NATURE OF REOUEST
Kent W. Ewing, agent for the property owners of lots 23-30,
inclusive, within the Meadows 300 PUD, Block B, Plat 1 (Bay tree)
is requesting abandonment of a portion of a utility easement.
The subject utility easement is ten feet wide and runs along the
rear, or south side, of lots 23-30. The portion of the easement
requested for abandonment is the north three feet (see Exhibit
"A" for location map of lots 23-30 within Bay tree at The Meadows
300 PUD and Exhibit "B" for sketch of area to be abandoned).
BACKGROUND
The requested abandonment has been submitted to allow for the
continued existence of several concrete patios and screened
enclosures that were constructed within the utility easement.
The encroachment problem was detected when surveys were conducted
to meet real estate closing requirements. Abandonment provides a
remedy for the encroachment problem and allows clear title to be
transferred to future owners of the lots referenced. Also, a
master plan modification reducing the rear setback for lots 19-32
for screened rooms or Florida rooms was approved on June 14, 1988
as a partial remedy to the problem.
ANALYSIS
The attached responses (see Exhibit "CII) were received from the
City's utilities Department and the various utility companies
that have a potential interest in utility easements. As
indicated, no facilities are located within the requested three
feet wide portion of the ten feet wide easement.
RECOMMENDATION
staff recommends that the requested utility easement abandonment
be approved, unconditionally.

Please place the above-referenced item on the city Commission
agenda for January 18, 1994 under Public Hearing.
DESCRIPTION: This request is for abandonment of a three feet wide
portion of a ten feet wide utility easement on Lots 23-30,
inclusive, of the Meadows 300, Block B, Plat 1. currently on lot
24, 25, 27 and 28 there exist screened enclosures that were
constructed and permitted wi thin the utility easement. The
existing power lines have been moved to the southern seven feet of
the easement, therefore no facilities remain within the requested
three feet wide portion of the easement.
RECOMMENDATION: The Planning and Development Board unanimously
recommends approval of this request as submitted.

DESCRIPTION: Adoption of the attached resolution will finalize
the action taken by the City Commission at the January 18, 1994
City Commission meeting. At that meeting, the City Commission
approved the abandonment of a three feet wide portion of a ten
feet wide utility easement on Lots 23-30, inclusive, of the
Meadows 300, Block B, Plat 1. This abandonment was approved by
the City Commission with no conditions.
RECOMMENDATION: The Planning and Zoning Department recommends
approval of this resolution.

A legal advertisement for same has been prepared for January 1994
public hearings and will be forwarded to your office after review
by the city Attorney and City Manager. In order for our department
to meet the deadline for preparing planning & Development Board
agenda materials for this request, comments from staff and the
various utilities companies must be received by our office by
January 3, 1994.

Application for Easement Abandonment, Block B,
The Meadows 300, by Ewing and Shirley, Inc.
The applicant has requested abandonment of 3 feet of a 10 foot
easement along the rear of 8 lots on the south side of Bay tree
Circle.
This office has notified the non-City public utilities which would
be affected by this action. These utilities are: Florida Power &
Light, Florida Public Utilities/Flo-Gas, Southern Bell and Comcast.
All except Comcast have indicated they have no objection to the
proposal (copies attached). Comcast has not responded.
My representative has inspected the site and finds no reason to
object to the request.
I therefore recommend approval, subject to the comments by the City
Utility Department and the Planning & Zoning Department.
