WIDE ALLEYWAY, (LAKESIDE ADDmON) LYING
WESTERLY OF AND ADJACENT TO LOTS 12, 13,
14 , 15 AND 16, BLOCK 1 OF THE LAKE ADDmON
SUBDIVISION; BEING MORE PARTICULARLY
DESCRIBED HEREIN; AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE A DISCLAIMER
FOR SAID ABANDONMENT; PROVIDING THAT
THE ATTACHED DISCLAIMER BE RECORDED IN
THE PUBLIC RECORDS OF PALM BEACH COUNTY;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Rosa A. Bauer, Trustee for the property located at 811
North Federal Highway is requesting abandonment of a 20.18 foot wide alleyway
(Lakeside Addition), lying westerly of and adjacent to Lots 12, 13, 14, 15 and 16,
Block 1 of the Lake Addition Subdivision; and
WHEREAS, comments have been solicited from the appropriate City
Departments, and public hearings have been held before the City's Planning and
Development Board and the City Commission on the proposed abandonment;
and
WHEREAS, it has been determined that said alleyway to be abandoned
no longer serve any useful purpose.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1. The City Commission of the City of Boynton Beach, Florida
by and through its City Commission, does hereby abandon and vacate a 20.1S
foot wide alleyway (Lake Addition Subdivision) more particularly described as
follows:
20.18 foot wide alleyway lying westerly of and adjacent to lots 12, 13, 14,
15, and 16, less the east 17 feet of lots, Block 1 of the Lake Addition, (
subdivision of Boynton Beach, according to the plat thereof on file in the office 01
the Clerk of the Circuit Court, in and for Palm Beach County, Florida in Book 11
Page 71 of the Public Records of Palm Beach County, Florida.
Section 2. The Mayor and City Clerk are hereby authorized and clirectec

to execute and deliver the attached Disclaimer and cause the same to be filed ir
the Public Records of Palm Beach County, Florida.
Section 3. This Ordinance shall take effect immediately upon passage.

1. The dumpster enclosure at the site must be 10 feet by 10 feet
(inside measurements). The gate poles, as shown on the
drawings, reduce the width to less than 10 feet.

3. A reservation fee of $790.02 is due within thirty (30) days of City .

engineer, to insure the existing equipment will handle the
additional flows.

easement. Remove the sign from the easement or prior to
issuance of the sign permit, obtain a release letter from FPL

15. Nurseri. in a church require plans to be processed and approved
as conditional use applications, Eliminate the depiction of Nursery
from the floor plan, or, if the use is not intended to meet the
definition of the Nursery School and/or Preschool Facility, provide
more specific information regarding this use and rename the
space appropriately (LOR, Chapter 2 - Zoning, Section 5.G.1.a and
Section 5,F.1.c),
16. It is recommended that the proposed Cypress mulch be replaced
with another kind of mulch. such asMelaleuca Eucalyptus etc,
17. The submitted traffic statement shall be approved by the Palm
Beach County Division prior to issuance of the buildino permit.

architectural site plan with respect to the location, size and

20, The proposed free-standing sign shall be placed a minimum of 10
feet from the front property line. The sign setback is only five (5)
feet from the front property line. Relocate the sign to an
alternative location that complies with the minimum setback
provision of the Chaeter 21, Article III, Section 5 of the City's LOR.
21, Any roof top equipment shall be screened from view at a distance
of 600 feet. If such equipment is planned, indicate its location and
the height of the equipment above the roof level. Provide
elevations of the structure showing the roof top equipment and the
required screening (all reduced to a small scale) and draw in on

the equipment with eye level from a distance of 600 hundred feet
from the buildina (LOR, Chapter 9, Section 11.El.
22. City's Land Development Regulations, Chapter 7,5. Article II,
Section 5.E requires that vehicular use areas be screened with a
perimeter hedge not less than four (4) and no more than six (6)
feet in height. This provision is further modified in Section 5. E,2
allowing the on-site perimeter landscape hedge requirement to be
waived when the subject vehicular use area abuts an existing
hedge meeting all applicable city standards located on adjacent
properties. The submitted Landscape Plan indicates that such
hedge exists along the western, southern, and eastern property
lines. This hedge is depicted as Ficus Benjamina which is a non-
native Florida specie. Provide an additional on-site perimeter
:ledge to meet the native requirement of fifty percent of the
required landscape plantina (Comprehensive Plan. Policy 4.4.6).
23. On the Landscape Plan provide a tabular summary of the planting
material to include a "landscape material required by the code"
category. Also, provide relevant calculations for this category, For
the landscape buffer adjacent to the right-of way and along
abutting properties, provide perimeter distances of the parcel for
which the landscape buffer hedge material is being calculated
(Chapter 7.5 Article 11- Landscape Codel.
24. Incorporate the above calculation into the tabulation of the
landscape material provided for the site. All native species shall
be distinguished from non-native species with a recognizable
symbol,

standards as described in LOR, Chapter 9, Section 10.C, and

issued until the subdivision plat is approved by the City

Donald Bryan. of Bryan & Associates. represented the owner. He advised that the only
comment in Exhibit "C" requiring clarification is Comment #27 which deals with the platting
issue. Mr. Bryan advised that his client was unaware that platting would be required.
According to staff, there is a question about whether the property has been diVided more than
two times
Mr. Lewicki explained that when the tax map was researched, it was determined that Lot 53
was already split into four separate parcels. Our Code requires that when any property is split
into more than three lots, a plat must be submitted for City review, This process is bemg
omitted very often, and the City ends up with non-conforming lots that require variances in the
future. That problem will not present itself in this case, but staff would like to begin enforcing
this requirement. The applicant can either submit a subdivision plat for the City to review, or
request a waiver from this requirement since the split will be a very simple land subdivision.
Mr. Bryan explained that the platting process is a four to six month process. His client is hopin~
to submit drawings to the Building Department within the next 30 to 45 days. The client has a
financial commitment that must be met on this land by the end of July, They could lose the land
if they must go through the platting process,
Ms. Heyden explained that the timing of the platting process is driven by the applicant. The City
has a very quick platting process that can be accomplished in Mr. Bryan's time frame. The
process has been condensed to one step and can be accomplished within 30 days. The
applicant will not incur any additional impact fees.
The client accepted this condition,
Mr. Aguila pointed out that Cypress mulch is not to be used, and the Planning & Development
Board wants to see the signage at a future date, The applicant had no objection to these
recommendations.

use is consistent with the overall plan of the Park. He requested clarification on Comment #23.
Mr. Lewicki explained that the plan indicates one loading zoning and three leased areas, Staff's
recommendation is that each area have a separate loading zone, or a note is to be placed on
the site plan indicating that the other uses will not require loading zones.
Mr. Butters agreed with all of the comments contained in Exhibit "C". Mr. Butters also added
that the applicant will commit to including another window or some form of glass on the exterior
glass.
Mr. Myott questioned whether a planter system is proposed along the north elevation. Mr.
Butters responded negatively, but advised that there will be plantings underneath the Royal
Palm trees.
Mr. Aguila requested that this board review the individual signage when the second and third
tenants come into the building. He wants to make certain there is conformity.
Vice Chairman Golden referred to Item #15 on Page 10, He clarified that this should read PID
district rather than PCD district,

Vice Chairman Golden moved to recommend approval of the site plan for the Sun-Sentinel
Distribution Facility to construct a 22,791 square foot distribution facility on 1,52 acres of land at
Lot 46A in Quantum Park PID, subject to staff comments. Mr. Rosenstock seconded the
motion which carried unanimously,
