Mr. Livingston:
The City of Boynton Beach has completed its first review of the
site plan for the above referenced project. Attached are comments
made by the reviewing departments during their initial review of
your project.
In order to complete the review process, the site plan and
documents must be amended to comply with these comments within 90
days of the date of this letter. (If amended plans are not
submitted in 90 days, a new application fee will be required.) When
there are comments made by the reviewers that you feel are not
applicable to the approval of the proj ect or will be addressed
separately and you have not amended the plans to comply with the
comment(s), you must prepare written explanation for each comment
stating why the comment is not applicable and return the
explanation with the amended plans and documents.
After amending the plans and documents, please submit twelve (12)
complete sets of the plans to the Planning and Zoning Department.
When the amended plans and documents have been submitted to the
Planning and Zoning Department, they will be distributed to the
reviewing departments for a second review and the reviewers will
recommend if the site plan will be placed on a board approval
schedule (see attached). If there are major comments not addressed
by new plans or the reviewers recommend that the plan not be
forwarded to the Planning and Development Board, this office will
notify you on your alternatives regarding the site plan as soon as
possible.

changes that were made as a result of amending the plans and documents
to comply with the code of ordinances and the Technical Review committee
comments. A copy of the original form with a distinguishable symbol
identifying the change(s) may be submitted or a completed new form with
the changes identified. It is the agent of the owners responsibility to
notify the owner(s) of changes. If there are no changes required to be
documented on the application form, a letter from the applicant stating
same must be turned in with the amended submittal.

SUBMITTAL REQUIREMENTS
The following shall be incorporated as part of the submittal of
amended plans and/or documents for review
1.
Submit a scaled locator map that identifies the location and
perimeter boundary of the site and the surrounding roads and
current zoning districts including the district of the subject
property. The map shall show and identify by name the roads
surrounding the site and the roadway path that links the site
to the closest arterial road with the names of the roads and
arterial road(s) identified. The map shall show the zoning
district line and the title of the zoning districts that abut
the perimeter of the zoning district where the subject
property is located. The map shall have the North compass
direction and scale identified. Maximum size of locator map is
8 1/211 by 1411.
Submit color photographs of the buildings on the site that are
to remain in their existing condition and photos of existing
buildings that are located on the sites that abut the
perimeter of the subject property. The minimum size is 811 by
1011. Each photograph shall be labeled to identify the location
of the existing structures with respect to the location of the
proposed project.
Submit a 8-1/211 x 1111 transparency of the landscape site plan
drawing to be used on an overhead projector at board meetings.

Submit colored elevation view drawings - a colored duplicate
copy of all drawings of the elevation views of each side of
all buildings and signage associated with the project. The
colored elevation views shall match the elevations shown in
the documents that where submitted for site plan review. The
applicable exterior surfaces as identified above shall be
colored with the color name and associated color reference
number identified. The type of exterior surface material shall
be identified next to the associated color. The colored
elevation drawings shall have compass direction or title of
the side of the building identified. The title block of the
original drawing shall be shown. The maximum size is 2411 by
3611. Do no submit on board of any kind.
Submit color samples as an example of the proposed colors.
Each sample shall have attached a label that identifies the
color by name and numerical/letter code from an established
color chart.
Where a specific exterior surface is not applicable to the
project, signify by placing a IIN/AII on the appropriate line.
Submit a copy of the legal description of the subject property
on an 8 1/211 by 1111 sheet of paper.

The following comments are in response to the submittal of the site
plan for the above referenced project. The comments for the project
will be discussed at the March 11, 1993, Technical Review Committee
meeting. The site plan was reviewed for consistency with the review
standards specified in section 8 of Chapter 4, site Plan Review,
Part III, Land Development Regulations of the Code of ordinances.
The applicant shall amend the drawings and documents to show
compliance with the following comments:
1. Provide written documentation for Florida Department of
Transportation that verifies the location of the proposed
entrance driveway is not in conflict with the bridge right-of-
way.
2. Transfer all information listed on the separate sheet titled
site data to the site plan drawing.
3. On the second floor floor plan drawing identify what the
circular and rectangular shaped objects are that are shown in
the area designated dining 72 seats.
4. There are inconsistencies with respect to the number of seats
shown on the second floor plan drawing and the number of seats
identified on the site Plan Review application, site data and
building data. Correct all inconsistencies.
5. Amend the parking calculations to specify the correct number
of required parking spaces as specified in the Zoning Code.
(See attached requirements)
6. On the site plan and drainage plan specify and show plan the
total number of required and provided handicapped parking
spaces.
7. Provide data on the plan that verifies that the overall height
of the structure does not exceed the City approved forty-five
(45) foot height limitation. The overall height of the
building is based on the distance the peak of the building is
above the finished grade. (Find attached the definition of
finished grade)
8. Incorporate into the drawings the proposed building and site
signage. Show and specify on the plan the location, size,
material and color of the proposed signage. Note: The signage
shall be consistent with the specification listed in the sign
Code and central Business District Guidelines.
9. On the elevation view drawing, correct the notation
referencing the location of the gray tinted glass and specify
the color of the pipe and guywire railing.
10. Amend the east and north elevation view drawing to depict the
proj ect as shown on the second floor plan and roof plan
drawings.

11. The color of the standing seam metal roofing is not listed as
a permitted color. Change the color or request an appeal to
allow the light green color be an acceptable color. (Find
attached the appeal procedures)
12. The intent of the development of the Central Business District
is to create a pedestrian system. On the site plan, landscape
plan and paving and drainage drawings show and identify the
location, size and type of material proposed for an on-site
sidewalk that links the on-site parking areas to the building
and an on-site sidewalk that begins at the driveway entrance
to the site and terminates at the entrance to the building.
The sidewalk shall be positioned where free unobstructed
movement is created, with little or no interference, where
pedestrian traffic crosses vehicle traffic. Where the driveway
entrance to the site intersects Boynton Beach Boulevard,
create an entrance treatment and cross walk as described in
the Central Business District Guidelines.
13. Find attached a copy of the applicable sections of central
Business District Landscape code and Design Guidelines. Amend
the landscape plans to show compliance with the required
improvements specified in the Landscape Code and Design
Guidelines. Prior to a project being forwarded through the
approval process the landscape plan shall meet the
requirements of the code.
14. show on the landscape plan the figures and calculations that
show how the landscape material proposed for the site meets
the landscaping requirements specified in the code.
15. On the landscape plan show the location and specify the type
of fixture and illumination standard that is proposed for the
required pedestrian lighting. The lighting shall be consistent
with the central Business District Landscape code and Design
Guidelines.
16. On the landscape plan show the location and specify the type
of lighting pole/fixture that is proposed for the required
si te lighting. The lighting shall be consistent with the
central Business District Landscape Code and Design
Guidelines.
17. To avoid a conflict with the location of site amenities show
on the landscape plan the location of the site and pedestrian
light poles, drainage structures and exterior furnishings.
18. On the site plan show a three (3) foot wide landscape strip
west of the west parking area.
19. With a distinguishable symbol, identify the native specie
landscape material shown on the landscape plan and plant
legend. Note: 50% of all required hedge landscape material
shall be a native specie. show on the landscape plans the
figures and calculations that indicate how the material
proposed for the site meets the native specie requirement and
delineate on the plan where said required landscaping is
provided.
20. Show on the landscape plan the line-of-sight rectangles that
are required at the driveway entrance to the site. place a
note on the plan next to the line-of-sight areas that describe
the following: landscape material placed within the line-of-
sight area shall be installed and maintained to form a clear
and unobstructed space between thirty (30) inches and six (6)
feet above the elevation of the driveway.

21. with a distinguishable symbol, identify the specie, location,
form of installation and type of irrigation for the required
lawn grass.
22. Place a note on the landscape plan that includes the following
text: All planted areas and trees shall be irrigated by an
automatic irrigation water supply system, which shall be
maintained in good working condition.
23. On the drainage plan and/or site plan drawing show with a
distinguishable symbol the location of the required curbing.
See the attached section of the code regarding the required
location of curbing.
24. On the site plan, landscape plan and paving and drainage
drawings show and identify the location and size of the on-
site service area where supplies and/or merchandise will be
delivered and tendered to the restaurant. Note: All service
areas shall be screened as described in the attached Central
Business District Landscape Code. Also, the service area shall
be identified as permanently maintained, have a twelve (12)
foot width, thirty-five (35) length and a fourteen (14) foot
clear height. The area shall be located where it will not
obstruct pedestrian sidewalks, parking spaces and traffic
circulation aisles or driveways.
25. On the site plan, landscape plan and elevation view drawings
show and identify where the mechanical equipment will be
located. Also, indicate the location, color type of material
and size of the visual barrier that is required to screen the
equipment.

Sec. 7.5-57. Central business dJstrict landscape requirements.
Development in the central business district shall conform to
these minimum landscape requirements, and where possible shall
~ conform with recommendations of the central business district
design guidelines.
(1) Landscaped areas:
a. Perimeter strip landscaping. Landscape strips with
landscaping material are required to be located within
the property line along the entire perimeter of park-
ing and vehicular use areas, and shall meet the follow-
ing minimum requirements:
1. Landscape perimeter strips shall be at least three
(3) feet wide.
2. Living plant materials shall cover at least sev.
enty (70) per cent of the required landscaped area,
and shall include trees, shrubs, and ground cover,
but not lawn grass.
3. Trees are required at the rate of one (1) per thirty
(30) linear feet of perimeter strip, and may be
either grouped or unifonnly spaced. Trees required
may be planted a maximum of twelve (12) feet
from the property line.
4. Shrubs shall be planted eighteen (18) inches on
center in perimeter strips to fonn continuous screen
hedges. Hedges shall be allowed to grow and shall
be maintained at a height of two and one-half(2Y.z)
to three and one-half (3th) feet. Screen walls may
be installed in lieu of hedges.
5. Landscaped area edges adjacent to vehicular use
areas shall be protected by upright curbs or
wheelstops.

and for purposes of safety be obliged to conform to the laws of the

6. The applicant must be present at both PUDi1C meetings.

(e) Curbs and Car stops. No more than, two (2) access aisles
may be traversed without interruptiC?n which shall be ac-
complished by the placement of wheel stops or the installa-
tion of a r8tised, continuous curb. Landscaped areas in
parking lots shall be protected from the encroachment of
vehicles by a continuous. raised curb, or in the instance of
a parking stall, by a wheel stop or a raised continuous
curb. Areas to be protected include all lambcaped islands,
landscaping adjacent to parking stalls, and landscaping
adjacent to curvilinear driveways where encroachment is
likely to occur. Curb design shall comply with city standards.

Staff has reviewed the plan and offer the following comments:
1. Entry into the existing manhole must be accomplished by
construction of an outside drop. A private lift
station and force main with 4" inside drop would be
considered an acceptable option.
2. Water service must be extended from NE 6th Court.
Developer is instructed to contact Mr. Mike Kazunas,
with the Utility Department, for details,
3. The developer shall perform field investigations and
fire flow calculations to verify availability of
1500 gpm at 20 psi residual fire protection (Art. X,
Section 16 ,B).
4. Use of galvanized or black iron pipe is not
recommended.
5. Reduced pressure backflow prevention is required on

6, Double detector check valves are required on the fire

7. All utilities must be within easements or right of way

Your submittal for Site Plan Review for the above referenced
project has been reviewed for completeness. It has been determined
that the submittal is incomplete. Prior to further processing of
the submittal, the following deficiencies must be corrected and the
documents submitted for review as stated in Chapter 4, Site Plan
Review, Section 7, Submission Requirements:
Submit a traffic impact analysis. The traffic impact analysis
shall be prepared by a professional engineer competent in
traffic engineering.
