information for your review and comment.
The information provided with this notice is very brief, but you may contact the
permitting agency directly for further information if needed in order for you to assess the
impacts of the proposed activities on your community.
If the proposed activities are not consistent with your comprehensive plan or other locally
adopted plans or regulations, or if you have any other comments, please submit them to
the permitting agency by the deadline date indicated in the attached materials. We would

submit them in writing to this office within 30 days of receipt of this notice.
This is also an opportunity for applicable State agencies to concur with or object to the
proposed project under the federal consistency provisions of the Coastal Zone
Management Act. Review must be in accordance with the procedures adopted by the
Interagency Management Committee on October 25, 1989. Findings of inconsistency
must describe how the project conflicts with your agency's statutory authorities in the
Florida Coastal Management Program and provide alternative measures, if any, which
would make the project consistent. Commenting agencies must provide a copy of all
consistency comment letters to the Florida Coastal Management Program Director.

Dear Ms. Conmy:
Attached is a permit application for the referenced project. The proposed scope of work
consists of renovating an existing docking facility including replacing damaged timber
piles, cross bracing, stringers, and decking. This work is being done to repair an unsafe
condition and provide adequate mooring for small boats.
No additional square footage will be constructed. No additional slips will be created. All
proposed work will be within the established limits of the existing land lease. For your
use we have included a drawing showing the limits of our work, and the limits of the
existing land lease (8 ~" x 11") with each application package as well as one copy
(24" x 36") for clarity. Copies of the originalland lease information are also included.

A SPECIAL PURPOSE AND A UTILITY EASEMENT,
(LOCATED AT 1632 NORTH FEDERAL HIGHWAY);
SAID PROPERTY BEING MORE PARTICULARLY
DESCRIBED HEREIN; AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE A DISCLAIMER FOR
SAID ABANDONMENT; PROVIDING THAT THE
ATTACHED DISCLAIMER BE RECORDED IN THE
PUBLIC RECORDS OF PALM BEACH COUNTY,
FLORIDA; P:10VIDING FOR CONFUCTS,
SEVERABILnY AND AN EFFEcnYE DATE.
WHEREAS, the applicant, Jan C Hansen, AICP, agent for Olen Residential
Realty Company, property owner, has requested abandonment of a speci'a1
purpose and a utility easement, located at 1632 North Federal Highway; and
WHEREAS, comments have been solicited from the appropriate City
;' Departments; and
, , WHEREAS, publiC hearings have been held before the City's Planning and
Zoning Board and the City Commission on the proposed abandonment; and
WHEREAS, based on the foregoing information, the said easements no
" longer serve any useful purpose.
. : . NOW, THEREFORE, BE IT ORDAINED BY THE CITY C~MMISSION
, OF THE CITY OF SOYNTON e~r.H, FLORIDA., THAT:
Section 1. The City Commission of the City of Boynton Beach, Fiorida
by and through its City Commission does hereby abandon a special purpose
easement and a utility easement, located at 1632 North Federal Highway, and
more particularly described in Exhibit "A", subject to Conditions included in
:' Exhibit "B" - Conditions of Approval, attached hereto and made a part hereof.
Section 2. The Mayor and City Clerk are hereby authorized and directed
to execute and deliver the attached Disclaimer and cause the same to be filed in

Section 3. All ordinances or parts of ordinances in conflict herewith be

ordinance.
Section 5. This ordinance shall become effective immediately upon

The Parks Division has reviewed the attached letter and plans from Olen Residential
Realty Corporation concerning the recreation fee for the Manatee Bay project.
Previously, this site was known as Banyan Cove Apartments. Also attached, is a copy of
Parks Memorandum #98-93, which included recreation comments.
Based on the most recent submittal, the Parks Division is recommending one-half credit
toward the recreation fee as follows:
180 dwelling units (multifamily) X .015 acres/d.u. = 2.7 acres including one-half credit
for private recreation. 2.7 acres divided by 2 = 1.35 acres required.
This division recommends fee in lieu of land. The Department of Development has
determined the value of the land to be $229,865.00. ($170,270.37/acre X 1.35 acres).
Since plating of this project is optional, collection of the recreation fee will occur before
the issuance of building permits.
