed
on the site plan drawing: Site sign age not approved. Separate site plan review required for
site signage.
9. Add to the elevation view drawings the proposed building signage or place a note on the
elevation view drawing indicating that building signage will not be provided. Where
sign age is proposed provide detail drawings of the signage. The signage shall comply with
the applicable sign regulations specified in the Sign Code, Chapter 21 of the Land

These permits include, but are not limited to the following: site lighting, paving, drainage, curbing,
landscaping and irrigation. Permits required from other permitting agencies, such as FOOT, PBC,
SFWMO, OERM, LWDD, DEP and any others, shall be included with your permit request.
2. Provide sealed surveys for both sites that are not more than six months old with those requirements
specified in LDR Chapter 4, Section 7.A.
3. All plans shall be signed and sealed by the appropriate design professionals.
4. Driveway to be located 180' east of east R/W line of U.S. #1 or apply for a variance. [LOR Chapter 23,

1) All utilities easements shall be shown on the rectified landscaping drawings so that we may
determine which trees may interfere with utilities. In general, palm trees will be the only
tree species allowed within utility easements. Canopy trees may be planted outside of the
easement so that roots and branches will not impact those utilities within the easement in
the foreseeable future. LDR Sec. 7.5-18.1 gives public utilities the authority to remove any
trees that interfere with utility services, either in utility easements or public rights-of-way.
2) Fire flow test data will be required demonstrating the City Code requirement of 1500
g.p.m. as stated in LDR chap. 6, Art. , Sec. 16, or the requirement imposed by insurance
underwriters, whichever is greater. (see Sec. 26-16(a)).
3) Provide an engineer's written certification that drainage will conform to all rules of the City
and the South Florida Water Management District. (LDR Chap. 4, sec. 7F)

4) The rainfall amount for a 3-year, 24-hour storm should be on the order of 6 inches, not 2.5
inches, for this area. Please use this value in your calculations submitted for drainage
permit.
5) Neither NE 12th Avenue, nor NE 10th Avenue have well-developed drainage systems. This
project may have to retain up to the 25-year storm on-site, or discharge to the US 1
drainage system after obtaining Florida DOT permission.
6) The ex filtration trench sizes seem to be too small. Please be prepared to fully justify your
calculations when applying for a drainage permit. You will need firm documentation of
exfi1tration testing to support your calculations.

CONDITIONAL USE APPROVAL-STANDARDS FOR EVALUATION
In evaluating an application for conditional use, the board and commission shall coh$ider the
effect of the proposed use on the general health, safety and welfare of the community.
Provide written comments certifying that satisfactory provision has been made concerning tt'le
following standards, where applicable:
1. Ingress and egress to the sUbject property and proposed structures thereon. With
particular reference to automobile and pedestrian safety and convenience, traffic
flow and control, and access In case of fire or catastrophe.
2. Off-street parking and loading areas where required. with particular attention to the
items in subsection 0.1. above, and the economic, glare, noise. and odor effects
the conditional use will have on adjacent and nearby properties, and the elty 8S a
whole.
3. Refuse and service areas, with particular reference to the Items in subsection 0.1.
and 0,2. above.
4. Utilities, with reference to locations, availability, and compatlb1l1ty.
5. Screening, buffering and landscaping with reference to type; dimensions. and
character.

11. Conformance to the standards and requirements which apply to site plans, as s,et
forth in Chapter 4 of the City of Boynton Beach Land DeVelopment Regulations.
12. Compliance with. and abatement of nuisances and hazards in accordance with the
performance standards, Section 4.N of Chapter 2; also, conformanoe to the City of
Boynton Beach Noise Control Ordinance, Chapter 15, Section 15.8 of the Boynton
Beach Code of Ordinances.

CONTENTS OF THE CONDITIONAL USE APPLTC~rON
II. CO~TENTS Of THE CONDITIONAL USE ~PPLICATION. Application for
conditional use shall contain two (2) copies of the following
items:
a. Statement of the applicant's interest in ~he property to be
peveloped, including a copy of the la~t recorded Warranty
Deed, and a certificate from an attorney-at~law or a title
insurance comp~y certifying who the ourrent fee simple
title holders of record of the subjedt property are, and the
nature and extent of their intere~t ther~in, and
1. If joint and several ownership, a written consent eo
the development proposal by all owners of reeord, or
2. If a contract purchase, a dOpy of the purchase dontract
and written consent of the seller/owner, or
3. If an authorized ag~nt, a copy of the ageney agreement
and written consent of the principal/owner, or
4. If a lessee, a copy of the lease agreement and written
consent of the owner, or
s. If a corporation or other business entity, the name of
the officer or per~on responsihle for the application,
and written proof that said representatives have the
delegated authority to represent the corporation or
other business entity, or in lieu thereof, writtAn
proof that he is in fact an officer of the ~orporation.
b. Legal survey, prepared by a surveyor registered in the S~ate
of Florida, showing an accurate legal description of the
subject property, and the total acrea~e comput~d to the
nearest one-hundredth (l/~OO) of an acre (theSe two aurvey~

requires the disposal of wet garbage, a ten foot by ten
foot (10' x 10') concrete slab shall be provided. All
dumpsters must be screened and landscaped in accordance
with the City Landscape Code (see see. 7.5-35(i)). A
minimum 10 foot wide opening is required for dumpster
enclosures.

En"ironmentally Sensitive Lands ordinance is
required, an Application for Alteration of
Environmentally Sensitive Lands (Environmentally
Impact Study) must be submitted to the Palm Beach
County Department of Environmental Resources
Management (copy to City) prior to or concurrent
with the submittal of the site plan to the city.
28. Submit a traffic impace analygis for the proposed
use. The analysis shall comply with the Palm Dea~h
County Traffic Performance standards Ordinanoe.
Six (6) copies of tbe analysis shall be submitted
with all conditional use applieations.

b. A transparency of the site plan (maximum size of.
8-1/2" x 11."). At the discretion of the
applicant, the Planning Department will pr$pare
transparencies f~om th~ site plan do~ument.
However, the Planning Oepartment will not be
responsible for poor quality transparencies which
result from the submission of poor quality site
plan blueprints, and poor quality transparencies
will not be presented to the Planning and
Development Board or City Commission.
c. Colored photographs of surrounding buildings

Dear Mr. Ruhl:
Nutting Engineers of Florida, Inc. has performed one exfiltration test for the proposed
drainage improvements at Lot 15 in Boynton Beach, Florida This report presents a brief
description of the field procedures, and provides the results of the exfiltration test.
One exfiltration test was conducted at the site and was located by representatives of Gator
Engineering Services, Inc. This test was conducted to a depth of six feet below existing
grade in accordance with South Florida Water Management District (SFWMD) criteria for
'Usual Open-Hole' conditions.
Prior to starting each test, an 8-inch diameter hole was augered to the test depth to
determine the depth to groundwater and to examine subgrade soils. After establishing the
above parameters, the hole was stabilized by a full-length perforated PVC pipe in
accordance with South Florida Water Management District specifications. Water was
then pumped into the hole maintaining a constant water level at the ground surface. The
stabilized flow rates were recorded in one minute intervals for a total of 10 minutes.
The exfiltration test revealed a hydraulic conductivity ('K'-value) of3.9X 10-3 cfs/ft2 - ft
of head. Soil descriptions and flow rates for the test are shown on the attached
exfiltration summary sheet. We note that the water table was below a depth of six feet at
the time of the test.
