FL 33462 Dear Mr. Fauk: On August 11! 1992 the Planning and Development Board reviewed and approved your request for a master plan modification to reduce the rear setback within your development from 15 feet to 6 feet on the rear utility easement. The only condition placed on your approval was that you contact the private utility companies and verify with them that the reduction of the setbacks will cause a problem for them if they desire to use the existing utility easements. R94-/9 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, ABANDONING A PORTION OF A TEN (10) FOOT UTILITY EASEMENT (BAYTREE AT THE MEADOWS) ; SAID PROPERTY BEING MORE PARTICULARLY DESCRIBED HEREIN; AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A DISCLAIMER FOR A PORTION OF SAID UTILITY EASEMENT; PROVIDING THAT THE ATTACHED DISCLAIMER BE RECORDED IN THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA; PROVIDING AN EFFECTIVE DATE. WHEREAS, Ewing and Shirley, Inc., as Agent for Meadows 300 (Bay tree at the Meadow) has requested the abandonment of the north three (3') feet of the ten (10') foot utility easement hereinafter described; and WHEREAS, comments have been solicited appropriate City Departments; and from the WHEREAS, public hearings have been held before the City's Planning and Development Board and the City Commission on the proposed abandonment; and WHEREAS, based on the foregoing information, the said portion of the utility easement no longer serves any useful purpose, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA THAT: Section 1. The City Commission of the City of Boynton Beach, Florida by and through its City Commission, does hereby abandon a certain three foot portion of a ten (10') utility easement, located in the City of Boynton Beach, Florida and more particularly described in Exhibit "A" attached hereto. Section 2. The Mayor and City Clerk are hereby authorized and directed to execute and deliver the attached Disclaimer and cause the same to be filed in the Public Records of Palm Beach County, Florida.
