The Department has completed its review of the Comprehensive
Plan amendments (Amendment 90-2 and 90-S1) for the City of Boynton
Beach, as adopted on December 18, 1990, and determined that they
meet the requirements of Chapter 163, Part II, Florida statutes,
for compliance, as defined in Sub-section 163.3184(1) (b). Amendment
90-2 includes the stipulated Settlement Agreement amendments. The
Department is issuing a Notice of Intent to find the Plan Amendments
In Compliance. The Notice of Intent has been sent to the Palm
Beach Post for publication on February 9, 1991.
Please note that a copy of the City of Boynton Beach
Comprehensive Plan Amendments, the Department's Objections,
Recommendations and Comments Report of October 22, 1990 and
the Notice of Intent must be available for public inspection
Monday through Friday, except for legal holidays, during normal
business hours, at the City hall, Planning Department, 100 E.
Boynton Beach Boulevard, Boynton Beach, Florida 33435.
The Department appreciates your City's effort to prepare and
adopt these Comprehensive Plan Amendments to guide the growth and
development of your community and further the growth management
policies of the region and state. Very soon, the Department's
attorneys, in conjunction with your attorney, will be filing a
motion for the hearing officer to relinquish jurisdiction over
your Plan, as amended, so the Administration Commission can enter
an order finding your plan as amended "in compliance."

CITY OF BOYNTON BEACH
COMPREHENSIVE PLAN AMENDMENTS IN COMPLIANCE
DOCKET NO. 90-2-NOI-5005-(A)-(I)
The Department gives notice of its intent to find the
amendment(s) to the Comprehensive Plan for City of Boynton Beach,
adopted by Ordinance Nos. 090-69, 090-72, 090-74, 090-60, 090-66,
090-76, 090-78 and 090-58 on December 18, 1990, IN COMPLIANCE,
pursuant to Sections 163.3184 and 163.3187, F.S.
The adopted City of Boynton Beach Comprehensive Plan
amendments and the Department's Objections, Recommendations, and
Comments Report, are available for public inspection Monday
through Friday, except for legal holidays, during normal business
hours, at the City Hall, Planning Department, 100 East Boynton
Beach Boulevard, Boynton Beach, Florida 33435.
Any affected person, as defined in Section 163.3184, F.S.,
has a right to petition for an administrative hearing to chal-
lenge the proposed agency determination that the amendment(s) to
the City of Boynton Beach Comprehensive Plan are in compliance,
as defined in Subsection 163.3184(1), F.S. The petition must be
filed within twenty-one (21) days after publication of this
notice, and must include all of the information and contents
described in Rule 9J-11.012(8), F.A.C. The petition shall be
filed with the Agency Clerk, Department of Community Affairs,
2740 Centerview Drive, Tallahassee, Florida 32399-2100. Failure
to timely file a petition shall constitute a waiver of any right
to request an administrative proceeding as a petitioner under
Section 120.57, F.S. If a petition is filed, the purpose o~ the
administrative hearing will be to present evidence and testimony
and forward a recommended order to the Department. If no
petition is filed, this Notice of Intent shall become final
agency action.
If a petition is filed, other affected persons may petition
for leave to intervene in the proceeding. A petition for inter-
vention must be filed at least five (5) days before the final
hearing and must include all of the information and contents
described in Rule 221-6.010, F.A.C. A petition for leave to
intervene shall be filed at the Division of Administrative
Hearings, Department of Administration, 1230 Apalachee Parkway,
Tallahassee, Florida 32399-1550. Failure to petition to inter-
vene within the allowed time frame constitutes a waiver of any
right such a person has to request a hearing under Section
120.57, F.S., or to participate in the administrative hearing.

This letter is in response to your letter of September 6,
1990 regarding the proposed Knuth Road and Boynton Beach
Boulevard Planned Commercial Development amendments to the
Boynton Beach Comprehensive Plan. The plan amendments change the
land use designations for these parcels of land from
"Agricultural Residential" to "Planned Commercial Development".
The proposed plan amendments were submitted to the Department
on July 10, 1990, after the City of Boynton Beach received local
input through required citizen participation procedures. Staff
is currently reviewing the proposed plan amendments in accordance
with the requirements of Chapter 163, Florida Statutes, and
Chapters 9J-5 and 9J-11, Florida Administrative Code. In
addition, the proposed plan amendments have been sent to nine
other state and regional agencies for their review. As a part of
this review, the Department will determine if the data and
analysis presented with the proposed plan amendments support the
commercial land use classification. The review will also
determine if the proposed plan amendment is consistent with the
data, analysis, objectives and policies with all elements of the
adopted plan. If the data and analysis do not support the
proposed land use classification, or if the proposed amendments
are not consistent with the objectives and policies, the
Department will cite this as an objection. The Department will
send its Objections, Recommendations "and Comments Report, which
includes comments received from the oth~~~~d regional
agencies, to the City of Boynton Beach ~'~~990. The

recommendations and comments and amend the proposed plan
amendments.
Upon receipt of the Department's objections, Recommendations
and Comments Report, the City of Boynton Beach will have 60 days
to officially adopt the plan amendments or adopt the plan
amendments with changes. After adoption, the City of Boynton
Beach will submit the adopted plan amendments to the Department
for review and the Department will then issue a Notice of Intent
to find the plan amendments either in compliance or not in
compliance. As you can see there are a number of steps yet to go
in the plan amendment adoption process.

Recently, I had the opportunity to speak with Ralph Hook,
Planning Coordinator for the Department of Community Affairs
in Tallahassee. He advised me that the approval of the
amendment for the Knuth Road property would be within ninety
days (by June 9). In all probability, the approval will be
sooner, by the end of May. He also stated that the City of
Boynton Beach could proceed with the ordinance approval as long
as the second reading was not prior to their approval.
It would be appreciated if you could advise whether this
procedure could be followed on this project.

KNUTH ROAD PLANNED COMMERCIAL DEVELOPMENT
Requirements (g) and (h) of the Land Use Amendment/Rezoning
Application require a justification and a comparison of
impacts between existing zoning and proposed zoning.
Currently, the Comprehensive Plan of Boynton Beach designates
the north 300 feet of the site as Local Retail Commercial
with the remainder of the site as Residential Moderate
Density. The Palm Beach County Comprehensive Plan designates
the north one half of the property as CH (Commercial High)
and the south one half of the property as CR (Commercial
Recreation). The petitioner is requesting the entire site be
designated as Commercial Local Retail under the Boynton Beach
Comprehensive Plan.
This request is reasonable in that currently both the County
and the City Comprehensive Plans recognize that at least some
of the property should develop commercially. Additionally,
the property has been in single ownership for many years and
the owner has never intended to divide the site for multiple
uses. Finally, a Local Retail Commercial designation for the
property permits the entire property to develop within the
Planned Commercial Development zoning category.
The comparisons required in Requirement H. are as follows:
1. The current zoning (AR-Agricultural Residential) in the
County al lows for one dwelling unit per five acres which
would allow two homes to be built on the property.
Additionally, there is an approved Special Exception on
the site which would permit a recreation center
including a driving range and tennis club. This use is
Commercial in nature although permitted in the AR-
Agricultural Residential Zoning District.
The current City Comprehensive Plan designates 4.11
acres of the site as Local Commercial Retail which could
easily accommodate a lot coverage of 20% or 36,764
square feet of retail space. Additionally, the balance
of the site permits Moderate Density Residential which
would allow the construction of 70 units.
