Bay tree is a planned Unit Development consisting of 66 single family homes in a zero lot 1 ine configuration. We are partitioning to amend the rear yard set back for those lots identified on the Master Plan enclosed herein more specifically known as lots 19 through 33. The homes within Bay tree have been completed by the developer, Hasco Development Corporation. Such an amendment would enable the single family homeowners of the specific lots to construct covered patios or florida rooms. We are requesting an amendment of the rear yard set back in the specified areas from fifteen feet to eight feet. Under the existing master plan approval homeowners are permitted to construct open air screened enclosures within eight feet of the rear yard property boundry. We base our justification for this request on the fact that Bay tree is a planned unit development in which such zoning flexabilities are permissible, and the unique nature of the land contiguous to the homes for which this petition is being made. Directly to the south property boundry of Bay tree is a hundred foot wide canal and an eighty foot road right of way. This in mind we feel that this request will benefit the residents of Boynton Beach that live in Bay tree. We do not for see any negative impact to the surrounding property. We hope that the Boynton Beach City Council will look favorable upon this request of the homeowners of Bay tree. Should there be any questions please feel free to contact me at your convenience. ANNUNZIATO, PLANNING DIRECTOR RE: MEADOWS 300 TRACT B "BAYTREE" MASTER PLAN MODIFICATION Donaldson E. Hearing, agent for the Bay tree Homeowners Association, has requested a modification to the previously approved master plan for Tract B "Bay tree" at the Meadows 300 Planned Unit Development. The modification requested is to amend the rear-yard setback from 15 feet to 8 feet for those units which abut the L.W.D.D. L-20 canal for the purpose of constructing screened porches or Florida rooms, as outlined in the attached correspondence. The procedure for approving master plan modifications in planned unit developments is twofold. First, the City commission must make a determination as to whether or not the changes requested are substantial in nature. A determination of substantial change on the part of the City Commission, which has sole discretion in this matter, would require a new application for PUD. On the other hand, a determination of no substantial change allows the forwarding of the request to the Planning and Zoning Board. The Plann~ng and Zoning Board then may approve the request. This procedure appears in Appendix B, Section 12 of the Code of Ordinances. With respect to the change requested by Mr. Hearing, the Technical Review Board (TRB) met on Tuesday, May 3, 1988, to review the plans submitted, and they offer for your consideration, a recommendation that the City Commission make a finding of no substantial change for the requested modification, and that the Planning and Zoning Board approve this request subject to the attached comments from the Building Department and the Planning Department. ~ (Z~ /l_ ~ CARMEN S.
