Dear Mr. Ware:
I have reviewed your application for removal of all wheel stops at Meadows Square Shopping
Center and the corresponding out parcels, and I have determined it as a minor site plan
modification.
This letter serves as approval of your application under two (2) conditions. One, is to comply
with the upgrades suggested by Mr. Ken Hall, Plans Check Inspector for the City of Boynton
Beach, and outlined in your letter to me dated October 12, 1999; and the other one is to secure a
building permit for the wheel stop removal according to Building Division guidelines.

Dear Mr. Rumpf:
Thank you for the courtesy extended to Mr. Jim Sellen and myself on the 8th regarding
the above referenced matter. Enclosed, please find the following:
1) Four (4) outlined site plans depicting the existing parking lot configuration
2) Information regarding accident claims directly associated with the existing car
stops
As a follow-up to our meeting on the 8th, I respectfully request the following for your
review and approval:
A) The removal of all car stops located within the demised property. This
includes all "field", side and rear stops.
B) Per your request, as a secondary choice, the removal of all car stops depicted in
yellow; leaving only those car stops outlined in orange.
As you can see by the enclosed documentation, we have fought this very expensive
liability for a long time. Not only with the claims, but also the constant cost of labor
and material to repair and replace the car stops as they become fractured and/or
broken. We take life-safety issues very seriously at Benderson Development as we
want both our tenants and their patrons to have a pleasant and safe shopping
experience.

We are happy to include the following upgrades per the suggestion of Mr. Ken Hall,
Plans Check Inspector for the City of Boynton Beach:
A) Replace the stop signs with "Yield for Pedestrians" in front ofPublix for both
directions.
B) Restripe directional arrows in all driveways with a "Stop Bar" at the proper
locations
C) Add "$250.00 Fine" on all handicap poles below handicap signs.
D) Add "Right Turn Only" at the exit unto Hypoloxo Road.
I hope you and your staff review this in the same scope as the recent WalMart request
due to the size, nature and amount of car stops.

Dear Mike:
In follow up to our phone conversation concerning Meadow Square, the following is a list
of all alleged claims involving the concrete car stops;
1. Nancy Brown alleges that on 2/12/98 she fell over broken car stop. The Browns are
suing for an amount in excess of$15,000.
2. Robert Rohack alleges that on 5/4/98 he damaged his car on exposed rebar. The
amount of damage totaled $ 240.51
3. Jeri Meyers alleges that on 8/3/99 she damaged car on exposed rebar. Damages totaled
$710.62
4. Joseph Pino alleges that on 8/21/99 he da:m.aged his car on a car stop. His damages
were $603.14
5. Karl Ijams that on 9/3/99 he damaged his tire on exposed rebar. Cost ofms tire was
$100.68
6. Edgar Lewis that on 9/11/99 he damaged his car on exposed rebar. Estimate of repairs
were $190.92
7. Kevin Cleary alleges that on 9/17/99 his car was damaged on exposed rebar. His repair
bill totaled $253,00
[ have enclosed some photos evidencing the car stops and the alleged damage. The total
amount of property damage is $ 2,158.51. It is unclear at this time what the Brown claim
will cost, if anything. Should you have any additional questions please feel free to contact

explained to you, we are having a very difficult time with the existing car stops located
within our above referenced shopping center.
Enclosed please find our site plan outlining those car shops we respectfully wish to be
removed along with a check for $100.00 for your review process.
Please call me as soon as possible with your decision. As Jim explained to you, we are
constantly, (almost daily), fighting trip and fall, life safety, and automobile damage liability
due to the car stops being dislodged and broken.
