Cannon, Interim Planning Director FROM: RE: Lewis Day Care Center ~ Conditional Use , Please place the referenced item on the city Commission agenda . for Tuesday, November 21, 1989 under Public Hearings: DESCRIPTION: Request submitted by Kimberly Dellastatious for conditional use and site plan approval for the Lewis Day Care Center. Property is located on the East side of N.E. 2nd Street, .between East Boynton Beach Boulevard and N.E. 6th Avenue. RECOMMENDATION: After conducting a public hearing, the planning and Zoning Board recommended approval of this request, subject to deleting all staff comments (see attached), with the exception of the comment concerning the provision of the fire hydrant and. the safety issue concerning the power lines which are located over the children's play area. Concerning the staff comments that were deleted, it should be noted that most of these' comments are code requirements, with the exception of the followin~: . 1. Police Department - comment #~ 2. Public Works memorandum 3. Community Improvement Memorandum (the code issues raised by the Community Improvement Director have been addressed in the staff comments by other members of the Technical Review Board). In addition to the above, the following comments can also be deleted as they relate to the parking lot variances which were approved by the Planning and Zoning Board: 1. Building Department - comment #5 2. Engineering Department - comments #1 and #3 3. Police Department - comment #4 Concerning provision of the drop-off area which is required pursuant to Section 11.H.16.c(4) of Appendix A-Zoning, the applicant had been informed by the Building Code Permit Administrator (AI Newbold), who is the Building Department's zoning representative, that the drop-off area shown between the row of parking spaces ~nd the public street meets the require- ments of the above-referenced section of the zoning ordinance. Based on the above, the following comments can also be deleted as they relate to the provision of the drop-off area: 1. Building Department - comment #1 2.
